I had purchased a vehicle with USA Auto and besides the mechanical problems I had faced I loved the car and was completely satisfied with the company. Unfortunately they do not keep your loan and after a few months of on time and early payments I was handed the misfortune of being a customer with Red Mountain Funding. I soon learned there seemed to be no way to contact by phone getting an error message of "check the number and dial again" on multiple phone lines. This didn't work out as they like to berate their customers vocally and not through email. Every employee from the ground all the way to the GM Al Vendt are derogatory and juvenile in the way they treat customers. I had fallen into a bad time and luck kept getting worse. As I push my car after an hour and a half of working on it in the middle of a busy phoenix street to get it out of gear my phone flew out of the window and was ran over. I sent an email in regards to everything and their response was to tow the car. It has been almost a week and they still will not respond to my emails so I can at least pick up personal effects from the car and this has created many issues since now I have spent any monies I had left to try and find work without a car that was my only source of income. It has been made obvious through their communication that they waited till right before the holidays to have it towed out of spite. Extremely unprofessional and not a way to run a business. Out of everyone there I would like to thank Ciera as she was the only one who would help where she could and contact me the only ways possible.

It does not show as a write off. I am unable to get a car because of this. In fact it shows I have a car and I do not have a car. Thats what a dealer told me Saturday, oe who apparently knows the owner. You guys did that loan under false pretenses, I am contacting an attorney

this may have caused and want to help get this resolved as soon as possible.

Purchased a vehicle in 2012, moved out of state and fell briefly missed payments ( 3 months) completely honest with vehicle whereabouts and attempted to catch up on balance via check or authorization to withdraw from acct) Al whom intimidated the women I was residing with to the point that I stopped one from putting out a restraining order on refused the checks ( one returned over 6 mo ago for insufficient funds)and that was the reason I rendered two options. Received a call from Mesa detective that the call was being reported stolen for no payment, Al neglected to tell the officer that I had attempted to pay or that he knew where the car was located. My dilemma, how do I get a stolen car from Mi to AZ without having someone face the same criminal charges as myself. It couldn't be done. To shorten this up, I was charged with " unlawful failure to return a motor vehicle subject to a security interest" when I was willing to have vehicle transported to he company. I was given 2 opportunities to accept a plea deal for criminal charges, 2 unsupervised years of probation and up to a $4500 fine on top of still owing for the "stolen vehicle". The day of my trial 4/4/16, charges were dropped, company has vehicle per prosecutor. Prosecution stated that these small companies are the only ones in AZ to use his law for they only need proof of sending a certified letter( which I didn't receive) and it becomes the police/ judicial system responsibility, vehicle retrieved and they sale it all over again. Upon, getting ready for court Red Mountain Funding had taking $1861dollars out of my account and indeed reported to the credit bureau. The problem is that it was unauthorized, when the payments were authorized they refused to do so and instead filed criminal charges. Also, under the Federal Fair Credit Reporting Act provides that a creditor may not report an account delinquent to any reporting agency while there is a dispute that has been filed by the borrower of party involved. To date I have not received anything from this company, a report was made to equifax 5/13 stating the balance is still reported from Red Mountain Funding.

If Ms. [redacted] will contact my General Manager AL @ [redacted] Extension 103, He will resolve this with a credit report deletion letter so that it can be removed from her credit reports.  I apologize for the inconvenience and hope to have this resolved immediately.

We are sorry that Ms [redacted] was laid off, but per her Motor vehicle Contract, she is required to keep Full-Coverage Insurance on the vehicle at all time.
Forced-Placed Coverage is the only way a finance company can protect their collateral if the insurance is expired or...

cancelled. The cost of these type of coverage are very high because it is considered "High Risk".

Sincerely,

[redacted]...

This is a balance that is still owed on a purchase made in Mesa, AZ.
The account should show as a Write-off and we no longer have an interest in pursuing balance.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

This account was a voluntary repossession because of being laid off from my job at the time. The account shouldn't show as open as if I still own this vehicle as I do not it went back to the dealer. This should show as a repossession ONLY.
Regards,

Red Mountain Funding NEVER refuses payments from customers that pay on time.

This account was turned over to the [redacted] department and [redacted] was being pursued Under [redacted]  §13-1813-1, §13-1813-1, §13-701 and §13-801 on 11/20/2013, failure to return vehicle. ...

The vehicle was repossessed on 03/25/14. The account was over 240 days past due.  Vehicle was sold and there is a deficiency balance of  $1884.91 that [redacted] is still liable for.

We will gladly allow [redacted] to make payment arrange on her balance & report it paid once the balance has been satisfied.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

The response from Red Mountain is totally inaccurate!   The manager, [redacted], set up a situation for failure on the part of the customer.   Red Mountain manager would never take a payment early, in order to secure late payment fees for the vehicle.  The vehicle was made available for Red Mountain to repossess in front of a specific residence, but the manager, [redacted], wanted to rack up late fees and allow his ego to get in the way of working with clients.  The $1800. plus in late fees came from where??????    Ths is truly the worst company to deal with for auto financing and [redacted] needs to remove these fees immediately.

Regards,

[redacted] vehicle was sold on 03/25/14 for $6750.00. Her principle balance at the time was $7884.91. We paid a Repossession fee of -$350.00, a Skip Tracer -$275.00 & we had the car detailed for -$125.00. This leaves $1884.91 principle still owing to our company.
