Attached please find the approved net metering agreement, the rebate approval is part of the net metering agreement? The date this was approved is November 24, ? Monolith Solar had six months from the date this was approved to make substantial progress on the installation

Monolith Solar’s mission is to make solar affordable for allA large portion of solar is funded through tax rebates from the State and Federal GovernmentEveryone’s tax situation is different and extremely personal and it is for this reason that we ask the customer to consult with the tax advisor or program such as Turbo TaxThe rebates can be taken in one year or over many years depending on your total income and deductionsThe following is from page in the monolith proposal:Total Tax Credits**The combined tax credit amount may be taken out as a loan with 0% interest, loan terms will vary based on credit scorePlease consult a tax professional to determine eligibility for tax credits.The following is from page of the Purchase Agreement: Tax Credit Financing TermsWhen financing through a Monolith loan provider, the "Payment Authorization Form" must be signed and submitted by the Customer within (5) five business days of receiptFailure to complete the form will result in a $late fee assessed by Monolith SolarCustomer is responsible for repayment of tax credit financing back to the loan providerCustomer is responsible for filing his/her taxes and any documentation necessary to receive the tax creditsPlease contact your tax professional to determine tax credit eligibility.The following is copied from the NYSERDA portion of the agreement:Tax Incentives: Customers are encouraged to consult the Internal Revenue Service (See www.irs.gov), the NYS Department of Taxation and Finance (See www.tax.ny.gov) and with an accountant/tax adviser for details on eligibility for the credit provided in the law, regardless of whether the Installer/Contractor has provided information regarding the expected tax benefits (real property, federal or state tax incentives, or sales and use tax exemptions).We are very sympathetic to Mrs [redacted] situation and we are doing everything in our power to assist her at this timeSincerely, Steven E***

Bob *** of Monolith Solar Associates came to my home to discuss the installation of solar panels on my property. I showed him where I wanted the solar panels placed and where to feed into the barn's amp subpanel to feed back into the amp house panelThereafter, some younger employees from Monolith came to the house to take pictures of both the amp barn subpanel and amp house panel. Several weeks later, I was informed that they were unable to install the panels per Bob and my agreement. At that time Bob informed me that we would have to change the installation by installing trenching and underground cable to my the house and go through the main panel, which has a Generac whole house switch panel. At that time, I told him I didn't want to go that route and at that time wanted to cancel and wanted my credit card credited the $deposit. This was not my fault but his fault because he didn't know what he was "speckin" out because of the whole house Generac located at my residenceCoincidentally, Bob incorrectly "specked" out my neighbor (who I referred to Monolith) with the amount of solar panels needed which resulted in his cancelling the job. He asked for his refund and after several calls, received itBob told me that my refund would be credited back to my credit card. After months of not receiving the refund, I called and sent numerous letters to receive my refund*** W***

Our policy and practices purvey honesty and transparencyOur goal is to provide all information with clarity and confirmation of understanding which is documented several times throughout the contract and installation processThere are two signatures required to acknowledge that the tax credits
are based on eligibility. That is personal financial information of which we strongly encourage each customer to advise with their own financial or tax consultant as we do not investigate personal finances. The customer also signed three additional forms of acknowledgement of the tax credit bridge loan. The original contract was signed in February of and installed in July of which gave the customer ample time to obtain the information of eligibility and to cancel the contract with a full refundIf more time was needed to establish the security of tax liability we would have happily extended the time period to do so Our installation crew was on site for three days, two of which to install the system It would take approximately hours to uninstall the system This costs the company exponential expenses to the deposit which was a fraction of the costs to apply for permits, engineering and installation of the projectThe notion that the equipment be removed to be reused is inconceivable and does not conform to our best business practices The day the customer came into the office unannounced, a majority of the office staff was attending a press conference The customer has been contacted several times to resolve this matter which will be beneficial to both parties

I spoke with Lindsay and she confirmed the consumer's refund check was cashed on 8/24/If we need a copy of the check, she can forward

After a final review internally, we will be returning Mr***'s deposit

We have been working with the owner to resolve the issue of lower system production due to shading of the systemIn the contract, it states that the owner is responsible for the removal of any trees that that would be shading the systemIn an effort to maintain high customer relations, we have
offered to remove the tree that is shading the system at no cost to the customer, however the customer has refusedSolar will not work without sunlightThis is the equivalent to trying to drive your car without gas
