Review: I bought a car from public 3.5 months ago and it has broke down 4 times in that period now I have called them 10+ times in a couple of days and they keep telling there general manager will call me back and no one ever does. It feels like they are just avoiding me and ignoring the situation. I live 140 miles away and I have to drive there every time they is a problem and those miles from my house and back put me over my warranty. Because of that I had to pay the last time the car broke down and would start. Also no one in the store seems to give a dam about there customers at all. I also checked on yelp and even before I got to there home page there was a headline or search and I came up santa ana scams and this business was at the top of the list. I really hope you can help me with this situation .Desired Settlement: Pay of remaining balance of car

Consumer purchased mentioned vehicle on 4/25/14 with 115,172 miles. The last repair visit mentioned by the consumer was for a non-warranty related repair. For this reason, the consumer agreed to pay for needed repairs. This repair was a lot less than his $300 deductible, and we waived the labor amount as a one time goodwill gesture. The limited warranty does not cover any tow or rental expense. Dispite this fact, at his first repair visit we provided a loaner as a one time courtesy.

Consumer has been assisted by [redacted] our service advisor, [redacted] our service manager, and myself. At no time have we intentionally have ignored to assist Mr. [redacted].

Consumer's limited warranty expired on 7/25/14 or at 3k miles from the mileage at the time of sale. At this time PM has no liability in the mechanical malfunction of the mentioned vehicle.

Review: In or around the first week of December I purchased a used vehicle from Public Motors. It is an auction house, but they sell cars during the week and auction on weekends. I paid with a preapproved check from my bank, Schools First Federal Credit Union. The first sign of trouble began immediately, about the time I had expected to see a registration card in the mail, the car's registration was due, I instead received a letter from the bank, informing me they had been denied title. Apparently, the odometer had been tampered with and it took three months to resolve this first issue. During this time I had most communication with the bank who worked to resolve this issue while I drove around town with expired tags.

The next problem is one that is now part of the ongoing saga. It has to deal with the warranty. The car failed on a drive through Costa Mesa. I managed to get to the nearest dealer, [redacted] of Huntington Beach, where I believed I could have my car worked on with my "everything but M warranty", m being maintenance. The serviceman who took my warranty information called to explain the warranty had not been filed and I needed to take it to the place I bought it from. I called Public Motors they came and picked up the car and had it fixed.

Then shortly thereafter, about 3 months, the car completely fails while I'm exiting the freeway. Again I take it to the dealer. The diagnostic is horrific. A complete engine overhaul required had anyone worked on the car recently? Why yes Public Motors! Take it back to them the mechanic may have goofed. Public Motors while not taking responsibility for the failure agrees to fix it, but not piece by piece they agree to get me a new motor. Two and a half months go by. Week after week I call them to get any word. Finally the car is fixed and I am on my way.

Three weeks later the check engine light comes on. This time I take the car directly to Public Motors. The mechanic will not have any time.Desired Settlement: I need to be refunded for the engine core of the car's motor I bought originally.

Consumer

Response:

The vehicle is 2010 Volkswagen Tiguan. The engine replaced by Public Motors is 2009. Their mechanics seem to take liberties with my car that result in diminished capacity of the vehicle. This is the second time a repair has gone south then south again. Where there has been good faith is now lack of confidence. I would like the refund amount to reflect a new factory motor and any refund on my warranty. If you need a number for those things I would say the motor is 6000 and the warranty new was 3000.

Review: I purchased a 2008 Hyundai Elantra from this dealership. At the time of the purchase, it was explained to me that the vehicle had a clean title, it hadn't been involved in any accidents. I was told there were never any insurance claims on the vehicle. 5 months to the date later, my insurance agent advised me that the vehicle had been involved in an accident just two months before I purchased it and that there was a claim on it for $3000+ dollars. If I had know this at the time I would not have purchased the vehicle. Knowing this now, I feel it is a safety issue for my family and myself to be driving around in this car without knowing the full extent of damages caused by the accident that was never disclosed at the time of purchase.Desired Settlement: I would like a different vehicle or my money back.

