Vehicle warranty sold with poor wording in coverage of components. Filed a claim for a failed Haldex pump on my cars rear differential. The pump is partially mounted externally and part of it goes inside as a lubricated component. The warranty states verbatim; REAR AXLE ASSEMBLY: Ring and pinion gears and all internally lubricated parts contained within the rear end assembly and case(if damaged by internally contained within the differential housing). I called and spoke with adjuster and said they were not covering due to the fact it is partially mounted externally. The pump goes into the differential and is a internal lubricated part. The warranty also states that will cover up to a hour of diagnostics. When The dealer called for the hour of Diagnostic fee being $130 for their labor rate, they were told that they only cover up to $75 of that but is not stated in contract. The claim was filed on a Friday morning around 10am and never received a call back till Monday at 4pm. I asked to speak to someone in customer service to get both my vehicles warranties refunded and cancelled. They told me I have to return to the dealer where I purchased the vehicles.

NVP Warranty Response • Dec 06, 2018

I spoke with the customer. I told him that management had agreed with him and NVP is covering not only the part but the full amount of labor. He was happy with that. Unfortunately the only time the dealer could get him back in for the repair was Dec 14th. After the vehicle is repaired the customer is willing to withdrawal their complaint. I would like to thank Eric and his wife for their understanding. Climb to Glory.

I have had horrible experience, I have been waiting to have repairs for 3 weeks. NVP arguing with repair shop over price of part so NVP said they can get it cheaper and will have it sent to repair shop next day, its been 5 days now no part has arrived. they have no care how long your repair takes. I believe their goal is to drag out repair so you fix it yourself quicker and not use the warranty you purchased.

PURCHASED 4 STAR POWERTRAIN WARRANTY WITH USED VEHICLE. 45 DAYS LATER ENGINE BLEW. BOTH ENGINE AND TURBO COVERED UNDER PURCHASED WARRANTY. NVP INVESTIGATOR CLAIMED ENGINE BLEW DUE TO PRE-EXISTING ISSUE WITH OIL HOSE. ( WHICH BY THE WAY IS ALSO COVERED UNDER PURCHASED 4 STAR POWERTRAIN WARRANTY.) SO ENTIRE CLAIM IS BEING DENIED. SO, WHY IN THE WORLD DO I EVEN NEED THIS WARRANTY COMPANY FOR? I HAVE HAD MY TRUCK A TOTAL OF 45 DAYS..... ONLY DRIVEN IT 30. I AM BEYOND PISSED OFF. I ACTUALLY AM LOOKING INTO STARTING A CLASS ACTION LAWSUIT WITH THIS COMPANY! NVP TOLD ME THAT I NEED TO GO BACK TO THE DEALERSHIP. WELL THE ONLY REASON I EVEN BOUGHT THE WARRANTY IS BECAUSE THE VEHICLE WAS SOLD USED AS IS. THIS IS WHY The Magnusson Moss Warranty Act WAS CREATED TO PROTECT CONSUMERS FROM BS LIKE THIS. I KNOW I HAVE A CASE. I ALREADY SPOKE TO DEALER AND THEY WILL PROVIDE ME WITH WRITTEN STATEMENT THAT THEY DID NOT SELL ME A LEMON!!! I BELIEVE THEM!!! I PURCHASED AND DROVE THE VEHICLE FROM OHIO, DROVE FROM OHIO TO PITTSBURGH PA. THE HOSE, TURBO AND ENGINE ALL WHERE FINE. EVEN GOT THE VEHICLE INSPECTED A WEEK PRIOR. IT PASSED WITH FLYING COLORS! WILL ALSO GET A LETTER FROM THAT MECHANIC SHOP AS WELL. I WILL NO LONGER GET THE RUN AROUND. IF THEY DO NOT MAKE GOOD ON THIS MATTER, I WILL CONTACT MANY NVP WARRANTY HOLDERS START A CLASS ACTION SUITE

I am sorry to just now be getting back to you. We were under the impression that *** was going to cancel the contract. There were at least 3 phone calls were the customer said that she wanted to cancel the contract. She was informed that she will have to get with the selling dealer and complete the cancellation form. Both parties would have to sign the form. Please let me know if the contract is going to be cancelled and this issue resolved.

