In no way could we label out every possible add / delete to all 50 states for titling purposes.  Then you have all the name change and variation issues with people titled on registration differently than title which is different than their drivers license.  The matrix is complex and would befuddle consumers.  I appreciate the suggestion but it isnt practical to our business.   Again I am sorry for the complaint.

This may be true that the consumer has had consistent employment over 3 years but with several employers. Given his current credit situation (low fico, tradelines, etc) job stability is important. Our requirements for this credit tier must have a minimum of 6 months consecutive employment so he is welcome to reapply in 2 more months of employment with his current employer. I am sorry for this misunderstanding.

First
let me start by apologizing this was not a good experience for you.
Our goal is to make applying with our company a positive experience for
everyone. There are specific disclosures you agree to once you complete
the application.
Once you complete the application, you agree to...

allow us to pass your
information to other lenders who may be able to offer you financing:
I agree that OpenRoad Lending may forward this application and my financial
information to one or more third party lenders, dealers, affiliates or others
that may be able to offer me, or assist me in finding, financing or other
products that meets my needs. Some of these affiliates may offer or arrange
dealer financing rather than a direct loan from a lender.
I authorize those third party lenders, dealers, affiliates or others which
are forwarded the application to share information in the application and any
other credit information they obtain with other third parties who may be able
to offer or arrange for a loan or financing through a dealer or other
products and services.
We have now removed you and opted you out of future mailings and your
information will not be passed to any additional lenders.
Again, we do apologize for your poor experience with our company and hope
we can earn your business some day in the future.Regards,The OpenRoad Lending Team

I am sorry we were unable to help you in refinancing the car but let me address a few of your items in the complaint.  First, we can close loans in 3 to 4 business days but we need to have help from the customer.  I can see that we spoke to you almost everyday (and sometimes several times...

per day) for more than a week.  Second, in your case your credit is really not "A1" but rather what we would consider "Average".  Third since you are self employed we needed tax returns (to prove stated income) for 2015 and 2016.  It appears that you have never filed 2015 since the IRS 4506-T showed no return.  Finally, you live in NY which is a title holding state which means the consumer holds the title with the lien on the back. In your case we spoke to Nissan and they showed they had sent it to you so we needed for you to get a duplicate title from the State of NY. So there are many things going on that prohibited a timely and complete loan closure.  I am sorry we couldnt help you at this time but we have some minimum requirements that must be met.  Like you, we spent a lot of time on this and got nothing to show for it so it doesnt benefit us to go through all the steps as well.

I am sorry we could not help you.  We received your application and the vehicle that you are trying to refinance has over 150,000 miles on it.  On the back of the mailer you will see a disclosure that states we cannot refinance any car over 100,000 miles.  So from a credit perspective...

you are eligible but from a collateral perspective you are not.  The good news is we did not pull your credit since your mileage was too high and no lender can refinance a vehicle with that high of mileage.

It is a little unusual that someone is using your information (ie employer, SSN, year, make, Model, lienholder, etc) and its not you in order to lower your car payment. There is not much for someone to gain in that scenario because this is a refinance. However, since you believe that someone else is using it without your permission, you will need to file a police report with the Ardmore police, since that is where the address was used to commit the possible crime. Also I need to get proof of residence in Sanger to show you have moved. Once you have that police report and proof of residence we can start the process to remove your inquiry. Thanks.

I am rejecting this response because: i checked the the mail today and my title is not there. Why would I want to do business with you?  You don't keep your word. And your offer is Not generous. My gap insurance is with my car insurance. So it is with the vehicle. Your company just wants to do the mess around and Not be responsible for your short comings. Don't promise what you can't do and we wouldn't have this issue. I had walked away. And your email clearly stated there was a special exception for the 378. It didn't say anything or disclaim ltv. So that is on you. And I want my title by cob Friday. Or I want a check for $20+ dollars to get another one from the MvA. You should've sent it already.
Regards,

We have spoken with Ms. [redacted] and there is simply nothing we can do with her case. The signed note and Security agreement (that she signed and submitted) did not have GAP. I am sorry that we didn't add it but she has some responsibility to make sure that the paperwork is correct before and of course afterward but not 3 years later after an accident has occurred.

Again once you apply at https://www.openroadlending.com/applyone/ you agreed to the terms on this page (http://www.openroadlending.com/terms-conditions/) which are as follows:  Pay close attention to bullet #2, #7 and #8.  Also as stated earlier, multiple credit inquiries within a 14 day period has no effect on your score.  The credit bureaus know people show around so that don't ding your score for that shopping.By clicking on the “Click to Complete and Start Saving” button, the applicant and any co-applicant (each individually referred to as “I”, “me”, or “my”) agree to the following:I certify that everything stated in my application is true, correct and complete.I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needs. Some of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender.I expressly grant OpenRoad Lending and its third parties, affiliates, agents, service providers or assignees the authority to call and/or email me with questions related to this application and share information about other products and services available.I have read and agree to the State Disclosures and OpenRoad Lending Privacy Policy.I have read and agree to the Consent for Electronic Disclosures, agreeing to the receipt of these and future disclosures and communications electronically, including, without limitation, providing the Privacy Notice on OpenRoad Lending’s web site.If I have applied with a co-applicant, I and the co-applicant both acknowledge it is our intent to apply for a joint account.I authorize OpenRoad Lending and its lending partners, automobile dealers,  third parties, affiliates, agents, service providers or assignees to obtain such additional information as may be required, including credit reports, in order to complete the processing of my application.I authorize those third party lenders, dealers, affiliates or others which are forwarded the application to share information in the application and any other credit information they obtain with other third parties who may be able to offer or arrange for a loan or financing through a dealer or other products and services.I am sorry that we are unable to help you at this time.

