*** [redacted] *** [redacted] [redacted] I'm [redacted] , owner of MrTransmission, responding to Complaint ID [redacted] I'll be discussing with a time line what really occurred with Mr [redacted] , with proof to show that what he is stating is false.On the morning of March [redacted] called me explaining that his car was not moving I suggested to him that we could tow it in and check it out at no charge The towing would be at no charge providing we did repair He agreed and I arranged for his Nissan [redacted] to be towed (Included in this email is a receipt of the tow with date included) When his car arrived we began checking it out confirming his car quits pulling shortly after take off After a thorough check out and lift inspection we concluded this was not a simple fix The transmission also was making a noise internally (Included in this email is the check out sheet with dates and times) [redacted] called me the same day and I explain to him that we needed to perform our RDI service This included Removal of the transmission, Dismantling it, and Inspecting all internal hard parts to determine what the problem was and the cost to repair itThe charge for this service is and when repairs are approved the is not charged If the repairs are not approved then he would get charged the It covers us at this point since there is a lot of labor involved taking the transmission out and inspecting it He understood and approved this service at 12:46pm, on the same day of March Which is noted on the check out sheet I explained to him I would be in touch with him the next day He said due to his job it would be easier to call me.He called the next day, we had the transmission out and I explained what the problem was and the cost to rebuild the transmission He approved the repairs at 12:11am on March I also explained to him that we had most parts in stock, but there were a few items that needed to be ordered and gave him an estimated day of completion between Tuesday the 8th of March or Wednesday the 9th of March He understood that He explained when completed that I could call him, but he may not be able to answer the phone but leave a message On Wednesday the 9th of March the repairs were completed I called him leaving him a message to call me, he called me back He picked up the same day on March 9th (The completion of repairs and receipt of what was done with his signature is included in this email.)The following day on March 10th [redacted] called me and informed me that his car was not shifting I explained to him that Nissan designed their transmissions so you don't feel the shifting of the transmission I asked him to come by to take a drive together so I could better show him how his transmission works He said he would but he never showed up On the 24th of March he called again explaining that is still was not shifting I told him if he would just come in we would take a test drive together and I would explain how his transmission worked in person He said he would on Friday the 25th of March On that morning of the 25th his car was here before we opened at 8:00am He had dropped it off I looked for the keys in our drop box and they were not there I called him leaving him a message to call me He called back and I asked where he left the keys Also telling him, that I wish he were here so we could drive his car together At that time he also explained to me that on his dash sometimes manually it was not showing the gears though I told him that I would check that out myself asking him again to come up here He said he would.Once I checked out his car I confirmed that at times in the dash that the manual selection was not showing up This was a simple adjustment and we promptly fixed the issue I drove his car seeing that the transmission was working properly I contacted him I explained the manual selection was a minor adjustment and his transmission was shifting as it should Explaining again how Nissan had designed the transmission so that the shifts are not felt (Documentation of the shifting of Nissans is also included in this email.) I asked him again to please come up here so we can drive together in his car He said he could not and instructed me where to leave his keys and he would pick the car up after hoursAs you can see in the receipts the time frame does not match what he is stating His car was not here for two weeks before we began repairs I still request that he would stop by so we could take a road test together Nissan has a different type of transmission called a CVT (Continuously Variable Transmission), not a traditional transmission in other cars where shifts are clearly felt.If you have any other questions, feel free to call me at [redacted] or through this email.Sincerely, [redacted] MrTransmission / Milex

