Mr [redacted] filed the initial version of this compliant with the Texas Department of Insurance (“TDI”) on or about June 16, Texas Farm Bureau Mutual Insurance Company (the “Company”) responded on behalf of Agent [redacted] as follows: Mr [redacted] states in his complaint that he requested to change the covered vehicle on his policy on or about January 15, to a [redacted] ***He also states that he requested the [redacted] have all of the coverage that was provided to the [redacted] Our records and agent [redacted] both indicate that there were multiple conversations concerning this vehicle change and the coverage to be provided for the [redacted] ***Mr [redacted] clearly indicated to agent [redacted] that he wanted liability coverage only for the Toyota due to the increased cost involved with comprehensive and collision coverage On or about June 30, 2011, TDI accepted the Company’s response and closed its file Mr [redacted] filed a second complaint, without raising any new issues, with TDI on or about September 5, The Company responded to TDI, advising that Mr [redacted] had not raised any new issues following the initial complaint On or about October 12, 2012, TDI accepted the Company’s response and closed its file On or about June 5, 2014, Mr [redacted] filed a third complaint, which contained statements we previously addressed twice to the satisfaction of TDI In that third complaint, he also complained that the Company set his policy to non-renew after he accepted a job and changed his address to British Columbia, [redacted] Subsequently, he informed us that the vehicle was still garaged in Houston In response, we offered to remove the non-renewal code from his policy, but he informed us that he had purchased insurance elsewhere Additionally, he requested that his membership dues be refunded due to the non-renewal of his insurance policy In our TDI response, we informed him that Texas Farm Bureau is a membership organization and our insurance services are a benefit of membership The Company has notified him on several occasions that Texas Farm Bureau membership dues are non-refundable On or about July 2, 2014, TDI accepted the Company’s response and closed its file Mr [redacted] has not raised any new issues in the complaint recently filed with the Revdex.com Our position remains the ***e as stated on multiple occasions to TDI Thanks [redacted] ###-###-#### ###-###-#### (Fax) [redacted] @txfb.org Fish Pond Road Waco, TX WWW.TEXASFARMBUREAU.ORG

Complaint: [redacted] I am rejecting this response because: I only went to offices for medical attention regarding this auto accidentI could easily get a copy of all treatment/payment records within a couple days so I am confused why this has taken monthsIs it not acceptable for me to get these records and just provide them to you? Additionally what is an expected timeframe for this to be resolved? What is the release from your insured you are waiting for, I've never been made aware of that? It seems unprofessional and unrealistic to just keep telling someone we are working on it for months on end with no end in sightNot that one complaint will change anything with the way this company opperates but this insurance company has been the worst I have dealt with by far in my entire lifeI have been in accidents times worse and all the repairs and medical bills were resolved within a couple monthsI was never pushed off onto another individual even once, let alone the times it has happened with this claimI am never contacted when the contact person for my claim is changed or even when the claim was closedI need to know an expected date for this to be completed or to be made aware of ways I can help speed this along Regards, [redacted] ***

This matter is not resolvedThere are a few inconsistencies with the company's response Based upon the initial inspection of Mr [redacted] ’s home, it could not be determined if Mr [redacted] ’s home suffered damage that was caused by a covered peril I believe we all agree Mr [redacted] ’s home suffered damage due to wind driven rain - my response - No, we can not all agree it was caused by wind driven rainNo one went up on the roof from the insurance company of the second story, nor did anyone enter the attic to view from within However, Mr [redacted] was unable to determine if Mr [redacted] ’s policy covered the damage from wind driven rain based upon his inspection- My response, Mr [redacted] denied the claim on site claiming the issue was from wind driven rainHe stated it is not covered with great confidence and told me to contact my agent but he didn't see anything they would pay for Mr [redacted] ’s home is a two story home with an overhanging metal roof covering the porch, and metal roof covering the second story Mr [redacted] inspected Mr [redacted] ’s homenoting the water damage to the interior of Mr [redacted] ’s home He was able to inspect the roof covering the porch, but was not able to get on the second story roof The roofer at the scene was able to get on a portion of the roof covering the second story, but the steepness and the fact that the roof is metal did not allow for a thorough inspection due to safety concerns - My response, completely falseThe roofing contractor which came with Mr [redacted] did NOT attempt to go up on the second storyNeither brought the equipment / ladder sufficient to even attempt to go up on the roof of the second storyI watched them on the porch roof from the ground and followed around the house as they wentNo one attempted to get on the second floor roof We have had rains sinceEach is documented by date in my claim journalThe president of the company nor my agent have ever called me as I have requested multiple timesWith each rain, we now receive more water inside the house coming down the drywall, little to no windSurely not mph plus winds as from the original storm, so their claim the water damage within the house was cause by wind driven rain is insufficient with the rains since and water continuing to come in with each passing rain Please continue forward with this matterI am available for questions or concerns with an appointmentAnytime I am on the phone, I request to know all parties and the role of each being included to listen in on the conversations I will also forward you my most up to date journal entries Thank you Regards, [redacted]

