On July 25th [redacted] came to my residence & stated he was [redacted] of NorthEast Pools Landscaping & Home Improvement. Mr.[redacted] stated that the pool needed to come down as soon as possible & that the previous contractor had "dug too deep" & the ground needed to be "built back up" for foundation. He also informed me that the original liner had been installed incorrectly & would be "no good". He stated that I would need to give him a check for the liner right away to be ordered as soon as possible. He also requested $100 towards labor & that the remaining balance could be paid at the completion of the job. I gave him a check that night for $695.63 including the $545.63 for the new liner. Friday July 26th Mr. [redacted] returned & took the pool down. He stated then that the entire project would be finished by Monday July 29th. He stated that he would return at 5am saturday to start the retaining wall and building the foundation. Mr. [redacted] returned at 1030am & asked if he could have a check for materials as he wanted to try to get to the bank before they closed. I gave him one for the sand & fill($600), one for the remainder of the labor for taking the pool down ($426) & one for the timber & material to build the wall ($950). He called later & stated that all those materials could not be delivered til Monday. He only worked a few hours on Monday & left early not doing much besides measurements. He stated the pool now wouldnt be up til Thurs. This continued until the following Saturday. On Sat he called to say that he couldnt be there to pay for the dirt that was on its way & asked if I could "front it" ($247) & he would take it out of the labor later ( he was given $260 later). SUN he returned & finished the wall, received $550. MON he came & took his tools saying he was selling them & asked I pay for the sand. Later said he cashed all the checks, spent all the money & didnt get any materials or my liner. He also said he had sold the Transit level that was required to put the pool upDesired Settlement$545 for the liner that I did not receive. $366 for the remainder of the materials I did not receive. $187 for the sand that I had paid Mr. [redacted] for and then had to pay directly to the sand company upon delivery as [redacted] Receipts to prove timber/wall material costs. That [redacted] be responsible for any damages or incorrect work he performed when assessed by a newly hired contractor.