Business

Response:

At the time of sale and financing, our F&I staff provides the consumer with the DMV National Vehicle History/Title Pointer (NMVTIS). This DMV document discloses all title or accident issues pertaining to the vehicle. As far as DMV shows, the title is clean, has no insurance reports, or junk/salvag reports. By DMV regulations we provide this report to the consumer at the time of sale. The consumer signs the disclaimer agreeing to the report. At this time we are not taking any liability in any reports told to the consumer by different agencyies. We only rely on the DMV records provided to us. Unfortunately, at this time we are not able to by the vehicle back and refund our customer.

Warranty Solutions

7125 West Jefferson Avenue Ste200 Lakewood, CO 80235

Public Motors has violated my consumer rights by not adhering to the Used Car Lemon Law Bill Of Rights in conjunction with the Song-Beverly consumer warranty act with civil code section 1790. I paid full for a car and warranty at Public Motors. I have possessed the title of the car since the issue date if 3/26/14. I cancelled my warranty on 6/24/14 policy number [redacted] with public motors through warranty solutions. Warranty Solutions informed me that the dealer is responsible for my refund of $2,950 within a 30 day time frame they have fail to meet the Used Car Lemon Law Bill Of Rights in conjunction with the Song-Beverly consumer warranty act with civil code section 1790 requirements and would like a full refund for warranty with a 20% interest fee for treating me like trash avoiding my calls, driving my vehicle and falsifying my mileage documentation when they are suppose to be repairing my vehicle, and throwing out all my cars possessions from the date I purchased, they ask me to remove valuables but that doesn't give them the right to trash CDs, and car cleaning supplies that belongs with the car, and failing to comply with consumer rights.

[redacted]Desired Settlement: Repair vehicle & give 20 % interest fee.

Public Motors has assisted consumer in cancelling her service contract with Warranty Solutions. At the time of cancel. we provided consumer with the cancellation form which states a disclosure of how long the refund process can take. At this time, the cancellation process has been completed by the warranty administrator and pending for refund release from our accounting department.

Public Motors also assisted consumer in fixing her concerns related to her vehicle, despite the fact consumer cancelled her service contract.

At this time, we request that consumer waits for the refund process to be completed. Consumer may contacted me for updates periodically. The refund check will be issued within 90 days of the cancellation date.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted]nd have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Regards,

My vehicle is still not fixed after their second attempt. Public Motors warranty cancellation contract of this 90 days is in reference to financiers only which is connected to a lien holder, that does not apply to me, nor does their fraudulent contract going against California State Lemon say that 90 days is the process for all warranty purchases. California Lemon Law States the Dealer or Warranty company has 30 days to reimburse the lien holder. It took 30 days for me to received my pink slip therefore I am the lien holder, and owner. I have documentation of all of all my transactions and dealings with Public Motors including the repair form from the day I purchased the vehicle and the same reoccurring issue found to never have been repaired but rigged by the Audi dealership along with that a statement from Audi's service manager. Currently the vehicle still has the same issues and is in the shop now due to the same reoccurring issue they claim they had fixed after I cancelled my warranty, and I have that documentation as well. I have more than enough grounds to sue Public Motors for their negligence in never fixing my vehicle but rigging it twice, and all I ask was that they refund me my money according to the California State Lemon Law Warranty Policy not there own policy, because I am the vehicle's owner and lien holder, not a financier. I owe them nothing, nor have I borrowed anything from the company. The fact that a used car dealership does not want to abide by the used car law is completely asisnine and a violation of my consumer rights. If I have to wait 90 days for my warranty refund, I will want a full refund for the vehicle Public Motors nevered fixed, a long with my lawyer fees paid for because I will take this matter before a judge along with all the documentation and statements acquired.

Review: I purchased a car on 9/16/15 from Public Motors and was notified on 11/22/15 that the dealer went out of business due to unforeseen circumstances. The dealer failed to complete auto transfer from Arizona to California with the DMV. Even though I purchased the taxes license and registration as apart of my loan financing. This dealer has left me without proper registration and since I'm not on title since the title is still in Arizona I can't get the proper vehicle registration.Desired Settlement: I would like assistance to determine who took over possession of this dealer and all of its paperwork and cars. There surely must have been some bank who worked with this dealer. Who now owns this business and its cars? This is not fair to consumers that a business goes away and can leave the customers with no help. I would like to know what am I suppose to do to get the car registered in CA.

