Thank you for the opportunity to respond to the above-referenced consumer complaintThis complaint is in regards to outstanding collections accounts for [redacted] and [redacted] Each account concerns a returned check made payable to [redacted] that was forwarded to Payliance for collectionsIn the complaint, Mr [redacted] alleges that Payliance reported the outstanding accounts to the credit bureaus after payment arrangements were made for the outstanding balancesPayliance records for each account are as followsAccount # [redacted] was received by Payliance for collections on August 12, and was initially reported as outstanding to the credit bureaus on October 24, Account # [redacted] was received by Payliance on July 31, and was initially reported on October 8, Account # [redacted] was received by Payliance of August 13, and was initially reported on October 24, Account # [redacted] was received by Payliance on September 12, and was initially reported on November 26, Account # [redacted] was received by Payliance on September 18, and was reported on November 26, Account # [redacted] was received by Payliance on March 25, and was reported on May 28, Account # [redacted] was received by Payliance on September 3, and was reported on November 8, Account # [redacted] was received by Payliance on June 2, and was reported on August 7, Account # [redacted] was received by Payliance on June 8, and was reported on August 7, Collection notices were mailed upon Payliance’s receipt of each account to the consumers at the address associated with each returned checkOn September 16, 2016, [redacted] called the Payliance Collections Department and arranged one $post-dated partial payment to occur on October 4, and a second $post-dated partial payment to occur on November 4, On September 20, 2016, [redacted] called Payliance asking why Payliance had reported the accounts to her credit history after she had made the September 16, payment arrangementsThe Payliance representative informed [redacted] that arranging a post-dated partial payment would not remove an outstanding account that had been previously reportedOn September 30, [redacted] called and canceled the October 4, post-dated paymentOn October 11, 2016, [redacted] again called in to complain that Payliance had reported the outstanding accounts after she had arranged the September 20, post-datesThe collection supervisor attempted to explain to [redacted] that Payliance initially reported the accounts to the bureaus well before the arrangements were made but [redacted] terminated the call before the supervisor could finishOn October 26, [redacted] called Payliance and moved her November 4, post-dated payment to December 2, As stated above, Payliance initially reported the consumers’ outstanding accounts to the credit bureaus before the consumers contacted Payliance to arrange paymentsTo date, Payliance has yet to receive any payments concerning this matterShould the consumers’ December 2, post-date payment clear their account, Payliance will ensure the adjusted balance is reported to the credit bureaus

Thank you for the opportunity to respond to the above-referenced consumer complaintTo clarify our previous response, Payliance did not have any contact information for the consumer when the outstanding balances for her returned checks were forwarded to Payliance for collections***’s stores utilize check scanners at the point-of-sale which read the routing and account numbers at the bottom of the check as well as the face value the check is written forThese scanners then electronically present the scanned information to a consumer’s bank for paymentTherefore, when ***’s # [redacted] forwarded the consumer’s outstanding accounts to Payliance, Payliance only received the consumer’s bank account and routing numbers for each returned check as well as the outstanding balanceBecause Payliance did not have contact information for the consumer, no direct attempt to notify her of her outstanding balances could be madeWhen the consumer called Payliance and arranged payment on July 8, 2016, she provided Payliance with her address and telephone numberThe consumer’s accounts were then updated with the provided information and the accounts were successfully reported as paid-in-full items utilizing the consumer’s newly acquired contact informationAs stated in our initial response, as of June 1, 2016, ***’s is sending their new returned checks to a different collection agencyHowever, the consumer’s checks were sent to Payliance for collections in April and May of Any accounts Payliance received from ***’s before June remain legitimate collections accounts at Payliance unless recalled by ***’sCurrently, all five of the consumer’s accounts have been paid-in-full per her arrangements she set up with the Payliance Collections Department on July 8, and August 5, Notices were previously sent to Equifax, Experian, and Transunion to have these five accounts deleted from the consumer’s credit reportIf not already removed, these accounts should be deleted from her credit history within the next days

Thank you for the opportunity to respond to the above-referenced consumer complaintThis complaint concerns a returned check placed into collections at Payliance by the US Postal Service (USPS)When the consumer’s check returned, the USPS charged a $returned check fee in addition to the original amount the check was written forAt each USPS location, there is a returned check notice posted at the point-of-sale stating any returned checks will incur the $feeThe notice further states that returned checks may be re-submitted to the consumer’s bank account via an electronic debit attemptWhen the USPS placed the check in collections with Payliance on January 10, 2018, Payliance attempted to re-present the $face amount of the check as well as the $returned check fee to the bank account associated with the returned checkThe January 10, presentment attempts failed to clear the consumers account and an additional attempt to present the $fee to the customer’s account was initiated on January 16, The January 16, presentment attempt did not successfully clear the consumer’s account and the total $balance remains outstanding for this matterPer the posted returned check notice, the consumer was informed what would happen in the event her check payment returnedPayliance has only attempted to present the $face-amount of the returned check and the $returned check fee for this matter—in her complaint the consumer states the $in fees were bank fees charged and refunded by her bankIn response to this complaint, all future attempts to present the outstanding balance to the consumer’s account have been haltedFor questions or payment options, the consumer may contact the Payliance Collections Department at ###-###-####If the consumer would like to discuss this matter directly with the USPS, they may be reached at ###-###-####

