Complaint: ***
I am rejecting this response because: After not being able get in contact with the GM or any other manager able to offer assistance for months, I did not have another viable opportunity than to fix the truckThe offer for trading in my truck with a blown engine came at the end of AugustAt this point I had already been waiting a very long time to get an estimate from the dealership and had made alternate arrangements because the GM would not return my correspondenceAlso, a truck with a blown engine has almost no valueI expect the dealership to do something for me as I purchased this vehicle expecting it to be safe and reliableAfter the engine blew the dealership did not return my phone calls and emailsThey told me they look into pricing a replacement engine, but failed to do soAfter months of being without transportation and unable to speak with anyone in regards to options, I was forced to spend the money to replace the engineI bought the vehicle from what I thought was a reputable dealership because I thought they would operate with integrityUnfortunately, this was not the case and they continue to demonstrate this
Sincerely,
*** ***

I am sorry to hear that but I specifically offered the customer to bring the vehicle back to trade it in to something elseour vehicle are sold as is and when this vehicle left it was in perfect working condition If the customer decided to fix it that would be at their own costsincerely,*** ***

Dear *** ***,Here are the answers to your concerns, I am sorry if my previous response did not answer those. We have a special finance department here at O'meara VW and here is the process of how a transaction goes in those cases. When you fill out a credit application through one of the 3rd party company that we use, you authorize that company as well as us to pull your creditThat credit application is forwarded to our system, and to one of our special finance representativeAt that time we look at your credit and pre qualify you for an auto loanThe pre qualification process is just making sure that you have the minimum income required by the different programs and banks and that you have the credit history required to qualify for a loan, I know it is kind of a broad explanation but there are 25+ special finance banks and within those banks there are or program each, sometimes more, so for example we have a bank that will finance you if you have had a good paid auto for at least 12 months, even if you had a reposition after words The representative will then call our customer and set up an appointmentOnce you come in the process requires us to, then, print your credit application and have you sign the hard copy, after you verify we have all the correct information, for our records, and we will go through your credit with you to get details of what happened on each account, to make sure that if and when the bank as any questions, that we are able to answer those for youWe also get an idea of what kind of vehicle you are looking for and what is your budget so we can match your needs to the best available program you qualify for and get you as close to your budget as we canAlso one of your concerns was that when you asked what the interest rate was, you did not get an answerAs I mentioned earlier in this email, there are 25+ special finance banks we use, with to or more programs eachWe have a bank that will have a different rate depending on the year of the vehicle, another that will vary depending on how much you are financing and how much your earnest money you have, another that will vary depending on the make, the model and the miles of the vehicleAnd so as frustrating as it maybe, it Is virtually impossible to quote a rate until we know what vehicle you want to buy, how much you have as a down payment what term you are financing for..etc...This is our process for special finance customers, as it makes the unpleasant experience of getting financing on a vehicle, a little easier for the customerIn no way shape or form did we try to offend you in anyways and if we did we truly do apologizeIt was never our intention.Sincerely,*** ***

Volkswagen Credit holds the account on this vehicles leaseThe amount due to obtain clear and free title to the vehicle would be be what ever Volkswagen Credit says the payoff isThis is based on the contract you signed which was presented to you at time of saleYou are more than welcome to negotiate with Volkswagen Credit regarding the balance due on the contract that you executed. Regards, *** ***GSMO'Meara VW

Good Afternoon, *** *** came in Monday 02/22/We had several approvals for this customerWhen *** *** came in he wanted to get a 4WD vehicle which are more expensiveWe tried to get him financed on the only vehicle he would buy patriotWhen the structure was called in
and the income verified the only bank that was able to finance only allowed up to a dollars loanAt that time we called in the customer and were able to get him into the Ffor under 15k which was 2/29/I am not sure why the carfax was never provided, the vehicle went through our pre-delivery inspection and there was nothing wrong with it, the vehicle left this dealership in perfect condition for a fwith 95k miles on itThis vehicle has never been in an accident. When *** *** reached out, I told him I would check with my service manager and see if he could find a rebuild one with warranties on it to minimize the cost of the repair for the customerWe still have not been able to find anythingSo when the customer followed up on 8/22/I let him know that I was not able to find anything yet but he could come in with the vehicle and see if we could trade him out of it in another vehicleI have not heard anything back from the customer since. Please let me know if there is anything else that I can do on this. Sincerely,

