 Complaint: [redacted]
I am rejecting this response because:From: Revdex.com of Metro Washington DC<[email protected]>Date: Tue, Jul 12, 2016 at 8:16 AM---------- Forwarded message ----------From: [redacted] <[redacted].com>Date: Mon, Jul 11, 2016 at 7:53 PMMy name is [redacted] and I own a small business [redacted]. My complaint ID is [redacted].I have been away and did not have access to my email. I could not respond to the automated email that Revdex.com sent to me on June 25th, 2016. Can this case be re-open as I was unable to respond within 10 days?I have reviewed the information sent to me regarding the response from NSA Financial Bankcard Services. I have reason to believe that NSA practices business in a deceptive and unfair manner. On July 21, 2015, NSA sent their agent to my store. I was not present in the store at the time and my cashier clerk told me the agent said he needed to switch out our old terminal for a new terminal to be in compliance with the new security EMV chip card requirements. After he switched out the terminal, he handed my cashier clerk a computer tablet and told her she needed to sign for the receipt of the new machine. No paperwork was provided to my cashier clerk. When I returned to the store at the end of the day, she told me about the terminal exchange and I assumed it was a terminal update to be in compliance. However, as our end of contract date approached on 12/28/2015, I contacted NSA to cancel merchant services. They told me that our contract was renewed for an additional 3 years. I asked them when was this renewal and why was I not provided any information for this renewal. They told me it was renewed when they switched out the new machine in July. I said I was not in the store at that time and did not sign a new agreement. They told me anyone in the store can sign for the new agreement. I said that is unacceptable. I am the owner of the business and should be the only one with authority to make such an agreement. That means you can find anyone on the streets to sign such a contract. I requested for them to send me a contract with my signature. I waited over one week and they did not send me any documents. Again, I called NSA and spoke with Danny S**. I told him I have not received anything in the mail regarding a contract renewal with my signature. He refused to provide it and after much argument he finally agreed to let us cancel the contract and return the equipment. With his instructions, the equipment was returned the next day, signed and received by Danny Suk on 1/19/2016. On 3/4/2016, I received a letter from NSA threatening us to either use their services again or pay and Early Termination Fee of $1495.00. I responded by certified mail explaining the case and that an Early Termination Fee should not be charged as we did not sign a contract renewal and the equipment was returned authorized by their agent Danny S**. No response was received from their company. However, in May, we received our first contact from a collection agency demanding us to pay the alleged debt of $1495.00.We have already full-filled our initial 3 year contract. We no longer need merchant services for another 3 years as we will not have a place of business without a lease.NSA Financial Bankcard Service practices business in a deceptive and unfair manner: 1. They mislead the business to think that they are updating the equipment and ask anyone to sign for it, even if the owner of the business is not present. 2. They do not reveal the renewal contract, but presents it in a tablet and pass it off as a simple receipt of updated equipment. 3. They do not provide a copy of the renewal contract to the business. 3. When you try to cancel the initial contract upon the expiration date, they claim you have a renewal contract but cannot provide a copy of the alleged contract with the business owners signature. 4. After authorizing a return of equipment, leading you to believe they agree to cancel the expired contract, NSA sends a letter out 2 months later and demand the business to resume using their services again in 5 days or be charged an Early Termination fee of $1495. However, you have no equipment and is stuck with the Early Termination Fee.NSA is not transparent with their customers. They dupe the business into signing a renewal contract and locks them in for 3 years. Then when you try to cancel, they charge outrageous early termination fees. No business should be held "hostage" this way. Please advise me of what steps I should take next to resolve this issue as the company continues to harass me with collection agencies. For your reference, I have attached the proof of delivery for the equipment returned dated 1/19/2016 and also the letter NSA sent us 2 months later asking us to pay the ETF of $1495.00.Thank you [redacted] for you kind attention on this matter. Sincerely,[redacted]Regards,