Faxing info regarding Acct # [redacted] Transunion advised me this item has been deleted aftere I disputed it in 9-I was verifid paid in full & Payliance ansered the dispute to have it deleted

Hello [redacted] , Writing in regards to the above compliant number we received this afternoon As usual, this complaint concerns a returned-check we are attempting to collectThe issue is, however, that the check and the collections account are not in [redacted] name but a name unrelated to hisDue to collections laws and regulations, I cannot discuss the account/check with [redacted] without the check-writer’s explicit consent I know [redacted] complaint is related to the collections account in question because both parties are listed at the same address and the check writer was making similar complaints to our collections department a couple of days agoIs there anyway [redacted] can amend his complaint to include the check-writer’s name as well? Thank you for the opportunity to respond to the above-referenced consumer complaintIf Mr [redacted] and Mrs [redacted] believe that the checks in collections were fraudulently written without their consent, then Payliance requires the previously requested police report copy or notarized affidavit for proof of fraudShould Payliance receive the requested proof of fraud, the accounts will be canceled from collections and the credit bureau listings of the accounts will be deletedIt is not Payliance policy, however, to delete credit listings of accounts in return for payment and neither [redacted] or [redacted] were ever informed by Payliance that the accounts would be removed from their credit history in return for paymentAs alleged in the most recent rejection, checks #### and ##### have been paid-in-full and were reported to the credit bureaus as paid accounts on May 8, Payliance respectfully denies the consumers’ request to remove the accounts from their credit histories in return for payment

I never received any letter or notice only until I contacted the Revdex.com and [redacted] and then they waited the whole month of November to re send it there fore causing it to still be in a negative balance Regards, [redacted] ***

This complaint concerns a collections account for a returned check that was placed in collections at Payliance by the [redacted] (***) on December 13, A dunning notice was mailed to the consumer’s attention by Payliance on December 14, to the [redacted] ***, Willcox, AZ address associated with the returned checkThe account was paid-in-full on March 10, and all collection activity concerning this matter has since been ceasedThe account was initially reported as outstanding to the credit bureaus on February 24, and notices were sent to the credit bureaus on March 24, to update the account to a paid-in-full status with a $balance past dueIn his complaint the consumer claims he was never notified of the returned check until Payliance mailed the December 14, dunning noticeAttached with this response is a copy of a letter the [redacted] mailed to the consumer on November 2, notifying him of the returned check and stating the account would be placed in collections if payment was not receivedBecause no payment was ever received by the [redacted] the matter was placed into collections at PaylianceOnce the account remained outstanding in collections for an excess of days, the account was reported to Equifax, Experian, and TransunionTo ensure the account is reporting as a paid item with a $balance, additional notices have been sent today to Equifax, Experian, and Transunion to update the account to accurately reflect a paid statusHowever, because the account was outstanding when initially reported, Payliance respectfully denies the consumer’s request to delete the account from his credit historyIt is not Payliance policy to delete previously-reported collections accounts once they are paid-in-full; instead accounts are updated to accurately reflect their paid status

Thank you for the opportunity to respond to the above-referenced consumer complaintAs stated in our initial response, the first of the consumer’s outstanding accounts was initially reported to the credit bureaus on October 24, and the final account received was initially reported on August 7, The consumer did not contact Payliance to arrange payment for the accounts until September 16, Even if the outstanding balances had not yet been reported by the time the consumer arranged post-dated payments for the accounts, arranging a post-dated payment would not halt an account from reporting to the credit bureausOnce an account received by Payliance remains outstanding in collections for a period of days, the balance is reported to the credit bureaus unless the account has been disputed or paid-in-fullPayliance respectfully denies to consumer’s request to delete the credit bureaus listings of his outstanding accountsTo date, no payments have yet to be made —the consumer has been calling in and moving the post-dates further ahead so that no payments have actually been processed for this matter at this time

I reviewed the response made by the business in reference to complaint ID [redacted] , and am willing to resolve the complaint However, I continue to have concerns about this company as I have been told by [redacted] Family Practice that they never authorized Payliance to debit against our account, and in my investigations of this company I have found many complaints about their illegal practices I hope that the Revdex.com will take a further look into this organization, and whether or not it is in compliance with practices authorized in your state

I believe the actions of Payliance were not legal. I have included the statement that I received from the company which clearly states that I am to mail they a check or money order. No where on the statement does it state that they will or can debit my personal account. I submitted a check the day that I received the statement from the company. Why would I do this if I was made aware that they would take the liberty themselves? Further, I have confirmed from LeeAnn in the accounting department at Lexington Medical that no such agreement exists whereby a third party may extract money from my account without my knowledge or permission. At this point, I would like the BBB to note the poor business practice of this agency as you are misleading people.
