Dear [redacted] ***: 0in 0in 0pt;"> Thank you for your letter inquiry dated October 9, 2014, regarding [redacted] ’s complaint, which Midland Credit Management, Inc(“Midland Credit”) received the same day via E-mail Midland Credit appreciates the opportunity to answer your questions An investigation of this matter indicates that Midland Credit is the servicer of two accounts belonging to [redacted] Midland Credit became the servicer of account no [redacted] , on behalf of purchaser, Midland Funding, LLC (“Midland Funding”) on December 27, Information provided by the seller, [redacted] ***, at the time of acquisition indicates this account was originated on December 7, 2010, as a [redacted] account number ending in ***, in the name of [redacted] , under the last four of the social security number *** Subsequently, the account was charged-off as an unpaid delinquent-debt on February 15, The balance at the time of purchase was $3, Midland Credit became the servicer of account no [redacted] , on behalf of purchaser, Midland Funding, LLC (“Midland Funding”) on April 29, Information provided by the seller, [redacted] ***., at the time of acquisition indicates this account was originated on December 8, 2010, as a [redacted] ***./ [redacted] account number ending in ***, in the name of [redacted] , under the last four of the social security number *** Subsequently, the account was charged-off as an unpaid delinquent-debt on February 9, The balance at the time of purchase was $1, [redacted] expresses concern that Midland Credit has attempted to collect the above-referenced debts without taking his situation into account Midland Credit is sensitive to [redacted] ’s situation However a review of its business records indicates that Midland Credit was never previously made aware of any financial hardships, physical disabilities, or any other reason that would preclude him from being able to work with Midland Credit representatives to resolve the above-referenced accounts While Midland Credit continues to service account no [redacted] directly, a review of its business records indicates that account no [redacted] was outsourced to the law firm of [redacted] on April 28, [redacted] is located at [redacted] Their phone number is [redacted] Midland Credit has forwarded a copy of [redacted] ’s complaint to the firm The firm has advised that [redacted] has never previously contacted them or responded to attempts to resolve the account [redacted] also alleges that Midland Credit and/or [redacted] has taped documents to his residence and blocked his driveway Midland Credit has only sent letters or attempted phone calls to [redacted] Similarly, [redacted] advises they acted appropriately in their attempts to contact him Service of process was completed by posting court documents to [redacted] ’s home However, this was an acceptable form of alternate service which was approved by a judge after [redacted] proved that [redacted] had been avoiding service A copy of the affidavit of service is enclosed Please note that it shows that an order was granted authorizing alternative method of service for the summons and complaint A default judgment was subsequently obtained on March 10, Since [redacted] failed to make arrangements to resolve the judgment, [redacted] appropriately proceeded to obtain a garnishment A review of Midland Credit’s business records indicates that it is accurately reporting the above-referenced accounts to the three major credit reporting agencies Based on the information available to it, Midland Credit must respectfully conclude that both its representatives and [redacted] have acted appropriately Midland Credit encourages [redacted] to work with [redacted] to assist in reaching a positive resolution for account no [redacted] If [redacted] is ready to resolve account no [redacted] , please have him call Account Manager [redacted] at [redacted] She can assist [redacted] in reaching a resolution that will be both beneficial to him, as well as settle the account balance In the meantime, per [redacted] ’s request, the above-referenced account has been marked “Cease and Desist.” While it remains due and owing, [redacted] will no longer receive correspondence or calls from Midland Credit representatives unless a response is required by law or unless it is for a specific purpose related to its legal efforts Midland Credit considers consumer complaints a serious matter, and fully respects consumers’ rights Midland Credit apologizes for the inconvenience caused to [redacted] Thank you again for your assistance in this matter Please contact Midland Credit’s Consumer Support Services team at [redacted] *** should you have any further questions Sincerely, Midland Credit Management, Inc [redacted] Corporate Counsel, Legal Affairs & Compliance *Admitted in Colorado; Registered In-House Counsel in California [redacted] Enclosure

Dear Ms***: 0in 0pt"> Thank you for your letter inquiry dated November 6, 2014, regarding Ms [redacted] ‘s complaint, which Midland Credit Management, Inc(“Midland Credit”) received the same day via E-mail Midland Credit appreciates the opportunity to answer your questions Ms [redacted] filed a similar complaint through the Consumer Financial Protection Bureau (“CFPB”) A copy of Midland Credit’s response to the CFPB is enclosedAn investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding, LLC (“Midland Funding”) on September 8, Information provided by the seller, [redacted] , LLC, at the time of acquisition indicates this account was originated on November 15, 2005, as a [redacted] VISA card account number ending in ***, in the name of [redacted] , under the last four of the social security number *** Subsequently, the account was charged-off as an unpaid delinquent-debt on January 28, The balance at the time of purchase was $ Ms [redacted] expresses a concern in regard to the validity