Review: This company somehow got my cell phone number and has been leaving recorded advertising messages every week for nearly a year. I have tried repeatedly to get off their call list and was told they would remove my number but they still continue to call...I was charged when they did this while I was overseas...plus I don't even live in California anymore!Desired Settlement: I would like for them to stop calling me!

Review: I bought a car from them under warranty and my car broke two days after buying it. They have yet to fix the car completely therefore the car is still in a shop and I have not had a car for 5 months. I bought the car 8/7/13 it is now 12/10/13. They have fixed part of the car but not finished or done the repairs needed on the transmission therefore the car is undriveable until the transmission has been replaced. The car blew up the first engine because the transmission got stuck in a gear while I was driving it on the freeway the day after I bought it, they put in a new motor but I no everything that is wrong with it because bmw has done three diagnostics on it. They are saying they haven't found anything wrong but I have proof something is wrong and it got stuck while I was driving it! The car has not been touched for over a month and is sitting in the shop. It's not my obligation to fix it as it is covered under their warranty. I'm lost on what to do I just want a car...Desired Settlement: I want my car fixed plain and simple if they do not fix my transmission I will have to handle this case legally.

Business

Response:

Miss [redacted]'s vehicle was not brought to our service shop for the transmission repair. She dropped off her vehcile to [redacted] for further diagnosis and repair of her transmission. [redacted] has followed all guidelines in submitting a claim to the extended service company for authorization on repair. The warranty company authorized the repair and has agreed to pay the max of $2500 for the needed transmission repair. Miss [redacted] has agreed to pay [redacted] for the difference of the repair.

Unfortunately, Public Motors could not have authorized the claim any sooner, as we are not the warranty company.

Review: Public Motors should be shut down! I purchased a 2006 Audi A6 from Public Motors on 2/28/14 in the hope of replacing another car that I had. I was under the impression from the dealership that this car was in excellent condition. 10 minutes after pulling off the lot the car had transmission issues. I called the dealer and they said to bring it back the next day so they could fix it. I took it in and the Service Manager said that they would fix it and I wouldn't be charged anything. It took them 31 days to give me an answer about my car that I purchased. The transmission was shot and the GM his name is BK told me they refused to fix it because of the cost. This was my car that I wanted but they wouldn't fix it. They tried to get me into an older car with more miles for the same price. What horrible ethics! He also told me that the car was there on consignment and that the owner was going take back the car (TOTAL LIE). During that 31 days I called and left messages for the service manager with ZERO calls back and to the GM who only called 3 or 4 times. I finally convinced them to give me my money back. When I got there they said the car would be ready tomorrow and I could pick it up (BIG LIE). What happened to it being on consignment. They then tried to make me sign a paper stating I wasn't going to speak of my experience..they had this happen before. I crossed that out very quick!!!! They also wouldn't give me a check but said it would be credited to my account 5 days and still NO MONEY!!!! Did they steal my money?!?! This company is ROTTEN they are all crooks!Desired Settlement: I still haven't received my $1,000 deposit! I am scared they are going to run off with it. They have horrible reviews online. Hopefully you can do something!

Consumer's credit card was refunded on 4/11/14 in his presence. We issued refund in the amount of $1,000 which was refunded to the card he provided ending in 7868. We have the merchant copy receipt which he signed in agreement to the refund. At this time we cannot expidite the refund process as the credit card compy would be reversing the funds.

Review: I purchased a vehicle at a dealership in Santa Anna California.

In the contract it included three insurances/services that I did not want. I do not speak or read english, the entire conversation I had with the Salesman was in Spanish. He explained to me the contract including the additional services and insurances that were optional to purchase, I told him in Spanish stated that I did not want any of the supplementary services/insurances. He had me sign a portion of the contract stating that my signature was to state that I have denied the services/insurances.

Apporoxmatly a week later I noticed that I was charged for those insurances/services. I went to the dealership believing this was a mistake and I wanted to clarify this issue. I told them that I did not purchase these insurances, I was then given three separate insurance documents that I supposedly signed for, up until that point I have never seen these papers. My own signature on these documents were forged.

I have returned to the dealer and I am refused any type of assistance.

I was told by the manager that he will return a phone call and I have yet to receive any type of contact.

I have called on multiple occasions to speak with the manager and he always seems to be busy and I am just given the run around or directed to a different manager.

