Complaint: [redacted] I am rejecting this response because: [redacted] is [redacted] 's sister Me and my sister are close I work a lot of overtime at my job I give my sister, [redacted] money to put in her account and she makes the payments for me, to several of my credit card companies Including Merrick Bank If Merrick Bank desires I can have my sister, [redacted] to write a letter It is perfectly fine for my sister to pay bills for me, as long as I give her the money I have my own checking account with Bank of America However, my personal relationship with my sister is a personal matter Merrick Bank does not have any rules against using someone else's checking account to pay a bill I know for a fact, Merrick Bank will allow someone else to use their checking account to pay a credit card payment I have asked Bank of America to write a letter to Merrick Bank 11/18/17, still waiting for a letter from Bank of America Yes, I reject this response from Merrick Bank Sincerely, [redacted]

Ms [redacted] opened an account with Merrick in June and has used the account for the purchase of goods and servicesAccording to the account history on October 3, Ms [redacted] called Merrick regarding possible unauthorized charges on her account The account notes indicate that there were charges that Ms [redacted] did not recognize On November 19, 2017, Merrick completed its investigation into Ms***’s dispute, accepted the claim and sent her a letter about the resolution of her claimFollowing that letter, Merrick has given her account a credit for $and the purchase interest was adjusted

A review of Mr [redacted] account was made In October he was late making the payment that was due on the 23rd of October that payment was not received until November 5, This resulted in a late fee being assessed to the account Mr [redacted] called and spoke to two different representatives of Merrick bank regarding the late payment Mr [redacted] requested that the late fee be waived and the first representative waived the fee However, the payment made was not the full minimum payment due and because of this another late fee was assessed to the account in December Mr [redacted] will need to make the full minimum payment due each month to avoid additional late fees from being assessed to the account It is Merrick’s policy to waive one late fee in a year Mr [redacted] account will not be eligible for any additional late fee waivers for year from November I have enclosed statements for his review

Unfortunately the recurring enrollment system does not show any attempt to set up a schedule of payments prior to the 15th as noted in the original reply Merrick has no other response to this matter

Complaint: [redacted] I am rejecting this response because: I made payments on line after March and I continued to make payments until I was locked out of my account and I called and was never able to get back in my account to make any additional paymentsNo one ever sent me a bill in the mail eitherSO this account was never delinquent on purpose by any means and I wont pay anything if its in collection because it has no reason to be in collection! Makes me think Merrick Bank makes it impossible for its customers to make payments so they can charge late fees and then over the limit fees and then send them to collection - how convenientWhy was I locked out of my account? Why was a bill never sent to me? Why did it take me filing a complaint with the Revdex.com to get anyone from Merrick Bank to respond to me? I dont know what company is sending me emails but they obviously for my email from Merrick Bank and they are asking me to pay themWont happenI will only pay Merrick Bank Sincerely, [redacted]

Complaint: [redacted] I am rejecting this response because: I sent the theft avidavit back and you can check your cal records I spoke with a guy and I informed him that I never received anything else form your company after I sent the avidavit back he stated your company never received itWhat proof will I have to show I did not open this accountI was just made aware of the account when I informed your company that I was not aware of the account that's when the forms were sent to me that I returnedYour sending statements that goods were purchased that I did not make Sincerely, [redacted]

Complaint: [redacted] I am rejecting this response because: I can't provide a letter indicating what they want because THEIR system did not process payment correctly due to the amount of numbers in my account! I've sent them bank statements clearly showing the payment NEVER HIT my accountI have replaced the payment with a debit card on the same account and paid additionally to do so! This company is a fraud and the way they treat customers is awful Sincerely, [redacted]

A review of Mr [redacted] account was conducted Mr [redacted] opened the account in November and has used the account for the purchase of goods and services On November 21, Mr [redacted] informed Merrick of the fraud on his account An affidavit of fraud was sent to the address of record on November 30, Merrick received the executed affidavit back via fax on December 2, Merrick has issues a temporary credit to the account in the amount of $34.99, and an investigation into the fraud claim has begun Once the investigation is completed Mr [redacted] will be informed of the results and if the claim is accepted the credit will become permanentAn adjustment to any finance charges will be made at that time If he has questions or needs additional information he can contact the Fraud department at ###-###-#### for help with this issue

Mr [redacted] opened an account with Merrick in May and he used the account for the purchase of goods and services The account became delinquent and charged off in September According to Merrick records Mr [redacted] never contacted Merrick regarding the account after charge offMerrick does not continue to report charged off accounts once the charge off has been submitted to the three major credit reporting agenciesThe date of first delinquency is the date that drives how long a derogatory report will remain on a credit fileMerrick has not changed that date which is June 11, The credit reporting history of the account is maintained by the credit reporting agenciesGood credit information can remain on a file indefinitely; derogatory information can remain on a file for 7-years The term charge-off does not mean the debt is forgiven Consumers with charged-off debts are still legally obligated to pay that debtMerrick has received several credit bureau disputes made by Mr [redacted] Merrick responded to each one after doing an investigation of the status of the accountMerrick is required under the Fair Credit Reporting Act (“FCRA”) to accurately report the status of accounts it reports to the credit bureaus The various statuses’ reported on the account were and are accurate for that given point in time and Merrick will not remove or alter that information To do so would be a violation of FCRA

