I believe you misunderstand the services that we provide. We do not service your student loan; we prepare the paperwork and submit on your behalf for consolidation. This service was provided as agreed upon. Part of our service is to provide years of recertification. Per our
records, we show that you completed the re-cert on your own prior to your 1-year anniversary. Our records also indicate that you contacted us after you completed the recert and asked us to resubmit because the payment you were given was too high. We received your updated POI and resubmitted on 2/19/with additional information submitted once your was received. Your shows an increase in your earnings, therefore the recert could come back with a higher payment. Our records indicate that you are currently working with our company (as recent as 3/13/18). I believe your initial complaint is now moot

I believe there still remains some misunderstanding.  You were originally approved by the servicer (not Performance Settlement) for a REPAYE (pay as you earn) repayment plan.  As the title states - pay as you earn - if you earn more income, then your payment will increase.  Our records  indicate that the higher payment of $133 was an outcome of you doing the recertification on your own - and that you contacted our company on 12/14/17 to request that we submit your recert again for you - which we did not due to 1) you had already submitted, and 2) we would have garnered a higher payment as well since it's all based on your earnings.  Your loan servicer, [redacted], determines the payment amount based on your proof of income - Performance Settlement does not.  Performance Settlement provided the service that we guaranteed.  Please see attached quote that was provided to you in January of 2017.

Performance Settlement does not have access to wire funds from a client's account. A third party trust account provider is used and only debits a client's account in accordance with the terms outlined in the contract signed by the client. Robo dialers are not used as a telemarketing tactic for...

Performance Settlement and all outbound call campaigns used within the organization are to actively enrolled clients. Our telephone systems provide an option to opt out and remove clients from our call lists in order to minimize the amount of communication that takes place with the client.

The response is clearly a canned and templated response.  The Business does in fact use auto dialers.  I have the recording of the call that proves that fact without a doubt.  Further, the Business violates 47 USC section 227 of the telephone consumer protection act by calling my cellular telephone which is registered on www.donotcall.gov.  Anyone can easily verify my number is a protected number to going to said web page, typing in my number and click confirm.   The Business has made a false and completely untruthful response and reply to my complaint.  I have had a personal, first hand experience and my statements are made from my own personal knowledge.  Additionally, I have third party proof of each fact. The Business should be downgraded by Revdex.com as a result of their illegal business practice that violate federal law (Title 47) and CA state law.  The public needs to know how this business operates in an unlawful manner.  My privacy was invade against my will and in violation of the law by the Business.

the accounts that you have enrolled in the program, and we have consistently provided monthly updates pertaining to your account.   It is the client’s responsibility to make the monthly payment in order to fully payoff any negotiated settlements and ensure the settled debts are paid off to be successful in the program. In recent weeks we have been unable to reach you to resolve issues with your trust account. If we are unable to resolve the current banking issues you risk losing any active settlements that are in place. Our number one goal is to see you successfully graduate the program debt free. Thank you for bringing your concerns to our attention and pushing us to constantly provide better service. If there is anything else we can do to address your concerns, please let us know.

So far everything is going well. At this time I would recommend them to anyone.

on her account as of our last email correspondence  on 9/15/17. [redacted] is the current collector for the client’s [redacted] account that was originally negotiated back in September 2016. [redacted]t [redacted] Services acquired [redacted] and all payments are still being honored through the current settlement.  The final settlement payment will be sent on 10/10/17 to pay off the final balance of the negotiated debt. I’ve attached a copy of the settlement letter for review. A settlement for the [redacted] One account was negotiated for $731.52 in February 2017. The settlement was voided at the client’s request.  The [redacted] One account cannot be marked as satisfied as we did not honor the settlement agreement with the creditor. At this time, the account remains delinquent and we are unable to satisfy the account unless re-negotiated with the client’s approval. At this time, we have removed the [redacted] from the client’s account as requested.

Once I got noticed that my payments was going up if I didn’t recerf. For days, week I tried to contact your company with no success so I call the dept of education for help and was informed that I may have gotten scammed by your company. So I recerf myself. Now I no that I wasn’t scammed, I asked your company to recerf on my behalf. Please understand my income hasn’t changed that much to increase my payments from 14.25 to a 133.00. I was guarantee a payment of 14.25 a month for 270 months and remaining balance forgiven I understand it may increase because of my income but not that much. I just won’t what was sold to me by your company, and your company can’t hold up the agreement, I need a refund, but I really need a low student loan payment.

They were the best company to deal with my problem. Very friendly and helpful people with whom I ever dealt with. They solved my problem quick and efficient. I would highly recommend Performance Settlement.
