This still does not explain why shingles seals are failing all over the roofAlso it does not explain why year shingles are delaminating in less than yearsThe improper nailing does not account for all of the delamination because I have personally replaced the shingles myself and they were nailed through the common bondI have found that a lot of people are having similar problems with the heritage shingles like mineThe adhesive is not holdingThere are lots of claims on the internet

The applicable limited warranty has a Full Start Period of five (5) years from the date of purchase in which TAMKO provides a certificate for replacement shingles and a certificate for the reason able cost of labor to install them (excluding tear-off, removal and disposal of old shingles)After the Full Start Period has expired, the limited warranty states the TAMKO will provide a certificate for replacement shingles prorated to take into account the amount of time the shingles have been in use on the roofI have attached a copy of the limited warranty for your review

unacceptable response from tamcoon an aesthestic basis alone, this shingle has created worry and it was unknown why it was turning colorsno notice had ever been sent concrning the issueand on a functional basis without granules to protect from the elements, hardness of shingles ,rusting nails that hold the shingles, its obvious there has been luck involved on having any leaks
saying that tamko turns everyone down was stated , for those who find out the condition of their shingle, it is usually after the no matter what warranty from tamcoif these shingles are able to stay on the roof under conditions will be much more than luck and meanwhile having to look at them is sickning

I noticed all the shingle samples, provided by Mr***, were nailed with only three (3) nails (the Installation instructions require a minimum of four (4) nails in each shingle) and some of the nails were improperly nailed above the common bondSince TAMKO does not have control over the installation of its products by homeowners and/or their contractors, issues resulting from improper installation are excluded from coverage under the limited warranty

11/10/2017@11:55  {mediator called consumer and left him phone number and hours, requesting he call to discuss}11/13/2017  (voice mail from consumer) Well, believe it or not, Tamko got on the bandwagon and got this taken care of. They sent a representative from Missouri over here to Ohio to make the repairs.  It took me contacting the Revdex.com and the AG's offices in Missouri and Ohio to get this done. I wanted to wait awhile after the repairs before reporting anything  and have some rains to make sure the repairs worked. We had some rain a few weeks ago and so far, so good.  I am all set. Thanks to the Revdex.com for helping.

TAMKO strives to strictly abide by the terms and conditions of the limited warranty as it administers each claim. Ms. [redacted] indicated to TAMKO that she began having problems on December 13, 2014. She filed a claim with TAMKO and sent in photographs of her roof and two shingle samples. The photographs do not show any evidence of the alleged blistering or excessive granule loss but do show improper flashing and top nailing through the flashing around her vent stack which can certainly result in leaks.
Extra granules are used during the manufacture of shingles so some granule loss over time is not unusual. The shingle samples submitted do not show excessive granule loss but do show signs of scuffing (possibly from foot traffic during installation).
Although TAMKO cannot respond as Ms. [redacted] requested (since there does not appear to be a manufacturing defect in her photographs or shingle samples), her limited warranty still remains in full force and effect.

The limited warranty associated with Mr. [redacted]'s purchase of TAMKO shingles remains in full force and effect and he may contact TAMKO again if the shingles develop a leak directly caused by a manufacturing defect pursuant to the instruction contained in the limited warranty. We have reviewed the response from tamko and would like further clarification on the matter.
Mr. [redacted] inspection is still in question because there are no torn or damage shingles around the satellite television equipment. Therefore, did Mr. [redacted] really do the inspection and did he do it at the correct home. Majority of torn shingles and the area that was blown off are on a different level of the roof than the satellite equipment. Therefore making tamkos response to this concern still unclear.
We do understand tamkos response in regards to the shingles being mishandled. This still doesn't explain or answer the question of what are the the guidelines and instructions for handling these shingles

I have confirmed with Mr. [redacted] he did inspect the correct property and as stated before, he noted a good deal of foot traffic over the garage area/satellite equipment which caused scuffing and broken corners/edges.
Shingles like most (if not all) goods and merchandise should not be mishandled or damage may occur. Shingles must be handled in a manner which does not cause the type of shingle tearing noted on your roof. Like improper installation and foot traffic, the mishandling of shingles is outside of the control of TAMKO and is therefore not covered under the terms of the limited warranty. I hope this answers your questions.

Again, like we stated before, there are not torn shingles around the satellite equipment. Majority of torn shingles are on a different level of the roof. The same level that shingles were blown off. So foot traffic do to satellite installation is not accurate.
Also, the question has not been answered in regards to handling instructions not being listed on the shingles or in the warranty. Therefore, what are the specific handling instructions of these shingles? And why are these instructions not listed on the shingles or in the warranty?

