Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Although this refund was received the terms and comments that accompany it show that this is much bigger issue that will remain unresolved unless some sort of action is taken by you and or the government. This is scamI recently retraced my steps and encourage any of your staff to follow the same route hundreds - thousands- of others have followed: search for realty properties in a specific area - Realtytrac pops up in a number of different places and offers you information- AS YOU FOLLOW A LINK something pops up saying by clicking the link you agree to the terms of service, which are not present but are actually found in another link. Once they draw you into the "free trial" screen it appears to be something that would be easy to cancel. But, even though you sign up with a couple of clicks, it turns out as I learned too late, you have to call during business hours and speak to someone to cancelThis is something I could not doI sent an email that was not acknowledgedAn internet search demonstrates that this is a common problem with Realty trac and their lack of effort after years of complaints (do an
internet search to see the many complaints over the years - NOT given to
Revdex.com) might indicate this first $charge is a major portion of Realtytrac's profit marginONLY after the charge was made against my *** account was there an option via *** to cancel this "membership" thus the recorded cancellation they reference in response to my complaintFurthermore the email provided in their *** profile shown in the records of the charges leads to someone who "doesn't have the authority" to do anything about charges and tells you a call during business hours is requiredThis is a *** issue, as it violates their TOSIn addition to all of this, the actual information obtained via the actual "free trial" is the same as
information available elsewhere for free, and most of Realtytrac's information
was out-of-dateA survey of complaints appears to show this is a common complaint by users, including RE agentsThe options that would remedy this situation would put their many successful charges of $at risk.
There should be a policy or law that requires a company that perverts the "free trial" option like this to contact the potential customer via email address given before charging following a "free trial."
Require that any company who allows "free trial" sign-ups via the internet also provide a cancellation option in the same manner.
Or like other legitimate services, cut access to the service after a free trial; if people are actually using the service they will pay!
I filed a complaint with the FTC that will be copied to my AG's consumer protection bureau and will do the same to the San Diego AG and will file a complaint with the CFPB. Again, whether it is at state or federal level, consumer protection must be in place to prevent these unwanted charges that are so difficult to removeIn the mean time, statistically, how many people who have been taken advantage of via business like this actually complaint to you? I would guess only a small percentage of people actually file complaints with you, it seems from research that most contact their credit card co's or banks and Realtytrac has a system in place to fight charge-backsAnd, many simply post complaints on online review sites. Would it not seem that despite the refunds that have been successful because of your intervention, the complaints themselves indicate there is clearly a pattern of abuse? Many others don't know who or how to complain, feel like they've been scammed, and see your logo. Do associations like that mean anything to you?I recognize that it is the business who pays you for membership, but it's the customers who decide if that really means anything

The Member called in and requested cancellation 10/20/2014, after the trial period had expiredThe representative advised the member of the charges and that they would have access until 11/17/The member inquired about a refund and the representative advised the member of the Terms of Use agreed to upon registering the account including that the membership fees are nonrefundable unless the billing was in errorThe last charge to the account occurred within a hour grace period and as such RealtyTrac issued a refund for the October payment on 10/20/
The Member called in on 10/23/claiming to have been charged after cancelling the membershipThe Representative explained the Terms of Use and the charges to the account and offered to submit a refund request on the September charge for further reviewThe second refund request was initially denied due to the terms of useThere were no previous attempts to cancel the membership during the trial and therefore the account was charged correctlyDuring this conversation the member located the email sent by RealtyTrac on 9/10/welcoming them to the service and explaining when the trial would convert into a paid monthly membership as well as the directions to cancel the membership should they choose not to continue
Although no further refund was due, RealtyTrac issued an additional credit of $on 10/24/as a one-time courtesy

