Regarding the ***’s spoke to *** about replacement. We have no record of such a comment from ***S&A will repair the areas mentioned on the December letter regarding the glue releasing from the sub floor in areas *** told my husband they would had come back in and ripped out all the hard wood There is a reason why they are not responding S&A no longers subs them out, that is not our issue We hired S&A, who S&A hires to sub out to to make sure the job is done correctly is their responsibility, not ours.Regarding an engineer reviewing the sub floorThe independent inspector *** *** who was hired by the ***’s indicated that the sub floor is not levelS&A Homes would have and engineered measure the floor to insure it is within industry standards My husband has been traveling, I work full time running two business as well as take care of our children We have spent countless hours of our "free" time trying to get things taken care of in our "home." The amount of times S&A has been here has been exhausting in a BRAND NEW HOME This is not a selling point to customers, they purchase a brand new home to not have to worry about this many issues I will talk to my husband this week when he returns to see his thoughts on the engineer coming in Pictures and videos attached We aren't making this stuff up. Regarding communication from *** and *** ***Please share where the manufacture says rip outIf that was the case it would be a product warranty and *** would need to do so and *** would warranty the installation *Multiple *** *** Reps confirmed with us that this is a glue down floor and therefore nails should not be used to hold the floor down in multiple locations If this is an issue where the floor / joists are not level, the flooring will always come loose S&A has already (CB Flooring) nailed areas that were coming up and they are loose AGAIN Video Attached Pe per *** *** *** *** stated if using nails on a glue down floor they are only to be used on the edge of the flooring on walls to hold in place This is NOT a Warranty issue of the hardwood, this is FAULTY WORKMANSHIP DURING CONSTRUCTION PHASE AND INSTALLATIONSame as the upstairsPlease note, our project manager Ken was NEVER here due to health issues Another S&A employee should had been here in his place to assure floors were level before moving onto the next stage Clearly a reason not to rush the process as well They had to grind down a joist for goodness sake because how out of wack our flooring was, our wall is still bowing out because of this First thing anyone sees when they walk upstairs Another eyesore that we are to be happy with. Regarding the ceramic tile. I was told by Rich from S&A Homes that after we explained the action that could be taken that the ***’s decided not to repair *One of Rich's solution was to pop out the tiles that were in the areas that were uneven Rick from CB Flooring advised against doing this because it could crack other tiles We obviously did not want MORE cracked tiles, so are we to just be happy with an as is tiled flooring in a BRAND NEW HOME? We paid for this and it is FAULTY WORKMANSHIP It is uneven, not square and tiles are cracked Not one good thing about it I attached pictures of tile Our tiles are not even cut right, they are not even square When they ripped out our subfloor/hardwood in the hallway and lowered it, they should have ripped out the bathroom as wellCB Flooring said this is what they should had done when he was in our home, Rich talked around it and our bathroom was not ripped out Rich's approach for everything is to leave things as is and expect the customer to be happy with that We did not buy a used car We bought a brand new home and it needs fixed S&A states "Delivering value, service and superior construction is not only what we say, but what we doWe are S&A HomesThis is Home." *I have countless pictures dating back from construction to our first year of what most would think is too many issues to have in a BRAND NEW HOME I know you are replacing other customers flooring, not sure why we have been given the run around and the Rich approach on everything These are upgrades we paid for and have been nothing but the opposite We hope MrD*** was hired because of his work ethic and will do the right thing and make this right