We disagree with Mr***’s position about ‘no one’ getting on his roof. The adjuster did not get on the second story, but the roofer that was at Mr***’s home did. Photos were taken of the issues on the second storyThe roofer, *** *** and the water mitigation man, *** *** helped do a double pull with the ladder to be able to inspect the second story roof
Also, Mr*** advised he stated at Mr***’s home he did not see any storm damage from his inspection, however, this is when he offered to have an engineer come out and inspect to see if there was anything he overlookedThe only time he discussed the insured's agent was to advise him that the agent’s inspection of new properties is not as thorough as the adjuster's inspection
The engineer did not put his feet on the second story roof as it is too steep for him to safely climb on He also thought it was unsafe to pull a ladder onto the first floor roof to inspect the second story as the metal roof is too slick to safely support the ladderHowever, Mr*** visited with the engineer and the engineer advised he rented a man lift in order that he could safely inspect the second story
Finally, the damage caused from leaking is not related to a covered peril, but rather maintenance issuesThe engineer’s report documents all of the maintenance issues Mr***'s home is experiencing.

I am rejecting this response because: I was getting over the phone conflicting stories from the insurance agent *** *** of Texas Farm Bureau. He told Texas Department of Insurance that I did not request full coverage on my car when in fact I did , and then he proceeded to call me over the phone and tell me verbally over the phone he could not cover me on my car due to the age of the vehicle. When I asked him for proof of this he would never say to me there was a policy for this. I have asked that Texas Farm Bureau simply tell me that they did not fully cover me as instructed, and simply take care of the repairs to the car
This is very bad business practices when they do not follow instructions by the consumer in covering the vehicle. All I'm asking for is for them to cover the cost of the collision to the vehicle, and re-imbursement of the membership fees. I contacted Texas Farm Bureau and told them verbally over the phone that my car is in Texas parked inside my garage and that I was flying by airplane to Vancouver BC for a job opportunity. They are completely at fault and would like this taken of

Mr. [redacted] reported on 12/21/2015 that his 1977 John Deere 4430 diesel tractor was totally destroyed by fire on 12/17/2015. The tractor was inspected by a representative of Texas Farm Bureau Insurance Companies and it was determined to be a total loss.   The policy carried by Texas Farm...

Bureau Underwriters on the tractor is an actual cash value policy. Several comparable tractors of like kind and quality were found. Based upon our market analysis from those comparable tractors the actual cash value of the tractor in question was determined to be $17,816.67.  Mr. [redacted] stated that he wanted to retain the salvage. Therefore, we obtained quotes from local salvage buyers and determined the salvage to worth $1,350.   After deducting the salvage value and policy deductible of $250 from the actual cash value amount referenced above, Texas Farm Bureau Underwriters issued payment to [redacted] on 1/26/2016 in the amount of $16,216.67.   It is the position of Texas Farm Bureau Underwriters that the amount Mr. [redacted] has been paid reflects a fair and reasonable actual cash value settlement for the property that was lost.

This letter is written in response to the above-mentioned complaint filed by [redacted].
 
This complaint arises out of an auto accident and a subsequent auto insurance liability claim where Mr. [redacted] has filed a claim for his wife’s injuries against one of our insured’s.  We have asked Mr. [redacted] to submit her medical bills and records to us for review.  If he previously sent the medical bills and records to us, we did not receive them and have requested that he resubmit them to us again.  This policy and claim are not like a medical or hospitalization insurance coverage.  There is no provision for payment of medical bills as they are incurred.  The payment of this claim will be in the form of a onetime payment and settlement of any and all claims after all treatments have been completed.  This has been explained to Mr. [redacted] more than once. 
 
We remain ready to review Mrs. [redacted]’s medical records and settle this claim but they must comply with our request to submit the damages and claim to us for review and settlement which still has not been done.

Response from [redacted], Vice President Sales - We regret any difficulty that Mr. [redacted] has experienced related to his insurance coverage.  We aren’t aware of numerous calls from his bank, but it wouldn’t be unusual for a bank to call the agent for verification of coverage or loss payee...