In order for an application to be submitted, a person has to complete additional information, have the box check and then click on the Submit button.  There is no other way for the job to run to capture the application information from a technical standpoint.  We literally take thousands of applications each day and never have anyone complain that their application was submitted without them clicking on the submit button.  I'm not sure what FCRA 1681 (c) has to do with this issue since that section of the code is entitled "Requirements relating to information contained in credit reports" and talks about what is supposed to be reported in a credit report by the credit bureau.

Mr. [redacted] - First let me apologize for the poor experience you had with our company and thank you for your service to our great country. I have read through all of the information on your file and it appears the issue stems around a debt you have on your paystub that we were not aware of. That...

payment of $1,200 per month for child support forces you to no longer qualify based on your DTI (debt to income meaning the amount of money you have left over each month after all bills are paid). Our guidelines allow for up to 50% and yours with this additional debt we were not made aware of up front puts you over 60%. We attempted to get an exception to this with all of our underwriting and lending partners but to no avail. We should have recognized that much sooner in the process and for that I am sorry. I hope we can earn your business sometime in the future. The OpenRoad Lending Team

Remove inquires. I do not care about the loan.

Actually I have called experian and I have viewed my credit report as I monitor my credit report quite often and the accounts you listed publicly on the other website have been reviewed incorrectly by you. Those dates you speak of represent a balance update and the balance is decreasing because I am paying on the account. Date opened June 30, 2012 Status Updated June 2015 Balance updated July 2016 and the other account has a Date opened June 2012, Status Updated June 2014, and Balance Updated July 2016. Again no changes to my credit report since you sent the letter. Read the REPORT and understand what you are reading because these accounts have been there. Per Experian Account Specialist and previous and current credit reports.Just erase the inquiry.

I'm afraid that there seems to be some confusion on the part of the business as to what they have or have not done.  For one, OpenRoad Lending DEFINITELY accessed my credit file before issuing the "decline" response.  OpenRoad Lending produced a .pdf letter that detailed why they were declining my application, and I have a copy of that particular letter both in physical and in electronic form if the Revdex.com needs to see it.  The letter confirms that in fact OpenRoad Lending accessed my credit file with Experian, even listing my credit score.  My concern at this point is that the company is attempting to have other lenders run my credit...over and over again...until they find some lender that will give us the loan.  I do NOT want this done multiple times!  I have already asked this company through email and through the Revdex.com to instead rescind the other credit inquiries so that my credit score will not suffer.  There has already been a reduction in my score and further attempts by multiple other lenders will only continue to damage my credit.  This needs to stop.I assert once again that there seems to be more than just an opportunity to lend someone money, but it appears as if there has been an attempt to garner business for credit issues through a law firm.  I am asking again that OpenRoad Lending speak with Experian and whatever other credit bureaus they have worked with about removing the inquiry or inquiries since this appears to be more than just an offer for credit.  I can't afford to have multiple inquiries putting a dent in my score for the next two years.  STOP sending in inquiries and have any other lenders stop doing the same.

First of all I am sorry that we were unable to help you.  We send mailers to prospective customers because based on their credit we can save them money.  Based on your credit we could save you money.  However, we do not know your income or the vehicle that is going to be refinanced...

until you apply.  In your case, the loan to value (the amount owed compared to what the car is worth) is over 200%.  Most lenders will not even do 150% because of the risk of default.  Therefore we were unable to help you at this time unless you were able to lower the balance owed.  I know that is probably an unreasonable request but it is the reality of the situation.  Again I am sorry we couldnt help you and unfortunately no one wins in these situations.

Ms. [redacted]Thank you for sharing your concerns about our company. I have reviewed your application and have determined the reason you were denied is because you did not meet all of the criteria listed on the back of the mailer. We allow up to a 40% debt ratio and yours exceeds 70% meaning that is...

the portion of your income that is eaten up each month in debt payments. I am sorry we were unable to assist you in refinancing your vehicle but hope that we can earn your business in the future. The OpenRoad Lending Team

I am sorry for your experience

I would like a copy of the full application they referernced that I completed. I have not paid ahead on my loan. OpenRoad Lending wanted to turn a 30 mo loan into a 72 mo loan w/o telling me.

Mr. [redacted] - thank you for voicing your concerns about our company and processes. I have reviewed your application. It appears the reason for the decline is due to Capital One reporting to the credit bureau that you are now past due on a credit card payment which is a change in the credit file we...

obtained when we made the offer to refinance your vehicle. The back of the letter you received from us states that if there are any changes in your credit profile then your offer is no longer valid. Once that account is brought current and Capital One reports it that way to the credit reporting agencies, we can reconsider the pre-approved offer for you refinancing your vehicle.I do apologize this was a poor experience with our company and hope we can earn your business in the future.Regards,The OpenRoad Lending Team

Complaint: [redacted]
I am rejecting this response because: my experience with the company was not in line with the company response. I discussed the value of my car and the amount owed prior to running my credit. at that point the loan to value ratio was established. My ratio was way to high so running my credit was totally unnecessary. No matter how good my credit was I would not qualify for the loan. The company has poor business practices that hurt the consumer instead of helping them. A reasonable company would have not run my credit when it was obvious I didn't qualify for a loan.