At this point, there is no reason to review the door We do not want it "reviewed" we want it fixed We have taken it upon ourselves to reach out to whomever we need to, whether it be subcontractors, etc because we feel the way S&A "fixes" things is not up to par with that of a "Brand New Home." We have been given the run-around for TWO YEARS and anything that has been fixed has been fixed cheaply You can not just caulk, glue or nail everything and think that is ok, especially in a brand new home The majority of our fixes have been done this way and that is not acceptable when we have paid for brand new You can not expect a customer to be satisfied with "as is." We did not buy a used home. The door manufacturer was kind enough to come to our home not once but twice The first visit they replaced all of the weather stripping, etc to possibly help with any issues in the meantime They also looked at the door and noted that it was not caulked/ painted correctly, they said it actually should NOT had been installed because the frame was cracked (which we noted to Ken S&A and he said it was fine they would paint over it), they also said that it was an improper door and a composite door should have been installed with there being no front porch That being the reason it was rotting and why we had water damage in the inside of our home Please note, our floor has become worse by the front door and the flooring needs replaced AGAIN due to water damageWe are working with the door manufacturer and their customer service has been absolutely amazing We are business owners ourselves and value customer service *** Flooring will not replace anything at this point because nails were driven down into our flooring by ** *** *** *** the flooring manufaturer ALSO noted that this voided our warranty as nails are NOT suppose to be placed down through on this kind of flooring, other than along the walls to keep the flooring in place when installing *** Flooring would had replaced the flooring had S&A requested *** to replace it S&A never made us aware of this, however the subfloor is not level and that falls back on S&A anywaysThe framer and Project Manager should had made sure of this before moving on to the next phase. Yes, ** *** recommended to us in not replacing the tile because if they did, it could/ would also cause other tile to break in the process We agreed that removing tiles and replacing was not the answer We wanted our whole floor replaced as it was not installed properly and have been asking for this for two years and have had many emails ignored when requesting Being ignored for two years is not professional at all in an error you have made and have done everything since day one in NOT correcting You surely can't expect customers that are building a brand new home to except flooring "AS IS." Who in the world thinks that is even or acceptable in a BRAND NEW HOME? S&A is apparently the only one Note we have cracked tiles, no grout and a cracked transition strip that was custom made to fix the mistake that S&A made in ripping out the hallway STRUCTURAL ISSUE going into our bathroom NOTE floor was not level in upstairs either We have talked to multiple people in the flooring industry and other homeowners/ individuals looking to build and EVERYONE agreed that none of this is an acceptable fix. Our flooring is not level** ***'s remedy was to shoot nails through it That has obviously not worked Clearly the only other way to fix is to rip it out We are done with S&A looking at things Clearly S&A has known this has been an issue and has not done anything to fix it properly, they have had more than ample amount of time to do so and have chose not to. We spent hundreds of dollars on an inspector to come in after email after email being ignored You have had two years to fix and just like the door, have chose not to handle any of it properly. Windows have again not been addressed We have had multiple water marks from recent rains showing the caulking/adjustments have not worked This has been an ongoing issue for two years and clearly the amount of times the caulking/ adjustments have not worked They have never been ripped out to see where the isue is and every professional we have spoke to said that needs to be the next step. The amount of times S&A has been in our home has been countless not to mention ridiculous for it being a brand new home How does S&A think this is even let alone fair to their customers who have to work How much time/ vacation do they think people have and don't they think their customers would rather spend their time elsewhere We really just want to be done with this all and have these things fixed by true professional trades that specialize in the specific areas of concern, not "handymen." Clearly you can see by us talking to the actual companies and their take on it, something needs to be done other than reviewing and adjusting countless times Items need replaced, not substandard We honestly want to be done with this all and be able to tell others especially those that are building and asking our opionion, that S&A did resolve things, not the opposite