I have contacted Lynwood Police Department, they sent Officer [redacted] Badge #[redacted] refused to make a report, claiming that it was not any type of identity theft.

at this point I do not know what to do.Desired Settlement: I would like a full refund and restitution for time loss and any other expensive that may come up as an outcome of this fraud.

Response:

HI.This are the attachments I was going to send you. I all ready went to filed a police report, they helped me. The dealer canceled the insurances all ready and they are going to give me my money back. I resolved my problem, but I am very concerned for what they did. I am wondering to how many more people they have done this. At this moment, I am only waiting for my money, but if something goes wrong I would let you know. Thank you very much for your help.

[I have not got any money back jet. Plus, now I am concerned with other problem. I have two months all ready driving the car and I haven't get any registration of the vehicle. I went to the DMV and they do not know anything, neither of me about the plate, registration or any other document regarding the proses for the DMV.

Review: I bought a car from public motors last year. They convinced me to buy a warranty program from warranty solution. First of all the program didn't work as it was explained at the time of purchase. Thus I decided to cancel it. I canceled it since December 2013 and I haven't received my refund of $ 353. Every time I called they give the run around.over a month ago the service department they told me that I was to fill out a form ( no one told me about ) even though I canceled since December and filled out all the paper works by warranty solution . Anyways I filled out the form and was told that within a month I will get my refund . I still haven't receive the check. Last week I called they start changing their words and someone promise that she will call me back after talking to the accounting dept. she never called back and not returning my phone calls.I need my money back and they need to stop false advertisementDesired Settlement: I want to get my money back

We issued her refund and mailed it on 5/8/17 in the amount of $353, check # is [redacted]. The 90 days was up on 6/25/14, but the check was issued sooner than this date.

No other promises were made.

True I received the check on 5/10 for $ 353 but [redacted] personally told that the process took a month after I signed the cancellation form with her. Even though I had cancelled my contract with their warranty provider since December and she was aware of it. I received the refund after I called the GM and left a message. I'm glad I get my refund but customer service is horrible at public motors

Regards,

Review: I had my car in for under warranty repairs. Instead of the few days it should have taken at most, it needlessly took 13 days. The warranty covered 5 days of car rental. While they acknowledge that the repairs done should not have taken so long(not even the 5 days the warranty company pays for), they refuse to reimburse me for the financial damages I had suffered due to having had to rent a car for this extra week. Instead of trying to come to a quick resolution they kept trying to give me the run around and stall, probably hoping I'd just go away, by telling me I should contact the manager and having said manager never answer any of my calls or get back to me after I left him messages, and was told by the service manager that he would leave him a message to contact me as well. After a week of this, I finally had to drive down there to have the issue addressed, only to have the public relations representative talk to me and tell me that he is the highest authority on the matter and that he can only offer me a free oil change. It was an insult. They effectively stole my car for over a week.Desired Settlement: I think they should pay for the cost of the second week of rental (350$) and that is being kind.

Business

Response:

Mr. [redacted] brought his vehicle in to our service drive without an appointment. Our service manager, [redacted], disclosed the warranty/rental terms before he dropped off his vehilce. We had a clear understanding that Portfolio, which is the warranty company, only reimburses up to $175 for any rental used at the time of any authorized repairs being done.

We tried our best to expedite the repairs, normally the turn around time for a transmission replacement is 7-14 business days. Our shop is not as rapid as a Volkswagen dealership would be due to the fact we have a lot less staff. Obtaining parts delays repairs also. There are different obsticles that we jump through to repair a vehicle as quick as possible

Unfortunatley, Public Motors So Cal will not be able to reimburse Mr. [redacted]'s expense for the additional days that Portfolio is not covering. Please refer to all terms and conditions with Portfolio before seeking any repairs. The consumer also has the option to take it to a bigger facility for future repairs.

Their whole response is basically a lie.

Review: Purchased a dodge [redacted] from public motors. Within 3 weeks of purchase the vehicle overheated and stopped working. The vehicle was towed back to public motors the following day. I was advised by [redacted], the service manager, that the engine needed to be replaced. he later advised me that the engine has been replaced three times and he is still unable to get the vehicle back to working condition. It has been 9 weeks since I have seen my vehicle. I have left voicemails with my call back number with no response. I am currently driving a rental car that was provided by the dealership. the vehicle enables me to get back and forth but it does not meet all of my needs, secondary to its size.Desired Settlement: I want the vehicle to be replaced with a comparable vehicle and an extended warranty to be provided. If this is not an option. I would like to receive a full refund of not only my deposit but also of every payment made.