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. The reply from Realty Trac contains several statementsEach year in and I called to cancel the service and was told by their representatives that it has been cancelledIn fact during my discussion with them last week one of their agents acknowledged it was noted in May that I spoke to Israel my account rep and that Israel noted in the account that I wanted to extend my account another yearWhich was because I called to complain that they had not cancelled it in when they said they wouldThe agent stated they would listen to the recorded call and reply to me in 24-hoursOver the next several days I received numerous calls from Realty Trac but rather than listening to the recorded call they were trying to get me to renewI realized this year that the Realty Trac agents are challenged to be honest so I recorded this years call and if you wish to listen to it you will hear that they do actually have notes on my call last year when I called to cancel for the second year contrary to their statement to the Revdex.com that I had not called previouslyRealty Trac and I both have a recording of this years callIf you would like a copy I will be happy to send it to you so you can see that they have lied to the Revdex.com about the call historyI demand a refund of the and charges for which I received no service and was lied to by their agents when they told me they had cancelled my renewals

Member registered for a 7-day free trial of RealtyTrac on 6/15/The terms of the trial are clearly stated on the registration page prior to submitting a form of payment for the monthly subscription feeThe terms state that if the trial account is not cancelled during the
trial period, the account automatically converts to a monthly subscription and the monthly fee of $will be charged to the account information supplied by the new memberThese terms must be agreed to by the registrant prior to continuing with registrationThe member’s account was not cancelled within the day trial period, and the account was charged the first monthly subscription fee on 6/22/
Our records indicate the member called on 6/27/to request cancellationThe caller was verbally abusive towards the representative and refused to allow the representative to address the account or respond to their issuesThe caller demanded further escalation and was promptly transferred to Customer ServiceThe next representative attempted to explain the account, the service provided, and the customer’s usage of the service after converting to a paid member but was quickly interrupted by the caller and subjected to profanity and abuse from the callerRealtyTrac has a zero tolerance policy for abusive behavior and therefore the representative was authorized to disconnect the call after confirming the membership had been terminated
RealtyTrac is a foreclosure listing service, and as such, we do not take part in the sale or purchase of foreclosure propertyThe lists of distressed properties that are on the website are intended to be leads on homes that may be available for purchase, either from the current owner, or from the foreclosing lender who has repossessed the propertyHowever, the posting of a property on RealtyTrac’s website is not a guarantee of availability.
It is important to be aware that many of these foreclosure properties are not “on the market”, posted on the MLS or being advertised as for saleHowever, many investors successfully purchase foreclosure property by contacting the current owners directly, and making an offer on the propertyRealtyTrac provides access to foreclosure information and leaves the following disclaimer on all properties: The information at this site is provided solely for informational purposes and does not constitute an offer to sell, rent, or advertise real estate outside the state in which the owner of the site is licensedThe owner is not making any warranties or representations concerning any of these properties including their availabilityInformation at this site and its property ratings are deemed reliable but not guaranteed and should be independently verified
We regret that we are unable to process any credits to the accountHowever, we can accommodate the member with complimentary exclusive website access for up to monthsThis offer has been noted on the account; please contact our customer service department at ###-###-#### or [email protected] to take advantage of this offer

Per the Terms of Use, the membership fee is the same regardless of usageCustomer pay for the ability to access the RealtyTrac services regardless of whether or not the user chooses to login each monthThis is similar to cable television in that the customer is charged each month whether or not the customer chooses to watch any televisionBecause these accounts are created online by the user, it is the user's responsibility to request cancellation should they choose not to continue the serviceIt is unfortunate that the customer chose to neglect their credit card statement and failed to cancel the account in a timely mannerThe account has since been cancelled and a one-time credit was issued in the amount of $Based on the Terms of Use, the customer is not eligible for any further refunds, offsets, or credits