TAMKO attempts to treat all claimants fairly by abiding by the terms of the limited warranty and thereby not showing favoritism to one person while denying it to another in the same situation. Therefore, the wind-related claim of Ms. [redacted]'s was not initiated since that portion of the limited warranty had expired.

function of the finished roof. Lower temperatures affect the ability of shingle sealant to activate and bond to adjacent shingles. Shingles installed in cooler weather or on areas of the roof that do not receive direct sunlight may not seal fully until weather conditions are adequately warm enough to allow the sealant strip to activate and the shingles to lay flat. Two things must occur for the shingles to seal. First, there must be contact between the sealant strip and adjacent shingles, which may not occur if the shingles are not laying flat. Second, the sealant must be activated by exposure of the shingle to the sun for a sufficient period of time. Because numerous variables are involved (e.g. shingle color, roof slope, exposure direction, air temperature, angle of the sun), the time required to fully seal is unique for each roof. Dust and other contaminants blown under shingles prior to sealant activation may accumulate on and around the sealant strip and may interfere with proper sealing of the shingles. This is more likely to occur when shingles are installed in cooler conditions and experience longer times before sealing. Please see the applicable application instructions for the purchased shingles, available on every wrapper of the shingles or at tamko.com, for complete details related to installation during cooler months.
ALSO, please be advised that the applicable limited warranty states as follows: "Unless authorized in writing by TAMKO, any claim for Shingles that have been replaced or repaired prior to resolution of your claim by TAMKO may be denied." Please see TAMKO's limited warranty for complete details.
I would strongly recommend you advise your customer to leave the shingles on the roof for 4 more months (into the summer) so the sealant will have a chance to activate and the shingles will have an opportunity to seal down as they are designed. Please be advised that this writing does not waive or alter the application instructions or the limited warranty. It is also NOT authorizing you to replace your customer's roof on behalf of TAMKO. the install was done mid summer when temperatures were in the lower to mid 90's with over night temperatures in the 60's plenty of warm days to seal the shingles. the shingles just did not seal and with the winds we have got through the winter months have caused the shingles to rip off. something has to be done to correct this.the home owner does not want to leave his roof like it is. I will replace the shingles that have been ripped off but as for the shingles that are not sealed I will wait your 4 months to see if they seal

a remedy to the purchaser in the event TAMKO shingles have a manufacturing defect directly resulting in leaks. The limited warranty is printed on every package of TAMKO shingles so homeowners (as well as retailers and contractors) have the opportunity to read and compare our limited warranty to others as they consider which brand of shingles to buy.
The applicable limited warranty has a Full Start Period of seven (7) years from the date of purchase in which TAMKO provides a certificate for replacement shingles and a certificate for the reasonable cost of labor to install them (excluding tear-off, removal and disposal of old shingles). After the Full Start Period has expired, the limited warranty states that TAMKO will provide a certificate for replacement shingles prorated to take into account the amount of time the shingles have been in use on the roof.
Mr. [redacted]'s shingles were installed on July 20, 2007. He initiated her claim with TAMKO on January 22, 2016. The Full Start Period expired before his first contact with TAMKO. Further, he indicated that his roof was not leaking. Nevertheless, TAMKO made a good faith effort to resolve his claim by providing a material certificate for 29 squares of Heritage Premium shingles in accordance with the limited warranty terms. The material certificate is prorated by 83% to take into account the 102 months his shingles were in service during the limited warranty term.
TAMKO regrets that Mr. [redacted] experienced issues with his roof and has made a good faith effort to resolve this claim. THIS GOOD FAITH OFFER IS STILL AVAIALBLE TO MR. [redacted]; HOWEVER, THE MATERIAL CERTIFICATE HAS AN EXPIRATION DATE OF MARCH 23, 2017 AND MUST BE REDEEMED ON OR BEFORE MARCH 23, 2017. instructions for redeeming the material certificate are found on the face of the material certificate.

This new roof I have to put on cost me $5,870.00. Yes I understand they prorated my shingles but after 9 years my 50 year roof should have lasted way longer then 9 years. I have had other houses with just standard shingles and were still good after 20 years or more. I feel these shingles were defective. Just sick about 50 year premium shingles bad in 9 years. I also have heard of class action suits against Tamko premium shingles on the internet. I am on fixed income and purchased these shingles to last my lifetime. But failed after 9 years $5,870 dollars is a big hit for me. I would like for Tamko to stand behind there shingles. Yes 100.00 voucher does not make up for $5870 for new roof replacement.

