Thank you for providing us with the opportunity to address this customer’s concerns. Alice Spencer contacted our office on 12/04/2015 in regards to obtaining a loan for $500. The terms of the loan were explained to the customer. [redacted] was given all the dates and amounts of each payment...

(total of 7 payments). The loan agreement was sent to the customer, the customer acknowledge she has already signed a loan document. The customer service representative explained the system set it up as 6 installments which was incorrect. [redacted], acknowledged the issue and continued with the application, the new loan document indicating 7 payments was e-signed by Alice Spencer. The customer received thank you and congratulations message indicating the E-signature has been received. The customer was advised of the daily interest at the time of the loan application.  At this time, the customer has made partial repayment of the loan based on the terms and conditions within his signed loan agreement. As clearly indicated in its website disclaimers and the loan documents executed by you, Niiwin LLC dba Lendgreen is an economic development arm of, instrumentality of, and a limited liability company wholly-owned and controlled by, the Lac du Flambeau Band of Lake Superior Chippewa Indians of Wisconsin. Our website clearly identifies its location within the exterior boundaries of the Lac du Flambeau Band of Lake Superior Chippewa Indians of Wisconsin, a sovereign Native American Nation. As such, Niiwin LLC conducts its’ business under all applicable Federal law and the laws of the Lac du Flambeau Band of Lake Superior Chippewa Indians of Wisconsin. Consequently, Lendgreen is  exempt from state regulation due to its Native American status. Pursuant to Federal Law, Niiwin LLC is a completely lawful enterprise and can conduct business within the US.By signing your consumer loan agreement, you agreed to be bound solely by the laws of the Lac du Flambeau Band of Lake Superior Chippewa IndiansTribe and the jurisdiction of its Courts. In addition, you agreed to comply with all the terms and conditions of the Loan Agreement and the terms of our agreement will stand. Niiwin LLC relied upon your representations in good faith and approved your loan based upon such representations. Niiwin LLC loaned you $1000 on 4/20/15 in good faith with the promise that you would repay the note as promised. Niiwin LLC is fully within its rights to require repayment as originally agreed.In your Revdex.com complaint, you stated you believe you only owed a total of $322 to pay off your loan. Unfortunately, the letter you received stated that the $322 was due to catch up with your payments and get you back to the payment schedule as outlined within your signed consumer loan agreement. Additionally, you requested a change to your payment arrangement after hours on 11/23/15. Because we need 2 full business days to review your request, we were unable to make any changes to your payment schedule prior to your 11/25 due date.On 4/20/15 you requested and were funded a $1000 loan with Lendgreen.  At this time, you have made payments totaling $726. As a courtesy, and in an effort to resolve this amicably, Lendgreen has accepted all of your payments up to date to satisfy the principal loan and all finance fees incurred throughout the life of the loan. As per your request, the loan is now completely settled. requested by and funded to Mr. [redacted] on September 16, 2014. The customer had the opportunity to review all of loan’s terms and conditions as they appear in both the consumer website and the loan agreement reviewed and signed by the customer.  At the time of the customer’s call, w also went through all of the customer’s options when it came to repayment. To date, Mr. [redacted] has only made a partial repayment toward his $300 loan based on the loan terms. As a courtesy, at this time, we have decided to waive this customer’s remaining balance and deem his account closed. Should Mr. [redacted] have any remaining questions, we urge him to contact us at his convenience to discuss.

Regarding your ID # [redacted], [redacted] for a loan with Lendgreen. I have reviewed Ms. [redacted] file and listened t the recorded calls...

and here are my findings:-
 
·         Ms. [redacted] applied for and was funded a loan in the amount of $400.00 on June 11th
·         Ms. [redacted] was given several r4e-payment options at the time loan was originated, and she chose the option of partial pay-down of the principal in increments.
·         On June 17th Ms. [redacted] called our office to inquire on her payment arrangements, she was given the next payment date of June 20th and an amount of $130.00. She was asked if she wished to increase the payment, which she refused.
·         On July 27th Ms. [redacted] again called our office to verify her payment of August 1st.
·         4 payments totalling $502.00 successfully cleared Ms. [redacted]’s bank account on June 20th, July 7th, July 18th and August 1st.
 
We have had no further communication from Ms. [redacted] until receiving this complaint.
 
At this time we are prepared to accept Ms. [redacted]’s payments as made to satisfy the loan.
 
I have copied Ms. [redacted] on this response.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is NOT satisfactory to me.  When I called them on the 24th to pay it off they stated that they were going to still take the payment of $167.and some cents on the 25th. I just don't understand why they wouldn't take the payment minus the pay off amount they told me, not add it to the payoff amount.

We have received the complaint regarding your case # above, concerning  [redacted]. I have reviewed the file & here...

are my findings:- 
·         Mr. [redacted] was funded a loan in the amount of $400 on July 17th 2014.
·         On July30th 2014 a successful payment in the amount of $120 cleared his bank account.
·         On August 13th & August 27th payments in the amount of $120 each were returned from his bank. The 1st payment came back NSF. The 2nd was returned as “Account Frozen”
·         On September 8th we received an email from Mr. [redacted] asking for the full balance of the account so he could pay it.
·         On September 8th we responded to the customer’s email telling him he would only be able to pay via Money Order as the last payment came back from his bank as “Account Frozen”
·         On September 9th the customer sent an email requesting an address to send the Money Order.
·         On September 9th we responded with the mailing address for a Money Order and asked him for approximate dates when he would be sending the Money Orders & for how much.
 
Since then we have had no contact from Mr. [redacted] until this complaint.
 
The current balance on this loan is $700, however we are prepared to apply the payment of $120 that did clear his bank account & settle the loan for $280 – which is the difference between the $400 principal borrowed & the successful payment of $120.
 
I am copying Mr. [redacted] on this email, so he is aware of the settlement offer.

[redacted] has only made partial repayment towards the loan of $700 loan based on the loan terms. As a courtesy, at this time we have decide accept $238.00 to satisfy the loan. We encourage the [redacted] to contact our office to make suitable arrangements.
