I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowThis is a typical non answerHere are the factsThe company did not pay for all the damages due to the claimThey then used the adjuster as an opportunity to review my entire houseThey told me I had to make numerous repairs that were not neededThey then canceled my insuranceThey gladly accepted my premiums for eleven yearsWhen I needed the insurance they breached their fiduciary responsibility and left me with a major issueThe repairs they wanted to me to make were far in excess of the claim and were not neededIt is truly stunning that they are not held accountable for their unethical business dealingsbut it is no secret why the insurance companies have such a strong lobby.As a mutual company, I was an owner at the time and appalled at how the treated me as a customer and owner.The culture of obfuscation was systemic throughout the organization from the CEO down to the receptionistBut it has been well documented that mutual companies answer to no oneMy guess is this will just be filed in the proverbial bureaucratic etherThus this business practices will continue in perpetuity Regards, [redacted]

NYCM Insurance's response is attached, Dear Sir or Madam: This response acknowledges your letter dated March 8, regarding the above captioned matter. The dispute arises over payment for damage to the Complainant’s vehicle which allegedly occurred on February 19, On February
26, 2016, NYCM Insurance contacted their insured who advised that they were travelling in the left lane, and saw the Complainant off the left side of the road after he lost control on the slippery pavementThe NYCM insured moved to the right side of the lane to avoid the Complainant’s vehicle and hit a snow drift which threw him into a vehicle travelling in the right laneThe NYCM insured states that after hitting the vehicle in the right lane, he was forced back over to the left lane, but he was already beyond where the Complainant’s vehicle was off the road, and did not strike the Complainant’s vehicleNYCM Insurance understands that the police report indicates that their insured struck the Complainant’s vehicle after striking the vehicle in the right laneHowever, the police officer did not speak to the NYCM insured until a few days after the accident as they were transferred by ambulance to the hospital from the sceneOn February 26, 2016, NYCM had an automobile appraiser inspect the damage to the Complainant’s vehicleThe Complainant had previously advised that the collision with the NYCM vehicle was to the left side of his vehicle, and caused his driver’s side window to breakHe further stated that this impact pushed his vehicle into a guard rail, causing more damageThe appraiser determined that there was no damage near the window of the Complainant’s vehicle that would indicate that a collision had occurredThe appraiser did note that there was minor damage to the left front of the Complainant’s vehicle; however, the paint transfer is white, and the vehicle owned by the NYCM insured is goldHe also advised that the damage to the left front corner of the Complainant’s vehicle was not significant enough to have pushed the vehicle into a guard rail or even move the vehicle at all.An inspection was also done of the NYCM vehicle, and there was no damage found to the left side, which according to the Complainant, is the side that struck his vehicleAs a result of the appraiser’s findings, along with the NYCM insured maintaining that he did not strike the Complainant’s vehicle, NYCM stands by the denial of the Complainant’s claim. I do not accept this response because both the insured and NYCM are not being truthfulThe insured gave a statement to the officer prior to leaving with his wife in the ambulanceAll three of us were sitting in the back of the police officer's car telling him what happenedSecond, the insured 's car is white and arguing about what shade of white is not an excuse to not acknowledge that he struck my vehicleThe vehicle comes in white or beige not goldThe paint is still there on my car and it matches the color of the his vehicle exactly as I saw it Also, the insured could not see what he hit because his airbags were deployed and he was still slippingI saw his vehicle hit mine, and bounce off to hit the guardrail a few feet ahead of where my vehicle wasMy first interaction with the insured was him asking me, "Did I hit you?" The police report acknowledges that his vehicle bounced off the truck that he had hit in the right lane, then hit my vehicle and bounced off of mine as well before hitting the guardrailMy broken window right above the traded paint marks on my vehicle is evidence of thisI was the closest witness, and the police heard his statementThere is no plausible reason for NYCM to refute the police reportAnd I very much don't appreciate how NYCM is using their insured's statement above all else with regards to this incident considering their age and vantage point.
