Payliance is a check recovery company that
collects on
returned checks and payments made payable to our clienteleThe consumer’s
complaint is in regards to a flag she has attached to either her bank account
number or her driver’s license number in the National Check NetworkThe National
Check Network (NCN) is a database of consumers who have outstanding checks or
debts tied to their names that businesses can subscribe to in order to prevent
accepting checks from customers with outstanding payment historiesPayliance
is a subscriber and data furnisher to the NCN and we regularly report all of
our outstanding accounts to NCN
In response to this complaint, Payliance has searched our
records and have not found any outstanding accounts under Shanequa ***’s
name or addressTherefore, we do not believe that Payliance is the entity that
has flagged Ms*** with the NCNBecause ***’s is a current client
with Payliance, ***’s automatically refers customers to Payliance to
resolve any flags they may have within the NCN database
In order to resolve this matter, we request that Ms***
contact Payliance at ###-###-#### with both her driver’s license number and the
routing and account numbers for the checking account she attempted to write the
check to ***’s againstPayliance will be able to use this information to
determine the name and contact information of who has the consumer flagged in
the NCN databaseAlternatively, Ms*** can also contact the National
Check Network directly at ###-###-#### for more information on her flag

I work at *** *** and know for a fact that there is nothing posted ANYWHERE in that store about Payliance, them auto withdrawing fees from consumers accounts, or how the return check process works at allI spoke to my manager at *** *** where I wrote these checks at and she had to call the accountant for *** *** to find out what Payliance was and why they were collecting on the checksI stood right next to my manager *** while she spoke to the accountantThere is nothing clearly posted anywhere that these people have access to your bank accountAlso to make matters worse your letter or debt collection clearly states that I am suppose to pay you by money order, check, or credit cardPer the attached copies of the letters I emailed you can clearly see the company mis represented itself and it's ways of collecting debtsI am in full knowledge I owe this money but was not aware of it until after they tried taking the money out of my account which was days before I received a letterPlease be aware of your sending letters to people you need to give sufficient time for them to recieve them and manly be change your letter so it doesn't say for people to send money to youLet them know they will just keep accruing charges until you get it

This complaint is in regards to two collections
accounts
under the consumer’s name for returned checksThe consumer called the
Payliance Collections Department on January 4, to enquire about the two
accounts which were reporting to her credit history as outstanding itemsOne
account, #***, had been recalled and canceled by the original creditor,
*** ***, on December 29, and was set to be removed from the
consumer’s credit report with Payliances next update of our files to the credit
bureaus on January 8, The second account, #***, had a remaining
balance of $after the consumer previously paid the majority of the
outstanding balance on the account in This payment on account
#*** was updated with the credit bureaus on November 9, During the
January 4, phone call, the Payliance representative agreed to waive the
remaining balance for account #*** and have the account removed from the
credit bureausUpon receipt of the consumer’s complaint, we have verified with
Experian, Equifax, and Transunion that accounts #*** and #*** have both
been deleted from the consumer’s credit history
When the consumer spoke with Payliance on January 4, 2016,
the consumer was erroneously informed that account #*** was sent to the
credit bureaus to be removed on November 30, when, in reality, November
30, was the last time the account was updated as outstanding to the credit
bureausWe apologize for any inconvenience this misunderstanding may have
causedAs stated above, the account was canceled per request of the *** *** on December 29, and was an outstanding collections account up until
that point
The trade-line listings for accounts #*** and #***
have been removed from Equifax, Experian, and Transunion and all collection
activity regarding these items has been ceased

Consider the timeline. I am truthfully claiming that I did not receive the notice from the ***. Payliance notified me and, almost immediately the debt was resolved. So why the punitive action by Payliance? Why would they have such "itchy trigger-fingers" to report the issue as a DEFAULT in payment when I resolved the issue almost immediately with them. If the postal service wants to claim I unfairly dragged my feet in payment, they might have reason had they sent a "second attempt" to contact me. I received no such courtesy and now suffer a significant setback in my credit rating because of a COLLECTION ACCOUNT. An account which was paid forthright upon receiving notification of the error. Please, be human about this. The appropriate response is to consider the circumstances. If it were my intention to renege on the dishonored check, I would have done sobut the timeline says otherwise Or does Payliance exist solely to damage people's credit rating. If they exist to collect the funds due, they did their job well. If they exist to hurt people, they are also doing that joy well