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below I could not upload all pictures of every angle of the transmission that I could take under the vehicle This would only let me attach If you need more, I have those available at your convienence First of all, [redacted] stated that we left the keys in a night drop box in his remarks That is untrue My wife came with me and sat in the car I walked inside and gave him the keys and even went back out to the car and had her come in to explain in more detail to [redacted] what was wrong with the car and what noises and problems it was making because it is her car and she would know better than me We also told [redacted] from the very get go that we had time to work with this car because my wife was going to be having a major surgery 5-19-and that she would be unable to drive for 6-weeks and that I had another vehilce and a company car to use So, being in a hurry to repair the car was not an issue He was aware of this and understood.Secondly, I submitted the same quote that he submitted and the original quoted amount was over $and the was reduced after a discount was applied and military discount was applied Therefore, that was not wrong information that I gave [redacted] has also stated to you that he invited me to come and look at the car That is totally false I, nor my wife, was never invited to come and see the car at anytime I never asked to come see it either but I was never ever told or invited by [redacted] to come and see it[redacted] was correct when I called and asked him how much to install a used transmission if I found one and the price that he has quoted sounds about right I also understood there would be no warranty if they simply installed[redacted] is right that he didn't hear from me for several days because of work, out of town, and my wife in the hospital However, there was more than one phone call that was made about not putting my transmission back together We discussed this at least 2-other times and no policy was ever mentioned that "they had to put it together, because of policy." [redacted] kept telling me they have to put it back together because there was no discount for not putting it back together I told him on several phone call occasions to "just put the parts in a box and in the car and I will come and get it and pay the $698." Matter of fact, the last conversation that was heated over the phone was on 5/23/ I told him to put the disassembled transmission in a box in the car and I would pay him the $ At that point, I just wanted to cut my losses, learn, and go on to have it repaired elsewhere He finally agreed and said that I would still have to pay the $ I said ok and Hung Up.The next morning, I was at a job in Elizabethtown, Kentucky and he called and was nice and said the car is back together and I could pick it up anytime I immediately asked him why he went ahead and did opposite of what we talked about the day before He said, again, he couldn't do that I told him he basically he did exactly what I asked him not too I was suprised when he told me that the car is drivable I was under the impression that they would have not put "new transmission" fluid into the car that would have charged me more Come to find out, it was the same old transmission fluid I was prepared to find a tow truck to come and get it so finding out the car was drivable was a surprise.Again, I was never invited to come and look at the disassembled transmission at anytime That is totally false Matter of fact, I am totally resigned to the fact that the reason that the transmission "had to be reasembled" and "put back" into the vehicle is because it was never taken out Any business would gladly get their full amount (in this case, $698), if they had to do only half the work (in this case, not having to put the transmision back into the car) The statement that is attached is from a reputable Volkswagon specialty shop that deals with this type of vehicle A short statement from the owner states that the transmission was never touched or removed from the vehicle [redacted] has told MrTransmission Corporate that there are ways to take a transmission out of a vehicle, which is false The [redacted] location, where the car is located now, stated there is only way to take a transmission out of a VW Jetta He also go on to state that if the transmission had been ever worked on at all, there would be hand prints, smudge marks, the grease on bolts would have been disturbed (exputting a wrench on a greasy bolt would disturb grease, smuding it), etc None of this was observed Even the old transmission fluied that came out of the transmission could not have been put back through the system as he says I personally went to observe the underside of the car and took total pictures There was absolutely no evidence of anything being removed, touched, or disassebled on this car My complaint with MrTransmission in Middletown is not the original quote or even the $to remove and "reassemble." My complaint is an over abundance of evidence showing that the work was not completed at all [redacted] can tell say all he wants that he had the transmission out of the car and reassembled it, but that is just not true when you actually see in the pictures He stated that the paramount of lies was on my part, there are absolutely no lies on this end A company that doesn't tell you to come in to inspect the vehicle (he said he did, but he did not), that the vehicle has to be reassembled when there is no state law are policy that demands that, and the evidence that is in the pictures shows that this shop is operating under unethically.This is the reason for the refund of $ Work that was said was performed and was obviously not performed Regards, [redacted]

At the same time... we were never inconsiderate to Mr. [redacted] The lines going to the radiator were leaking we had to order the radiator line fittings and installed the part at no charge Although I do remember the last visit From Mr. [redacted] he was told we would take care of the leak what ever it took. Mr. [redacted] closed the hood and left. Mr. [redacted] has a valid warranty, we take threats very serious I would like it to be noted that Mr [redacted] made a statement that if I didn't have a little [redacted] this situation would turn out different, the last line of Mr. [redacted] s letter states 3 months and 4 visits and the problem was fixed. I took my Chevy Impala there to get transmission rebuild receive my car check engine light on for torque converter and speed sensor they kept my car for more weeks saying some more codes came up I get my car back and light on traction control light on service brake assist on never seen these lights before in my car til after they took my transmission out worst experience ever and bad customer service not professional

