I filed a complaint once about National Student Aid Care on how they falsely informed me of my student loans being completely paid, off not consolidated as was told to me by Mr*** *** I was then responded to by NSAC through the Revdex.com with a message saying it appears you have been refunded sorry for any inconvenience, but I have yet to receive a refund from athem and I have yet to be able to contact them after they hung up on me and refused to answer my calls

a legitimate companyIt must be illegal to utilize someones user id and password for a government siteThe only reason I gave it to them is because I had NO idea what an FSA ID was and thought it was part of their company's systemWhen I was in college we used PIN numbersAdditionally, I think it is VERY important for others to know what they are doing and how they are doing it.? [Plaintiff [redacted], has been subject to unlawful telephone practices by your company in the form of (unwarranted or unauthorized) cellular telephone calls by use of an auto dialer or (ADAD) in relation to telemarketing / advertisements.Your company harassed Plaintiff [redacted] by making numerous 14 cellular telephone calls without prior express written consent / prior express consent as required by telemarketers or advertisers.Defendant National Student Aid Center, (NSAC) in their communication in connection with telemarketing / advertisements directly have violated 47 U.S.C. §227(c)(5) as Plaintiff [redacted] cellular telephone which is registered with the National Do Not Call Registry.Defendant(s) National Student Aid Center, (NSAC) has demonstrated willful or knowing non-compliance with 47 USC § 227(c)(5) by calling Plaintiff [redacted] wireless telephone number 202-XXX-[redacted] which is registered on the National Do Not Call Registry (DNC) since April 22, 2012, Plaintiff’s number, which is assigned to a cellular telephone service.“See Attached Exhibit D - The email confirmation sent from the (FTC) Federal Trade Commission [email protected] to Plaintiff [redacted] confirming cellular telephone registry on the (FTC) National Do Not Call Registry on a number ending in [redacted] on April 22, 2012.”These actions are unlawful in the District of Columbia pursuant to the Telephone Consumer Protection Act (TCPA) 47 U.S.C. §227(c)(5).Plaintiff [redacted] will be sending by email or fax a legal complaint draft, which explains the basis for my claims.Under the Telephone Consumer Protection Act (TCPA) 47 U.S.C. §227(c)(5), Plaintiff [redacted] is entitled up to $1,500 for each separate willful violation of the Act (TCPA), plus attorney's fees and cost.Damage calculations are as follows:• $1,500 x 14 = $21,000 for NATIONAL STUDENT AID CENTER, (NSAC) (willful or knowing non-compliance for violations of the TCPA, for using an automated dialing system to call Plaintiff [redacted] cellular telephone without prior express / written consent pursuant to 47 U.S.C. §227(c)(5).• $21,000 = total in statutory damages under (TCPA), for a grand total + including attorney fees and costs. Sixth Circuit Court of Appeals has held that damages under this section may be stacked on top of the TCPA 227(b) section covering “calls to cell phones.” This means that the consumer can get up to $3000.00 per call for violations of the cell phone prohibitions and the DNC provisions. Charvat v NMP, LLC, 656 F. 3d 440 (6th Cir. 2011). Courts may treble the damages award if the court finds that defendant's violations were committed "willfully or knowingly." 47 U.S.C. § 227(b)(3). Although neither the TCPA nor the FCC regulations define the terms "willfully or knowingly," courts have generally interpreted willfulness to imply only that an action was intentional. Smith v. Wade, 461 U.S. 30, 41 n.8 (1983). While the TCPA does not define willful, the Communications Act of 1943, of which the TCPA is a part, defines willful as "the consciousor deliberate commission or omission of such act, irrespective of any intent to violate any provision, rule or regulation." In Dubsky v. Advanced Cellular Communications, Inc., No. 2008 cv 00652, 2004 WL 503757, at * 2 (Ohio Com. Pl. Feb. 24, 2004), the court found that in the context of the TCPA, the term acting "willfully" means that "the defendant acted voluntarily, and under its own free will, regardless of whether the defendant knew that it was acting in violation of the statute.” 47 U.S.C.§ 227(b)(3). “Importantly though, the intent for treble damages does not require any malicious or wanton conduct, but rather is satisfied by merely ‘knowing’ conduct. Alea London Ltd., 638 F.3d at. 776. In Dubsky v. Advanced Cellular Communications, Inc., No. 2008 cv 00652, 2004 WL 503757, at * 2 (Ohio Com. Pl. Feb. 24,2004), the court found that in the context of the TCPA, the term acting "willfully" means that "the defendant acted voluntarily, and under its own free will, regardless of whether the defendant knew that it was acting in violation of the statute.”This notice is being sent to you as an opportunity for, (NSAC) National Student Aid Center (NSAC) to cure your willful violations of the Consumer Protection Statutes as these laws are enforceable by a citizen’s / consumers private right of action by private enforcement.(TCPA) Telephone Consumer Protection Act 47 U.S.C. §227(c)(5).This is your final opportunity come back in to honor in good faith and with clean hands... At your convenience, I am giving you 72 hours to contact me after receipt of this letter and if you fail to do so, I will have no alternative but to seek my redress IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLUMBIA via legal action.]
