Dear Sir or Madam, This claim for repair was denied as the failure to the engine was due to sludge buildup which is not covered per the terms and conditions of the service contractMr [redacted] contacted us and asked that we review the claim fileI reviewed the claim file and agreed that this was not a covered failureAs this was a recent sale the resolution for coverage should have been between Mr [redacted] and his selling dealerHowever, National Warranty agreed to step in and we contacted the dealer on Mr [redacted] behalf and we agreed to help in the cost of the repair with the dealerMr [redacted] was informed of the assistance of both parties and that the selling dealer wanted his repair facility to make the repair in order to keep costs downIt took the repair facility some time to get the disabled vehicle towed to their shopAt no time did National Warranty state that they were supplying an engine for repairThe repair facility informed us that they had found a used engine and we agreed to that repairIt has been difficult to make contact with the repair facility, please see attached claim notesWe have made every attempt to keep this repair moving forward including responses to Mr [redacted] After we were finalizing the used engine costs we were informed that there would be no labor warranty for the engineThat is not acceptable so now we had to look at alternativesThe repair facility informed us that they could repair the engine and provide a parts and labor warranty and that’s where we are todayThey have ordered parts for the engine and we are waiting for them to arriveThis repair for Mr [redacted] has been approved and we apologize for any delays but because of the unusual circumstances of this repair some of them could not be avoidedSincerely, Paul D [redacted] Director, Claim National Warranty Corporation

Complaint: [redacted] I am rejecting this response because: The issue of a bad VVTI valve was discovered before any oil change record discrepanciesWe brought this issue to the service technician at 80k; therefore the part was bad previous to any oil change record discrepanciesPlease review recorded submitted to National Warranty from Lexus of SeattleThis is not a new issue, it was finally diagnosed and NWC is using missing records as a way of denying the claim and keeping our moneyIf denial of claim continues I expect a prorated refund of warranty from date of 80k service.Sincerely, [redacted]

Dear Sir or Madam: The claim for Ms***’s engine repair requires that maintenance receipts be provided showing that the vehicle has been maintained in accordance with the manufacture’s guidelinesPlease see the service contract under VIIIGENERAL PROVISIONS, page five section DWHAT YOUR RESPONSIBILITIES AREIn this process we did not receive the needed records to validate manufacture’s recommended maintenance had been performedOn December 8, we were supplied with maintenance receipts for only half of the required intervals of service neededIn a conversation with Ms [redacted] on Jan18th, she explained that Dennis Dillon service department had recommended that she have the work done and seek reimbursement from National Warranty after she had all of her recordsShe authorized the repairs, contrary to the procedures for filing a claim as indicated on page two of the service contract under “HOW TO SUBMIT A CLAIM”Ms [redacted] should have contacted our office for instructionOn a claim of this nature a field inspector would have been dispatched to confirm the failure and to evaluate the cause and extent of the damageBy Ms [redacted] authorizing repairs without our knowledge we were not able to validate failures or adjudicate the claim as per terms of this agreementWhen necessary and cost effective we may have also supplied parts for this repair had it been determined to be coveredOn January 27th Ms [redacted] provided the remaining five additional maintenance receipts after the repairs were completedAfter review of all the receipts provided, there are two oil changes that are more than 2,miles over due from the factory recommended intervalsBased on the language in the vehicle service contract and a review of the failure I find that the claim was properly adjudicatedHowever, National Warranty will consider splitting the total cost of repairs with Ms [redacted] as a goodwill gestureIf Ms [redacted] agrees to this decision please advise her to call our officeSincerely, National Warranty Corporation

The claim for Mr***’s engine repair was denied based on the cause of failure. It was reported by the repair facility that the engine had no compression in the #cylinder combustion chamber. Upon further diagnosis and disassembly they found the spark plug electrode for the #
cylinder had broken offImpact marks are seen on the piston top from the broken electrode before becoming lodged between the intake valve and seatAn independent inspection company was assigned to verify cause of failure and extent of damage. The #spark plug failure has caused the valve not to be able to close, allowing compression loss and the failure of the #rocker arm on top of this valve
Please see page four of the vehicle service contract under section VIIWhat Is Not Covered, for the exclusion of spark plugs and section VIIWhat Is Not Covered 1.adamage to a covered part caused by a non-covered part
Based on the language in the vehicle service contract and a review of the failure I find that the claim was properly adjudicated. I regret that we will not be able to assist with the repair

was denied based on the cause of failure. It was reported by the repair facility thatthe spark plug had blown out of the cylinder head and damaged the coil pack. The Premium Plus vehicle service contract states that spark plugs are excluded from coverage and, as Ms*** already acknowledged, the cylinder head is only covered if damaged by the failure of an internally lubricated covered part. There were no internally lubricated failures thatdamaged the cylinder head. Please see page four of the service contract under section VIIWhat Is Not Covered, for the exclusion ofspark plugs and section VIIWhat Is Not Covered 3.bfor the cylinder head language. Based on the language in the vehicle service contract and a review of the failure I find that the claim was properlyadjudicated.
