This response acknowledges your recent correspondence on the above captioned matter.  This dispute arises over payment for damages to the Complainant’s vehicle as a result of a  motor vehicle accident on 10/1/2015.On 10/1/2015, we received our first notice of this loss via telephone from...

the Complainant.  He reported that he was traveling on 21st Street at the intersection with North Street in  Niagara Falls, NY with the right-of-way. The Complainant reported that our insured   stopped at the stop sign on North Street and then pulled into the intersection and struck the Complainant’s vehicle. On 10/5/2015, we attempted to contact our named insured to put her on notice of the loss  reported under her Personal Automobile Policy and to obtain her version of the accident. On 10/5/2015, we also sent an Automobile Loss Notice form and an Insured’s (or Driver’s)  Supplementary Accident Report form to the named insured for completion. On 10/5/2015, the Complainant called for status of his claim and was advised that we were attempting to obtain our insured’s accident report in order to determine liability for theloss. On 10/6/2015, the named insured called us to report the loss. According to the insured, she  made a full stop at the stop sign on North Street. The insured stated she did not see the  Complainant’s vehicle on 21st Street and was struck by it. On 10/6/2015, the Complainant faxed the Police Accident Report to us.  On 10/7/2015, we called the Complainant and advised him that we would be accepting full  liability for the loss and requested permission to move his predicted total loss vehicle to a  storage-free facility. The Complainant indicated that he needed to speak to his mother about moving their vehicle and would call us back. On that date we also arranged for the  Complainant to have a rental vehicle.  On 10/11/2015, the Complainant called and granted us permission to move his vehicle from his repair shop. The Complainant was advised at that time that he would need to removehis personal possessions and the license plates from the vehicle. On 10/13/2015, the Complainant called for status of the claim. He also notified us that their repair shop would not allow him to remove his possessions from the vehicle. The Complainant was advised that we would contact the shop to advise them that the loss was covered by insurance that that we would be having the vehicle picked up. We also told the Complainant that we would be assigning an appraiser to inspect the damages to his vehicle and we extended his rental coverage until 10/19/2015. The Complainant was again advised that he needed to remove his possessions and the license plates after we contact his repairer.  On 10/13/2015, we contacted the Complainant’s repair shop and advised them that we would cover the towing, storage, clean up, recovery and gate fees through 10/14/2015. On 10/13/2015, we called the Complainant and advised him that we spoke to his repair shop and that we would cover the fees but he would need to clean out the vehicle and release it on 10/13/2015. The Complainant agreed to these terms. On 10/16/2015, the Complainant’s vehicle was appraised and confirmed a total loss. On 10/19/2015, we contacted the Complainant and made a settlement offer to him for the total loss value of his vehicle. The Complainant was also advised that we would issue a settlement check to him upon receipt of the vehicle title and keys. We also extended his rental coverage through 10/21/2015. At this time our file remains open awaiting the title and keys to the Complainant’s vehicle so we can issue his settlement check and awaiting the final rental bill. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. This is a typical non answer. Here are the facts. The company did not pay for all the damages due to the claim. They then used the adjuster as an opportunity to review my entire house. They told me I had to make numerous repairs that were not needed. They then canceled my insurance. They gladly accepted my premiums for eleven years. When I needed the insurance they breached their fiduciary responsibility and left me with a major issue. The repairs they wanted to me to make were far in excess of the claim and were not needed. It is truly stunning that they are not held accountable for their unethical business dealings..... but it is no secret why the insurance companies have such a strong lobby.As a mutual company, I was an owner at the time and appalled at how the treated me as a customer and owner.The culture of obfuscation was systemic throughout the organization from the CEO down to the receptionist. But it has been well documented that mutual companies answer to no one. My guess is this will just be filed in the proverbial bureaucratic ether. 29, 2015. NYCM is not licensed to write commercial automobile insurance in New York state, therefore, our Special Investigation Unit investigated the usage of the 1999 Ford Econoline. The insured removed the advertising from the previous owner, however, he advised that his cousin, [redacted] was an occasional operator of the vehicle. Two requests for [redacted]s information were sent to the insured. On several occasions, Mr. [redacted] stated “he did not know a [redacted]”, yet in another phone conversation, he stated “[redacted] lives in Brooklyn and has his own car insurance”. A cancellation notice was mailed on September 8, 2015 for failure to remit the information on [redacted]. The policy cancelled on September 29, 2015. On October 7, 2015, NYCM received another personal automobile assignment for [redacted] to be effective October 2, 2015. Two more requests were sent for information on [redacted]. As this information was not received, we mailed a cancellation notice to the insured on November 20, 2015. The policy cancelled on December 14, 2015. cancellation, a remaining balance of $31 in earned premium was still owed toNYCM Insurance. • November 19, 2012 the insured called our Customer Service department regarding abill he received for $31. We told the insured that although he was cancelling his policywith us there was a balance due and if it was not paid, he would be sent to collections.• May 27, 2014, the insured called our customer service department regarding a letterhe received from NYCM Insurance, and he was told that he still owed $31 in earnedpremium.• February 8, 2016, the insured called again upset that he still owed $31 and it hadshowed up on his credit report. During the conversation with the insured we explainedthat we cancelled the policy on the day he requested and what the $31 was for. On September 3, 2015, we issued a notice of cancellation effective October 5, 2015 as the insured failed to make the necessary repairs to keep this dwelling insurable. We have also sent corrections to a loss database so the insured's loss will show as one incident. Please find a copy of correspondence sent to the insured from our claims department confirming that the insured intended to discontinue the appraisal request. was mailed to the insured for the current term. On March 27, 2015 a cancellation notice for non-payment of premium was mailed to the insured. The policy cancelled on April 15, 2015 at that time a bill for $105.00 was mailed to the insured for coverage provided by New York Central Mutual from March 17, 2015 to April 15, 2015. The insured did not pay the $105.00, which he was subsequently sent to collections. If the insured replaced coverage at all during that time period please forward a signed statement with the date the policy needs to be cancelled or proof the coverage was replaced elsewhere to us so we may revise the cancellation date. Like I said, I was told twice on 8/7/15 that nothing was owed. Then I suddenly get a bill that was printed the same day I called. We signed on with this insurance to pay 69.00 a month which would make it 37.50 for two weeks, not 47 dollars. Not only that but I was looked to several times about the billing and that the insurance was actually cancelled. They just kept repeating we never received any request to cancel. Then the bill I got clearly says it was canceled on the 31st by my agent. Very unprofessional and I'm not paying the extra on the premium for two weeks of coverage through an awful company. Take the 37.50 or nothing because we never agreed to pay that high of a premium nor should we just because my husband drives 35 mins to work!

