Thank you for forwarding the 9/23/response from Mid-Atlantic WaterproofingIn response to MidAtlantic's comments:
1) Regardless of what Mid-Atlantic Waterproofing's records indicate, we have photos showing that the edge of the footer was removed in placesAdditionally, I witnessed the work crew (which were subcontractors) taking a jackhammer to the edge of my home's footerThe work crew also told me they would be removing the edge of the footer to "make room for the drain" systemSee attached photo 1-P7230518.jpg
2) Geo-Filter fabric is indeed required per codeMid-Atlantic ascertains that fabric is not requiredWe have a Written report from *** *** Stating that fabric is required for the type work that was performed (installation of foundation drainage system)The specific section of code referenced by Mid-Atlantic Waterproofing (R406) applies to a different type of work (waterproofing the exterior of below-grade walls), not to excavation and installation of an interior drainage bedWe have verified this fact with yet another independent licensed professional engineering firm, and also with the building inspectorThis is now a total of three qualified licensed sources clearly stating that the project required approved filter fabricAccording to all three sources the lack of filter fabric has allowed soil to erode from under the foundation, causing the wall to collapse
See ICC Code excerpt below:"SECTION RFOUNDATION WATERPROOFING AND DAMPPROOFING RConcrete and masonry foundation dampproofingExcept where required by Section Rto be waterproofed, foundation walls that retain earth and enclose interior spaces and floors below grade shall be dampproofed from the top of the footing to the finished gradeMasonry walls shall have not less than /inch (mm) portland cement parging applied to the exterior of the wall." (emphasis added)According to my above sources the preceding section (R405) of the ICC building code is the one that applies to our home's situation:"SECTION RFOUNDATION DRANAGERConcrete or masonry foundationsDrains shall be provided around all concrete or masonry foundations that retain earth and enclose habitable or usable spaces located below gradeDrainage tiles, gravel or Crushed Stone drains, perforated pipe or otherapproved systems or materials shall be installed at or below the area to be protected and shall discharge by gravity or mechanical means into an approved drainage systemGravel or Crushed Stone drains shall extend at least foot (305mm) beyond the outside edge of the footing and inches (152mm) above the top of the footing and be covered with an approved filter membrane material(highlighting added)The top of open joints of drain tiles shall be protected with strips of building paperPerforated drains shall be surrounded with anapproved filter membrane or the filter membrane shall cover the washed gravel or crushed rock covering the drainDrainage tiles or perforated pipe shall be placed on a minimum of inches (mm) of washed gravel or crushed rock at least one sieve size larger than the tile joint opening or perforation and covered with not less than inches (mm) of the same material."3) Minor cracks were indeed present within the basement interior prior to Mid-Atlantic's workHowever, MidAtlantic's internal report, and the photographs they took (in addition to our serial photographs both pre and postinstallation) prove that the cracks significantly increased in scope, size, and location after Mid-Atlantic's workThe Complimentary carbon-fiber straps installed by Mid-Atlantic were, according to two separate independent licensed professional engineers, improperly installed.4) Jacks were installed in the basement to support the above flooring, and to take a portion of the load off the Collapsing basement WallThe jacks have in no way been used to lift the buildingThey merely assist in prevention of a catastrophic collapseAs the wall in question continues to sag and drop, the jacks prevent the home's structure above the basement from collapsing along with the basement wall5) The issue is not whether anyone else has assisted in the repair and/or cost of repair of our homeThe issue is whether or not Mid-Atlantic Waterproofing, through its own negligence and failure to follow the building code, Caused significant expensive damage to my homeJust for the record, Nationwide Insurance determined that they would not cover the cost of repairs because the damage was caused Mid-Atlantic Waterproofing6) Lastly, the September 18, service call was for a pump that was not runningA service technician cleaned significant amounts of stone and mud from the Sump and instructed me about when the pump would runWe was satisfied with the service callThat does not mean that we are satisfied with everything done by MidAtlantic*** & *** ***, homeowners
Respectfully submitted,