Thank you

Did you cancel the policy within 30 days? Was you able to get your money back?

I PURCHASED AN EXTENDED WARRANTY FOR A VEHICLE THAT I PURCHASED FROM A LOCAL ESTABLISHMENT. THERE A FEW ISSUES THAT I BELIEVE SHOULD'VE BEEN HONORED BY THE WARRANTY COMPANY. THE ISSUES ARE WITHIN THE PARAMETERS OF THE WARRANTY PLAN (3 STAR), AND ALSO SHOULD BE HONORED DUE TO THE POTENTIAL SAFETY ISSUES THAT COULD RESULT IN INJURY OR DEATH. PLEASE ADVOCATE ON MY BEHALF IN EFFORT TO RESOLVE THIS ISSUE AS AMICABLY AS POSSIBLE.

After my check engine light came on in my truck I took it into the mechanic. I called the warranty company and started a claim assuming everything would be covered since all of the work that needed to be done on the truck was on my warranty and says that it is covered. My truck was in the shop for 7 business days because the mechanics were waiting for NVP Warranty to get back with them. After that It took them 4 days to send the inspector out. He took notes and took pictures and said that it would be covered. It then took a week for NVP Warranty to respond only for them to tell me that none of it was covered. They're giving me responses of what's wrong with the truck that totally contradicts with what the mechanics are saying. They refuse to send a second inspector out and I've been hung up on multiple times. The guy running my claims and over and over he is doing everything he can to get out of covering a bill that should be covered by them. Also his boss told me that if he were the inspector he would not cover it at all because he's bias and works for the company. They later changed their story as to why they wouldn't cover the bill and it still doesn't match up with what the mechanics are saying happened to the truck. Everything that the mechanics need to do Cleary state on my warranty paperwork that it all should be covered under warranty. It's been 40 days now and my truck is still at the mechanic because I keep getting the run around

When this claim was called in, the vehicle had a failed timing chain. It was reported from the repair facility that the chain was stretched. When the claims adjuster told the repair shop that the timing chain would not be covered if they did not break (As per the contract), the repair shop said that the issue was really with the timing chain actuator. At this point the adjuster needed to verify the failure and point of failure since we received two stories about what had failed on the vehicle. He did this by sending an inspector out. The inspector found that right bank chain tensioner failed due to a seal leak causing the low upper engine oil pressure which damaged the cam phasers, timing chain guides, and the timing chain. Under section 10. Subsection F states that a claim will be denied if a non-covered component causes the damage to a covered component. Based on this section of the contract that the customer signed the claim was denied. If the customer would like to speak with the office manager he can call *** Ext 702. His name is ***. But based on the contract that was signed by ***, NVP cannot approve this claim.

10. EXCLUSIONS – WHAT'S NOT COVERED: This Agreement provides No Benefits for:
F. Repairs to Covered Components caused by non-covered components, or repairs to non-covered components caused by Covered Components.

I have reviewed the response made by the business in reference to complaint ID, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

According to the description of what was just written is the same thing that I've been hearing from NVP and that was just their first story. There was never an oil leak on my truck to cause that kind of damage. For 1, I'd have oil all over the engine and there's none. For 2, I have every receipt of all of the maintenance ever done on the truck and I make sure to thoroughly take care of my truck. For 3, if you look at what the mechanics had to say they prove that there was never an oil leak or a failed gasket, which you say isn't covered under my warranty so then you can't cover the rest of the parts that are covered. Therefore, since a oil leak isn't the issue the parts that need work on them are all covered under my warranty. Like I said, NVPs story doesn't match up with what the mechanics are saying.

It was never our contention that there was leak on the vehicle externally. We denied the claim based on the information provided by a 3rd party inspector. The inspection results were as follows.

“Tech states vehicle had a ticking noise from engine, noise was prominent from right side wheel well. Noise is described is consistent with cam phaser failure on 5.4 Triton. Tech showed right bank timing chain to be loose, movement of approximately 5mm can be seen at chain. Likely cause is bad tensioner and/or chain stretch, not able to inspect either due to state of assembly. It is likely based on experience that right tensioner lost oil pressure due to seal failure, causing sub-damage to right cam phaser. This is very common issue with 5.4 Titan engine. Recorded codes are consistent with this failure.”