Ms*** did drop off her car off here 12/31/but it was later in the afternoon. She had called early Friday and said would be dropping off that morning but did not. It being New Years Eve, we were unable to get the parts needed to get the cars currently in the shop out, so cars
could not be brought in to be checked. She could have picked her car back up if we knew she wanted to and she never mentioned wanting her car back that day. Also we never heard from her. I don't understand why we would not file a police report for a car that looked vandalized? We check all cars before leaving at night to make sure they are locked. Thieves do carry tools that can unlock cars. There is no way it was an employee. They have been here along time and they would not steal anything. I am sure of that. We have never had a need for cameras. Theft has not been a problem here for probably ten years or more and we have had no trouble sinceCars are safe here.There is a 6' barbed wire fence that is locked at night. Once again, she could have called to check on her car and asked to pick back up if she wanted to Seems to me this is a police matter not a Revdex.com complaint

Regarding the complaint made by *** ***First *** was never at any of the multiple appointments both myself and our lead painter *** had with *** ***I responded for the original proposal in early MayAt that time *** and I walked around the property and discussed painting the
window trim, aluminum siding, garage, dormers, door trim as wells as minor caulking / glazing as neededI provided *** a proposal dated 05-12-This proposal was based upon the condition of the home when I was at the first appointment*** accepted the proposalThen over the next several months, *** called or emailed me over a dozen times making changesOne of these changes was the deletion of the garage which per out terms we could have charged a feeI did not do thisI responded to his house multiple times and addressed his changesAt no time was *** at any of these meetings***'s involvement only occurred after the final invoice was sent.*** told me he wanted to remove the glazing, caulk and do some scraping himselfI explained to *** that if he was going to do this, any additional work that would be needed would be at time and materials per our original contractIt states:***IMPORTANT: Any work requested that is not outlined in this proposal/contract is NOT included in the bottom line price Additional requested work such as, but not limited to, additional wall prep, additional coats of paint or additional areas to be painted will be done only upon the customer's request The on site project supervisor will provide the customer with an approximate estimate for completing the additional work.At one point I explained to *** that if we were to remove the caulk and re-caulk it would add approximately hoursHe stated that was fineHe then called and said he was going to remove some of the caulkAgain I explained any additional work will be at time and materials*** agreed. *** called me numerous more times and kept repeating his plansI explained again the time and materials policy and *** stated he has a bad memory due to his *** *** treatmentsBeyond these conversations, *** the lead painter also responded to ***'s residence to walk through items over and over. When we finally arrived to do the work, *** had basically removed all of the glazing around the windows and some of the caulk from the areas around the windows and doorsThis created a situation where we had to basically re-build the windowsAgain, I spoke to *** regarding the extra time and material and his response was he understands as he is in the construction field.When *** completed the work, I pulled the hours from the jobThese hours are tracked via GPS as the painters log in on a job siteThe hours indicated we had hours of extra at $per hourThat total is $which we have every right to collect based on our proposalI only charged *** $I explained the work he created took much more time then anyone could have anticipated from the original inspectionI made this good will gesture without being askedThen *** sent me abusive emails and called me screaming on a SaturdayI explained to *** that I have a right to invoice for all the hours accrued per our proposal and I will do so if she does not calm down. On September 10th, *** responded to my email stating he was not happy with the total but "I will pay it is my only choice." He then stated he wanted to meet to have some items fixed.Then later on September 10th, at 8:PM *** emailed me stating there were some discrepancies on the invoiceI made the correct adjustmentsShe also stated she would pay the bill once the adjustment of was made. At no time during this month interaction did *** ever state anything about qualityIn contrast he told me things were going great*** also told *** to return because he wanted to give him a "tip" It was not until the invoice was sent that *** became involved*** has continuously been degrading, called our painters lazy slobs, told us we do the quality of a five year old etc....*** our lead painter has been with our company for yearsI have never had a complaint on him.Over the past several days *** has called me, our main line, emailed me and completely been degrading*** has returned to their home to fix a few punch list items*** refuses to meet with us to go over the items in person, instead she leave a list on the front doorThis is difficult to work off of but we have made it work.*** continues to ask for the ***The *** is not available and my job is to resolve customer issuesI have done so in this caseGenesis has fulfilled every part of our contract and addressed all of the punch list itemsAll while being professional*** and *** have called and emailed both *** and My cell phone at all hours of the evening and on weekendsAgain, none of this behavior occurred until the invoice was sentAt this time, the project is completed and paid

