Complaint: [redacted] I am rejecting this response because:I am sorry for your personal issues, however this has no bearing on our roof issueThere has been plenty of time for your company to correct the problems we have The work was done in April of 2015, it is now March of 2017! We did in fact pay $14,for our roof, I have the paperworkI didn't list every other issue we've had, I could have but didn'tWhat I expect is to have our roof fixed correctly and all the mold cleaned up and goneThe "leak" we had was not condensationThe only condensation we ever had was only AFTER your company came out and blocked off all of our venting to see where the leaks were coming fromOnly then did we get condensationThe ridge vent that was installed was requested by us to make the house more breathable, which only failedWe were told by your company that it was faulty and needed to be reinstalledIt took months for you to do thatWe were never told that our home was too tight by anyone from your company or any Manufacturers representativeWe knew it was an old house, which is why we asked for all top of the line materials and venting; obviously by the cost of the roofOur home is only 1100sqft and would never have cost $14,otherwiseAlso the only inspectors that came out were your company and GAFYour own guy said it wasn't done per your standards, but didn't make any effort to correct any of the issues found at that time, and still haven'tWhile I appreciate your good will payment for our Christmas decorations, it does not negate the fact that the roof leaked and left mold behind, which your company still has yet to address or correctYou fired the PM on our job and said you'd make it rightYou said he was at faultAnd yet we have never been contacted to have the mold taken care of, or any of the other faulty work correctedBlack mold is not something that is acceptable, and it should be taken care ofDon tried to tell us it was dead mold and was no harm to us and wouldn't spreadWell it's not and it has! I spoke to [redacted] a couple of months ago, she sent pictures and it's barely noticeable, not a water infiltration issue since it is protected by a covered porch area, and not unusual due to vinyl siding expansion and contractionEven though this has been explained to her, that knowledge has evidently not alleviated her concernIf you would like me to take a full day to go down there, I just need to know when she will be home I will have [redacted] call [redacted] and see what her schedule is like after the Thanksgiving Holiday

We have been awaiting the "report" for sometime We now have it We will respond to anything which is part of our scope of work As far as the payment booklet - your financing was a joint account and was approved prior to his death with the credit union and you were fully aware of that fact We are in no way in breech of anything and have done everything on the contract If there is a warranty or inspection issue again that fits within the scope of work we will be happy to oblige The project manager Chris R [redacted] from our company is working with your project manager on site I know this is a stressful situation; however, until we had information there is nothing to respond to - we will be tendering additional information after we have time to review the report which was just received this last week

