[redacted],A second RMA was issued to Mr. [redacted] on July 15th for replacement of the defective memory modules.[redacted]

Complaint: [redacted]
I am rejecting this response because:
The products were purchased within one year according to the manufacturers warranty. We were able to provide a receipt from the customer regarding these products.PNY is unwilling to offer exchange on these products. We are not accepting this response at this time. We would like PNY to simply replace the affected products ASAP.

I have just been made aware of this complaint.  Please allow me time to research the alleged issues in the aforementioned complaint.  We will respond with our findings.Thank youHeidi S[redacted]TreasurerPNY Technologies, Inc[redacted]

I am rejecting this response because:
PNY has notified me that they are processing two of the rebates. This is good. However, there is a third rebate claim that I...

am disputing. When tried to enter all three numbers in the body of your form a message informed me that I should not include any personal information (like SS numbers) and therefor didn't allow me enter those claim numbers there. I had to enter them in another field but here was insufficient space there to include all three numbers. I could only enter a partial number for the third. The number that was missing is [redacted] another $40 rebate.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is satisfactory to me.

PNY is more than willing to replace any ”defective” memory modules if the conditions for warranty replacement are satisfied.  Mr. [redacted] will need to contact PNY technical support, provide a receipt from an authorized reseller, and then willreceive an RMA for replacement. A reseller is authorized if there is a formal business agreement between the reseller and the manufacturing company. What is meant by business agreement is the manufacturing company's acknowledgment that bulks of its products will be bought and resold by the reseller. Inside this same agreement is a set of privileges, benefits and other corporate assistance thatthe manufacturer will provide to its authorized reseller throughout the course of their business contract. If Mr. [redacted] would like a refund he would need to contact the place of purchase. PNY will replace defective product not issue a refund.

Dear [redacted]PNY did issue an RMA to [redacted]) for a Micro SDHC Card part number P-[redacted]. The part was received via [redacted]  cut in half (see attachment).  PNY Technologies, Inc. ("PNY") expressly warrants the product to be free from defects in materials and workmanship...

for a period of 1 year from the date of sales receipt as sold to the original purchaser ("purchaser"), subject to all the terms and conditions hereunder. This warranty is not assignable; products purchased second-hand sources are not warrantied by PNY. PNY also indicates via e mail that it is not responsible for lost or misdirected or damaged mail sent via [redacted] send the product via [redacted] which may have resulted in the damage. [redacted] should contact the local post office to file a damage claim with them. PNY did send the product back as received because it was deemed to not be caused by a manufacturing defect.Marinus W[redacted]

Review: Complaint Description:

$10 rebate form I mailed May 29, 2014 never has been satisfied. Rec'd email from their rebate provider saying- approved on 06/18/2014 but never got check. Now, if they promised rebate, they need to send check to me because it was approved but not satisfied.Desired Settlement: I would like my $10 rebate, and an apology for the 2 phone calls I used trying to get a human on the phone and 2 emails that went nowhere. Thank-You, Revdex.com!!

Review: I purchased a product that was advertised as having a lifetime warranty. On the manufacturer (PNY) website there is no mention of registration in any of RMA pages. It was only told to me when I finished filing an RMA request that I had to register the product within 90 days. The RMA webpage and the fine print are therefore at odds and suspicious in that no need to register gets to the consumer until they attempt an RMA. This combined with an email exchange in which PNY blamed the vendor even though they themselves were able to benefit from it. I thought for a moment they had updated their warranty advertisements but I was mistaken.

It is worth noting that every competitor of theirs advertises similar warranties without a requiring a registration that has a time limit. What they are doing stands out without them ensuring that the consumer knows they operate differently. Also worth noting is that I never had a chance to see the box until after the purchase.Desired Settlement: I would like an extension to the registration period so I can get the original lifetime warranty and have my card repaired. Barring that I would be fine with a 3 year warranty equivalent to the lifetime warranty. The card is still less than 2 years after purchase. I would also accept a replacement card that was off warranty. Allowing me to go with one of those options is reasonable considering I can prove I am the original purchaser of the card. Most importantly there is no legitimate reason they can give for why they should not be willing to honour a warranty due to paperwork that I am perfectly willing to do right now.

