I sent a deposit for a whitetail deer hunt at Midlife Crisis Whitetails which is owned and operated by Butch B and his partner. I was no able to go on this hunt due to a back injury that I am currently under doctors care and treatment for. Mr. B has stated several times in text messages that he would be returning my deposit but as of this date I have not received it. I was told on 01/03/18at about 3:30 PM that he would send my deposit back and needed my address. Mr. B stated " I will send you your 500". On 01/22/18 I contacted Mr. B that I have not received a check in the mail and wanted Mr. B to be aware of this. Mr. B responded on 01/23/18 at about 3:38 PM and he stated "Address is all I need from you and I will send deposit back half at a time". I again gave Mr. B my home address. Mr. B now claims that no outfitter gives back a deposit but he can not produce anything in writing to this affect in regards to his preserve. There was no contract signed or agreed to, there was no disclaimer or anything whatsoever about deposit or forfeiting of deposit. I have only seen videos on YouTube and visited his Facebook site. There is nothing at all about deposits or loss of deposit, in fact no mention of it at all. Mr. B is claiming that this is an unwritten rule by outfitters. Mr. B has told me several times that he was sending my $ 500 deposit back but as of this date has failed to do. Mr. B has been aggressive in text messages but in each and every one of them agrees that he will send my deposit back.

I am writing this in response to Mr *** complaint. Mr *** contacted me sometime in Oct of 2017 about a hunt here at Midlife Crisis Whitetails . I proceeded to show him numerous pictures of bucks here along with numerous texts about the deer. He told me him and maybe another hunter were interested in a hunt but he was looking for a certain type of buck . He was looking for a great typical . I told Mr *** I know where their is a great buck that he would like. I also told him the price of this deer would be 3200 dollars and that since I had to go to the New York state border to get him I would need to have a deposit of 500 dollars on the deer for expense to get deer along with food for his three day stay and a guarantee that he would come hunt the deer . I even kept the deer in seperate area for Mr *** because he said he wasn't sure when him and his buddy could get away to come for the hunt at that time. For almost the next two months I kept texting and talking to Mr *** about setting dates to come hunt. He proceeded to keep telling me different reasons schedule didn't work . He wanted to wait til leaves were off to hunt and it kept getting later and later in the season . I kept asking and telling him this buck is going to drop his antlers at any time if he doesn't come hunt him . He finally told me he would be down in third week of December I set aside time for him.and took no other hunters to accommodate him . He proceeded to tell me his schedule was changed again and couldn't make it then . I then proceeded to tell him that I have 2500 dollars invested in buying this one specific deer for him and that I can not take the chance any longer of him dropping his antlers and that I would have to offer him to other hunters . A week or so later he text me saying that he had hurt his back and that he definately won't be able to hunt the deer no matter if it's still there or not. I then told him that if I was able to get someone else to hunt that buck for the same price that he was going to pay which was 3200 dollars that I would refund him his 500 dollars. To this day that deer has not been hunted it is still standing and walking in this preserve at Midlife Crisis Whitetails . If Mr *** would like to come hunt this deer tomorrow with no antlers for 3200 dollars as we agreed he is most welcome. But I will not offer him that same deer next year because he will grow to be even a larger buck . Plus cost of feed and care for him . We here at Midlife Crisis feel we have gone way above our obligation to try and give Mr *** a chance at a great hunt with us . We went for deer. We offered several dates when we could of had other hunters and lost that business. We had food waiting for the week he was supposed to come . We kept deer in separate area to prevent anything happening to it until he arrived to hunt . And we are.now still feeding and caring for a deer that we hope doesn't die or hurt it's self before we get it hunted next year or we will be out 2500 dollars . If needed we can supply a long list of references to you of hunters who have hunted with us and have already rebooked to do the same this coming year . Unfortunately Mr *** will not be one of them . I have reviewed the response made by the business in reference to complaint ID, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I have highlighted several areas of inconsistencies by Mr. B which are either exaggerated or outright lies. First there was no discussion of a deposit until after Mr. B had already picked up the deer. Mr. B went on October 26, 2017 to get this deer. It wasn't until October 28, 2017 that there was ever any mention of a deposit. The deposit mentioned on October 28, 2017 was for $ 500 with NO stipulations whatsoever, Midlife Crisis Whitetails does NOT even have a deposit policy. Mr. B admits that they DO NOT have contracts, written or expressed with any of their clients. Mr. B has also stated several times (12/18/17), (01/01/18), (1/3/18) (1/23/18), (2/8/18) that he will be sending my deposit back to me in full with no stipulations, fees or penalties. But all of a sudden Mr. B has put stipulations on returning the deposit, something that was NEVER discussed or agreed to. Mr. B then goes onto say that I gave him confirmed dates for a hunt. This is totally false and inaccurate. I told Mr. B on December 18, 2017 that I would like to come down December 29 and 30 2017 to hunt. Mr. B could NOT accommodate the December 30 into his schedule. Therefore the dates did NOT work for him and he was the one who actually wanted to changed the dates to December 28 and 29. Those dates did not work for me, so through no fault of my own Mr. B was given dates that he stated did NOT work for him. At NO time did Midlife Crisis Whitetails suffer any loss of hunters or business, as he himself has already stated that the dates were no available. Just after December 18, 2017 I sustained a back injury and made Mr. B aware of it and that I would not be able to come to the preserve to hunt, again through no fault of my own. As of March 15, 2018 I am still under a doctors care for my back injury and an MRI was ordered while I was at an appointment at the Unity Spine Center. Mr. B asked a short time after December 18, 2017 if he should find another hunter for this deer. I told him YES, please find another hunter to hunt the deer. Mr. B agreed to this and even took a young girl out to hunt this particular deer. She hunted the deer and got within 50 yards of him but was unable to get a clear shot at him. The definition of "HUNTED" in numerous dictionaries is, Hunted: 1. Being pursued or searched for. That is from the Oxford Dictionary. Mr. B has a picture of the girl who hunted this buck on 01/01/18 which I have attached as proof along with Mr. B's statement in reference to it. Even after making up his story about how the deposit would be returned once the deer was hunted, I have met his conditions, even though they were NEVER explained to me at any time. The following statement by Mr. B was never discussed at any time "I then told him that if I was able to get someone else to hunt that buck for the same price that he was going to pay which was 3200 dollars that I would refund him his 500 dollars." This is a complete fabrication and holds no merit whatsoever as Mr. B is just now trying to put stipulations on the return of my $ 500. Mr. B admits that he owes me the $ 500 and is doing everything he can not to repay it. If Mr. B would stop playing games and return the $ 500 to me, then this case would be resolved. Mr. B also fabricated the story about where this buck was penned. Mr. B told me that this buck would be in a private smaller pen until hunting dates were confirmed. Seeing no dates were confirmed, then this buck should have remained in the smaller pen. But Mr. B took it upon himself as of 12/14/17 to release this buck into the larger pen where he could have been damaged, harmed or even killed. The release of this buck into the larger pen was never discussed with me at any time. In his complaint response Mr. B stated that the buck stayed in the small pen, this is not at all accurate or factual. So as I have stated before, there was NEVER a contract of any kind , there is no refund policy in place at Midlife Crisis Whitetails. There is nor was there ever any discussion on what would happen to said deposit if I couldn't make it to the preserve to hunt. Mr. B has taken it upon himself to make up a story that the facts just go against him. Therefore I am requesting immediate return of my $ 500 deposit as Mr. B has agreed to do several times, I am only holding him to his word. If his word means anything, then he will do what he said he would do and return the full deposit without delay.