RE: ***
Dear Revdex.com:
This letter is in response to a customer concern submitted by Mrs*** ***. I was quite surprised to see a complaint from the Revdex.com, as we have an open line of communication with the ***s. Up until receipt of your notice, we considered this account an insurance claim. We will do what it takes to settle this matter as soon as possible.
Mid-Atlantic Systems of CPA, Inc., began work for the ***s on October 13, and completed the project on October 17, 2014. Mid-Atlantic was contracted to install our Hydro-Trac system with two 7500SS heavy-duty pumps submersed in Saber Pit sump wells. The system was to be installed at the interior perimeter of the basementThe agreed price for the job was $13,447.00. Mid-Atlantic accepted a deposit of $1,344.00, and the balance of $12,was approved for financing, but remains unpaid.
During the installation, it was discovered that the foundation was a monolithic pour and required installation of our Monolithic Hydro-Trac system to prevent damage to the foundation. A monolithic pour simply means that the house has only a 2-part foundation (thick floor and wall) instead of the industry standard 3-part foundation (wall, footer, and floor). The only way to make this determination is to open up the floor. Our Monolithic Hydro-Trac system is similar to the Hydro-Trac system, but includes an additional 7500ss heavy-duty submersible pump and Saber Pit. All changes were presented to Mrs*** in writing and approved by her signature.
Although Mid-Atlantic installed an additional pumping station, no extra charges were assessed. Further, our comprehensive warranty remains for the entire time that the consumer owns the home. It is effective once the contract is paid in full.
In response to dust concerns, the installation technicians took standard precautions in efforts to minimize dust. These steps included placing plastic barriers around the personal belongs which were moved to the center of the room, placing a barrier around the staircase leading to the first floor, covering the doorway at the top of the basement stairs with plastic from both sides, wrapping the heat pump with plastic, layering the floor with water, and closing vents.

RE: ***

Our Quality Control Inspector, Nick Cloakey, was at the property on October 14th and 15th. He noted in his conversation log that the ***s had dust concerns. He confirmed that all of the listed dust reduction methods were in place. Mrs*** thought that the technicians used a fan and blew dust, however, MrCloakey did not see any fan in use during his observation of the two day job. Further, MrCloakey’s pictures show the fan next to the heat pump, wrapped in plastic, and not in use. (Picture attached)
On October 16, 2014, Mr*** called the office and asked if Mid-Atlantic would pay for a *** *** to clean the dust. I explained that Mid-Atlantic, as stated on our warranty initialed by the ***s, does not guarantee against dust, nor are we responsible for the removal or cleaning of dust or residue. With that said, as a gesture of good faith, I agreed to contribute $toward any cleaning that the ***s choose.
Subsequently, the ***'s contacted their insurance company which advised that dust is not covered under their policy. Despite this, the insurance company sent *** Cleaning and Restoration to the home to provide an estimate. The estimate (attached) was at a cost of $12,and included duct cleaningInterestingly, upon speaking with the *** ***, they advised that they do not perform duct work cleaning and only added it to satisfy the insurance company. A claim to the installation technicians’ insurance carrier was filed, but they denied coverage as well
Mid-Atlantic Systems of CPA, Inc., has offered to clean the inside of the ***’s home, using equipment provided by any other *** ***, including air scrubbers and hepa-vacuums. Additionally, we have scheduled an independent *** *** to inspect the home and provide an estimate on November 30, 2014.
We look forward to amicably settling this matter. Please call me with any questions or concerns you may have
Best Regards,
Daniel MR***

Heather,I am in receipt of a complaint submitted by *** ***. Mid-Atlantic visited *** *** on March 17, to inspect the basement. Part of our inspection entails filling out an Foundation Inspection Analysis form which shows a diagram of the basement and lists the problems
found. We ask all homeowners to initial this form which allows Mid-Atlantic to call back and follow up. MrHane, the inspector, simply forgot to leave a copy with *** ***. On Monday March 20, 2017, *** *** called in the morning and spoke to Tasey M***, our office administrator, to inquire about this form. Tasey reassured *** *** that as soon as she receives the form from MrH*** that it would be emailed to him. MrH*** came in the office shortly after and provided the form which was emailed to *** ***. *** *** I am in receipt of the complaint received by *** *** ***.Mid-Atlantic did service the work in May of 2016. During that visit, a perimeter drain system was installed at the exterior perimeter around the home and the exposed cinder block walls were sealed to that point. A
4" corrugated pipe was installed backfilled with gravel with the pipe terminating to daylight and the area backfilled. Later in October, I spoke with *** *** *** regarding some additional issues. Mid-Atlantic offered to install our patented Hydro wall over all of *** *** ***'s interior walls. This would allow further management of the wall against water and allow *** *** *** to finish his basement should he choose to. This work is several thousand dollars but would be performed at no cost to *** *** ***. That offer went unanswered. After receiving this inquiry, I spoke with *** *** *** to set up a time to meet and discuss further options. Revdex.com:I apologize for not making a response sooner, have not had internet at home.
I have reviewed the response made by the business in reference to complaint ID ***, I am willing to give them a 2nd chance to re do the entire waterproofing system, hoping that it works this timeWater lying in the trench or up the walls is not going to be acceptable The basement is to be dryI have spoken to Dan an Mid Atlantic and the work is to begin today The cleaning by Quality Cleaning is to start immediately following the completion of Mid Atlantic's work in the basement, per DanI do have some concerns about freezing pipes, as I have to shut down the heating system in order for them to do more concrete demo Are they making provisions against this? Had this work been completed back in October when noted it was needed instead of January freezing pipes would not be a concern
I also have concerns, at what point the duct work will be cleaned????
I ask that the Bureau not close the claim, until I am satisfied with all aspects concerning this claim as indicated in previous emails, and conference call.