Business

Response:

Dear [redacted]PNY gives a warranty to the purchaser stating that a product is reliable and free from known defects and that the PNY will, without charge, repair or replace defective parts within a given time limit and under certain conditions. One of the conditions for the extended warranty is that the product must be registered within 90 days of purchase. We can find no registration information under any information you provided, so the warranty period defaults to 1 year. While PNY will continue to support you in trouble shooting the video card, we cannot proceed with a replacement as it is no longer covered under warranty. This information is on our web site [redacted] The product warranty ended 9/11/2012 and PNY will replace product that is under warranty. [redacted]

Review: [redacted]

I am rejecting this response because: Scams and disreputable business practices are often perfectly legal in a strictly technical sense of the word. They often work by misrepresenting something that is described only in the fine print. That is what has happened here. The way vendors have been allowed to falsely advertise their products aside their RMA procedure has a checklist that does NOT have registration anywhere on it. The application process itself does not mention registration. This is completely at odds with the reality and they should take responsibility for this deceptive marketing. Almost all consumers have to rely on important points of fine print being mentioned elsewhere (especially on their website RMA process checklist). If this business wants to get anywhere with resolving this they have to stop giving the same excuses a scam artist would give. Fine print that includes important details (1 year vs. lifetime warranty) not at least hinted at elsewhere (especially not mentioned on the RMA checklilst and submission pages) and is also completely at odds with industry standard for graphics cards is dishonest and shameful business practice.

Review: I purchased a set of RAM from [redacted] which turned out to be defective. I went through the process of submitting an RMA request, and eventually got a replacement pair, however one of the sticks of RAM in that pair was also defective. I have attempted to contact the company twice by using their online form, and have yet to receive any response.Desired Settlement: I simply want what I paid for, without having to pay for a 3rd time to ship back a defective product.

Business

Response:

PNY is very sorry for any inconvenience this may have caused. It seems we missed the e mails requesting an RMA. PNY has reached out and issued RMA [redacted] for a replacement.

Review: 8Purchased a two pack of what are labeled as PNY 2GB memory cards from [redacted] in early September 2015. Have been trying to get them to work in a guitar amplifier that will only use 2GB maximum size cards. Have since discovered that these cards are mislabeled, and are in fact 4gb cards. The part number on the back of the cards actually show that they are indeed 4GB. Found numerous complaints on [redacted]'s site as well as numerous forums about this exact issue. Contacted PNY via email, and was told that since I no longer have the receipt or packaging, they will not replace their product which they falsely advertised as 2GB.Desired Settlement: I paid for 2GB memory cards, and I would like PNY to replace the falsely labeled cards at no expense to me.

Business

Response:

ranty service PNY requires the proof of purchase which is defined as an invoice or sales receipt. The full warranty policy can be found on our web site. In the case of Mr. [redacted] we require the receipt because 1st it is policy and 2nd if we cannot replace with "genuine" [redacted] cards we will issue a refund. The receipt will indicate purchase price and give PNY the refund amount. without this receipt we cannot proceed.

Review: My RMA number is [redacted], and this is regarding a [redacted] I purchased this on 11/23/2014 from [redacted] and I still have the invoice, and I am covered under warranty. The device just stopped working, and I can't get it to charge my phone, and none of the lights come up. I received the RMA label, but I have to pay to ship the item back to you for a replacement which is unacceptable. Companies should take responsibility for a faulty product and cover shipping both ways.Desired Settlement: I should like you to send me a prepaid shipping label, and I will send the defective item to you. Then, I am expecting a replacement of the same item or better.

Business

Response:

Dear [redacted],Per PNY's warranty policy all shipping costs are the responsibility of the customer. PNY will pay for shipping the replacement product. Below is the relavint portion of the warranty policy. The entire warranty policy can be found at [redacted]

The consumer is responsible for all shipping costs. When shipping from outside the United States this will include freight, duty, customs fees and taxes. All pricing is in USD. [redacted] Manager, PNY Technical Support

I am rejecting this response because it is unacceptable that a company would charge the customer to ship the product to therm, even though it is PNY's fault for the faulty product. I'm expecting you to cover the shipping both ways.

Response:

[redacted],As was stated in our previous response it is the customers responsibility to pay for shipping to PNY. We understand [redacted] concern however that is our warranty policy that is applicable to all.[redacted]

Else I would have purchased [redacted] Warranty .. I'm out $200. I bought this from [redacted]n, who also will give me now warranty, on 24 August 2014 for $200. I have the receipt.Desired Settlement: I would like a $200 refund on Defective Solid State Drive from PNY ...

Response:

In response to the complaint from M. [redacted], PNY’s warranty is for a period of 1 year without registration. From the warranty web page

https://www.pny.com/File%20Library/Support/PNY%20Products/Warranties/Solid%20Sta... />
“PNY Technologies, Inc. ("PNY") expressly warrants the product to be free from defects in materials and workmanship for a period of 1 years (3 years upon registration) from the date of sales receipt as sold to the original purchaser ("purchaser"), subject to all the terms and conditions hereunder. This warranty is not assignable; products purchased second-hand sources are not warrantied by PNY.”We can find no registration information so a 1 year warranty is in effect.