Complaint: ***I am rejecting this response because: Broken Light- had no awareness of this:Fact: Exhibit are two pictures, one with the lights and one without. On May 7th, 2013, after spending a day tearing up the deck, Kyle came to the door with our outdoor light fixture in his hand and said “I am sorry, this is not on the contract, but I miscalculated and the light had to come down in order to fix the deckIn fact, I have more bad news, I will have to permanently seal off your all your electrical outlets to that of the houseYou have no other choice in the matter because the deck is already ripped up.” All of this news was not communicated beforehandIt was done after the fact and without our consentWe feel we are owed some type of compensation for the loss of the (2) decorative outdoor light fixtures, electrical outlets and cost of re-wiring to necessary to route electricity to that part of the houseThe fixture on the other side of the will no longer match and will have to be replaced as wellWe will get an estimate from a professional electrical contractor.Heavy electrical Power Saw dropped on deck:Fact: Traci, we did send you immediately an email with the picture of the spot on the deck where the power saw was dropped and subsequent damage incurredThe tan color represents the caulking material your employee, Song, put down to protect the deck from any further damage from the elementsI am shocked your employees did not share with you what happened that day involving the dropped sawSong’s son could have easily been fatally injuredThere were no safety precautions in place at the time and no supervision (See Exhibit 2) of the email and pictures we sent on May 10, 2016.) You did not respond to this email nor did you reach out to rectify the situationWe had a lot more information to share with you regarding this incident but you showed an unwillingness to communicateFurthermore, Song and his son came to our property with no advance warning, nor did they have a written contract of what they were going to accomplishWe were not at home at the time Song initially came onto the property, erected the scaffolding and began working on the chimneyWe had no clear idea what he was exactly doingWhen questioned he said Jerry would stop by that day and explainIt is August th, and we are still waiting to hear from Jerry During the two days Song worked on the project Jerry never made contact with usWith the exception of Friday morning, someone was at home until Song and his son departed on Saturday. What we find so confusing and frustrating, is why would a company like yours which has shown not recognize or honor verbal agreements and only feels accountable if something is in writing, be willing to work on a two-day project involving scaffolding and major repair work without a specific written contract of understanding? Please address this question in your next replyAlso, please forward to us any type of written authorization you obtained prior to those two days of work.Damage to the chimney and drywall,Before Song and his son left the property he apologized for damaging numerous panels on our chimneyHe said a number of them had unexpectedly split and he tried to fix them with glueHe said because of the damage the life of those damaged sidings had been reduced significantly and would require replacement in the near futureI had to go Home Depot to get a quart of house paint so he could cover up the glued siding before he dismantled the scaffolding We feel we are owed compensation for this but do not know the amount until a professional contractor gives us an estimateAlso, we do not know if additional damage was done to the chimney until we get a professional on the roof to further inspect the chimney and surrounding areaSong and his son also did not repaint the side corner of the chimney before dismantling the scaffoldingThe side corner extends at least feet verticallySong said sorry and said I needed to take this up with JerryI asked Song and his son for their cell phone numbers since Jerry never came to the propertySong said it was too expensive to own a cell phone and there was no way to get ahold of him or his sonThey both said Jerry would follnext week.I asked Song and his son about fixing the drywall in the garage, Song said someone from the company would come out to fix it when they arrive to repair the damage from the power sa., Jerry will take care of that he saidThe hole in the ceiling was never more than a foot x inOn a previous, visit, Jerry spent a half hour with a stop watch calculating the rate of leakageImmediately thereafter he reassured me that the company would do whatever they had do to find and repair the leakHe then asked me for verbal permission to tear down additional dry wall in order to find the leak from the bottom upI ageed to the requestJerry then took pictures of the damaged area before tearing down the drywall and said he needed to take them to show people back at the companyJerry expanded the hole in the ceiling to approximately ft., X ftwhile unsuccessfully looking for the leakBy my calculation the area of the original damage was intentionally enlarged by 90% from the existing holeBecause Jerry had promised to fix the leak we feel his company should be accountable for any additional damage to the ceilingIn fairness to your company I would be willing to reduce this portion of my original claim from $1,to $1, see exhibit (pic in garage)Power saw incident/accidentThis portion of my rebuttal I had hoped to address with the ownership in a face to face meeting or by phoneMy attempts to arrange such a meeting were completely ignored in previously documented emailsI had also hoped to talk to Jerry about the accident during the two days his workers were on our property but he never attempted to talk or contactSong said he was in the area but he never set on our property.In a nutshell, one of your employees, specifically Song’s son, was almost killed or at least grievously injured while working on our houseThis incident/accident occurred on the morning of March 19th, while both of us were home We were in the kitchen when we heard this “loud crash”, We immediately rushed out to our small deck and asked what happenedSong said his power saw had fallen off the scaffolding while he was perched on the scaffoldingWe all looked at each other in stunned silence and expressed how lucky his son was since he was standing directly below on the deckassisting his father while he worked with the heavy power saw approximately 20-ftabove his headWe were especially thankful since his son and his father were not wearing any type of protective head gearWe are not safety experts but we feel other common sense safety precautions were also not in placeAlso, Song and his son pointed to where the power saw hit the deck and said his company would immediately take care of the damage. Song recommended repair to the deck with some sort of patch created from the exact materialWe will need to contact a number of roofing companies to match up the productWhat is the product name and number for the sake of expediency? Also, you mentioned for time and material your company charges a minimum of $for a visit We assume other companies charge the same reasonable rate We will be revising our compensation expectations to reflect this additional cost. In your reply you offered to continue to work on the leak on a time and material basis. We have several problems with this offerBy walking off the job in March and refusing to answer any further attempts to communicate with us, we have lost our trust and confidence in you companySecondly, your company has had three years to fix this leak and have not been able to get the job doneTo date, we have spent $7,and have the exact same leak as we did when you first commencedWhy would we want to spend more money with your company with such a dismal history of performance? If you were in our shoes, we are sure you would be having the same doubts and concerns. Therefore, we would like a financial settlement so that both parties can find a middle ground and part amicably. With that being said we are willing to lower our requested reimbursement to $5,based on the following breakdown;