The member registered for a 7-day free trial of RealtyTrac on 2/25/The terms of the trial are clearly stated on the registration page prior to submitting a form of payment for the monthly subscription feeThe terms state that if the trial account is not cancelled during the trial
period, the account automatically converts to a monthly subscription and the monthly fee of $will be charged to the account information supplied by the new memberAll members receive an email welcoming them to the service and explain the date the trial will convert to a monthly subscription as well as cancellation directions should the member choose not to continue past the day trial periodThis account was not cancelled within the day trial period, and the account was charged the monthly subscription fee beginning on 3/4/2015. The first call record from the customer’s phone number is dated 5/5/All phone calls are logged and recorded regardless of speaking to a representativeListening the recorded greeting will create a record of the call attemptWe have also thoroughly reviewed the [email protected] address and found no emails have been received from [email protected] invite the customer to provide copies of the messages they claim to have sent or phone records showing attempted calls for further review of the accusations made in the complaint. When the customer called in to inquire about the account on 5/5/a representative explained that there is no record of cancellation and no correspondence had been received by the support email addressThe representative explained the Terms of Use agreed to by the customer including the refund policy which states that the monthly fees are nonrefundableRealtyTrac clearly labels the monthly subscription charge including the customer service phone number on the customer’s credit card statement but unfortunately the customer explained to the representative that they do not check their statementThe representative explained that they had cancelled the account, sent an email containing a confirmation number, and submitted a refund request for further review. Although no refund was due, RealtyTrac issued a refund in the amount of $on 5/5/as a courtesy

The complaint is not clear in what the customer is claiming or requesting of RealtyTracFrom what we gather they are claiming they were being charged an incorrect amount for the monthly subscriptionThe advertised monthly subscription of $is clearly displayed on the registration and
reactivation pages. On 9/19/2015, *** *** logged into RealtyTrac’s website with her previous username and passwordShe was advised via an online prompt that her account had expired, and that in order to view RealtyTrac’s foreclosure listings, she would be required to subscribe to the monthly membership, and be billed $upon reactivation. The customer changed her billing information and chose to use *** which required her to enter her *** account credentials and verify once more that she had selected the $monthly subscriptionAs she chose to reactivate her membership at that time by clicking “Reactivate”, she was billed $and agreed to a reoccurring monthly membership until she chose to cancel the accountThe process is very clear and prompts the user to verify the purchase on both the RealtyTrac and *** web sites. There was no request for cancellation until 2/22/when RealtyTrac was notified by *** that the customer chose to end their billing agreementThe account was cancelled and the customer has not been charged since the last payment was transacted on 2/19/

RealtyTrac had received a document indicating that the property in question had undergone foreclosure proceedingsThe information was published as it was provided to us by our data sources prior to the complainant’s purchase in January The record was clearly marked with
the date the document had been recorded with the county as well as the date the record was entered into RealtyTrac's database RealtyTrac does not always know immediately when a property is no longer available because we are not directly involved in the saleHowever, we are checking this information on a regular basis, and once we know that a property is no longer available, we will list it as Sold on the Property Details pageThe property record was promptly removed from the website on 7/7/2014, within hours of notice by the homeownerThe information at this site is provided solely for informational purposes and does not constitute an offer to sell, rent, or advertise real estate outside the state in which the owner of the site is licensedRealtyTrac is not making any warranties or representations concerning any of these properties, including their availabilityInformation at this site is deemed reliable but not guaranteed and should be independently verified

On 6/7/the member spoke with RealtyTrac regarding promotional packages for the serviceThe member chose to take advantage of a special $annual membership instead of the standard Premium access of $monthlyThe member indicated that they understood the terms
and conditions of the promotion prior to the chargeAll members agree that once billed the RealtyTrac fees are nonrefundable and will not be eligible for a prorated refund of any portion of your current term's paid membership fee The customer requested that the account automatically renew to lock in the low annual rate until cancelledBecause the customer did not cancel the account, the annual promotion renewed automatically in 2013, and There is no record of phone calls made by the member from June until May 1, when the customer called to request cancellation and a refund. The representatives explained the terms of use, why the account had continued to renew and asked the customer for the confirmation number as proof of a previous cancellationAll customers are supplied a confirmation number via email and verbally over the phone whenever an account is cancelledThe customer is unable to provide a confirmation number as there was no request made for cancellation.
All members agree that the membership fees are nonrefundableAlthough no refund was due, the member was advised that a refund of $would be issuedThe amount refunded is per RealtyTrac’s terms of use regarding billing disputes:
“…In no event may Member dispute any charge or account billing here under later than ninety (90) days after such questionable account billing or other discrepancy should have been or could have been discovered by MemberOtherwise, any and all such Member complaints are waived by Member.”
It is unfortunate that several months’ time had elapsed before the charges to the account were disputed, and we were notified of his desire to cancelThe time frame for credit card disputes is limited, and it is the cardholder’s responsibility to investigate charges that are unfamiliar to them in a timely fashion