of the debt On December 5, 2009, Midland Credit mailed Ms [redacted] a validation letter, which informed her that Midland Funding had acquired the account, and of her rights pursuant to the Fair Debt Collection Practices Act, U.S.C§ et seq (“FDCPA”) Please note that the letter was mailed to Ms [redacted] via the United States Postal Service, and was not returned as “undeliverable” – satisfying the requirements set forth within the FDCPA Midland Credit’s business records indicate that it did not receive any correspondence disputing the debt or requesting validation from Ms [redacted] in response to the letter A review of Midland Credit’s business records indicates that it received the first correspondence requesting validation from Ms [redacted] on September 12, 2014, which cannot be considered timely The FDCPA specifically states that, unless a consumer provides a debt collector with notice of such a dispute within days of receiving the initial validation letter, “the debt will be assumed to be valid by the debt collector.” U.S.C§ 1692g(a)(3) Because Midland Credit did not receive such a notice at the time, Midland Credit appropriately proceeded with efforts to contact Ms [redacted] and collect the debt Ms [redacted] also questions whether the above-referenced account may be reported on her consumer credit files, due to an order issued by the Federal Trade Commission (“FTC”), which Ms [redacted] states applies to the credit reporting of the above-referenced account After reviewing both the account information, as well as a copy of FTC order [redacted] , please note that while the FTC may have issued an order against the [redacted] and [redacted] , LLC providing restitution payments to certain defined consumers, it does not render all accounts ever issued by [redacted] invalid or unenforceable Part II of the FTC order provides that only affected accounts in which the restitution payments were greater than the balance due were to be removed from a consumer’s credit files Accounts in which a balance remained after an adjustment for restitution payments, the consumer’s credit files were allowed to be updated under the FTC order Prior to receiving Ms [redacted] ’s complaint, Midland Credit received additional correspondence from Ms [redacted] disputing the debt Although her request was not timely, in keeping with its Consumer-First policy, Midland Credit made the business decision to close the account There will be no further collection activity, credit reporting or sale of this account In addition, the three credit-reporting agencies will be notified to delete all reference to the account in question from your consumer credit files Midland Credit considers consumer complaints a serious matter, and fully respects consumers’ rights Midland Credit apologizes for the inconvenience caused to Ms [redacted] Thank you again for your assistance in this matter Please contact Midland Credit’s Consumer Support Services team at (800) 825-ext [redacted] should you have any further questions Sincerely, Midland Credit Management, Inc [redacted] , Esq Corporate Counsel, Legal Affairs & Compliance *Admitted in Colorado; Registered In-House Counsel in California [redacted] Enclosure

In Sept I received notice of a default judgement against me in court for a credit card debt (I was never served)In Nov I paid a reduced amount and this was reported paidA few months ago I began receiving calls and letters on this same account from Midland and requested verification of the debtThe only thing I got back was a letter telling me I had to provide proof it was paidSince I paid by prepaid card over the phone the only proof I have is the settlement reported paid on my credit reportFour days ago I received a paper from a law office for Midland with a judgement from the court (also never served) to garnish my wages for this paid accountMidland is making my life Hell and I don't understand how they can resurrect accounts paid years ago and harass and threaten people

They keep shifting the blameFirst it was my fault because they said I didn't know what a charge off is and now they are saying it's the reporting agencies fault how things are reportedI called the CRA'S and it's up to Midland to report thier information correctly or it has to be removedThe CRA'S only report what information they are givenIt's not their job to try and collect or make accountsThey just report what they are givenIt's not the CRA'S fault that Midland is reporting incorrectlyI also mentioned how now that Midland has noticed activity they are adding more interest which they haven't done in years They are trying to bully me and only use what's convenient for themThere is no proof I ever had an account with [redacted] so they can't collect what doesn't existThey didn't even get the information from [redacted] it was from some other companyThey haven't been able to show the account is mine all they showed it what they bought from some other companyNo one can history and how they came up with the $original balance and how it went to now it's I believeIf they own the account they should have all this informationThey were asked to show how when and for how open account days past dueI don't have any payment plan with them, the debt isn't even mineThen they want me to send them my private information to themThey know they are reporting under two different namesHow can they not know what THEY are reportingThat shows nothing is verifiable and they are an irresponsible company They are just putting what they want, wear ever they want and how they want with no reguards to what is true or notThey are just trying to get money and I don't owe itThey were asked to show proof of a number of thingsThey ignored the request and all they could show was they bought a debt from another party not even the original creditor they listIf they own the account they should have all