Also, we would like to clarify a point you brought up in your rebuttal, we feel compelled to provide some additional information regarding your assertion. At the time of the signing of the initial contract, Kyle and Phil both verbally agreed to finish the drywall repair for only a couple of hundred dollars on a time and material basis .Immediately, upon completion of the written portion of the contract we attempted to contact both of them numerous times to set up a date for completion of the verbal portion of the contract and received no response from either employeeWe felt anger and disappointment that they had decided to ignore this portion of the overall agreementIn an effort to hold Rainier View Construction accountable for their promise, we took steps to withhold our last Visa payment until they honored their commitmentWe felt powerless at that time and felt this was the only recourse we had to bring attention to the matterWe take offense to the word “stiff” on the last response. We then called Visa to delay final payment until your company complied with the verbal agreementThey said, regretfully, they can only recognize what is specifically stated in writing and would not honor our wishes. Finally, Kyle did call us back and said Don, the owner, had authorized the drywall to be completed for $1,500.00. Jan felt this was an exorbitant amount of money and not in keeping with what was originally promisedShe refused the offer
After a month, Kyle called our home and said he had to offer an apology for not fulfilling his part of the agreementHe stated his boss Don, would not allow him to go out and finish the job because there was not enough profit in the original quote of a couple hundred dollarsHe had no choice but to follow his orders and said he felt really bad about breaking his promise. We hope this history also sheds light on why Phil showed up and refused to charge us for any work he did to attempt to repair the leak. He also apologized for what had happened a year agoActions speak louder than words
Back to the Bottom Line-
The only reason your company came to our home was to fix a leak in the garageYour employees at that time said that the only way to fix the leak was to rip up the deck and replace itYour company did in fact rip up and replace our deck but the leak was never fixedThey did not do their due diligence in the first place to figure out where the leak was originatingTherefore, the origin of the leak was completely misdiagnosed and cost our family approximately $7,in unnecessary expensesReplacing the deck never stopped the rate or location of the leak
In closing, we would be willing to accept $5,at a minimum because of the misdiagnosis of the leak, so we can repair it with our own contractors. Sincerely,*** ***

In the additional comments, first paragraph, the customer states we walked off the job in 2016. The job was done in 2013, in the following transpired:
We did not hear from this client for a very long period and then they called and stated they had a leak - Jerry K*** the Project Manager states:
First time I went out to look at the job the Membrane looked good. Put a little caulk on the inside corners. Adam went out next. He said the membrane looked good. He thought the door was where the water was coming in. Talked to the customer about the leak and explained the leak is not coming from the membrane. Contract is for repair damage to deck and install only (see attachment). Tracey P*** told me to go and talk to them again. 3rd time out. Investigated deeper and found that the way his siding is installed on corners of entire home is letting water get behind the siding and run down the walls. Explained to customer and Tracey the problem. You told me to fix the corner on the deck. Corner was repaired. While repairing discovered siding cracked and roof flashing issues. Customer was told about it. The water could be coming in from many different places on this house. Chimney cap could also be a way. The areas where it could be leaking are way up in the air with no room to put up ladders. Not very safe. Nothing in this contract says find where the water is coming in and make it stop. I have found multiple places where water could come in and the customer was shown. The gutters are completely filled with debris. Water can be backing up at gutter/roof/wall line and go into the wall. I have been out several times and we corrected additional areas free of charge at Tracey's request to provide good customer service
It is not a matter of expertise in finding the leak, the problem is there are too many areas where it could come from - but it is not coming from our contracted area, so where do I go with this? I have suggested to the customer areas (as stated above) but the client does not want to invest money into this and we have serviced the area our warranty covers
At Tracey's request I did call the homeowners in mid-May but did not hear back and I do admit I did not follow up