Business

Response:

Mr. [redacted] vehicle has been repaired at no cost to him. There was a huge delay in getting the correct engine from our vendor, which caused the vehicle to be in the shop longer than expected. We have provided the consumer with a loaner vehicle at no charge for the time being his vehicle was in repairs. We have also waived the $300 deductible as a one time courtesy gesture due to all the inconvenience. At this time we are waiting for the consumer to pick up his [redacted] as the repairs have been completed.

Review: On 3/12/15 my wife n I went to purchase a 2006 nissan frontier SE at public motors located in Santa Anna, CA. The vehicle has lots of scratches on the outside of the vehicle. The sale person told us that he will take care it for us if we buy the vehicle. The vehicle also has a spare tire with a rim on. After we finalized the purchase, the sale person didn't fix the scratches for us, which is a lie. He told us we have to bid higher in order for him to fix it for us which it was not disclose at the original statement when he told us he will take care it for us. Second, they took out the spare tire and claiming it was not the correct size for the car. A guy by the name, [redacted] says that since we live in Sacramento, CA, we can take off with the vehicle and as soon as he order a correct spare tire for the 2006 nissan frontier, CA license plate:[redacted], VIN:[redacted], he will ship it to us. Ever since 3/12/15 until now, my vehicle has not been fix nor has [redacted] ever sent me the spare tire for the vehicle. We contacted him week after week and he continue to lie that he will sent it over. Last week he lied again telling me to get a queto for the spare tire n he will sent me a check. I then should go buy it myself. The spare tire, according to nissan of yuba city, ca, it cost $173 for the tire, $387.86 got the rim, n $55 to install for a total of $615.86 plus sale tax.Desired Settlement: Please have the company sent me the $615.86 plus sale tax to purchase a spare tire for my vehicle as promised n require by California law or have them sent me the spare tire: Yokohama P265/7 1/LS, wheel assy-spar spord 1/LS or I take the vehicle to nissan of yuba city, ca to purchase the spare tire there, have it install and the company pay for the invoice.

Review: While I was reviewing my sales contract in the financing office I came upon a section that said "Gap insurance" and it amounted to 595.00 dollars. I asked the financing manager about it and he said the bank requires it so it is mandatory so I signed for the Gap insurance. When I got a phone call from the finance company going over my contract, they informed me it was not required so Public Motors lied to me and made me spend an extra 595 dollars.Desired Settlement: I want the Gap insurance taken off my contract or directly reimbursed for it.

Review: Public Motors advertised a car online, and I emailed to confirm that it was still for sale. They said yes, and I made an appointment for the following day. When I came in they insisted on showing me other cars before the one I had an appointment for. Finally, they inform me the car was sold, but forgot to change the website. When I told them that someone confirmed over email they had no response. Later, I anonymously inquired about the same car via cars.com instant messaging and was again told that the car was for sale. The woman proceeded to ask to set up an appointment. After I informed her that I knew the car was indeed not for sale she immediately stopped responding.Desired Settlement: I hope this business fixes their shady practices. It is no surprise they have only 1.5 stars on yelp and I would like to prevent this same situation from happening to other people.

Review: BAIT & SWITCH!

I called on Thursday and was verbally working out a deal on a 2003 Ford Focus. I was told I was pre-approved and would be getting in house financing. Today on 3/7 I called at 4 pm was transferred to [redacted], then transferred to [redacted] (the financing manager) who were all looking at my file. Then two hours later I hadn't heard from anyone so I called back at 6 pm. I spoke with [redacted]. He advised me the Focus was still available and I would qualify for the financing.

So I drove down there an hour and a half with my daughter. I walked the lot with no one bothering to help me and I did not see the car. Finally I went inside and asked where it was. Someone was helping me look for it and then [redacted] came by and said he would pull it up for a test drive. When I walked outside there was a Chevy HHR there instead of the Focus. I asked where the Focus was and he told me that the management wanted me to test drive this. I said fine, strapped my daughter in and we went. During the drive I asked some questions - like where was the Ford I'd driven all this way to try. I was then advised I couldn't get financing on that car. EVEN though I was told at 6 pm just before leaving my house I could. I asked him how much the car I was driving was listed at and he ignored me. Continued on and on about the safety features, blah blah blah.

