Hello,This customer owes September and October We received a call from the customer on October 15th from [redacted] stating that they have sold the shopWe do require a day notice in order to cancel an accountWe cut it by a few weeks so that they wouldn't have to continue for a product they wouldn't be usingWe had advised that it would be cancelled 10/31/On August 14th [redacted] paid May and June invoices,On October 15th [redacted] paid July and August and stated that she would call back the following week to make the other paymentsOn October 20th [redacted] called back and stated that she would like it reinstated through November and that she would call back later that day to pay September and October invoicesAfter that we haven't receive a payment for the September and October billPer their request we reinstated the account and the usage is up until 11/30/that is also why they owe the September and OctoberPlease see attached for the usage reportShe had made support calls until November 30th.On March 22nd is when we received the call from [redacted] stating that we had charged her cardTherefore we refunded those monies to correct the issueWe had received the card information on the new owners order and that is the only way we would have charged the cardIn conclusion the customer has been aware of the September and October payment since the cancellation request and the monies are owedThank you

To whom it may concern, We stand behind our original response regarding the dispute The terms of the agreement, which was signed by a representative of the company and agreed to, can only be terminated within the first days This initial day period is provided for the company to determine if the product fits their business needs Therefore Tallmadge Auto and Truck LLC will need to fulfill the obligation of the agreement which expires 10/31/Mitchell has made a settlement with the collection agency and until the settlement is paid by the customer we will be continuing efforts to collect what is owedThank you,Contract Review Committee

I have reviewed the response made by the business in reference to complaint ID ***,I totally disagree with their explanation as they have a contract that they say I accepted..I did not and my signature is not on any line of this contract and the signatures on it were not close to being mine..It was explained to me as a day trial that did not require anything from me ESP a contract that I did not authorize..Max from the billing department called me and apologized for the mixup and made an offer to return my service to what I had prior before the trial upgrade..I find that this resolution would be satisfactory to me. I consider this complaint resolved

Hello,The first call we received from the customer was on June 8th We do not offer month trials, we sale it on a contractual basis with the day opt out if they decide during that time that it wasn't a fit for their shopThe customer opt out date ended 03/04/2016.They have been denied to
cancel before the contract terms that were agreed to due to the usage past the day opt outAt this time they are responsible for the agreed amount and termsWe only conduct business with other businesses and not individualsWe offered for *** to submit documentation or anything where he had requested to cancel with the rep but he did not send us anythingWe have offered to assist with any issues they may have been experiencing Thank you,*** *

Hello,We received the order for Social CRM on 10/13/for a month term signed by ***The promo they received was a month contract and the initial months free of chargeThey had days to opt out and we do not offer the program as a trial The customer did have the first
days to opt outWe didn't receive a call to opt out until January 27thWe received the order by an employee that was representing the companyWe did verify with *** two times if she was authorized to sign up for this during the initial sales call and she said that she was. We were given the authority to charge the checking account by *** who signed the orderAt this time we are holding this customer to their contract as it is what was agreed upon and they have received the servicesWe have reviewed this with the customer and advised that their current contract for Social CRM ends 12/31/18. We have attached another copy of the contract that you signed with us that clearly states you had 30 days from the time of signature to opt out of the contract. The opt out date ended on 7/15/2017 and you called to cancel the contract on 10/5/2017. special instructions that "You may opt out of this agreement within 30 days of the receipt of the welcome email, without any penalty by contacting Mitchell1 customer service at 888-724-6742."The welcome email containing the customer's log in information was sent to [redacted] the same day we received the signed order. Furthermore, the customer has used our services from the day of the receipt of the welcome email and during subsequent months. Lastly, the customer didn't call us to cancel the services until 02/17/17, at which point they were past the opt out period specified in the contract. We've attached a copy of the usage report as well as the signed agreement on file for your review. Cordially, Mitchell1 Contract Review Committee

They did not get the payment info from the new owners. They did not charge my card, they made an unauthorized withdrawal from our company checking account.  Their representative who set up the account for the new owners told me that our account would be closed and no further action was needed on our part.  If we owed the money for Sept and Oct why didn't they mention it to me when I called in March, Aoril or May.  Why did they turn the account over to collections to hurt the owner's credit rating??   Why have they been so nasty in trying to resolve this issue.  Remove the account from collections and if they still insist on payment, I will pay one month and then close this whole matter with acknowledgement that we should be been treated in a more respectful manner by their representatives.

Mitchell 1 has a recording of the call they claim [redacted] agreed to that she has the authority to sign up for this. I would like to hear this call or at the least the Revdex.com to hear the conversion Mitchell 1 had with [redacted]. I'm sorry but after I reviewed ALL the complaints on line about Mitchell 1 I would like someone other than them to tell me that they heard [redacted] agree to this contract. I'm sure she was tricked into this by trying to agree to the 3 month trial offer but was not told all the details of the offer.