the information that came with itThey are taking advantage of me and keep shifting didn't check my report I wouldn't even know about this and now they are adding more interest If they can't show the original contract with my original signature the payment history the dates what the balance was and how it got to $then to $how can they damage my credit reports with no way to prove itI noted some of my private life to show there is no way the account can be mine and their answer was to say I'm a hardship case and they won't contact meThat isn't even close to being relevant to the private information I gaveThe point was there is no way the account can be mine and that if they have all this proof (wich they didn't give) then maybe they should consider it could of been a fraudulent account They are just doing whatever they want because I'm the little guy in thisThat's why I enlisted the Revdex.com help with the matterWhat do I need to do to get this completely removed from my credit reportsI'm starting to believe that I am being targeted for being Disabled and a VeteranAs soon as I let that little bit of private information out to show my side and how it's impossible the account is mine I get hit with more interest and remarks and they won't show anything asked to verify this account What really bothers me about all this is that I don't owe them anything I wouldn't go through all this and have it effect me and even aggravate part of my huge disabilities more I just want this settled I figured Midland would be professional about this going through the Revdex.com but they just keep shifting responsibility and they can't show the paperwork to back it upThey pick what answers they want to or can answer and ignore all the important thingsAll they showed was a bill of sale from a company other than the original creditor they have listedThey didn't even show how they verified the information they got and was 100% sure they could try and collect from meIf they own the account they should have all the information and be able to show itI mentioned the statue of limitations because they have different dates under the same account numberThen they insinuate that I'm just trying to have it removed from my reportsI'm fully aware that if it was my debt it would still be owed and if I owed it, it would of been taken care of already I don't want to be a pain and I know this takes up people's time but I don't owe this debt in any way shape or form and because of Midlands actions and/or lack there of it's been a nightmareI think Midland needs to show all the documentation asked for and prove I owe thisThey know I don't owe this and that they can't prove it so they try to hide behind that they sent a letter that they can't prove they sent and say because of that I owe a debtI just want this resolved and completely taken off my credit reportsIt's not right that I have to deal with this issue it should have never been put on my reports periodIf Midland are professionals they need to provide all the requested documentation and show what they claimMidland said in both thier replies that they take consumer complaints and rights very seriously but they won't even provide the necessary paperwork to prove their claim against meThey don't even care if the account could even be fraudulentI feel Midland has no proof and can't verify everything asked for and they are trying to bully me They are adding stuff to the accounts and they are putting remarks on my reportsI feel they are trying to punish me for enlisting your help by adding things and all of a sudden adding of interest since I contacted the Revdex.comIt's like they know they are wrong and are trying to bully me into paying before they get exposed and have to remove their inaccurate reportingI'm not liable for this and if they think they are 100% correct they should prove it in every wayWhy didn't they with thier response? There has to be a reasonThey decided to pick what they wanted to answer and all it was, was a bill of saleLike I've said many times if they own the account they should have all that information and be able to show why they believe what they doI mean all their merit is behind a letter they can't prove they even sentI guarantee you that if I would have gotten any letter we wouldn't be going through all this now I just want this handled and removed off my reports completelyMidland needs to also consider this could be a fraudulent account and like I've said if they own it they should have all the requested documents and information to prove what they sayI would think that Midland would want to provide all the information requested to clear them and prove they are a reputable company and not taking advantage of me and others as wellI really want this to be handled properly and it will show I don't owe this moneyIt's not my account So I again request that Midland remove the account off all my reports and state it won't return all in writing I thank everyone for their time and Thank You for taking the time out of your day to read thisI'm looking forward to hearing from you and getting all this resolved Regards, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below [redacted] Thank you for the responseI know it has been sometime and I'm sure that Midland is very busyHowever in the mean time I did some investigation myself including calling [redacted] directly I spoke with [redacted] in the executive departmentWe spent about 30-minutes going over the information because I was concerned that this was a [redacted] account and [redacted] was reporting it incorrectly and now it appeared that somehow midland became the original account holder and not [redacted] ***I also expressed my concern on how this account was reporting She was very knowledgeable about the credit reporting agencies as she had previously been employed working for the credit reporting agencies