12/8/2014 her vehicle was vandalized, resulting in four damaged tires and scratches all over the vehicle.On 12/11/2014, the insured vehicle was inspected by *.*. [redacted], [redacted]. and, due to the damages sustained, the vehicle was declared a total loss. The Total Loss Valuation report determined the market value of the vehicle was $5,707.72.On 12/17/2014, a letter was sent to the Complainant advising her that we were awaiting the police report and notifying her that additional investigation into the claim was required.On 12/17/2014, we received the Police Incident Report. The police office responded to the complaint at 5:07p.m. on 12/8/2014. The police report states “Upon arrival I met with the VI, [redacted], who advised me of the following. [redacted] stated that on 7Dec14 at approx. 0800 hrs she parked her vehicle, described as a 2007 [redacted] color grey bearing NYS REG [redacted], in the driveway to her residence, [redacted] St. [redacted] stated that at the time there was no damage to the vehicle. [redacted] stated that when she returned to her vehicle on 8Dec14 at approx. 1300 hrs she observed that said vehicle had several large scratches throughout the entire vehicle. Said vehicle also had four flat tires, which appeared to have been punctured using a sharp tool, and white sugar in the gas tank. I did observe said damage.”On 1/7/2015 fluid samples were taken from the engine and transmission of the Complainant’s vehicle for forensic analysis. The fluid samples were sent to [redacted], Inc.On 1/9/2015, a letter was sent to the Complainant notifying her that additional investigation into the facts and circumstances surrounding the claim was required.On 1/20/2015, we received the laboratory report from [redacted], Inc. on the Complainant’s vehicle. The two samples evaluated are identified as **-[redacted] (engine oil from oil dipstick tube) and **-[redacted] (transmission fluid from transmission dipstick tube).The report signed by [redacted], PhD, Forensic Consultant and [redacted], PhD, Certified Professional Chemist, offered the following Results and Conclusions:**-[redacted] consists of a very small volume of dark oil. No water or glycol is detected but a low level of fuel is present. Metals analyses establish elevations in the levels of copper, iron, lead and nickel indicative of wear to the gears and bushings. The levels establish wear is occurring and is elevated but failure is not demonstrated.**-[redacted] is a brown fluid of normal apparent viscosity. No water is detected. Metals analyses establish elevations in the levels of aluminum, chromium, copper, iron, lead, nickel and tin indicating above normal wear and probable failure to one or more areas. The metals content indicate failure has most probably occurred to the gears, thrustwashers, bushings, clutch plates and bearing cage metal.In a signed affidavit obtained by our Special Investigations Department, the Complainant stated that the vehicle had no prior mechanical issues. This information contradicts the forensic findings, which identified elevated levels of metals in the fluids, indicative of probable mechanical failures.On 1/28/2015, a denial was sent to the Complainant based on material misrepresentation of the claim and failure to provide credible proof that the loss occurred as reported.If any additional information is needed, please feel free to contact me.Very truly yours,[redacted]Examiner III###-###-####

On 9/17/2015, we sent a letter to the Complainant advising him that consideration of his claim is delayed pending receipt of the police report, and that additional investigation into  the claim was required. The insurance policy was in place at the time of the accident. Is it the car that is covered or the driver of that car covered by insurance policy?  Isn't there any legal action on the part of NYCM Insurance can proceed with ?  The Insurance Co. takes the payments for the policy without any other identification procedure, no questions asked, but hesitate to settle this claim until confirmation from policy holder. telephone from the Complainant.She reported that she was at the intersection of Jefferson Street and East Utica Street in Buffalo, NY when our insured vehicle turned in front of the Complainant. Our insured vehicle reportedly struck the Complainant’s vehicle on the left front. On 12/7/2015, we received our insured’s loss notice via telephone. The insured reported travelling straight on Jefferson Avenue when the Complainant, on Jefferson in the opposite direction, went around a parked car and struck the insured vehicle. On 12/7/2015, we sent accident report forms to the insured and the Complainant for completion. On 12/9/2015, we received a copy of the Police Accident Report in which our insured is identified as Veh 1 and the Complainant is identified as Veh 2. The Accident Description/Officer’s notes state “At location of Jefferson & E. Utica Veh 1 & Veh 2 did have green light. Veh 1 turning W. bound on Utica did strike V2 traveling southbound on Jefferson which then struck Veh 3 which was stopped at red light facing e. bound on E.