Ok like I said before 50 year heritage shingles they last 9 years only.placed on my new built home. Avg life for just regular shingles 20 years. You have a defect in your shingles and you should be accountable for that. It now cost me $5,870 for labor to replace my roof just after 9 years. Tamko you should help a fixed income person and own up that you had a problem with these shingles. Asking for labor help cost. I know you voucher 29 of 35 squares but come on 9 years and have horizontal deep cracks over 90 % of the shingles.

TAMKO offered to Mr. [redacted] a material certificate for 54 squares of [redacted] shingles (75 squares prorated 71% for the 104 months the original shingles were in service). The limited warranty proration takes into account that the shingles performed for the expired portion of the limited warranty term.
TAMKO has made a good faith effort to resolve this claim and the Material Certificate sent to Mr. [redacted] on June 17, 2015 is still redeemable according to the instruction on the Material Certificate.

I have read the response from Tamko and disagree with their findings. My issue is that well before I filed the claim the shingles were defective and the fiberglass is showing through the defective shingle and has lost the majority of its granules. How often does a person get on top of a 12/12 pitch and start looking for damage from a 30 year architectural shingle that I paid good money for. Tamko should do the right thing and replace all the shingles with the reasonable cost of removal and labor to repair the defective shingles that they have agreed to as being defective, not by weather damage but by defective manufacturing as they have already admitted to. I don't know of any manufacturer that has made a defective product who would not rectify the decision with a true good faith effort in making it right by replacing the product to its full standing at no extra cost to the consumer. Thank you to the Revdex.com for your help to resolve this on going problem and if you would like, I can send pictures of my defective shingles to prove the state of deterioration.

In TAMKO's opinion, it is doing the "right thing" by abiding by the limited warranty that was printed on every package of shingles Mr. [redacted] purchased. TAMKO tries to ensure fairness and uniformity in handling all claims under the limited warranty and accordingly, TAMKO administers all such claims in accordance with the terms and conditions of the applicable limited warranty so all claimants are treated fairly and equally. Although, Mr. [redacted] would like special treatment and would like TAMKO to provide a remedy beyond that stated in the applicable limited warranty, that would not be fair to other claimants nor to TAMKO since proration takes into account that the shingles performed for eight (8) years of the limited warranty term. IF a defect is discovered in a vehicle that has been driven for several years, the car manufacturer is not going to give a brand-new car to the claimant but some type of prorated remedy that recognized the several years of service that the vehicle provided. TAMKO has offered the same type of Prorated remedy to Mr. [redacted]. Again, the offered remedy is not arbitrary but is prescribed on every bundle of shingles for Mr. [redacted] (or his chosen contractor) to read before he decided which brand of shingles to buy.
The Material Certificate for 54 Squares of [redacted] shingles is still redeemable as full and final settlement of his claim. I hope this is helpful in explaining TAMKO's position.

Again I am not seeking special treatment because I believe the shingles were defective within the full start period and began to loose it effectiveness within the 5 year start up period. If the paint job were defective on a car I would not ask the manufacturer for a new car but for only a new paint job, as in this scenario if my shingles have defective material on 80% of the house the whole roof would need to be repaired as so a new paint job on a car would be. If to reroof a house didn't cost $15k+ it would be a different problem, but to ask a homeowner to eat 80% of the cost of replacing a roof all due to a defective manufacturing problem is extreme and unjust. I would like to ask the Tamko representative personally if their house had a defective shingle if they think it is fair for them, personally, to have to come out of pocket 80% of a new roof for a defective shingle that the manufacturer has acknowledged was defective, would you not pursue the manufacture to absorb that cost? I know that Tamko has been in the shingle business for years and provides good products but in this case there was a run of defective shingles that I happened to purchase and I believe that they can look at the shingles that were sent to them and determine that material was well defective from beginning and not after the full start period, this is where I am stating my problem and therefore I am not requesting special treatment but am requesting that the warranty be instated to cover the defective product due to the bad run of shingles from the factory. I am not requesting a new house but just the one thing that protects the house from all elements, rain, sleet, snow, sun and wind. I believe that Tamko wants to back their products because they are essential in the protection of a person's greatest asset in life, their home. I have served 2 tours of duty along with purple heart for wounds received in combat and I believe that defending this country is and was an honor for people and businesses to thrive and to do the right thing and I believe Tamko will do the right thing in this warranty claim.

I have reviewed Mr. [redacted]'s claim file and confirmed that the limited warranty associated with his EverGrain deck boards...

purchase is a 10-year limited warranty. (Mr. [redacted] was sent another copy of the original limited warranty on May 6, 2016 for his convenience.) The products were installed in December 2004; therefore, the coverage under the limited warranty ran to December 2, 2014.
