On the agreement the customer [redacted] signed it states "you may opt out of this agreement within 30 days of the receipt of the welcome mail, without any penalty by contacting Mitchell 1 customer service at 888-724-6742." On the contract there is a spot for Automatic withdrawal that was filled out with credit card information that he was not on before since he was on monthly invoicing. The customer [redacted] did upgrade his services from manager SE to full teamworks on May. We have forwarded this customers request to our review committee. [redacted] spoke to an agent yesterday afternoon regarding his account and was advised what actions we are taking for the account, which is letting the customer downgrade within contract effective 08/01/16 to Manager SE since we did not receive any phone calls regarding cancellation until 8/2/16. License Agreement for clarify. As company policy (this is also noted in the special instructions in the order), we offer a 30 day "opt out period" where the consumer may choose to opt out of the agreement, with no penalty. The terms of the agreement are listed in the term column. There were follow up calls made to the business on 04/22/15, 04/23/15, 04/29/15, 05/04/15, 05/14/15, and 05/28/15. On 05/14/15 the customer was also given a 2 week extension on the opt out period. After the phone call on 05/28/15 a follow up email was sent to the customer as well with instructions on how to opt out if they so choose, and the end date of the opt out period. Our agents and supervisors have offered training and support, which was declined. Training is available in the form of video training, documents, and live training sessions, which can be found http://m1training.net/get2know/prodemand/. This dispute has gone to our Contract Review Committee and has subsequently been denied. We will still provide training and support throughout the terms of the commitment, and this has been marked to not renew at the conclusion of the contract term on 06/30/16 (confirmation #[redacted]). Figured the paperwork and contract would be completed when the Mitchell rep came for training. The name of the rep is [redacted] Phone#412-728-0856. I have his business card as well if you would like a copy of that. He was to come 7-14-17. He cancelled and never called back! That date is also written on the card. I did call in once and spoke to a "service tech" about some electrical issues with a [redacted] Cobalt's turn signal!! He was clueless. Again, not knowledgeable staff. If there is no record of that from Mitchell One, then it has been deleted!!! I can send a receipt showing proof of that! Totally frustrated! Thank you!

The same field representative came and cancelled the whole thing. The response Mitchell 1 wrote to you is totally false. They just came and wipe out the software from our computer and asked us to drop the complaint from Revdex.com.I guess our dispute with them is over.Thanks for your help.
I spoke to [redacted] in regards to the complaint and he stated he is going to continue with the service and pay for the service himself. I have attempted to contact ling and have been unable to reach her. The service is installed and being used. Mitchell1 has fulfilled all of its obligations for the customer’s account. [redacted] just purchased a new computer and needed the program reinstalled. Our representative was out this week to complete the reinstallation.

This initial 30 day period is provided for your company to determine if the product fits your business needs. Therefore you will need to fulfill the obligation of the agreement until it expires on 08/31/2019. Upon researching your account, we listened to the recording of the phone call and we determined that the sales representative clearly went over the 30 day opt out period with you and the applicable free month promotional period for which you qualified. At no point was a 90 day trial period ever mentioned. Furthermore, we went over the fact that if you chose to keep the program past the opt out period that the card you provided on the call would be charged starting in the month of October 2017 and you signed the agreement authorizing the monthly charge. We processed your order on 06/15/17 and we show that the product has been used through the end of September, indicating your decision to adhere to the contractual terms to which you agreed. At this point there will be no refund given and the contract will be in effect until 08/31/2019. We have marked your account for non-renewal as well. In response to the latest message, everything that Mitchell 1 is using to dispute this case is a lie! I never signed any documents that bound me into a contract! That is falsifying a signature. I never had a representative place a contract in front of me to sign! I tried to have training!! Again, Mr. [redacted], a sales rep for Mitchell scheduled with us for training on 7-14-17, a Friday at 1pm. He cancelled and said he would call back to reschedule! Never heard from him! I have his business card and cell number [redacted]. Anyone is welcome to call him!! I physically have his business card if anyone would like a copy!! It has the date and time that he physically wrote himself! Lastly, the call I made to one of their "technicians" for help is also documented on our end, I, with permission from the customer, would gladly give anyone his name and number to confirm me calling in to Mitchell for help. I also have a sales receipt that I will gladly photocopy as well. Again, they were clueless and not of any help. Mitchell conveniently does not have that recorded call. Mitchell 1 is clearly a huge company and feel like they can push people around. I call people and companies like that bullies!! How about the many months I paid on time and got subpar service!! Why would they treat people like that and not expect them to be upset and discourage fellow automotive shop owners to look elsewhere?? I did, and found an excellent service, [redacted]op notch company-highly recommend them!! Again, folks, go with Identifix!!

This initial 30 day period is provided for the company to determine if the product fits their business needs. Therefore Tallmadge Auto and Truck LLC will need to fulfill the obligation of the agreement which expires 10/31/17. Mitchell 1 has made a settlement with the collection agency and until the settlement is paid by the customer we will be continuing efforts to collect what is owed. Thank you,Contract Review Committee

I have repeatedly requested a member of their review team to call and THEY WILL NOT CALL TO DISCUSS THIS. Their sales rep said they would be back to our business and havr NEVER came back or called us. We are not a truck garage. I have attempted to cancel this for the last 60 days. I want a member of their review team to call me. This is the poorest excuse for a company I have EVER dealt with. I WANT THIS CONTRACT CANCELED.

We have a contract (see attached) which was signed by [redacted]. Our contract clearly states "30 day opt out from date welcome is received" as well as the 14M (14 month) term listed. The customer was given an extension to the opt out on 04/24/15, making their new opt out...
05/08/15. This extension was given on a recorded call. The first cancellation request we have is from 05/15/15. We have made our training options clear and are more than happy to work with the customer, while staying within the terms of the contract.
