Ms***'s request that TAMKO pay 100% of the cost of replacing her 11-year-old roof overlooks many pertinent parts of the limited warrantyAccording to Ms***, her shingles were installed on November 4, She noticed a possible issue with her roof in Her first notice to TAMKO was three years later on October 23,
The applicable limited warranty has a 5-year Full Start PeriodAt the time of Ms***'s notice to TAMKO, the Full Start Period had long expiredIn accordance with the applicable limited warranty, the remedy after the Full Start Period provides that TAMKO provide Ms*** a material certificate for new TAMKO shingles prorated by the months of service provided by her original shinglesThe proration takes into account that the shingles performed for a portion of the limited warranty term and provides compensation for the remaining term of the limited warrantyTherefore, on January 28, 2016, TAMKO sent a Material Certificate for Squares of Heritage shingles to Ms*** which she may redeem until January 28,

Tamko's representative told me I had every opportunity to check out their warranty online, however their legal page specifically disclaims all expressed and implied warranties describing them as informational onlySo, which is it?
When we purchased our home my understanding was that the roof had a year warranty, Tamko claims In either instance, we were not provided Tamko's warranty, limited or otherwise, as Tamko now claims warranties are printed in or on boxes which new home owners are very unlikely to view as the boxes of shingles are provided to sub-contractors, not the owner
Tamko did not do its due diligence to assure that their "limited warranty" was provided to the purchasers hands; it's efforts apparently are more focused in sales pitches of quality, durability, lasting beauty and value as can be found currently on their website, thus, did not provide a "limited warrant," nor opportunity to review and compare its warranty when considering purchase, to us nor our builder as part of the original saleI want to be clear with regard to Tamko's "Limited warranty." When we purchased our home my understanding was that the roof had a year warranty, Tamko claims 30, however, in either instance we did not see nor sign and Tamko did not provide us personally with a warranty, limited or otherwise, as Tamko claims the warranties are printed in or on boxes of tiles which end up in the hands of subcontractsThat would be like saying your warranty for your vehicle engine is printed underneath the engineOdd that this important document would not be provided to the contractor and homeowner to be signed, dated and of utmost importance, reviewed! It is apparent to anyone who has spent a cursory amount of time at a construction site (and construction products are Tamko's business) that subcontractors do not take the time to gingerly read boxes and sheets of paper therein and spend half their day reading and preserving same; they are NOT on retainer, rather, they get the job done and move on to the next; they are not warranty managers, attorneys nor employees of Tamko
The week of February 11, Tamko sent a generic photocopy of a "limited warranty", not dated or signed by us or by Tamko (which says it is not to be photocopied) which states that it covers shingles sold on or after with a year "full start." When did the full start change from to years, as years is what is stated on Tamko's website,more than twice the time?
We had been aware of what Tamko claims is the "full start" period for a day when we first contacted Revdex.com, PERIODBinding us to an agreement that we knew nothing of, never agreed to, leading to many thousands of dollars of debt because of Tamko's defective product is imprudent and unfairHad we known the shingles Tamko sold are defective we would have initiated a claim years ago, and proration of any kind is an absurd notion with regard to defective products which obviously will not remove nor reinstall themselvesBut for Tamko's defective product, we would not be in need of a new roof and certainly not within 1/of the roofs expected lifespan
Furthermore, the pertinent warranty information is not conspicuous, in fact, it is difficult to read as the type is tiny, tiny, tinyVitally important information, in specific the full start period should be conspicuous, i.e.: heading of full start period in huge bold caps equal to or much greater in font size than the surrounding text, instead it is tiny tiny tiny
Perhaps it is worth noting that a billionaire who sells defective products can take a hit like replacing a defective roof but for unsuspecting middle class families, faced with replacing a roof years early, because it is and was defective from the start is devastating
Our claim is that that Tamko breached its duty, selling defective merchandise which is not fair value for money spent, the shingles are and were not merchantable for their particular purposeThe implication that the goods (shingles) were fit to be sold in the first place, (were tested for Tamko's stated durability), will do what they are supposed, are free from product defect(s), that there is nothing wrong with them and they will remain free from defects and durable for a lifespan is falseThe defective shingles did not perform for the expired warranty portion, as, being defective in the first place the performance is faulty in form and function from the day Tamko created themUnlike ordinary wear and tear, it is clear that quickly degrading defective shingles are unsafe, unusable and unsuitable from the start and when applied to the roof simply breakdown at an accelerated rate harming the roof rendering an unsafe, unsightly and an unfair monetary burden upon the homeowner which should have been avoidable with due diligence testing, i.e.: proper quality control testingI've heard from the company about the "limited warranty" that we were posthumously provided, a warranty that now has been extended twice the length to customers purchasing currently, as an excuse for the company to avoid paying for the replacement (materials and labor) of our roof that would not need replacing, would not be defective but for Tamko's defective productTamko's website claims to provide top-quality (not defective) products and excellent (not excuse ridden, hiding behind tiny tiny tiny font paperwork that we didn't receive) supportIn sum, Tamko may choose to try to avoid responsibility for its actions and/or inactions with regard to the damage its defective products have caused to our home, (hiding behind paperwork we've not seen until a day before contacting Revdex.com) with its defective poor-quality degrading shingles and the high cost of roof replacement, in our case about years before expected, thus treating us unfairlyOr if honesty, openness, people centeredness and fairness is its code of conduct, take responsibility for its mistake, replace our roof (labor and materials or appropriate cash to do same)

