I have reviewed the response made by the business in reference to complaint ID 11133689, and find that this resolution is irrelevantI will never buy from this companyThis behavior is how you lose potential clienteleThe earlier response, "we have investigated ourselves and determined that the complaint filer is in error," is invalidBut, taking that it may have been just a bad business day for the business, I am letting it dropGood luck in your future endeavors

To Whom It May Concern:We are in receipt of a complaint as referenced above. We have reviewed the Customer's Statement of the ProblemMs***'s first complaint appears to be with the time involved in sealing her drivewayAccording to Ms***, our crew was there for minutesThe
work truck used for this job is equipped with GPS trackingOur records show that on August 25th, North Coast Sealing, Inconly had one driveway on *** ***, specifically ** *** ***Our GPS tracking report (enclosed and labeled Attachment 1) indicates that our vehicle was stopped for minutes and 37 secondsOn *** ***This is the time our crew spent at Ms***'s residencePlease know that the driveway at ** *** *** is square feet. In terms of driveways, this is a relatively small drivewayThree employees were on siteTherefore the amount of time spent working on the driveway by three employees who have experience in sealing is reasonableOur crew is not in the practice of notifying each homeowner of their departureThis is not only standard practice for our company but also for the industryMs***'s second complaint appears to be with her definition and expectation of asphalt seal coatingThe reference she uses is directly quoted from ***I have enclosed a copy of ***'s definition and explanation for your convenience and for your review (labeled Attachment 2).Application technique: *** describes sealer as a liquidIt is in fact a liquid. We do apply the sealer with a brush instead of a squeegeeA brush allows for more sealer to adhere to the driveway surface while a squeegee actually provides a much thinner applicationJust imagine a squeegee cleaning your vehicle windshield. Sealer can also be applied with a sprayerNorth Coast Sealing does not apply sealer with a sprayer on residential driveways.Sealer Amount: The *** explanation indicates that a properly mixed sealer with be applied at about square feet per gallon coatWe used gallons of sealer on square feet, which calculates out to square feet per gallonThis is in line with ***'s explanation. One application vsTwo applications: Ms*** also expected two applications of sealerResidential driveways receive one coat of sealer applied by brushesOne coat of sealer for driveways has been our company's standard for over yearsIt is also industry standard for residential propertiesIt appears that Ms. *** has a computer with Internet service available to herOur website, www.northcoastsealing.com, has two videos available for viewingOne is labeled "Commercial Video" and the other is labeled "2015 Residential Video." The residential video shows our sealing process and is narrated. It specifically shows one coat of sealer being applied with brushes and the narrator indicates that we use "brushes only."Crack filling: We do not offer crack filling to residential customersIf customers request crack filling, our office staff informs the customer of our practices.Painting: Ms*** repeatedly refers to North Coast Sealing "painting" her drivewaySealer is a liquidWe apply the liquid sealer with brushes as previously explainedMs*** may have had an inaccurate idea of what seal coating isShe may actually have been thinking about resurfacing or adding a topcoat to her driveway, which is completely different than sealing and costs thousands of dollars and not the cost $plus tax.***: Please refer to the references used by ***If you were to read these *** pages online, you would see that their references are actual links that you can click onI did so.The first link "*** Materials and Procedures for Sealing and Filling Cracks in Asphalt-Surfaced Pavements" took me to a 40+ page document that speaks to maintenance of highways and roadsI have included the cover page for your review (labeled Attachment 3)It is not an appropriate resource to refer to for residential driveways. The second link takes you to www.***.comI have included the part that refers to sealer and repaving (labeled Attachment 4).Ms*** was provided with a quote, which she requested, for repairing her driveway apronShe clearly indicated that she did not want any repairs and only wanted the sealing serviceI have included her estimate sheet (labeled Attachment 5) that is dated May 11, Please note that Ms*** signed the quote. Please know that we received a phone call from Ms*** on 8/25/(as she indicates) and a direct complaint via emailIn our efforts to address her dissatisfaction, the owner went to her residence, on 8/25/2015, to look at her driveway and discuss the matterMs*** refused to discuss the matter rationallyVoices became loud when she refused to accept that the driveway was ACTUALLY sealed and crack filling (according to her definition) is not done on a residential propertyShe insisted that North Coast Sealing did not do its job and she verbalized that she is not paying the bill. Her two physically fit something year old sons came out of the house and repeated her feelings.Shortly after the owner returned to the office, a police officer called and spoke to the owner, Fred B***The officer said that they were not going to the residence due to the nature of the callThe officer essentially thought the complaint was not something that the police department would "waste" its time on.We did not deceive her or any of our customersOur practices are clearly represented on our website by way of video and explanations (Attachment 6)Using this kind of language is quite slanderous and potentially damaging to our business. We ask and advice her to refrain from such slanderous remarksIt appears that Ms. *** had an idea of what she thought seal coating was, which was not accurate. This is unfortunate.Ms*** has indicated that she has no intention of paying North Coast Sealing, IncPlease know that we incurred the cost of gallons of sealer (Attachment 8), the gas and mileage to Ms***'s residence, and the cost of three employees during that timeIf she does not pay then we must pursue legal actionAccording to our contract, which she signed, "In the event contractor (NCS) shall be required to enforce the terms of this agreement, NCS shall be entitled to reasonable attorneys' fees, disbursements and costs."We simply would like Ms*** to promptly pay her invoice, enclosed for your review(Attachment 7).Sincerely,Fred WB***Enclosures:Attachment 1: GPS tracking reportAttachment 2: *** definitionAttachment 3: Cover page of the ***'s first referenceAttachment 4: Pages from ***'s second referenceAttachment 5: Estimate sheet from North Coast Sealing, IncThe customer indicates that she only wants the sealing service for $plus tax.Attachment 6: Print-outs from the North Coast Sealing, incwebsite that shows the website has video.Attachment 7: Invoice for $plus tax of$Total= $86.40Attachment 8: Work Order that shows the amount of sealer used: gallonsAttachment 9: *** search that indicates hits when searching "North Coast Sealing"