Further the customer states he wants $back from us for the drywall - he never paid for this:
The attached report from Kyle N*** from June 25, at 1:PM states that he spoke to Mrs*** at the end of May after her job was completed - to talk about the change order for the interior work in her garage(In the special remarks area of this contract it states that "garage and interior work will be on a time and material basis).
Kyle further states - I asked her if she was happy with her deck project and she was thrilled that it looked so nice. I said the change order for the interior work with the sheetrock is going to be our minimum repair charge of $1500.00. She said that this was too expensive and was going to ask one of her contractors that she knows from the hotel business to come by and fix it. I said I was sorry that we can't get this done for her but if she can find a handyman to do it, it would be much more affordable for her. She was very happy with our honesty and her overall job and said she would recommend us to anyone. She said thank you for all our hard work
After I learned there was a dispute of credit card charges I called them and left a voicemail asking why and if there was anything I could do to make them happy, they did not return my phone call

Further, in the response Mr*** states he wants $for a saw being dropped and a light fixture being broken. We have no knowledge of either and never received any pictures of such things
And, finally he wants $to find another contractor to fix the leak - why we performed everything we were contracted to do and much more and do not see where that number even fits in

The rebuttal about the reverse of the credit card charges states they did so as we did not perform to a verbal agreement (when we were told by *** it was due to their daughter's graduation note included in attachments):
Our General Terms and conditions #and #of the contract explain our stance on verbal agreements
3. Any alterations or deviation from the specifications involving extra costs of material or labor will only be executed upon written change order, and will become an extra charge over the total mentioned in this contract. All agreements must be in writing and will be billed separate from the original order. Separate agreements made with our salespeople or trades-people, will not be recognized
4. This instrument will become binding on the acceptance of Rainier View Construction & Roofing, LLC. It is understood that instrument, upon such acceptance, contains the agreement between the seller and the buyer, and that no representative of the seller has made statements, representations or agreements, verbally modifying or adding to the terms and conditions herein set forth. Separate agreements made with our salespeople or trades-people, will not be recognized
We ignored no portion of the agreement whatsoever and that is why on 09/11/Bank of America found in our favor and reversed the reversal of charges and gave us our money back
So where do we go from here. We have done everything and more than was in the contract and years later are asking for more. Not to mention that we have done a ton of free work. The warranty is for the deck shield product as stated in the contract as well
As a gesture of good faith, and to resolve this situation, I would be willing to extend a one-time credit for $to address the saw and light fixture issue - which again I have no idea about and this is more than generous; otherwise, I fear we will have to utilize the Revdex.com services of mediation to sort this out. This is the best I can do

Thank you for bringing this to our attention. I have attached photos of the roof to this response. Mrs*** had a composition roof put on her home and she had a flat carport (older structure) and we put an IB PVC roof on that structure. The roofing has been inspected and there
is no issue with the roofing we did whatsoever. There is some minor ponding on one corner of the carport, but this is due to the structure settling not to any substrate or sheeting not being replaced. We cannot be responsible for the structure. One of the reasons we felt that PVC would be a better product than the torchdown she had previously, was the durability and in the event of ponding there would be no issues. The manufacturer even states:
Ponding WaterIB Roofs are uniquely formulated to withstand pondingwaterMoisture will not pass through the IB membrane.Ponding water will not affect the performance orwarranty of IB Roof Systems single-ply membranes
Don did go out and inspect everything and saw no issues. He did tell Mrs*** we could come back and put a small gutter on that corner if she would like to divert the drips in heavy rain and that we would do that free of charge. Admittedly, we have not done that yet, due to a heavy workload, but it will be done in the next few weeks. We did not feel this was an emergency, and we had no responsibility to do anything but were trying to assist her in something that bothered her. We will see this gets done before Christmas. But, again there is absolutely NO DEFECT or issues with our work. And our work, had there been a defect, would be under warranty