Now about the reco***ngs, the way the company we go through, Yodle, the only time anything is recorded is when a customer makes a call to us. Unfortunately when we call out they don't make reco***ngsYou can call the company Yodle to find that this is true. As I stated in original complaint, and now proven on reco***ng, *** never disclaimed that the customer would be responsible for an upfront labor cost if they had to take something apart to diagnose. As proven in the reco***ng and typed response from him, *** stated they offered a "FREE checkout". I think it is worth noting he didn't provide the reco***ng from the 3rd call to *** *** stating he'd have to pay an upfront labor fee, nor the 4th call that I made to them complaining about the fact that they never disclaimed this possible instance. Below is a summary of my previous responses to this complaintI met with *** *** in May to discuss painting the exterior of his home and detached garageI provided a proposal to *** for this projectThe proposal clearly outlined the work to be completed and the total priceThe proposal also stated ***IMPORTANT: Any work requested that is not outlined in this proposal/contract is NOT included in the bottom line priceAdditional requested work such as, but not limited to, additional wall prep, additional coats of paint or additional areas to be painted will be done only upon the customer's request. The on site project supervisor will provide the customer with an approximate estimate for completing the additional work.*** accepted this proposalOver the next month or so, *** called me several times to meet with him at his home*** asked to remove the garage from the bid, maybe add the basement, maybe add caulking etc*** asked me what it would cost to re-caulk the windows and doors if he removed the caulkI had the lead painter look at ***'s house and told *** the cost would be about $plus materialsI further stated this is a ballpark and any thing done over and above the original contract would be at time and materials*** then stated he would do some caulking and scraping of the windows himselfAGAIN, I stated ANY ADDITIONAL work will be at time and materials as it is impossible for me to provide a proposal for work that I do not know the scope of* agreed and said he was fine with thatPlease note, *** was told numerous times about the time and material clause for additional work requested and this is also covered in the original proposal. Genesis Painting completed the work per the written proposal and all the additional items requested by *** at time and materialsI calculated the hours for the time and materials portion over and above the original proposal from the data gathered via our GPS tracking and the lead painterThe hours accumulated on the extras requested by *** added up to hoursI deducted hours from this total to be nice which I now regretThis deduction is over $in laborI invoiced *** for the original proposal and the net hours remaining of plus materialsThis equaled $in labor and in materialsI sent the invoice via email to *** explaining the extras and creditThis is when *** *** elected to get involvedShe called me several times over the weekendI explained that *** agreed to the time and materials and I gave them a credit for which I did not have to giveI also told *** that I would send a full invoice for ALL hours accrued at time and materials*** and *** stated they would agree to the revised bill and paid itA few important items to note: At not time did *** or *** complain about qualityAs a matter of fact, *** asked the lead painter to stop back so he could provide him with a tipIt was only until the invoice was sent that the quality concerns beganNext*** *** was not involved in ANY of the conversations or meetings that we had with ***...None!During all this, I have been insulted, my painters have been verbally abused, and I have also sent our painters back to the home twice to touch up items*** has told me it was my responsibility to know that *** had PTSD and memory problems from his cancer treatmentThis is not my responsibility nor do I feel comfortable even talking about itFrom my point of view, if *** knew of these issues she should have been involved from the start if she had concerns about ***'s Decision making skills In summary, our contract clearly states the time and materials extrasI discussed with *** numerous times the fact that the extra work would be charged at time and materials *** agreed*** is the name on the proposal and *** is the person I met with several timesSince the invoice was sent, *** became involvedAgain, *** should have been involved from the start if she was concerned about the decisions that were being made. Genesis Painting completed the original proposal and all the additional items to industry standardsThe invoice has been paidOver and beyond my personal and phone conversations with ***, the proposal clearly states in writing all the terms and conditionsI consider this matter closed with the client having received all the work promised in addition to over $of free labor that was not billed