before working for [redacted] So her knowledge was very reassuring and what she was talking about was factualShe took the time to actually go through my credit report line by line I hadn't heard from midland through the Revdex.com, my disputes go unheard and also anything I send in the UPSP so I figured my best coarse of action was to speak with the company that had a direct relationship with midland She has basically told me the same thing my credit union is telling me when I refinanced my truckAlthough I did get the loan it still was brought up that this should be corrected I will list what each individual account has [redacted] Terms month status Paid, was a collection account, insurance claim or government claim or was terminated for default (on this you stated you only report is as “Account assigned to internal or external collections,” “Account paid in full, was a collection account,” or “Account paid in full for less than the full balance.” It has me as a late on July you state Midland Credit does not furnish information that accounts are “days or payments past due” [redacted] is showing Midland as the original lender This is on any report pulled with a payment status of unknownthere has been no data provided to show paid/charged off/settle for less, no balance nothing, just shows the original amount [redacted] Only shows only [redacted] , we ( [redacted] and I) with the amounts and the acct number we figured it belonged to Midland but I have [redacted] on my credit report [redacted] was also nice enough to call midland on my behalf upon doing so she discover that I had in fact set this up as a PFD During the phone conversation, [redacted] stated contact would be made with Midland Credit Management to communicate my concerns regarding the "payment for deletion" that was agreed to when I paid Midland Credit Management in full This phone conversation took place on October 27thI know there was a call placed to your office from [redacted] I did let them know I would follow up with them regarding the issue as they have really gone above and beyond for me with thisGreat customer service , again I want to thank you for the responseI'm sure we can have a resolution in this matter where [redacted] , Midland and I all come out as satisfied in this matterAs far as talking to the credit reporting agencies about the Nomenclature that you have to use (yes I had to actually google that lol) I have been fighting with them tooth and nail to correct it but they just come back as verifiedI just know this is becoming time consuming so I just want to get this put behind me after its doneI also don't want to come across as passing the blame as its [redacted] fault, it's midland fault, or the credit reporting agencies faultI would just like it deleted seeing as no one can get it corrected or to status it correctlyA collection WITH a late dings my fico scoreI was also questioned about the one not showing a paid or balancebut the credit union was able to pull up the cancelled checkCredit unions are more likely to do a manual review of a credit report where as some other companies don't so it looks like that missed payment and balance is still sitting out there when I actuality it isn't gain [redacted] thank you for you time again I know midland is a very busy company and if I don't hear back before the holiday, Happy holidays t you and yours Regards, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below It is incorrect that Midland was never informed they were calling to collect debt on the wrong personI tried to tell them several times, but they either (1) did not listen, or (2) became irate and were verbally abusive toward me when I tried to tell them they were calling the wrong person on a debt that doesn't existIt may be true that they have the initial right to attempt to call a person to collect a debt, however, they are still bound by federal law to stop calling a person when they are told expressly "Put me on do your do not call list"This company failed to do so on more that one occasionPerhaps it would be be better for me to contact the FTC so they can explain the do not call laws to this company's lawyer, and be fined by the FTCThis said, I sill believe I deserve some sort of financial compensation for the aggravation they caused me, and for the verbal abuse of their employeesThey may think that using their lawyer to respond to the complaint will strong arm me into submission; however, it has the exact opposite effectI stand firm in my complaint and beliefs in this matterThis company wronged me, is trying to cover their tracks by saying they had a person with a "similar" last name as well as phone numberThey are clearly lying about that, and feel they are trying to scam money out of me, and who knows, others, by trying to convince them they have some outstanding debtI do not appreciate when someone tries to make lies to cover their tracks (such as this action), and again, I stand firm on my complaint and feel strongly they owe some kind of compensation for wrongdoing they have caused me, so many, many timesThis complaint would have never been made if the company had engaged a dialogue with me by explaining what they were attempting to do, and receive feedback from me to the extent that they were mistakenly calling me, and review their records as to what debt they were trying to collect uoponThey had not collected incorrect information for someone with a "similar" last name and phone numberThey knew exactly who they were calling and did not want to stop until they broke me and I gave them money for something I didn't oweTo that end, they now owe me compensationI have stated that enough times in this response so hopefully they can now understand what happened better, and will understand what needs to be done to correct their wrong doingI do not take kindly to being strong armed Regards, [redacted]