First of all you paid $12,for your roof not 15K. Secondly your "leaks" were not leaks it was condensation. We even had the manufacturer come out and take a look. As an act of courtesy we paid for your "Christmas ornaments" over $which was an inflated price but we did not
want to fight with you. We also convinced the manufacturer to replace the ridgevent with another product so you would have more air flow. As your house is too tight and does not breathe properly and we explained that as did the manufacturer. The roof was inspected by GAF and found to be sound. You have a Golden Pledge Warranty and as explained after years both labor and material become GAFs responsibility. And, *** or *** or what you prefer to be called - Don told *** exactly what I am telling you, and you ran off to social media and the Revdex.com to trash us and call us liars - that's fine. Rainier View did closed its doors on 2/7/2017. For very personal and tragic reasons - and we emailed the Revdex.com as well to let them know. I am still responding until the email account expires, however, as I want you to understand your warranty.Second, if you want to run off and trash me more online it is of no interest to me. Rainier View is out of business as you were told - it was not a "stall tactic" and I may or may not be here in a year. We have worked hard and now have lost everything and we are still trying to do the right thing. Your Golden Pledge Warranty will cover you and that is what Don tried to explain. Our phone still works in an effort talk to people and help them during this transition, and Don gets back to people as quickly as he can, but he has had to take another job to cover our family. We asked Yelp to take our profile down, cancelled Google and anything else - our website will expire on 3/and quite frankly I do not have a staff nor do I have the energy to be troubled with things that are of no matter. The internet lives on forever unfortunately and there is nothing anyone can do about that. Please follow the instructions in your warranty. Two years from the date the warranty is issued it becomes the responsibility of GAF to cover both labor and materials on any repairs; however, if it is an issue of condensation again it may not be covered. So file your claim based on the date of the warranty issuance - remember the year mark. You were sent a complete packet with instructions by both us and GAF. We paid GAF for the Golden Pledge so in the event anything ever happened to our company you would have the largest manufacturer of roofing in the US to pick up the warranty. Your roof has been inspected multiple times by both us and GAF and found to be sound, but again please follow the instructions in the above paragraph to the letter and you will have coverage for any roofing defects as per the written Golden Pledge warranty. Thank you

Our business is closed. I had a very serious diagnosis. We have responded to the *** via our lawyer as well as the Attorney General and felt that responding again was useless. Please close out our business on your site and remove us. We have always worked to respond,
however, my energy is low and I felt that I had responded enough to this particular client. I am sorry that you are angry. Rainier View always followed your standards when open. A call to perhaps understand the situation would have been welcome from the Revdex.com rather than just firing off a nasty form letter. Perhaps someone should review your handling of situations, as your tactics show no understanding, a distinct one-sidedness, and the Revdex.com uses its weight to hurt small business many times with high joining fees and so much additional work. For the most part I have enjoyed my dealings with *** and the staff at the Revdex.com but under the circumstances and after a long accreditation and almost instantaneous follon my part - again I think a human reaching out would have been a much kinder way to handle things.Respectfully,Tracey P***

Mr*** has been very abusive to ourselves and our staff - his verbal assaults are legendary and laced with profanity. We have been out on numerous occasions and explained his issues and how they do not have anything to do with our work. In addition, we extended Mr*** credit to do
his job and he has a balance. He has continued to verbally abuse us up until yesterday. At that time we told him to do what he needed to do because we will not come back to be abused anymore. Thank you

I am rejecting this response because: I have email documentation stating they would return deposit on 2/10/17, still to date they have not.  the amount is in fact $6986.40, $6000 deposit for roof and $900 for solar panel removal and reinstall with $86.40 tax.  Signed receipt from Rainier View attached.
