We are in receipt of your letter dated June 13, 2016 regarding [redacted]. [redacted].Mr. [redacted] enrolled in a "No Commitment No Enrollment 59.00 a Month' membership on our Web site on January 11, 2016. The "No Commitment" refers to no set term or open term for the membership in contrast to the "12...

Month" term which is the only other membership offered on the Web site shown as - "12 Month No Enrollment Only 49.50 a Month". "No Enrollment" refers to no enrollment or upfront fee. (See attached for Web site offering page)This is clearly indicated in the membership agreement (see attached) which Mr. [redacted] signed electronically that reads (see attached):Plan Name: No Commitment No Enrollment 59.00 a Month Agreement Term: Open Schedule Frequency: MonthlyAS indicated above, Mr. [redacted] purchased a membership with an open term, not a 30 day term. The agreement clearly indicates under Recurring Payments that the First Due Date is 2/11/2016, Payments are $59.00 and Frequency is monthly.All of our membership agreements contain cancellation provisions, for both the No Commitment and 12 Month memberships. Paragraph (J) of Mr. [redacted]'s membership agreement clearly states:You may cancel your month-to-month (open) membership upon providing a 60 day notice to [redacted] Services, Inc. P.O. Box [redacted], Sherwood, AR 72124. Payments will have to remain current throughout the 60 days.The earliest record we have of Mr. [redacted] requesting to cancel his membership is March 3, 2016. The request was not processed as Mr. [redacted] owed dues that were billed on February 11, 2016 when Credit card charges were declined. Mr. [redacted] was informed several times afterwards to contact one of our representatives to cancel. Mr. [redacted] eventually cancelled his membership by phone with the manager at our Queen Village location. In total he paid $118.00 in membership fees - $59.00 upon enrollment and S59.00 at cancellation - which approximates the amount due from the time of enrollment to thetime when we first received his request to cancel. He was not charged for dues for the 60 day cancellation notification period.Mr. [redacted] indicates he is willing to pay for the first 3 months of the membership - he was only charged for 2 months. We believe this approximates the billing adjustment Mr. [redacted] was requesting.We do not believe that our advertising is deceptive in any way and is supported by appropriate detail in the membership agreement itself. All members enrolling on our Web site are required to check/click on boxes to: 1) agree to the Terms and Conditions of the agreement 2) read and agree to the Note of the agreement - before finalizing the agreement (see attached for Web site enrollment page). Mr. [redacted] indicates he should have read the contract (membership agreement) more carefully. We agree and believe that the terms of the membership and cancellation provisions are clearly stated. We believe that we have complied with the terms of the membership agreement that Mr. [redacted] signed.Please let me know if there are any questions or need for additional information.Very truly yours,Dennis R. I have reviewed the response made by the business in reference to...

complaint ID [redacted]. While they say they have removed me from their mailing list, I have no way to verify this is true at this time. I also had to find Sweat Fitness' direct support email address in order to even get a response from them. If I receive another mailer from them I will submit another complaint. I do not trust that I have actually been removed from their mailing list so only time will tell.

[redacted]'s last contact with the company was today - Feb 7 -  as indicated in the complaint, at which time his email was removed from our membership database (before receipt of Revdex.com complaint).