Finally we get back to the dealership and he sticks me in some little room while he runs off to help someone else. Finally as I was about to leave, he comes into the room with my credit report. He starts to talk to me about my credit issues. To which I said yes I've made the office aware of these issues. He then goes out and comes back with a paper listing the HHR's price of 9995 (which is actually 1150 higher than listed on the website). With $1500 down for 5 years the payments are about $275.

All of this would have been fine if I hadn't EXPLICITLY mentioned to [redacted] and [redacted] PRIOR to driving down our budget was $5,000 - $7,500 with $1,000 at the most down. ALL of which were agreed upon prior to my arrival. [redacted] kept telling me about how good the car was for me, etc. He kept dodging all my questions. Finally I said look why wasn't I informed on the phone about not being able to approved for the car I drove down for.

I requested to talk to a manager. He "apologized" for my time being wasted. I'd like to be reimbursed my gas cost for driving down there ($20) for NO REASON and being lied to. I was also informed that the car I came to work out a deal for was sold that morning at 10. Please note this car is still listed as available on their website right now. I was told a 4 & 6 it was still available and ready for financing. SO THEY LIED to me about everything.

DO NOT USE THIS COMPANY. I had bought a car from them 7 years ago, and obviously they have either changed ownership or completely slipped in their values.Desired Settlement: I would like to be reimbursed for the cost of gas to get down to the dealership which was $20. I also wasted 3.5 hours of my time compensation for this would be appreciated but not expected. A formal apology is also desired. IT IS VERY IMPORTANT for an internal investigation that these practices cease.

Review: In short: "Public Motors" should refund me the money for the extended warranty and GAP insurancewhich I have cancelled soon after purchase date. After I have informed "Public Motors" that I moved to New York they stopped asnwering my phone callsand also ignored a letter which I have sent them 02/14/2014.02/09/2013 I have bought Mazda5 2009 at "Public Motors". At the time of thepurchase I have also got a loan and bought extended warranty for the vehicle and an extra (GAP) insurance which guarantees paying off the loan in case the car is severely damaged or stolen.Soon I decided that the loan interest rate is too high and payed it off. (The confirmation has been sent to "Public Motors".)I also decided to cancel the extended warranty. (The confirmation has been sent to "Public Motors".)Conversely, my expenses for both (i) extended warranty and (ii) GAP insurance should have been reimbursed at latest by 08/30/2013.In December 2013/January 2014 I had several phone conversations with their customer service department. They requested the confirmation of the fact that my loan has been payed off and Ifaxed it them 12/17/2013. I called them back approx. on 01/10/2014; they promised to resolve the issue soon. That time I told that I have moved to New York; I guess this is the reason why have stoped returning my phone callsand have ignored my letter.Desired Settlement: I should finally receive a refund for both extended warranty and GAP insurance which I have cancelled long ago.

Review: I bought A 2002 Nissan Altima on 01/19/2014 and had imitate issues with the car. I brought the car back to them three times in the two weeks I had the car because of the same problem. First time I noticed the problem with the car and I brought the car back was only four days after purchase, on 01/23/2014. The problem with the car is that it completely shuts off while driving in motion randomly, then in a few moments I turn the key to turn the car back on and it turns back on but the car doesn't accurate when pressing on the gas pedal. Public Motors is not fixing the problem and aren't giving me any alternative solution to the problem. The managers never return my phone calls or messages.Desired Settlement: I either want another vehicle because regardless I need transportation. And if that cant be done then I want a refund and let out my contract.

Review: I purchased a new used car on 8/26/15 with a 90 day warranty. Since the purchase I have had multiple issues with the car, last issue being engine is completely shot and car is inoperable. I have been trying to contact public motors since the middle of November. When I call business I get a recording saying operator is unavailable and hands up. I also drove to business which is closed down. The lot is vacant and gates are locked with a note saying "closed due to unforeseen circumstances".Desired Settlement: To replace car or refund