NVP is the third party administrators of the contracts. The claims adjusters are required to follow each contract based on how it is written. The contract covering this vehicle is under the name ***. It is a 3 Star that does not cover Seals and Gaskets. It was the techs at the repair shop that spoke with the inspector where the noise was that lead him to what he believed the cause of failure base on his prior experience, training, and knowledge.

I want to start by saying the Inspection service that we use is also used by a number of other third party administrators of vehicle service contracts. They are a reputable company that we have worked hundreds of claims with. Also the claims adjuster never said he did not understand what the inspector said. He did say however that he did not understand what the repair shop was saying. Since they claimed that the failure was one item and then changed it to a different item, that was why an inspection was ordered to find the point of failure. The owner of NVP has authorized me to order another inspection if the vehicle is still in the same state as before and a repair has not already be completed. I will follow up with both the repair shop and the customer. If this will help resolve the status of this claim for the customer I will order the inspection and turn the claim back to the claims adjuster.

I purchased a 90 day warranty from NVP through a dealership. 9 days after having my truck the transmission started slipping and not able to climb hills very well. Contacted the company, the claims adjuster was rude to begin with telling me that the claim most likely will be denied because I owned the truck for 9 days. He said they still could proceed. Ultimately my claim was denied for oversized wheels. The factory wheels that came on the truck were 17 inch. that is what is on the vehicle. The original tire size is 265 70 17. I upgraded to a 285 70 17. that is a 20 mm difference, about 3/4 of an inch wider than the ones that came on the truck with a different tread pattern. Every tire shop and transmission shop I spoke to said that there is no way that the difference in tire size can make a transmission go bad in a week. The claims adjuster then changed his story when I told him this, to a pre existing condition. Well sorry the car is used it has pre existing conditions, that's why you buy the warranty. The claims adjuster was rude and very unprofessional. Now I am out $2355.36. for a transmission that was covered under the drive train part of my warranty. He got mad and then said he was canceling my policy because the policy should of never been sold to begin with. That I would be receiving a full refund. This has yet to be seen. NVP has stipulated that I needed to pick my money up from the dealership, when I contacted the dealership my refund was around 20% with no explanation or invoice where the rest of my money went or why, considering I was to receive a full refund. The company has been very difficult to contact and deal with.

This vehicle service contract was purchased on 5/22/2018. The vehicle started with 172,075 miles. The claim was filed on 5/31/2018 with 172,595 miles on the vehicle. The contract was in effect for 9 days and the vehicle was driven 520 miles in that time. The vehicle service contract is in place to protect the consumer against mechanical failure. Like with any contract there are stipulations that need to me met or cause the contract or claim to be cancelled or void.

In this case the inspection found debris in the trans filter and in the transmission pan with internal torque converter failure. This failure was started from basic wear and tear as the torque converter started to wear out. The larger tires put extra stress on the transmission leading to the failure of the torque converter. The tires are larger than OEM specified 30.50 height. The larger tires are 32.71 causing a 7.23% variance. This is not a failure that would happen in the time frame that the customer owned the vehicle. The torque converter would have started wearing out before the customer purchased the vehicle. This claim’s first exclusion was the aftermarket, larger tires, with the second exclusion being that the failure had started before the contract was purchased.

The customer cancelled the contract and the funds were sent to the dealer for redistribution to the customer. The funds were the full amount minus any funds paid on claims. For this claim NVP paid an inspection service to go out and verify the point of failure in the transmission.

NVP Warranty Response • Aug 09, 2018

The contract was in effect for 9 days. A transmission will not fail in 9 days unless there was already something wrong with the transmission. If there was nothing wrong with the transmission then added stress on the transmission from the tires would have been the cause of failure. Both of these are exclusion in the contract that has since been cancelled and a refund issued. I can not authorize in more funds after a cancellation has been made. What I can offer is to have one of the claim's adjusters shop for a transmission at a cheaper price. This way we can do what we can to save you some money. We are the third party administrators, and we are required to follow the contract. Please let me know if you would like us to try to find you a transmission.