Thank you for the opportunity to respond to the above-referenced consumer complaintThis complaint is in regards to a returned check made payable to the US Postal Service (USPS)The USPS is a current merchant with Payliance authorizing Payliance to collect on returned checks made payable to the
USPSThe USPS forwarded the consumer’s outstanding balance to Payliance for collections on June 1, and a dunning notice was mailed to the consumer’s attention on the same day to the ** *** *** *** *** ** ***address associated with the consumer’s returned check (attached is a copy of the dunning notice)No communication from the consumer has ever been received by Payliance and the outstanding balance was eventually reported to the consumer’s credit history on August 8, In the complaint, the consumer alleges Payliance failed to provide her proper notice of her outstanding account in collectionsAs stated above and supported by the attached, Payliance mailed the consumer a notice as soon as the account was received for collectionsPayliance respectfully denies the consumer’s request to delete the outstanding balance from her credit history for failure to notifyShould the consumer pay the outstanding balance in full, the account’s status with the credit bureaus will be updated to a paid-in-full status with a $balance past due and will reflect the date the account was paid

I have been at this address for years & there WAS NO ATTEMPT made to notify me*** is using check alert & has been since June This can be verified

Thank you for the opportunity to respond to the above-referenced consumer complaintThis complaint concerns a debt that was forwarded to Payliance for collections on September 13, from ***Because the debt remained outstanding for an excess of days once placed in collections,
Payliance eventually reported the outstanding balance on November 11, to the credit bureausOn January 17, 2017, Ms*** contacted the Payliance Collections Department and paid her account in full and account was reported as paid-in-full to the credit bureaus on January 25, Per the Fair Credit Reporting Act (FCRA), Payliance is required to ensure trade-line listings of collections accounts are reporting accuratelyPayliance is not required to delete a listing of an account unless the information reported is inaccurate or expired under a year statute of limitations outlined in the FCRAPayliance reported Ms***’s payment-in-full to the credit bureaus upon Payliance’s next scheduled reporting following the payment in order to ensure the trade-line listing was accurateIn order to resolve this matter, however, Payliance has agreed to comply with the consumer’s request and, as a good-will adjustment, remove the trade-line listing of the paid-in-full account from Ms***’s credit historyNotices will be sent to Equifax, Experian, and Transunion on May 8, 2017, Payliance’s next scheduled reporting date, to have the account deletedWe ask that the consumer allow up to days for this action to be reflected upon her credit report

This complaint is in regards to collections
accounts for two
returned checks written to ***Payliance is under contract with ***
to collect on returned checks made payable to the business*** has, at
the point of sale, a returned check policy notice postedThis notice states
that in return for the merchant accepting a consumer’s check, the consumer
authorizes the merchant or its agent to electronically re-present the face
amount of the check as well as a state allowed returned-check fee to the
consumer’s bank account if the check returns unpaid after the initial
presentment
Both checks were returned for insufficient funds on October
29, and were sent to Payliance for collections on November 30, When
Payliance received the checks, the outstanding balances were electronically
re-presented to the consumer’s bank account and collection notices for both accounts
were mailed to the consumer at the *** * *** *** *** ** ***
address associated with her returned checks
On December 14, 2015, the consumer arranged a post-dated
payment for both accounts to occur on January 18, Because of this
arrangement, all collection activity regarding these accounts has ceased until
the post-dated payment takes place

This complaint is in regards to a collections
account for a
returned check that was forwarded to Payliance by our client, *** *** ***l on August 17, Because the account remained outstanding for an
excess of days, the item’s balance was reported to the credit bureaus on
October 24, Mr*** paid the account in full on January 4, and a
notice was sent to Equifax, Experian, and Transunion to have the item updated
to reflect a paid-in-full status with a $balance past due on January 8,
Mr*** alleges that the paid-in-full listing of his account is
negatively impacting his credit report
Upon receipt of the consumer’s complaint, Payliance has
verified with Equifax, Experian and Transunion that the account is currently
reporting to Mr***’s credit history as paid-in-full with a $balanceAs
a data furnisher, Payliance is obligated to ensure the information we report to
the credit bureaus is accurate and currentIt is not Payliance policy to
delete accounts from the credit bureaus in return for payment
Per Mr***’s request, a letter confirming the account’s
paid status has been mailed to him at the Harrington Dr address provided
with this complaint today, November 24, 2015.