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and although it is NOT sufficient, I must reluctantly accept the offer despite my strong objections as I cannot risk further financial loss However, I wish it to be known that after my initial correspondence, I revisited their website a second time to verify their claim that the automatic charge notification is "easy to find on their website". This was an absolute falsehood on their part. Given this information, it still took me a very long while to locate this statement and I finally found it cleverly hidden at the bottom of the page. I still believe I am owed the full amount due to their deception and hope you will consider my request for full compensation. The mere fact that they refused to offer me even a partial refund (however insufficient) for the remaining dates during our initial correspondence, serves to prove their unethical business practices. After all, they easily could have reviewed my access records to verify that I never visited their site even once, following the initial sign up, and obviously had no interest in becoming a member. I would also request that this business be required to send an immediate notification during the actual free trial siprocess that warns them about the $monthly charges should they fail to cancel within seven days, prior to final acceptance. Their practices exploit, trick, and deceive struggling people who are simply researching inexpensive homes in order to seek a decent qualify of life..

The terms of the trial are clearly stated on the registration page prior to

that if the trial account is not cancelled during the trial period, the account
automatically converts to a monthly subscription and the monthly fee of $
will be charged to the account information supplied by the new memberThese
terms must be agreed to by the registrant prior to continuing with
registrationThe member’s account was not cancelled within the day trial

The member called to request cancellation on 3/7/2014, well

and advised she would have access to the service until 4/1/at which point
the account would terminateThe caller was unable to provide any confirmation
as proof of a previous cancellation at the time of their callThe
representative explained the terms that were agreed to upon signup, which
states that charges on accounts are non-refundable

RealtyTrac provides access to foreclosure information and leaves
the following disclaimer on all properties: The
information at this site is provided solely for informational purposes and does
not constitute an offer to sell, rent, or advertise real estate outside the
state in which the owner of
the site is licensedThe owner is not making any
warranties or representations concerning any of these properties including
their availabilityInformation at this site and its property ratings are
deemed reliable but not guaranteed and should be independently verified
RealtyTrac does not always
know immediately when a property is no longer available because we are not
directly involved in the saleHowever, we are checking this information on a
regular basis, and once we know that a property is no longer available, we will
list it as Sold on the Property Details pageTo have the best results in
pursuing the properties on RealtyTrac, we recommend subscribers focus on the
most recently listed propertiesEach property has the date it was recorded at
the county and the date it was entered into RealtyTrac’s database
Subscribers can use the
'History' section of the property details page to check for all the data
records RealtyTrac has for a property
Our records indicate that the address provided was displayed
as a Bank Owned property recorded on 3/28/The details page also advised
the user that there had not been an update in quite some time and advised
contacting the lender to verify the current statusThe property details page
stated that the property’s listing status was not currently listed for sale and
was displaying the historical foreclosure data.
If a property is known to be listed as a resale home, a large banner
will display across the image which reads, “For Sale.” Most of the properties
on RealtyTrac are not currently listed for sale but are going through the
foreclosure processSubscribers would use this data to reach out to the
current owner to try and negotiate a premarket offer
Upon receipt of this complaint the property record was
deactivated pending further investigation

Revdex.com:
RealtyTrac.com is fraudulent at worst and deceptive at best with their billing practicesJudging by the other numerous complaints here, I'm not the only user to feel this way.
When you visit their site, they advertise to you that there is a risk free day trial in a few easy stepsWhen you begin filling out your info they ask for a credit cardIn clear, bold language and state it's only to ensure "you're a real person and to prevent abuse of their free offer".
To add insult to injury, the customer service reps I've spoken to have all verified that I never used their service outside of the day trialIn fact, I didn't use their service after the first day as I found their content useless.
I've already filed a fraud complaint with my credit card company but I hope I can get resolution here with a full refund.
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
