We bought a townhome (4 plex) from this company in June of 2015. Before we moved in, we voiced our concern that we could HEAR the neighbors through the common wall. (their TV, their dog bark, them cough and talk). When we brought this up to the company's realtor, Beth ***, she said that once our unit was totally finished and the carpet and flooring installed, that we would not be able to hear anything. Once we moved in, we continued to hear the neighbors (their TV, dog, talking, banging). We talked to OUR realtor and he tried to get a meeting set up with the neighbors and Beth ***, but Beth said that the neighbor's realtor did not want to do this. We found out from the neighbor that this was not the truth. We then contacted the owner/builder, Roger Merrick. He and his partner came to our house and also next door, but said THEY could not hear anything. We have gone to Elk River City to try get them to help.....they just give us excuses. This common wall is not made correctly. The first neighbors moved and we have a new neighbor. He lives there ALONE, and plays his music and TV so loud we can FEEL the noise. We hired an insulation company (paid over $800) to come in and blow insulation into the wall (their advertising said it would reduce sound). IT DID NOT, AND THE NOISE IS WORSE. The insulation guys said that the common was not built correct in some areas. We are tired of the noise. We are tired of Roger giving us excuses and we are really amazed that Beth *** can LIE to prospective customer and still have a job. We were told by a new neighbor down the road that Beth lied to her about her townhome also. This builder is terrible and should not be building townhomes. We had 25-28 things wrong with our townhome when we moved in. We had to fight to get them to fix anything. We have heard he is building in another area. We don't want any other people to get taken like we did.

I am rejecting this response because: It is full of "lies". I will explain in this response. The one truth there is that we have voiced many complaints in the last 3 years. We bought this townhome NEW, before it was even finished (no flooring, was not painted, no cabinets, etc.). The builder's realtor told us MANY things during the course of the finishing, that were lies. The builder even had to pay us back money because she lied to us about the water softener. When we would voice a concern or complaint to the realtor, she would act like we were complainers, like the builder is also stating. She at one point, told us we were NOT ALLOWED to come to look at our townhome while it was being finished (she also told a new buyer the same thing a couple months ago as the new buyer was not happy with some things). We had, in our NEW townhome, over 30 issues that the builder had to fix. i.e. all appliance had to be repaired in the first 6 months, we had a "flood" in our kitchen and bathroom, when the NEW valves broke, circuits break to this day and the electric company has been there 4-5 times to TRY fix it. We had over 200 NAIL pops that the owners son had to come and fix (and the son said he has NEVER seen that many), air conditioner broke down 2 weeks after it was installed. The sheetrocker taped the corners rounded, instead of squared. We were told by the realtor that our cabinets were BLACK, which we wanted, they were not...they were brown and cheap. Our driveway chipped and cracked and it took over a year for the builder to finally fix it. (yes the builder has fixed all these things, but 30 plus issues is very excessive for a NEW townhome). I could go on and on, like I said over 30 issues with our NEW townhome. BUT, back to the wall issue. Roger (the builder) and his associate DID come to do their test. I did go to the neighbors and TRIED to get them to make noise. The ASSOCIATE just sat in a chair and hardly said a word. The neighbor did not cooperate either, (his wife was not home and she was NOT very happy with her husband for not cooperating). AND, "Mr. Perkins" did NOT jump up on the couch and put his ear to the wall and say "I can hear them". Our complaint is about hearing the neighbors from the middle of the room not against the wall, and "Mr. Perkins" had surgery on his knees and can't "jump up on the couch". The builder did have the insulation guy come and put insulation around the plug ins. IT DID NOTHING. WE paid over $800 to put insulation in the entire wall - front to back, and it did nothing (oh, and by the way, the insulation guy was up in the attic and said the wall in the living room area is NOT made right). It's funny....in the builder's letter to the Revdex.com, he states "each unit has its own separate wall with a one-inch air space". HIS REALTOR kept telling us it was a 4 (FOUR) inch air space, and I believe the builder has told us that also. So which one is the truth?????? Industry standards should include the rule that a neighbor should not be able to hear their neighbor go to the bathroom through the bathroom wall, which we can. We have to have a fan on continuously to drown out the noise from next door. The builder stated he offered to buy the townhome back, unfortunately, we really do like the layout of the townhome and we LOVE our view, and no we would not "dream of moving" since it was suppose to be our last and final move. I doubt this builder would pay us the "going price" on our townhome, which is about $60,000 more than we paid for it, pack all our stuff and pay for movers. Plus, we are NOT going to move. This townhome was NOT built with the best design. It was built with a cheapest design. We have lived in townhomes where the common walls were cement and we NEVER heard our neighbors. We have had MANY friends and workers in our home who have heard the neighbors, and cannot believe we can hear that noise. So if the industry standards are what this builder says, then Minnesota's industry standards need to change so that builders HAVE to build soundproof walls. We have talked to our neighbor about this also. We are hoping he will send a letter to the Revdex.com also. I know he is unhappy with many things in the townhome he bought from the first buyers. Lastly, I know this will NEVER be resolved because all the builder wants to do is call us complainers. We have had to fight him to fix anything. BUT, I really do not believe that this builder, Washington Street Investors, should have an A+ rating with the Revdex.com. They are NOT even a B.
