There is absolutely nothing altered on the merchant application and I take issue with your continued belief that anything we have done is unprofessional. I take exception to your continued accusation that anything was altered and would be happy to present our documentation in any court in this country as well as let any expert examine the signatures.  You processed for 2 years without a single complaint but due to the fact that you do not want to pay a cancellation fee you continue to try to discredit Platinum Choice Bancard.  Please govern yourself accordingly before you accuse someone of something they did not do..and again you are probably a friend of the agent who violated her contract with us and are simply being used as a pawn in a lawsuit.

That is fine. I stand my ground also and will notify my attorney to proceed I have done everything I can to have this situation taken care of before I went to my attorney to have it solved... you said in one of your remarks that I just don't want to fulfill the contract... I would not have signed up if that was the case....  I knew I was paying way more then I should to accept credit cards and I was fine with that....I was not good with being mislead,  customers being double charged and not getting the funds next day.  Also being told it would work with quick books...  in the future I would suggest to be honest with customers and you would not find yourself in these situations...

Merchant never accepted credit cards before and we have no way of knowing where his credit cards will fall on interchange. This merchant is priced at interchange plus with minimal volume.  The agent gave him a baseline of where he thought his cards would fall but it is an impossibility to...

determine when you have no previous card types to refer to. Platinum Choice Bancard does not determine where the cards will fall, that issue is with [redacted], [redacted], [redacted] and [redacted]. The terminal did have some issues which were corrected as soon as we were notified and this was a software issue, not an issue caused  by Platinum Choice Bancard.  The merchant could have issued a refund immediately to his customers had he requested to do so. As soon as merchant notified us that two duplicate transactions were processed it was rectified within 2 days. On 1/5 merchant notified us that there were 2 duplicate transactions. Per our notes below you can see this was rectified for the merchant within 2 days.3:05pm on Thursday Jan 7th, 2016 [redacted] Called [redacted] to check on two refunds for merchant from 1/5/16 (1st for $80 / 2nd for $3,263.40. Confirmed that both refunds did go thru, and called [redacted] at [redacted] with information. Merchant has signed a contract, has used the terminal in the months of December and January. Merchant also entered into an agreement with [redacted].  [redacted] records every call to phone clear a lease and are very specific in their contract and in their verbal verification so there is no misunderstandings between them and the merchant on the lease.  I have attached the contract with Platinum Choice Bancard and with [redacted] that was clearly signed by the merchant. Platinum Choice Bancard has done everything possible and is holding the merchant accountable to the contract that he signed.

I am rejecting this response because:What about the misrepresentation that clinton said in order for me to sign. I am not paying 69.95 a month that I agreed to. it's actually over 100 a month.  no one called me to inform about the refund I called due  to my customers calling me to find out what's going on...it is an illegal business practice to bait and switch or misrepresent in order to get a contract signed...if the machine was actually fixed why was I not notified?

No where on the application or contract does it state that anyone told this merchant it would be $69.95 per month. A contract is a written agreement, not something that someone allegedly told him.   Nor is that even a possibility considering it is all dependent on how much volume in credit cards a merchant does and the card types they accept.  As stated previously, this merchant is on interchange plus pricing, which is the least expensive way to price a merchant.  There was no misrepresentation.   When the merchant called about the refund as he states, it was handled immediately for him.   This merchant just does not want to abide by the contract that he signed.

I would suggest talking to clinton before making those statements...  you are not the even answering all the questions. So I have already talked with my attorney and they said there former partner is now with the consumer fraud department of the attorney generals office and has won many cases just like this one in the past. So if all you want to do is keep coming back with partial answers and do not want to accept fault that's is fine I will have my attorney proceed with what they feel is necessary..

We stand our ground completely.  All the rates are written clearly on the contract.  There is nothing further to discuss.

Review: I called Platinum Choice to let them know that we would be using another Credit Card Processing Company. They informed that they had a $495.00 cancellation fee. I asked if they would waive that because we were leaving them because of a law suit they were having with the Rep that sold us on using them, and the way it was handled.( very poorly and unprofessionally) When I asked for a copy of the contract that said we were committed until 2016, I noticed that it was signed by our old Office Administrator, not our President, and next to her signature it was altered adding she was a "Director". All of the other Contracts were signed by our President and Managing Doctor. I believe this is not ethical. When I asked for the cancellation fee to be waived, they said "absolutely not".Desired Settlement: I feel they should waive our $495.00 cancellation fee.

I am sorry to hear that you are not happy. It appears that you have some hidden agenda that you are not disclosing to us. We do have a lawsuit going on with this agent for stealing accounts and putting them with another company which is a violation of her contract with us. This has absolutely no bearing on your merchant credit card processing account. The agent brought on your account and she set your rates. We simply called your company to advise you that due to these circumstances we were going to reduce your rates dramatically and offered your company a savings of over $400.00 a month in processing fees. We did this so the agent would not benefit financially by trying to move your account and make any money on it should she be successful in talking you into moving. Your company would be the winner in this situation financially. This lawsuit has absolutely nothing to do with you or your company, has had no bearing on your processing abilities and your company has incurred no hardship whatsoever. Your company has been processing with us since September 2013 without any issues. No one has called in 2 years of processing to say an unauthorized person signed this agreement. In 2014 your terminal died and we immediately overnighted you a new terminal at no charge. To file a fraudulent complaint with the Revdex.com should be illegal. It appears that you and the agent might possibly be "friends" and are trying every way to have her move your account without incurring any fees to terminate your contract which ends in 2016 and to put a blemish on Platinum Choice Bancard's name. Finish out the term of your contract and you can leave without incurring any fees whatsoever. If you choose to leave before the end of your contract you will be charged a termination fee as stated clearly in your contract signed in 2013. Platinum Choice Bancard has a A+ rating with the Revdex.com and we will not allow you, with your hidden agenda, to affect that. We pride ourselves in offering the best customer service, integrity and honesty with all of our merchants.

I have sent Platinum Choice our letter stating we are leaving the contract, and have asked them to waive the cancellation fee. If they continue to refuse to waive this fee, we will pay it, but wanted it known we are paying it under protest.