Response from [redacted], Vice President Underwriting - Thank you for the opportunity to reply to this complaint.  We have reviewed the underwriting actions taken on Mr. [redacted]’s automobile policy 23001485.  Three automobile claims were submitted on this policy by Mr. [redacted], or on behalf of Mr. [redacted], during 2014, 2015, and 2016.  The first claim occurred on June 28, 2014.  The claim involved Mr. [redacted]’s vehicle being struck by another vehicle.  Mr. [redacted] withdrew this claim and pursued reimbursement from the owner of the vehicle that struck his vehicle.  During the claims investigation it was determine that Mr. [redacted]’s vehicle was being operated by his 20 year old daughter who was not listed as a driver on the policy.  The second claim occurred on July 3, 2015.  This claim involved Mr. [redacted]’s vehicle damaging another vehicle as it attempted to pass a baler.  During the claims investigation it was determined that Mr. [redacted]’s vehicle was being operated by his son who was not a listed driver on the policy at the time of the accident.  $1,117.21 was paid to Mr. [redacted] for the damage to his vehicle.  On July 28, 2015 Mr. [redacted]’s policy was scheduled for non-renewal effective April 24, 2016 as a result of the 2nd claim involving an unlisted operator.  The third claim occurred on March 7, 2016.  The auto involved in this accident was removed from the policy in October 2015.  During the investigation of the third claim it was determined Mr. [redacted]’s son was operating the vehicle at the time of the accident.  The only claim payment currently recorded on Mr. [redacted]’s auto policy is the $1,117.21 from the July 3, 2015 accident.  Mr. [redacted]’s policy was non-renewed as a result of the unlisted operators.

We handle diesel fuel contamination claims on a case by case basis.  The policy contains an exclusion for mechanical breakdown. Since water is inherent in diesel fuel systems, we investigate to determine if the water’s presence is from a covered event. We found no evidence to indicate...

flooding was the source of the water. We checked with the fueling station ([redacted]) the insured purchased the fuel from and they confirmed that they have their fuel checked weekly and that they had no complaints or issues with their diesel fuel.  We took a fuel sample from the filter under the hood and found clean fuel. The shop later took samples from the lower primary filter housing and from the tank and did find water content and rusty metal shavings which would be from a failing fuel pump. 
 
Without the specific evidence of purchasing contaminated fuel, this is not a covered loss under this auto policy.

This is the response to the complaint submitted by [redacted] regarding the insurance claim to his home located at [redacted].  Mr. [redacted]’s home is insured with Texas Farm Bureau Mutual Insurance Company.   Our Claims...

Mr. [redacted]’s claim was reported as a leak in the roof, water damage to the eave, water coming in through the window frame, wind damage to the window exterior, drywall damage to ceiling, and water damage under the plywood porch.  Mr. [redacted]’s home is a two story home with an overhanging metal roof covering the porch, and metal roof covering the second story.  Mr. [redacted] inspected Mr. [redacted]’s home. noting the water damage to the interior of Mr. [redacted]’s home.  He was able to inspect the roof covering the porch, but was not able to get on the second story roof.  The roofer at the scene was able to get on a portion of the roof covering the second story, but the steepness and the fact that the roof is metal did not allow for a thorough inspection due to safety concerns. 
 
Based upon the initial inspection of Mr. [redacted]’s home, it could not be determined if Mr. [redacted]’s home suffered damage that was caused by a covered peril.  I believe we all agree Mr. [redacted]’s home suffered damage  due to wind driven rain.  However, Mr. [redacted] was unable to determine if Mr. [redacted]’s policy covered the damage from wind driven rain based upon his inspection.  I have provided the policy language of Mr. [redacted]’s policy that may apply which states:
 
COVERAGE A (DWELLING) AND COVERAGE B
(PERSONAL PROPERTY)
We insure against physical loss to the property described in
Coverage A (Dwelling) and Coverage B (Personal Property)
caused by a peril listed below, unless the loss is excluded in
Section I Exclusions:
 
3. Windstorm, Hurricane, and Hail.
This peril does not cover:
 
b. loss caused by rain, snow, sand or dust, whether or
not driven by wind, unless the direct force of wind or
hail makes an opening in the roof or wall and the
rain, snow, sand or dust enters through this opening
and causes the damage.
 
Mr. [redacted] was not able to conclusively determine an opening was created by wind.  Therefore, Mr. [redacted] was unable to tell Mr. [redacted] Texas Farm Bureau Mutual Insurance Company was to pay for the damage to his home.  Mr. [redacted]’s inspection determined possible reasons for leaking to be no drip edge on the roof, the siding did not overlap, some of the siding was cracked, the valley metal was cut too short and patched with caulk that appeared to be deteriorating.  Also, loose siding appeared to allow rain to leak around the window.  It was also noted that the decking overhang was too long in places allowing it to absorb water.    
 
Mr. [redacted] conferred with me to see if we needed to employ a structural engineer to inspect Mr. [redacted]’s home to assist in determining the cause of the leaks to his home.  During this time, Mr. [redacted] called the home office to speak with President [redacted] about his claim.  I was advised to follow up with Mr. [redacted] regarding his claim.  In speaking with Mr. [redacted], I reassured him that if he has a payable claim, we want to pay that claim.  I also offered to let Mr. [redacted] pick his own engineer to inspect his property to determine the cause of the leaks and Farm Bureau would pay for the services of his engineer.  Mr. [redacted] was willing to let Farm Bureau choose an engineer provided the engineer was able to inspect Mr. [redacted]’s home in his presence.  We hired Wharry Engineers to inspect Mr. [redacted]’s home to determine the cause of the leaks.  Once it is determined the cause of the leaks, we will advise Mr. [redacted] if his Home Owner’s coverage applies to his loss.