***After being made aware of the situation, the Service Manager has agreed to pay the rental bill on behalf of the customerHe has also counseled internally with the writer on the handling of the situationPremier has also confirmed as well with Kia there is no recall on the

***In researching the consumer's purchase, we found the finance manager that originally did the paperwork is no longer employed with the dealershipAnother Finance Manager, Terry, helped with the cancellation upon the consumer's requestTerry turned the paperwork in for processingUntil
receipt of Mr*** complaint, the dealership was not aware the cancellation had not gone through as the cancellation amount goes directly to the lender to deduct from the consumer's ending balanceIn speaking to Terry to follow up on the cancellation, Terry was happy to assist in looking in to any hold up, however, Mr*** failed to mention he did not conduct himself appropriately when approaching Terry, the Finance Manager, in his office as he was assisting another customer and Mr*** interruptedMr*** also proceeded to advise the seated customer "not to buy ..."At this point, Terry expressed he did not appreciate such behavior and still advised he would look in to the cancellation and any delay. When I spoke to the General Manager and Terry, the Finance Manager, I confirmed the consumer's cancellation paperwork had been submitted and processed for cancellationShould you need any additional information, please contact me at your convenience.Sincerely,Tracey F*Premier Automotive Management

*** In reviewing the paperwork from the consumer's purchase, it appears all terms and pricing as well as financing were agreed to by the consumer as reflected by his signaturesThe employees he worked with at the time of his purchase are no longer working at the dealership and I cannot
assume any verbal agreements took placeUltimately, any negotiations were left to the consumer to decline or acceptThis purchase took place approximately days ago and has been finalizedIf the consumer wishes to refinance his purchase he can do so however the dealership cannot reverse the paperwork or refinancing as he will need to pursue that with his bank or lending institution Please let me know if you need any further information Sincerely,Tracey F*, Premier Automotive Corporate

Andrea, I have spoken to the GM, Jerry B[redacted] and have been advised of the following; The deal was originally worked on the 2nd and finally got an answer on the 4th. The customer was approved pending proof of income. Unfortunately, after waiting till the 4th to get an approval and getting the...

fax from the customer, we found that the POI was very short of what the customer has statedand we were not able to sell the vehicle. Ricky K[redacted] worked the entire deal. While Ricky was waiting to hear back from the bank to reconsider approval, he left and dropped some paperwork down the street to the Nissan store. During this time, the customer confronted Taylor after waiting 2 hours and when Taylor went to put the deal togetherfor Ricky, he saw the deal was still not bank approved. Stefan took over for Alex and called the customer back to get the POI faxed over. The vehicle was not sold then. After seeing that the deal would not get approved with the current POI, the vehicle went back on the market and was sold on the 5th to a customer buying for his wife. The sales person apparently went to his desk while the customer was waiting. For this, the sales rep was sent home on a 3 day suspension and written up by Taylor for leaving the customer alone while working his deal. I Jerry B[redacted] has called the customer and left a message with his phone number to return the call.   Sincerely,Tracey F[redacted], Premier Automotive Management

The car is no longer on the internet. That is a start. It really doesn't answer the question about misleading representation. If you are allowed to investigate yourself you will always turn up clean.
