Response:

I spoke with a gentleman from the company and he stated that he will notify the accounting department and it will take about a week to process. The refund will be applied to the credit account.

I have reviewed the offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Good Afternoon [redacted],

Review: Ordered product on 6/10/13 with an oral commitment from the [redacted] that my [redacted] Spa would be delivered and set up for me ready to use. The spa was delivered when I was not home or notified, and my contractor was at my home and accepted the delivery. RecDirect did not set the spa up in any way and my contractor had to do most of the work of installation, after several attempts by unreturned phone calls to contact and get RecDirect to finish the installation. Once in a while, [redacted], the[redacted], would answer the phone but mostly he would not. I was on more than one occasion assured that he or his representative would be at my house to complete the installation, and I would wait all day and no one would show up. I would then place more calls and leave messages that were never returned. As of Sept. 12, 2013, I still do not have the cover lift attached to my spa, which was one of the attractions of the spa as it is difficult for me to do. My contractor has also been neglected on returns to his phone calls. I went to another company and they would not attach the cover lift for me, because it was not their spa and they would not assume liability.Desired Settlement: I would like to have the cover lift attached.

Business

Response:

Spoke with [redacted] of the business; he states that it is against the business policy to attach cover lift due to liability issues. He states it is stated to each customer that purchases a lift that the business will not and does not attach the lifts. Since the purchase the business has been out multiple times to fix chemical issues and has not charged the customer for any of that work.

[redacted] initially and thereafter stated that they would completely set up my spa, including the cover lift. The last time he was at my home on Fri., Aug. 23, 2013 (to bring a chemical that would clear my spa (which he wanted payment for and which was the second time he had brought a chemical), he stated that [redacted] would definitely be out the following Monday to install the lift. The lift has to be attached to the spa and no other company will do it because of the liability.

Not only do I still want the lift attached, but I would like a copy of the receipt for payment for this spa and and a recourse for getting service or warranty work done when [redacted] will not answer my calls or return voicemail left on his telephone.

Regards,

Business

Response:

Spoke to [redacted] and he has agreed over the phone that if the customer agrees to pay the service fee of $** a hour the business will come out and instant the cover lift. Even though it is not something that is normally done within their store policy.

Review: Received my brand-new hot tub on July 24. Filled it to recommended level 1 inch over highest Jett, we got in the tub and and spent 25 minutes in the tub. When we exited we realized water was pouring out of the bottom of the hot tub.I immediately called and was told because we had speakers installed by the manufacturer that we would need to drain the tub lower than the recommended level before using the tub and then refill it when we were done each and every time we use it. I don't believe that this is the issue I have had other hot tubs and have never had them leak. They have refused to send someone out to verify where it is leaking. At this point I want the tub packed up and a full refund. Don't buy from this companyDesired Settlement: Either fix the tub so it works and operates perfectly or give me all my money back

At this time, I have not been contacted by RecDirect Factory Outlets regarding complaint ID [redacted].

Review: HOT TUB DELIVERED OCTOBER 3013 WITH DAMAGED CABINET AND ELECTRONIC CONTROL BECAME DEFECTIVE IN FIRST MONTH OF PURCHASE. A PARTS AND LABOR WARRANTY WAS PURCHASED. INCORRECT AND CORRECT REPLACEMENT PARTS WERE RECEIVED AFTER SEVERAL REQUESTS AND WEEKS. WHEN CORRECT PARTS FINALLY RECEIVED I WAS TOLD TO INSTALL THE PARTS MYSELF. I HAVE CONTACTED THE COMPANY BY TELEPHONE AND EMAIL SEVERAL TIMES REQUESTING THE PARTS BE INSTALLED, TO NO AVAIL, AND NOW THEY HAVE STOPPED RETURNING MY CALLS AND EMAILS.Desired Settlement: FOR THE COMPANY TO INSTALL THE NEW PARTS AS PAID FOR WITH THE WARRANTY PURCHASED. ADDITIONALLY, TO ACCEPT THE RETURN AND REFUND OF THE UNOPENED COVER LIFTER FOR HOT TUB COVER, AS SINCE IT WAS NOT RECEIVED FOR A FULL MONTH FOLLOWING HOT TUB DELIVERY, WAS FOUND TO BE TOTALLY UNNECESSARY. THIS HAS BEEN ADDRESSED WITHOUT RESPONSE SEVERAL TIMES AS WELL.

ADDITIONAL DATES OF COMPLAINT ARE 11/13/2013, 12/3/2013, 12/13/2013, 02/07/2014, 02/12/2014, 03/07/2014.

Response:

I spoke with the business and they stated that the problems with the spa would not hurt the functionality of it. The business will put the consumer on their list and will be down in the area in a week or so to fix the hot tub problems.

I have reviewed the offer made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me. I will wait for the business to perform this action and, if it does, will consider this complaint resolved. If the company does not perform as promised I can get back to you at: [redacted].

ALSO, THIS HAS BEEN THE COMPANIES CLAIM FOR SEVERAL MONTHS WITH NO ACTION. I WILL GIVE THEM THE BENEFIT OF THE DOUBT, BUT RESERVE THE RIGHT TO CONTINUE THIS CLAIM IF NO RESPONSE IS RECEIVED FROM THE COMPANY BY 04.30.14.