I also have all call recorded and can send them to whom ever need themThe supervisor was very rude and unprofessionalIf this company is saying she did no wrong mean their okay with their employees being ghetto and unprofessionalI also never received a call from her supervisorWhen I asked for someone over her she was very rude and I will not contact this company again because it seems it's just employed by a bunch of unprofessional people that think it's okay to have poor customer serviceAgain I have all calls recorded and maybe the recordings are having problems like their phone serviceI have have the whole conversation even the calls where I was hung up onI even called someone to verify my phone was working just fine before I called the 4th time.

The checks are showing two different addressees, I was living in Lewisville, TX at that time, also that is not my license number on those checks (there are two different numbers on those checks)

Thank you for the opportunity to respond to the above-referenced consumer complaintIn response the Ms***’s rejection, we have reached out to *** *** and confirmed the consumer’s allegation that *** *** does not have a returned check policy notice posted at the point-of-saleWe would like to thank the consumer for informing us of this situationWhen Payliance was contracted with *** *** to collect and re-present returned payments from their customers, *** *** was provided with the appropriate returned check notices to be displayed at their point-of-saleHowever, at the time the consumer wrote her returned checks in question, these notices were not on displayOn Friday, July 15, 2016, Payliance mailed several notices to *** *** to display at the point-of-saleDue to the absence of the notices, Payliance has sent a credit in the amount of $to be processed to the consumer’s bank account to cover her incurred overdraft fees as a result of Payliance’s re-presentment attemptsWe ask that Ms*** please allow up to business days for these funds to appear in her accountMs*** had an additional account for a returned check written to *** *** *** ***While we have confirmed that *** *** *** does have the correct returned check policy notice posted, we have waived the $returned check fee for this account as a courtesy due to the misunderstanding that occurred on Ms***’s *** *** accountsPayliance had previously collected the $returned check fee for this account via re-presentment on July 15, and a refund of $was processed on July 20, to be credited back to the consumer’s accountWe would also like to advise Ms*** that an additional returned check #*** made payable to *** *** was received in our office on July 14, We have ensured the re-presentment attempts for this new account will not take place and, as a courtesy, we have waived the $returned check fee for this account and only the $face amount of the check remains outstanding

to *** *** *** and was returned for non-sufficient fundsPayliance
is under contract with *** *** *** to collect on returned checks
made payable to the school*** *** *** was provided with a
check payment terms notice to be posted at the school’s officeThis notice
states that returned checks are subject to a state-allowable returned-check fee
as well as electronic re-presentment of both the face amount of the returned
check and the returned check fee to the customer’s bank account by PaylianceThe
consumers account was forwarded to Payliance for collection on November 9,
and a collections notice was mailed on November 9, to the *** *** *** *** ** *** address associated with the returned check
Upon investigating this matter further, Payliance has been
informed that *** *** *** does not have the check payment terms
notice posted as requiredIn order to resolve this matter, Payliance has
agreed to credit Mr*** $to compensate him for his incurred
overdraft fees as a result of Payliance’s re-presentment attemptsThis credit
will be sent to the *** *** *** *** account ending in *** and may
take up to business days to appear on the consumer’s statementPayliance has
also returned the account back to *** *** *** and we will no longer
be handling this matter

We are not pressing charges due to my son condition we are really to send Payliance the money owed but we also want the checks to be deleted from credit files after receiving paymentsIf they don't comply with what we want I'm contacting the Attorney General office as least they are getting their money and the checks are old