Hello Mr***,
I apologized for the misunderstandingVolkswagen did add extra incentives to our vehiclesThe only one available for the Golf R being a and a specialty car was their loyalty programHowever to qualify for it you
needed to own a VW previous to the sale
If they were any available rebates for Golf R, they would have been applied to your deal as it is the only way the dealership can collect them
Please let me know if there is anything else I can do
Sincerely,
*** ***
Initial Consumer Rebuttal /* (3000, 8, 2015/11/13) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Here is a portion of the text in the email advertisement, verbatim:
"Volkswagen is giving its dealers extra money for the month of October, to make up for decreased sales at O'Meara Volkswagen, we're passing ** on to youThat's right, we're paying it forward! Our pay it forward sale applies to every new and model in stockAs an example, combine this one time only offer with our outstanding incentives and you'll save $5,dollars off any new Volkswagen Golf R models"
The ad also states:
"Included in the pay it forward sale, Volkswagen is offering $2,in owner loyalty." This clearly suggests that these are two distinct parts of the sale: loyalty + PIF, and both apply to all and models
Final Consumer Response /* (4200, 12, 2015/12/03) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The email clearly stated the incentive program was for the month of October
The Golf R is indeed a specialty car, however it was included in the incentive program, as stated in the email
The responses from the dealership are scatter-shot (constantly changing the "reasons") - attempting to grasp at any interpretation or wording to refute my claim, but all you need to do is read the email - read the advertisement of the incentive - as the wording makes it very clear
Final Business Response /* (4000, 15, 2015/12/08) */
Good evening,
O'Meara Volkswagen gave the customer all incentives and discounts available on the golf R at the time of the sale
Sincerely

Complaint: ***
I am rejecting this response because: The "State of *** Rebuilt from Salvage Title of Facts C.R.S42-6-136, 42-6-was a signed copy I and my wife (*** *** ***) reviewed on the day we spoke with *** *** and *** ***/Special Finance Manager. This document did not have any of the writing on it displayed in the copies attached in the dealer's response. Also I was not given a copy of the paperwork attached in the dealer's response, this includes a copy of the ***, upon completion of this contract. I signed paperwork that was not explained to me and in addition see the attached copy of the phone call I received from *** *** regarding the signing of a salvage title (see attachment) which indicates to me that the dealership in it's rush to sale the vehicle was aware that they not verbally disclose to me that this was a salvage titled vehicle
Sincerely,
*** ***

Thank you for resending those, As the customer stated we had his approval to run credit*** *** did have an appointment to come in an buy the vehicle, unfortunately another customer came in to buy this specific car before he came in. We can not hold a vehicle for anyone
unless we have a purchase order signedWe immediately had the sales person that was talking to *** *** call him to let him know the vehicle was sold out of respect for his time. I am not sure how to go from there

At this point there isn't anything we are able to offer in the form of a discount on a deal that was already negotiatedPer your admission the pricing you thought was actually at $not at $you are wanting after the factWhen taxes and fees are added the totals of course will increaseAgain we apologize for any confusion regarding your purchase and we would refer you to the lease contract you executed

***Good afternoon,Again I apologize for the late reply as I wasn't aware of this complaintI have read the complaint. The down payment of was in fact charged to their debit card but the customer did sign the receipt for it at the time of the purchase 6/4 ( it is in one of the
attachment enclosed) The customer agreed to pay a total of dollars down and it was paid in full 6/16/2016. Also, I went through the deal and I do not see anywhere that a 2nd key was promised, there is nothing on the negotiating contract or on the We Owe/due billAs far as the bank statement, we only have copies left in the fileUnfortunately, if we had the originals of those bank statements, I assume those were sent to the special finance bank as a proof of income instead of the copiesIf the customer is in need of originals from their bank, please know that I would be more than willing to pay for the extra copies with a receipt provided, as sometimes bank will charge a per page feePlease let me know if there is anything else that I can do.Sincerely,*** ***

Complaint: ***
I am rejecting this response because:I appreciate your sincere disposition for help to resolve this situationI reiterate that never needed any financing, or request to anybody any lease, that mentioned contract signed by me, was for instructions of O’meara's advisor, as the only way to obtain a lower price, than the one announced in ***, which was for the amount of $ 25,The same advisor told me that I only had to keep the contract until March Like at the beginning, after I made an initial payment of $ 10,on November 24, 2017, now, I want to make the payment of the remaining amount, to get the car and its clear titleCan you tell me what the amount of this payment would be, please?
Sincerely,
*** ***

Good Afternoon,
This is *** *** I am the GSM at O'Meara VolkswagenThere was in fact a difference between the payoff on the contract and the actual pay offOn 7/29/I was made aware that there was a difference and that she had
not gotten the money back yetI was not in the office, but I had my manager get in contact with her, and get a check recut in the amount of and, per the customer request, we mailed it to her Friday the 31stPlease let me know if there is anything more that I can do

Complaint: ***I am rejecting this response because:
This is the most common truck engine in the United States, and I find it very hard to believe you were unable to find a rebuildI have contacted several other engine shops and they were able to find them almost immediatelyI have called and left several messages for the GM, but have not heard back anything further. I bought the vehicle because I need a mode of transportation, and to go several months without being able to offer even a quote on a new or rebuild engine is absurdThe truck was sold to me above BlueBook value and I would not do well to "trade-in" on a different vehicleThe vehicle has obviously been in an accident as both door jams have been painted over and there was existing damage from an accident on the passenger side at the time of purchase
At this point, I had no other option than to repair the vehicle, $I am solely looking for compensation to help offset this, as the few months I had with the vehicle working were not sufficient for the overpriced vehicle to begin with.Sincerely,*** ***

I am rejecting this response because:The $i stated was with the taxes and the colorado package I did purchase I was told that was the total price I would payLike I said if I would have been told that it would cost $not the $i would have never agreed to a loan I would have paid cash and the salesman new that.