Dear ***,
This letter is in response to the complaint received from *** *** of *** *** *** *** ***, Pa. ***.
Mid-Atlantic did complete work for the ***’s on June 22, 2012. The ***’s complained of seepage through the basement floor on a few occasions after the work was completed. Each occurrence coincided with torrential rainfall. Mid-Atlantic dispatched service techs during each occurrence in a timely fashion to perform service adjustments to the basementThe type of services performed included breaking up the ***’s floor and running additional drains from the areas of seepage to the existing system Mid-Atlantic installed. These solutions held up during heavy rain, but unfortunately, not during torrential rains.
Our Production Manager, *** ***, visited the ***’s on May 2, 2014. During the visit, *** determined that approximately half of the basement floor is extremely thin and deteriorated, therefore insufficient to work with the perimeter water management system that Mid-Atlantic installed.
Mid-Atlantic has determined that the only way to remedy this issue is by removing and replacing approximately square feet of the thin, deteriorated floor. I have spoken with *** today and explained our plan to him. *** has accepted the plan and is completely satisfied with the outcome. In the coming weeks, *** will work with *** to schedule and install the new floor
As always, Mid-Atlantic Waterproofing stands behind its work and warranty 100% and is prepared to do whatever it takes to satisfy any of the ***’s concerns or issues.
If you have any questions, please feel free to contact me at ###-###-####.
Respectfully,

This letter is in response to the ***'s rejection. We understand the ***'s position regarding the paint on the walls and their frustration that the paint is peeling in a few areas. I want to note that the areas affected by the peeling paint are on very isolated areas and difficult to see without getting very close to the wall in some areas. In fact, it is difficult to notice any peeling or chipping paint in photographs. (see attachment). With all that said, it is clear the ***'s expectations were that they "would never have to paint again." Most homeowners that paint their wall with waterproofing paint are attempting to stop wetness and dampness on their foundation walls. It is very possible that the ***'s heard our representative say "you will never have to paint the wall again", as it relates to using paint to attempt to stop wetness, leaking and dampness. There are many factors why paint wont adhere to a wall, below are a few, but not all factors. 1. Prep work: It is critical to remove ALL existing unstable paint which includes any existing peeling, chipping, bubbling, blistering, and layered paint. Mid-Atlantic can not be responsible for the methods or overall effectiveness of the prep process as this is completely out of our control. 2. Cleaning: Removing any and all existing stains from the wall is extremely critical. Lime salt deposits are very common on cinder block walls and were present on the ***'s basement walls. This process is called efflorescence, which means "chemical unfolding". When the blocks get wet and then go through the drying process, efflorescence occurs which pushes the salt out of the block. In this case, it is very possible that pre-existing lime deposits beneath the paint, which were not removed, is causing the paint to peel. 3. Temperature and Humidity: The surface temperature and overall humidity is a factor in painting, too hot or too cold can be a factor in paint adhesion, as is the humidity. Again, Mid-Atlantic has no control over this. These are just a few of the important points that Mid-Atlantic has no control over which could be contributing to the peeling paint. Our guarantee is for a dry wall and no water, and the ***'s have acknowledged the walls to be dry. Despite all of this, in an effort to maintain good customer relations, Mid-Atlantic has increased the refund offer to $1,000.00. which keeps the warranty intact. I have communicated this with *** and he indicated that he wanted to run this offer by his wife and call me back by the end of the week. We look forward to bring this to conclusion, please don't hesitate to call with any questions you may have. Regards, Daniel *R*** General Manager