Base on the receipt provide that warranty ended August 22, 2015.

I’m sorry but, PNY does not replace out of warranty product.

Review: We are one of the leading car DVR companies servicing 90% of all taxicabs, limos, and paratransit vehicles in the Greater San Francisco (and Bay Area). Our camera system can be found in many cities in the greater 50 states, but predominately in San Francisco, Chicago, Los Angeles, and Anchorage Alaska. As a car dvr company, our company relies heavily on the storage media to capture all events and evidence for insurance claims, legal claims, criminal investigations, etc. Our company has been in positions where we had to testify in court based on the evidence presented. It is extremely crucial to have a source of reliable media storage. We started purchasing SD cards and USB storage sticks back in November 2013 until July 2014. Our company has spent over $112,852.00 in PNY products only to find that a lot of products are defective and unreadable, more specifically the 64GB SD cards, 64GUSB sticks, and 8G USB sticks. To date, we have:

1) 339-- 64GB USB stick

2) 318 -- 8G sticks

3) 194--64SD card

Totaling 841 defective units our customers have returned, and with more coming in everyday. As a CEO, I do not want to be in the middle of a lawsuit claiming that footage was not captured on a PNY SD card.

I have been exchanging emails with Colleen O[redacted] (OEM Inside Sales Manager) since 11/2014 and was told that she will get back to me and let me know when a refund can take place, however every time I called or emailed, I was told that she has yet to talk to her manager or that he is away on a business trip. It has been 3 months and I have not heard anything from them. A conference call was set-up in December to talk to the manager (Steve K[redacted])and he said he would look into the matter. My emails and messages are being ignored, leaving us in the hole with $17,229.00. Not only that, we are losing money as a company providing replacement cards to our customers. At this point I am demanding a refund.Desired Settlement: I would like to recover the cost of the defective merchandise in the amount of $17,229.00 sitting in our warehouse.

I am rejecting this response because:1) We have been trying to resolve this issue with PNY since 11/2014 and have been given the same answer: they need more time to look into this, the decision maker is out of the office/out of town etc. It has been 4 months and we have not received any kind of response. All emails, calls, messages are being ignored.2) If the key person is out of town, when will he or she be back and when can a decision be made? I am looking for a definite date.

Review: I purchased my video card on amazon 2 years ago. It has a 3 year warranty on it yet when I contacted PNY for an RMA the only response I was given was

ME-March 19: Filed warranty claim.

THEM-March 20: This video card is out of warranty - [redacted] @ Technical support

ME-March 20": ? It has a 3 year warranty how is it out of warranty? Also thats it PNY just says to its customers sorry not our problem? Pretty crappy if you ask me.

9 days no response

ME-March 29th: it has been over a week with no response. My card is not out of warranty as it has a 3 year warranty on it. So could you please elaborate?

THEM-March 30th: Only if it was registered - [redacted] @ Technical Support

ME-March 30th: You never even asked for the serial number so how would you know it wasn't registered? I am reporting this entire email chain on AMAZON.com and Newegg.com reviews. You guys are obviously just being shady and I will be filing a claim with Revdex.com over this obvious very unprofessional manner in which you guys are conducting business.Desired Settlement: I want my graphics card repaired or replaced. The manner at which this business conducts itself is unbelievable. I have tried to ammicably resolve this with them but they are unwilling to honor the terms of my warranty. Next I will be filing a claim with my state attorney general if this isnt resolved

Response:

Dear [redacted]Mr Economos has a video card that has a 1 year out of the box warranty with an addition 2 years if registered. PNY Graphic Card Warranty *One year (plus an additional 2 years upon completion of a registration form on PNY's website) LIMITED 1 YEAR WARRANTY* PNY Technologies, Inc. ("PNY") expressly warrants this Graphics Card (product) to be free from defects in materials and workmanship for a period of 1 year (*plus an additional 2 years upon completion of a registration form on PNY's website ) from the date of sales receipt as sold to the original purchaser ("purchaser"), subject to all the terms and conditions hereunder. Product must be registered within 90 days of purchase date. This warranty is not assignable; products purchased second-hand sources are not warrantied by PNY. We can find no record of the registration based on name, address, e mail, phone number so the claim for RMA replacement was denied. When registering the customer is sent a conformation e mail with a confirmation number. If [redacted] has this e mail and can provide the confirmation number we will be very happy to assist in the replacement of the video card. Based on the information PNY has at this time, we cannot issue an RMA because the product is out of warranty.[redacted]