Review: Here is a copy of my first complaint: I will need a tow truck for the 2005 BMW Purchase on 04/26/2014; About a week ago we pick up the vehicle 2005 BMW for repairs on the transmission. This morning on my way to my place of employment the vehicle the 2005 BMW TRANSMISSION indicator CAME ON AND SAID IT IS IN NEED OF SERVICE. We have pay our first car note 10 days early with the GOOD FAITH! That faith has been broken we have not driven this vehicle for a solid week since purchasing the BMW! As we don't want to continue going threw this until the warranty runs out 07/14 and which point PUBLIC MOTORS will say it is not their problem! With this economy who can afford to pay $401.00 mo for 60 mo. for a vehicle which has been having all kinds of problems from the bargaining THE of purchase? The car fax states this vehicle should not be having TRANSMISSION AND ENGINE ISSUES THIS IS VERY PROBLEMATIC for us as working consumers missing work to get these matter resolve. I was at your facility on 05/29/2014 for the door repair which I had to miss work! Now today 05/30/14 due to the car indicator's coming on I was force to return back home on my way to my place of employment so as not to do any further damage. Now I have miss two days of work due to this BMW 2005 being non operational and unable to drive. I am under a doctor's care and need transportation for appointments. This matter needs to be address ASAP!Desired Settlement: A better car of equal value and extended warranty or Money return and contract revoke.

[redacted] D. [redacted] Jr. purchased a 2005 BMW Vin# [redacted] on 4/26/14 and financed his auto loan with Wells Fargo Dealer Services. Mr. [redacted] Jr. opt out on the option of purchasing an extended service contract. We have provided Mr. [redacted] Jr. with a limited 3 month or 3k mileage warranty.

We originally diagnosed [redacted]' vehicle on 5/1/14 when it came in for the transmission jerking. We performed the repair under the limited warranty and provided [redacted] with a loaner vehicle for the time being his car was in our shop. As a courtesy, we wavied [redacted]' deductible of $300.

[redacted] returned to our shop for a new concern regarding to his diver door on 5/29/14. Eventhough the driver's door handle/latch is not covered under the limited warranty we repalced it at no charge.

[redacted] returned to our shop for a transmission light on 6/2/14. At this time we did not find any transmission codes, we only foudn the ABS control module out of calibration causing vehicle to go into limp home mode, so we recalibrated the ABS control module and test drove the vehicle. All repairs checked out.

[redacted] returned to our shop for a transmission warning light that kept coming back on, a coolant and oil leak, and for a screw that was in one of the tires, on 6/19/14. This time we sublet the vehicle to Crevier BMW for further diagnosing. They determined the transmission light was on due to a faulty alternator. Therefoe they recommended to replace the alternator, this work has been done. We have also completed the oil and coolant leak repair. We are currently waiting for a mobile BMW tech to come in to perform the adaptation updates to the vehicle. Both these repairs are not listed for coverage under the limited warranty, but we have done them at no charge as a courtesy.

We must emphasize that when [redacted]' vehicle comes in to our shop it is for a new concern everytime. We have also towed in [redacted]' vehicle every repair visit because he claimes it is not drivable. We always provide a loaner vehicle as well for the time being his vehicle is in our shop. Both rental and towing assistance is not covered by the limited warranty, but we have provided this service to [redacted] at no charge.

We apologize for any inconvenience with all these repair visits. We are trying our best to accommodate the situation and making the situation right.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

07/15/2014 PUBLIC MOTORS HAS HAD OUR VEHICLE SINCE 06/19/2014 ONE MONTH! We are still under warranty for Transmission; Not only did the Transmission light come on Public Motors in their response say they had to tow the vehicle in. I Wrote another request for our vehicle on 07/14/2014 asking why no one return our call regard the BMW which they have for one month 6/18/2014 for repairs to Transmission; again since 04/26/2014 date of purchase we have been having problems with this BMW Transmission which Public motors claim to repair they still have the BMW! wE HAVE PAY ALL CAR NOTES AND HAVE YET TO DRIVE THIS CAR FOR A SOLID TWO WEEKS! Issue not Resolve ready to proceed.

Response:

Our company does not offer any cooling off period where you can return at whatever time and receive a refund of the down payment or monthly payments made. At this time I would recommend Mr. [redacted] to come in and see our general manger [redacted] to inquire about possible options in getting into another vehicle. At this time. our service department can only offer to repair mentioned concerns. The vehicle repairs are completed we are now waiting for a final test drive to be performed to confirm all work was done and checked out.