[redacted] had his Jeep towed in here on the 2nd of January 2017.  He explained that his Jeep quit moving on him.  He was still under warranty at the time.  I told him that we will need to get the transmission out to find out what had happened.  We pulled the transmission out...

to find out it was abused.  He had rode the clutch and dropped it from neutral to first so many times, it had gotten so hot it melted clutch to the flywheel of the motor and to the pressure plate.  (Pictures will be included.)  I called him and explained this to him also inviting him to come look at this.  Also explained to him this is not covered under his warranty.  He does not have a warranty that covers abuse.  He then asked what the cost would be to fix it.  I told him the price and he declined repairs.  Since this is not covered under warranty I have the right to charge a labor fee.  the actual labor fee is 617.50, but only charged him $498.00.  He understood and we installed the transmission and clutch back into his car.  [redacted]

I'm sorry it was a mistake when we put that it was Friday, you are right it was Wednesday.  The statement about ordering parts, the parts that were needed were for the cars currently in the shop that needed finishing in order to get your car in to check.  We were here till 5:00 that Wednesday and takes at least 15 to 20 minutes to close up, so your call would have had to come after then.  If you wanted to pick up your car you should have just come and got it.  The reason you weren't called is the police officer gave us the impression she wanted to call and was going to do that right after she left.  I am very sorry your stereo was stolen.

last conversation that was heated over the phone was on 5/23/16.  I told him to put the disassembled transmission in a box in the car and I would pay him the $698.  At that point, I just wanted to cut my losses, learn, and go on to have it repaired elsewhere.  He finally agreed and said that I would still have to pay the $698.  I said ok and Hung Up.The next morning, I was at a job in Elizabethtown, Kentucky and he called and was nice and said the car is back together and I could pick it up anytime.  I immediately asked him why he went ahead and did opposite of what we talked about the day before.  He said, again, he couldn't do that.  I told him he basically he did exactly what I asked him not too.  I was suprised when he told me that the car is drivable.  I was under the impression that they would have not put "new transmission" fluid into the car that would have charged me more.  Come to find out, it was the same old transmission fluid.  I was prepared to find a tow truck to come and get it so finding out the car was drivable was a surprise.Again, I was never invited to come and look at the disassembled transmission at anytime.  That is totally false.  Matter of fact, I am totally resigned to the fact that the reason that the transmission "had to be reasembled" and "put back" into the vehicle is because it was never taken out.  Any business would gladly get their full amount (in this case, $698), if they had to do only half the work (in this case, not having to put the transmision back into the car).  The statement that is attached is from a reputable Volkswagon specialty shop that deals with this type of vehicle.  A short statement from the owner states that the transmission was never touched or removed from the vehicle.  [redacted] has told Mr. Transmission Corporate that there are 3 ways to take a transmission out of a vehicle, which is false.  The [redacted] location, where the car is located now, stated there is only 1 way to take a transmission out of a 2006 VW Jetta.  He also go on to state that if the transmission had been ever worked on at all, there would be hand prints, smudge marks, the grease on bolts would have been disturbed (ex. putting a wrench on a greasy bolt would disturb grease, smuding it), etc.  None of this was observed.  Even the old transmission fluied that came out of the transmission could not have been put back through the system as he says.   I personally went to observe the underside of the car and took 29 total pictures.  There was absolutely no evidence of anything being removed, touched, or disassebled on this car.   My complaint with Mr. Transmission in Middletown is not the original quote or even the $698 to remove and "reassemble."  My complaint is an over abundance of evidence showing that the work was not completed at all.  [redacted] can tell say all he wants that he had the transmission out of the car and reassembled it, but that is just not true when you actually see in the pictures.  He stated that the paramount of lies was on my part, there are absolutely no lies on this end.  A company that doesn't tell you to come in to inspect the vehicle (he said he did, but he did not), that the vehicle has to be reassembled when there is no state law are policy that demands that, and the evidence that is in the pictures shows that this shop is operating under unethically.This is the reason for the refund of $698.  Work that was said was performed and was obviously not performed.