I own and operate a successful small car dealership in PA. I was reluctant to start selling NVP WARRANTIES to my loyal customers but the saslesman was quite reassuring. I sold a few warranties, Everything was great till one of my customers filed an auto repair claim with them. They denied his claim based on a clerical mistake on the submitted, original contract. They actually canceled his contract because the date was off a few days.
I thought the states attorney general cleaned up these rouge aftermarket scam companies in the early 2000's .
BEWARE.....these people are still out there preying on good people. They are not in the auto warranty business. They are in the contract business.

has been terminated from being able to sell NVP vehicle service contracts. The dealer has sold 5 contracts and has had 3 claims all started less than 45 days after purchase of the vehicle service contract. There is a standard clause that states that a claim will be denied if it is determined that the failed part was damaged or worn before the sale of the contract. Vehicle service contracts are added to vehicles to protect the customer from mechanical failure. They are not to be put on vehicles to repair parts the dealer does not want to fix before the vehicle is sold.

NVP was canceled all contracts that the dealer or customer has requested cancelled. If the dealer wants the remaining two contracts cancelled, they will need to send in the cancellation form with an odometer statement.

NVP prides itself with offering its dealers straight forward contracts and we cover what is listed on the contract. Because these are legally binding contract and if the information is found to be false or possible fraudulent then the application will not be accepted.
Tell us why here...

Because the contract is a contract between two parties, the third party administrators would need both signatures on the cancellation form. Please fill out the cancellation form and turn it in to us with an odometer statement.

Please let me know if you have any questions regarding this process. I have attached the cancellation form to try to make things easier for you.

Thank you for your attention in this matter.

Revdex.com:

I have reviewed the response made by the business in reference to complaint ID, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]Prompt responses , although lacking a normal or average IQ level, are greatly appreciated.

I purchased a 12 month 5 star warranty contract in March 2018. The contract would cover a certain number of miles and had a $100 deductible. I received my service contract identification card in the mail in April 2018. On May 14 , 2018 the service engine light came on in my 2003 Expedition. I immediately contacted a repair facility and brought the car in for inspection the next morning. The repair facility contacted NVP with my contract number (***) and obtained a claim number (***) to begin the process. Additional diagnostics were required which I had to authorize after receiving the claim number with the understanding that the charge would be covered in the end. Today I am being told by the warranty company that they are cancelling my contract for which I paid $1,200. The reason I was given was due to the fact that the Carfax report reflected a total loss by the insurance company. It is common for insurance companies to declare a total loss when repairs exceed 75% of the pre-claim value. In my case, the loss was due to hail damage. The car did not and does not have a salvaged title but NVP refuses to honor the contract for which I paid for and received proof of coverage. Not only that, once the claim number was issued I had to authorize the additional diagnostics which was $512.14. I ONLY expected to come out of pocket $100 per my warranty contract and now I am out $1,200 for a contract that this company will not honor plus diagnostics and I still need repairs! I am extremely upset at how this entire situation was handled and NVP refuses to accept any accountability by claiming to be an "Administrator" of the warranty. Who do I need to contact to get this resolved? I was told by *** at extension *** that the owner of NVP was involved and he approved the cancellation of the contract. I am a customer and deserve better than this.

NVP Warranty Response • May 25, 2018

NVP is not going to cancel the contract and we are moving forward and processing the claim.

I am not happy with the response because the company has found yet another way to deny my claim and weasel out of paying for my repairs. I have been lied to and jerked around by NVP for the last time. At this point I have sought legal counsel.

we own a small dealership in colorado, we sold a number of warranties and included the 90 day on many of our sales...
had a customer with a 80k mile nissan, one owner, great car... a week went by, tranny failed.... NVP adjuster claims its a PRE EXISTING PROBLEM....
SERIOUSLY, it is a pre-owned vehicle, everything is PRE EXISTING according to them... had a few other like issues....
We threw away all their marketing garbage, they were RUDE, AND VERY UNPROFESSIONAL....