You will see I was lied to, stop saying you did and I was given proper info Last week on Thursday I was td there was NO HOLD, amd my money would be available Friday, you ruined my vacation and embarassed me Sincerely, [redacted]

Ms [redacted] opened an account with Merrick in August and has used the account for the purchase of goods and services The due date on the account is the 1st of each monthDuring a call with Merrick on November 7, Ms [redacted] explained that she thought her due date was around the 15th of each monthThe Merrick representatives who spoke with her explained that according to the account records it had always been the 1st Ms [redacted] requested a due date change and the due date was changed to the 16th of each month beginning in January Ms [redacted] requested that the late fee for November be waived due to the due date confusionThe representative who spoke to her explained that he would request a waiver of that late fee in the amount of $but could not guarantee that it would be waived The request for the fee waiver was declined Upon receipt of this complaint I have, as a courtesy waived the late fee assessed to the account in the amount of $ Ms [redacted] will need to make the December payment on or before the 1st of December as shown on her statement After that payment the due date will be the 16th of each month If she has any further questions or issues regarding her account she can contact us at 800-253-for assistance

I will request a further review of this request I cannot guarantee there will be any change in the reporting status but I will request a reconsideration

Merrick has replied to this issue with all of the information available in the account history and through the audits it has conducted on the mail delivery at the Dallas location There is no further information or reply that Merrick has to this matter We have accommodated the request for the late fee waiver and provided alternate methods to make payments

As stated Ms [redacted] can have the account removed if she send in the requested information

Complaint: [redacted] I am rejecting this response becauseiThat is not acceptable , this is the only credit card company I have that problem with and this is the second time in months that it has happenedI have only had the card for a couple of monthsThe first payment I ever sent was "lost" in the mail until I called in a day before the due date to see if it was posted and was told by Merrick Bank that they did not receive itSo to avoid a late fee I paid over the phone with a debit cardThe next day the payment that I originally sent in the mail was postedNow a month later the same thing happens but I do not make the over the phone payment with a debit card because I want to see if the payment will post and it does not post, Merrick Bank says they never and I am charged a late feeThis is not a coincidence, the late fee was taken off and I paid over the phone with a debit card againMerrick Bank says they still did not receive my payment I sent through the mail on June 2nd, it is now June 29th.I have credit cards and Merrick Bank card is the only card company I have this problem withNot once but twice within monthsI send the same envelope for every credit card and mail them within days of my due date, if not soonerMerrick Bank is the only one that gets "lost"The customer rep reminded me several times that I can pay with my debit card online or over the phoneSo, it seems like they are making it difficult to pay thru the mail so you will use your debit card to pay instead of sending the payment in the mail because it is more convenient for them.The Merrick Bank payment address is Dallas, TX Like I said my father lives in Fort Worth, Texas, it takes business days for mail to get from Philadelphia to Texas every time no fail, except maybe during a holiday, and never been lostI have other cards and none of the payments I sent to them were ever not receivedAnd for the record, I told the customer rep to cancel my account if they did not do something about the late chargeThe customer rep told me the late charge will be waived and canceled the card anyway!I do not want any further action, they are going to feed me the same old story and blame it on the mailI'll pay the remaining balance off and I will not use the card unless it is an absolute emergency Sincerely, [redacted]

Ms [redacted] was the authorized user on an account under the name of [redacted] ***Ms***, according to the application submitted by Mr***, was Mr***’s wifeShe was added by him as the authorized user at the time the application was submitted Regulation B requires Merrick to submit credit bureau reporting for spouses who are authorized users on accounts Merrick will consider removing the reporting for Mr***’s account upon receipt of a letter requesting deletion of the report and the reasons for that request Ms [redacted] can send that to us at the correspondence address of PO Box 9201, Old Bethpage, NY or via fax at 516-576-

Ms [redacted] can make a payment on her account at anytime Acceptance of payment on the account has nothing to do with the name associated with the account She can pay online or via the VRU If she wants to change the name on her account she can provide a copy of the marriage certificate and a written request to change the name

Ms [redacted] accepted and agreed to the terms and conditions of the account when she opened and used the card and the associated line of credit As stated she can payoff the balance in full and avoid the fees and interest in the future or continue to pay on the account under the terms she agreed to

Ms [redacted] opened an account with Merrick in January She has used the account for the purchase of goods and services Ms [redacted] requested an interest rate reduction on July 30, It is Merrick’s policy to not allow “on demand” APR rate reductionsThe representative who spoke with Ms [redacted] explained that Merrick does not offer rate reductions to any of its customersThe representative also explained that the annual fee assessed on the account was not a fee that Merrick would waive for its customers
