RCS failed to tell the truth.  At NO time was a payment made with an NSF check.  They also failed to address the additional facts that we were first accused of writing an NSF check for the last payment... Then the story changed to a check written on a closed account.  The day they finally awknowledgef there was no problem with any of our checks we also received a loan modification package.  We have filed two additional complaints with the attorneys general in Arizona and Fort Worth.  RCS just advised us that our loan was sold ... They will not be receiving further payments from us.

Please see attached response. This letter is in response to correspondence received by Residential Credit Solutions, Inc. ("RCS") on January 18, 2017 for the loan referenced above.In reference to the recent complaint filed with the Revdex.com and referenced above, RCS conducted research on the servicing of Mr. [redacted]'s account. The results of our findings indicate that as the result of the delinquent status of Mr. [redacted]'s account, foreclosure proceedings occurred on June 30, 2015. In accordance to state regulation, the redemption period following the foreclosure proceedings expired on August 20, 2015.For reference, RCS last reported this account to the four major credit bureau agencies, Experian, Equifax, TransUnion, and Innovis for the month of August 2015 and reported the following information:Account Status: Foreclosure Proceedings, 180 (+) Days DelinquentOriginal loan amount: $660,800.00Current balance: $779,067.00Amount Past Due: $165,985.00Date opened: September 22, 2006RCS has determined that no error occurred in the last reported information to all four credit agencies as referenced above. Please be advised that based on the Fair Credit Reporting Act ("FCRA"), RCS has an obligation and duty to provide accurate information to the credit bureaus. This also includes the remaining balance due on the loan. Although RCS will not attempt to collect this debt, the balance will remain on Mr. and Mrs. [redacted]'s credit file for the appropriate time established by law.In the recent complaint filed by Mr. [redacted], he references a credit update issued by RCS in October 2016 reflecting inaccurate information. According to our records, RCS has received and responded to numerous credit bureau disputes on Mr. [redacted]'s account since the final August 2015 reporting. Upon receiving a complaint from a credit bureau agency, RCS is required to research the complaint and validate the account information accordingly. In the event that an update was made to Mr. [redacted]'s account by a credit reporting agency, we kindly request that Mr. [redacted] contact that agency accordingly as we have no bearing over what updates a credit reporting agency may report other than the data we provided in our August 2015 final report.With regards to Mr. [redacted] being unable to contact our office, please note that the number referenced on our website, (866) 317-0012, is our current contact number. Please be advised that Ms. [redacted]'s most recent correspondence is substantially similar to correspondence RCS initially received on September 7, 2016 and responded on September 15, 2016. We have enclosed a copy of this response for your reference.Please be advised that RCS last reported this account to the four major credit bureau agencies, Experian, Equifax, TransUnion, and Innovis for the month of February 16, 2016 correctly as detailed in our September 15, 2016 response.Please note that RCS did not receive any payments on the account during the time we serviced the loan. Our research reflects that RCS has reported payment information for this account accurately to the credit bureaus and no error occurred. Please be advised that based on the Fair Credit Reporting Act ("FCRA"), RCS has an obligation and duty to provide accurate information to the credit bureaus. For your reference, RCS reports historical payment information to the credit bureaus on a monthly basis.RCS has concluded that our most recent reporting of 180 plus days delinquent is accurate: therefore, we are unable to comply with Ms. [redacted]'s request to modify our reporting.Ms. [redacted] stated that RCS failed to complete a loan modification in April 2015 and denied options along with the short sale review. As stated on September 15, 2016, Ms. [redacted] was evaluated for a short sale consideration in November 2015 upon receipt of a complete financial package, sales contract and estimated closing statement. Unfortunately, our Loss Mitigation Department was unable to negotiate approved terms of a short sale transaction due to subordinate tax liens on the title of the property. Please reference to the non-approval notice issued on November 2, 2015.We have enclosed a copy of the payment history for the time the loan has been serviced by RCS for your reference. This document provides detailed information with respect to the accrual and application of principal and interest as well as property tax and insurance payments and corporate advances as applicable.Ms. [redacted] requested retribution for the Consumer Financial Protection Bureau ("CFPB") settlement that occurred on July 2015. However, our records do not reflect Ms. [redacted]'s account was included in settlement funds as we have determined no servicing error occurred on the loan.Please note that the account was service released on February 16, 2016 to a new servicer, Ditech Financial Services ("Ditech").
