To Whom It May Concern:*** **l am writing this letter in response to the complainant that IUchard *** filed onApril 6, against our company.In early November, 2014, Mr*** cont.acted our company about providing aquote for certain excavation work he needed for a spec
home that he was going to bebuilding on *** *** ** *** **We provided Mr*** with a proposaldated November 24, 2014, for the work excavation work, which proposal includedpricing for digging the footings, back fill, septic installation and rough gradeJn orderfor Mr*** to be able to obtain a building permit from Louisa Cofor this project, heneeded to have a Registered Land Disturber font completed and turned into the BuildingInspections DepartmentMr*** requested that we sign that form and he wasexpressly told that in order for us to sign this form for him, we would have to do all of theexcavation work on the project and each item of work that was specifically set forth inthe November proposalMr*** indicated he had no problem with this and hesigned the November proposal and we in tum signed the Registered Land Disturberform for Mr***Copies of both of these documents have been provided.Sometime during late December or early January 2014, our company dugthe footing for the project and installed the culvert pipe, which is the subject of Mr.***'s complainantWe installed a 15" x 24' galvanized (metal) culvert which pipe wasspecified as an acceptable pipe on the *** entrance permit for the subject propertyAcopy of the *** entrance permit has been providedWe also installed the septicsystem in early MarchHowever, Mr*** performed his own backfill, even thoughhe contracted with us to do this work, and was told we had to do the work under our RLDform

They had 7 days to control the banks after pipe was installed. We are now done fixing their problems and will never send business to them or recommend the
m as we have so many times for more than 10 years. They have failed as a contractor. Yours truelly [redacted]

To Whom It May Concern: I am writing this letter in
response to the letter I received dated April 28, 2015, outlining Mr.
[redacted]’s response to our letter dated April 14,2015, which letter outlined our
position regarding Mr. [redacted]’s complainant against our company.We stand by our position in our
letter of April 14, 2015, that we have performed the work that Mr. [redacted]
contracted us to perform, and we installed the pipe that Mr. [redacted] contracted
with us to install.  [redacted] has no issue with
the size and type of pipe installed, they only suggested that grading be done
along the pipe ditch line for drainage. 
This grading was going to be done when we did the fine grade work, which
Mr. [redacted] contracted with us to do, but he hired someone else to do his final
grading work or did this work himself. 
As for Mr. [redacted]’s contention in the April 28thletter that
there was no soil controller on the banks and erosion has occurred, since we
did not do the final grade/stabilization work at the site, this would be on him
or his final grade contractor to correct. In an effort to avoid this matter
from going to litigation as Mr. [redacted] has suggested, we would offer the
following proposal to Mr. [redacted]:New Day would come to the job
site and remove the15”x 24’metal pipe from the
driveway and as long asthe pipe is not damaged, New
Day would refund thesum of $350.00 to Mr.
[redacted].  After the pipe is removedthere would remain a ditch
where the pipe was installedand Mr. [redacted] would have to
contract with anothercompany to install whatever
size and type of pipe that he chooses to have
installed. This offer to Mr. [redacted] in no
way represents any admission on New Day’s part that they have failed to perform
the work contracted for, nor is it an admission that Mr. [redacted]’s claim against
New Day has any merit.Sincerely,

Review: Refusal to correct pipe at driveway as instructed by [redacted] . They were asked several times. [redacted] at [redacted] in [redacted] spoke with them. Their reason I was told was because they did not make enough money as was over a failure on their part to assume we would have them do more work on job. In the bid which I signed all parts of site work was priced separate. After I told them we were doing some of site work they still added those in bid. Later they said they discounted the work they performed assuming we would change our mind later I guess. It was never the plan as I told them. We paid as soon as they completed their performed aspects of bid. The pipe failed and I had told them before putting it in that [redacted] recmended a different pipe but they ignored me even on the day of installing line

. Body told them to correct but they have told me over phone they were done with me. We will have to hire someone to fix some I can have [redacted] refund our 500$ bond. Yours truelly [redacted]