When we purchased our home we knew only of Tamko's representations/marketing materials, i.ereliable, durable and defect free for thirty years, fifty yearsTamko's customer service claims its shingles came with a Limited Warranty printed on the inside or outside of its boxes, however, according to the Lumber company where the shingles were purchased there is no box and the shingles arrive on flatbeds in palletsWe did not receive a copy of the warranty, Tamko did not contact us when they found defects in Heritage shingles nor did they contact the company where are shingles were purchasedWhen we learned there was no recall and Tamko did not and has not sent a representative to our home to access the damage nor to warn us of potential harmAS SOON AS WE LEARNED TAMKO'S SHINGLES ARE DEFECTIVE, THE DAY AFTER THE ROOF WAS INSPECTED, we contacted TamkoWe filled the packet forwarded to us by Tamko, sent in all the qualifying information, including proof of original ownership, photos including drone photos, measurements, and a sample of the shingles for Tamko to testIn defiance of the fact "Tamko's lab" found the shingles defective, it offered merely replacement for a portion of the shingles, excluding 40% which we would have to purchase from Tamko in order to have a matching roof, it offered nothing for labor, other roofing materials and disposal, and, obviously shingles do NOT replace themselves
Our Revdex.com complaint doesn't arise from a warranty we were not provided in the first place, rather, it arises from Tamko's defective productWe did not accept terms we had not seen by merely purchasing a home with Tamko shinglesAdditionally, we never signed any document agreeing to Tamko's limited warranty and do not believe one may warrant a defective productEven if, as Tamko's customer service claimed, it wrapped its tiny tiny tiny print warranty around packaging, the ultimate owner will never likely see as subcontractors tear off and discard packaging so we don't believe we are bound to construction trash that is thrown away or blows away in the windHowever, we would never purchase roofing with a thirty year warranty that really means that the bulk of the cost of replacement (ALL labor, disposal and % of materials) is on the homeowner after 5-years
Additionally we did not invoke a warranty we had never seenThe day after we were informed by the roof inspector that the shingles are defective we reported it to Tamko and complied with all of their requests
After doing more research I learned a couple of things with regard to Tamko
First, I was told by the local company that sold the Tamko shingles that are on our home that they do not receive them in a box with a warranty insideThe roofing department representative said the shingles are received on pallets, that they are not provided copies of Tamko's warranty, they are told by Tamko sales representatives the length of the warranty (20,30,years) of shingles correlating by style/weight
Secondly, Tamko is politically active; according to FEC Tamko's CEO contributes millions among Super PACs, Hybrid PACs Historical Soft Money Party Accounts, Political Committees Except Joint Fundraising Committees and Joint Fundraiser ContributionsI hope the above-mentioned political access does not mean that we do not have a chance of receiving fair treatment
Third, Tamko now warrants the same Heritage shingles that are on our roof for years with a fifteen year full startWe believe that the very LEAST Tamko could do to show good faith is to give us the same courtesy it extends to customers purchasing currently, "fifteen year full start" and replace the defective shingles and pay for the labor and shinglesIf you read it's website Tamko pushes their new warranty as a sales tool: From it's website:

I put a claim in on June X XXXXOn July XX XXXX, I received a phone call informing me that my claim can not be processed with the estimates I submitted because Tamko does not pay for the removal or replacement of Non-Tamko materialsTamko faulty materials caused has caused the damage to my wood framing structureI think the company should make an effort to resolve this issue in timely and fairly mannerI feel that Tamko should be responsible for their product that has caused damage to my framing structure

I am a disable veteran on a set income and I can not afford the extra cost to replace this damage caused by Tamko
My concerns are not only with the faulty Tamko products but the damage that they have causes to our wood frame structure
Here is an example of responsibility, if you cause an auto accident to happen, than you are responsible for the all damages you have causedthere is no mention in the warranty that if your product causes damage to other items such as my framing structure, So what remedy are they going to use to resolve this issue?