to a returned check written by *** ** *** * *** ***, LLC*** Auto Parts #***, *** * *** Tire, Inc., and *** *** are all under contract with Payliance to collect on returned checks made payable to the businessesEach of these businesses has a returned check policy notice posted stating any returned checks are subject to a return fee and may be electronically re-presented to the check-writer’s bank accountSince 2011, Payliance has received a total of returned checks written by *** ** *** * *** ***, LLCCurrently, checks/accounts remain outstandingIn October 2015, several accounts belonging to a *** *** *** * ** Service were erroneously tied in with the volume of accounts belonging to *** ** *** * *** ***, LLCLater, on August 10, 2016, the check-writer called the Payliance Collections Department and requested statements for all the remaining outstanding accountsWhen the Payliance Representative generated the requested statements, some of the incorrect accounts belonging to *** *** *** * ** Service were sent along with *** ** *** * *** ***, LLC’s actual remaining accountsOn November 9, 2016, *** from *** ** *** * *** ***, LLC called Payliance concerning the August 10, notices she had received for *** *** *** * ** ServiceIt was during this conversation that it was discovered some accounts belonging to *** *** *** * ** Service had been mistakenly tied in with the accounts for *** ** *** * *** ***, LLCUpon termination of the call, the Paylianc e Representative disassociated the *** *** *** * ** Service items from the volume of *** ** *** * *** ***, LLC accountsPayliance has since researched the matter further and confirmed that none of the payments sent in from or re-presented to *** ** *** * *** ***, LLC were applied to the erroneous *** *** *** * ** Service accountsIn the complaint the check-writer also alleges they had previously paid the balance for a check #*** directly to the original creditor, *** * *** Tire, IncOn November 8, 2016, the check-writer called the Payliance Collections Department to claim that account #*** for check #*** had been repaid and the check-writer was disputing the remaining $balanceThe Payliance Representative informed the check-writer that *** * *** Tire had recently informed Payliance of the check-writer’s payment for the original face amount of the check on November 8, and the remaining $balance was the result of fees incurred on the accountWhen the check initially returned on November 28, 2012, a $state-allowable returned check fee was incurred and an additional $return fee was incurred on December 20, due to a non-sufficient funds reversal of a December 14, arranged ACH debit payment authorized by the check-writer for this account (creating a total of $in fees for this matter)As a courtesy, Payliance has waived the incurred fees for account #*** and the account is currently paid-in-full with a $balance remainingAlso, during the November 8, conversation, the check-writer was incorrectly informed that *** ** *** * *** ***, LLC had a total of outstanding accounts remainingDue to the presence of the erroneous *** *** *** * ** Service, this number was not correctUpon the disassociation of the *** *** *** * ** Service accounts, the total number of remaining accounts belonging to *** ** *** * *** *** which remain outstanding is (accounts concerning *** *** and accounts concerning *** Auto Parts #***)As outlined above, Payliance had previously committed an error by tying accounts belonging to *** *** *** * ** Service with the check-writer’s accountsPayliance has since rectified this error and have verified that none of the check-writer’s payments were applied to accounts belonging to *** *** *** * ** ServicePayliance has also generated notices to Equifax, Experian, and Transunion to ensure the *** *** *** * ** Service accounts are not reporting to the credit history for *** ** *** * *** ***, LLCCurrently, Payliance is compiling statements/receipts for all of *** ** *** * *** ***, LLC’s paid-in-full accounts for the check-writer’s recordsDue to the large volume of accounts involved, we ask that the check-writer please allow Payliance up to business days to complete this process

The Debt Collector establishes a letter sent, but "No Certified Receipt." This letter was never sent nor received Furthermore, there is "No Evidence" to establish a copy of any "Returned Check." There is "No Evidence" that supports this alleged debt, other than, "Hearsay." Failure to comply to Federal Laws and remove the "Negative Comment" from the Credit Bureaus will be further reported and escalated to the appropriate agencies

authorizing Payliance to collect on returned checks made payable to *** *** *** #***The *** *** *** #*** location has a returned check
policy notice posted at the point-of-saleThis policy states that any returned
checks made payable to *** *** *** #*** incur a state-allowable return
check fee and are subjected to an electronic re-presentment process via an ACH
debitFor each check, Payliance will attempt to debit the face amount of the
returned item up to two times and the incurred returned-check fee up to three
times
Collection notices and check images for each account were
mailed to *** and *** at *** *** *** *** ** ***
on June 11, 2015, June 26, 2015, June 29, 2015, and on June 30, Letters
of validation for each account have been mailed to Ms*** today, July 6, 2015,
to the *** *** *** address associated with Ms***’s complaint and
her accounts have been updated to a disputed status to prevent any further
phone calls from Payliance regarding this matterIf Ms*** believes these
accounts are the result of fraudulent activity, mistaken identity, or banking
error, the validation letters explain the steps and documentation required to
clear the accounts from her name

if I am not showing in their system then why would ***'s deny my checkI don't feel that their system should in any way be able to flag me if they have no record of me every writing a bad check
I want something mailed to me in writing from Payliance advising that I am not in their system

I am also contacting Payliance today with additional information so that they can advise me on who has me flagged
