I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I only agreed with the first Loan that I did sign. I did know about, nor did I "electronically" sign the second one. I knew nothing about this, and I never spoke to anyone. I had no idea there was even a " second" set of loan papers, until I researched to see when my last payment would be.

Regarding the complaint filed by Ms. [redacted]. I have reviewed her file and listened to a recorded call concerning this loan. Here are my...

findings:-
 
On July 31st 2014, Ms. [redacted] applied for and was funded a loan in the amount of $400.00 on August 1st 2014
 
During the origination of the loan, several re-payment options were explained to Ms. [redacted] and she chose to have the loan “re-new”
 
Also during this call Ms. [redacted] was advised that the loan was fully open & she would be able to change her payments at any time.
 
A copy of the loan agreement showing the payment options Ms. [redacted] chose was sent out via email to her, which she acknowledged, signed & returned to us before the loan was funded.
 
In an effort to resolve this issue quickly we are prepared to accept re-payment of the principal only in the amount of $400.00.
 
Ms. [redacted] is being copied on this email, and a further email with payment instructions will also be sent to her.
 
We hope this satisfies and resolves this matter. Should you have any further questions, please do not hesitate to contact me directly.

I paid for a loan because I had to pay a bill before it went up in two days. I usually get loans from this lendgreen but when I tried to pay it off 3 days after I got the loan they would not let me when clearly it says in their loan agreement that I can pay off my loan at any time with no penalties. They just want to wait to be able to charge me more interest. And the so called floor supervisor John [redacted] was not helpful and had an attitude when I asked for his boss.

According to our files, we received a...

copy of the complaint from your office on May7th, 2014. Our team carried out an investigation, and on May 9th, 2014 we sent an email to your attention, the customer was copied in the communication. On May 12th, 2014 the customer communicated with us via email. We offered to settle for $110 (balance outstanding $424). On May 15th, 2014 Robin sent us an email stating she was going to do her best to honor the payment arrangement. However, we never received a payment for the new arrangement. The last payment received was on March 7th for $110, before the new payment schedule was placed. Since then, the account is not on regular collection activity.
 
I’d like to take this opportunity to ask for your advice on how we may improve our company’s rating on your site. Also, is the information attached going to positively impact our rating?

As clearly indicated in its website disclaimers and the loan documents executed by you, Niiwin LLC dba Lendgreen an economic development arm of, instrumentality of, and a limited liability company wholly-owned and controlled by, the Lac du Flambeau Band of Lake Superior Chippewa Indians of Wisconsin. Our website clearly identifies its location within the exterior boundaries of the Lac du Flambeau Band of Lake Superior Chippewa Indians of Wisconsin, a sovereign Native American Nation. As such, Niiwin LLC conducts its’ business under Federal law and the laws of the Lac du Flambeau Band of Lake Superior Chippewa Indians of Wisconsin Tribe. It is exempt from state regulation due to its Native American status. Pursuant to Federal Law, Niiwin LLC is a completely lawful enterprise and can conduct business within the US.
 
By signing your consumer loan agreement, you agreed to be bound solely by the laws of the Lac du Flambeau Band of Lake Superior Chippewa Indians Tribe and the jurisdiction of its Courts. In addition, you agreed to comply with all the terms and conditions of the Loan Agreement and the terms of our agreement will stand. Niiwin LLC relied upon your representations in good faith and approved your loan based upon such representations. Niiwin LLC loaned you the money in good faith that you would repay the note as promised. Niiwin LLC is fully within its rights to require repayment as originally agreed.
 
Your current balance is $230.39, however as a courtesy, accepting the payments you have already made to satisfy the loan, and close it with a zero balance

Regarding ID [redacted]. Thank you for providing us the opportunity to address the customers’ concerns. The letter [redacted] is referring to was in regards to the missed payment....

Which at the time was $322.Regrettably, the email sent by [redacted] we received late. Due to the holiday we were unable to stop the payment. We would like to take this time to apologize to [redacted] for any inconvenience this may have caused. We encourage [redacted] to contact our office to resolve the issue

I have reviewed the loan concerning the above complaint and here are my findings:-

·         The customer was funded a loan in the amount of $700.00 on April 4th 2015
 
·         Two payments successfully cleared her account totalling $448.83 in May
 
·         The third payment dated June 8th in the amount of $210.39 was returned from her bank as “Payment Stopped by Customer”
 
·         On June 17th during a conversation with an agent on an outbound call, the customer agreed to make payments in the amount of $130.00 to clear the balance of the loan. The 1st payment of this plan came back NSF
 
·          On June 29th the customer called in to advise us that she lost her job and would have to mail Money Orders for making payments. She promised to mail in $75 bi-weekly starting July 7th
 
·         On July 8th an outbound calls was made and the customer informed the agent that a money order had been mailed that same day for $75 (as of today we have not received a money order for this account)
 
·         On July 17th we received an email from the customer stating she had retained a lawyer and was disputing the interest and our licensing
 
·         On July 17th an email was sent to the customer offering to settle the loan for a payment of $251.17 – which is the difference between the principal she borrowed and the payment made towards the loan – as of today, we have not received a response to that email.