I am submitting the engineers report and pictures he took I also sent these to S&AThe report identifies three problems S&A states that this water issue was the result off too much rain and that houses flooded It is true houses flooded, however an email was sent that stated that the reasons for flooding in 4/homes was identified as plumbing issues that were repaired Our house was the one house at which no problem was identified.As such, ours was the only house to flood in this event without an identified cause S&A says that this was because of an unusual weather event If true, why was it our house that flooded and not the neighbor on the left or right of us? They say our house received too much water due to the weather event If true, then it must be the case that there is something different about our house relative to other houses as we apparently got more water than others It would not make sense to say it rained more at our house, therefore it must be the case that more water flowed to our house/foundation overwhelming the french drain.The engineer identified two likely causes or this increased water flow to our french drain One was the swale created by S&A when they built the house next door to us AFTER we moved in The second reason is that there is no installed gutter on a foot or so portion our roof which leads to cascading water directly at our foundation S&A states that this is how they constructed all homes of this model which seems to mean that it is ok According to the engineer, this is an issue that increases water to our foundation The fact that S&A repeatedly did not install gutters on this portion of roof does not mean it is okit simply means they repeated bad design over and over again A third issue the engineer identified was the failed seal between concrete pads and the house siding S&A says they sealed it, but the engineer identified this as a problem as it is clear that there is space between the concrete and the flashing that is not and has never been sealed.S&A has also claimed that we bought the house as is In our contract it clearly states that the house will be graded to direct water flow away from our foundation When we purchased the house, this was indeed the case Then S&A built the neighbors house after we moved into our house and they changed the landscape on our property such that the grading directs water directly toward our foundation This was clearly in violation of the agreement when we purchased the house as they altered the drainagenot us.S&A states that the house has flooded only once in years (as the model, or so with us as owners), therefore demonstrating that the rain event was unique The failed logic in this argument is that S&A created a swale next to our house that directs water to out foundation less than years ago The conditions of our house changed when they altered the landscape They indeed acknowledged this as a problem when the installed a drain at the back of the house when we identified the problem Unfortunately they never consulted with us and this was installed when we were not present and had no notice The drain is at the back portion of the house and uphill from the entire side of the home that flooded It fails to capture significant water that pools between our home and the neighbors home and runs to our foundation.We have asked S&A repeatedly to repair this problem There is no evidence that this was a unique weather event as only our house flooded without an identified failed plumbing problemand only our house remains vulnerable.Today I received our new home owners policy and our rates were raised by $per year The repairs cost about $and I lost a $insurance deductible and $engineering feeI want to give my insurance back their money to return my rates to normalThe estimates I have received so far are $to put a gutter on the roof and seal the concrete/house barrier, and $to install French drains The total cost so far is $not including my insurance rate increase In order to avoid court fees and further hassle, and to have the funds to correct the problems and move on from this event, I would accept a settlement of $ This is more than I asked for previously as I now know the costs to repair the problems with the house.Tell us why here

The business is not being honest. The outstanding items have not been scheduled for completion. In fact, we have not received any communication from anyone from S&A Homes since September 29, 2017. There are still quite a few items that need to be completed. At the time of this original compliant there was absolutely nothing scheduled for completion due to the lack of customer service we received from the business. It was only because of this compliant that we were able to get them scheduled to complete a few of the items. However, we are not satisfied or willing to accept the business's response because the outstanding items have not been scheduled or completed.

The rain event was an anomaly rain event and was not caused by any grading issues with the property. S&A has reached out to the customer and provided an explanation directly that based on extensive testing that was performed, including a dye test, that the flooding was caused by an extensive rain event that is beyond the control of S&A

S & A Homes has met with the customer at least one time on site since the complaint has been filed and have spoken on the phone at least one time since the complaint has been filed to review the customers concernsDuring those meetings, not only were the concerns reviewed but also the contract
that was signed between the customer and S & A HomesI personally received an email from the customer on April 24th confirming they have been in contact with our Pittsburgh employees reviewing the items and finalizing any punch list items to be taken care ofAt this point, it is my understanding everything is being addressed and move forward to an agreed upon resolution

S&A Homes is willing to come back to the *** home and review the front door and hardwood and make any necessary repairsRegarding the ceramic tile I have been told by Richard E*** that ** *** was prepared to replace a few ceramic tiles but Mr*** agreed not to replaceWe will also replace the few high ceramic tiles if they wishRegarding *** *** I have made several calls and have not received a call back regarding *** agreement to replace your hardwood flooringSince Mr*** was able to speak to *** I would appreciate knowing who he talked to and how I could get the information regarding replacementI would also like the opportunity to inspect your sub floor with and engineer who could document that the floor is level and meets all building standardsSincerely, Tim M***

S&A Homes provides a comprehensive year warranty for workmanship and materials, a year warranty on mechanical systems and a year limited structural warranty. Mr*** closed on 3/28/13, and thus would have had warranty coverage for full year for the items mentioned
below, ending on 4/27/14. S&A Homes was made aware of both items during this time period, and made multiple attempts to repair and replace items over a period of months. All repairs were accepted by Mr*** after final completion. Further, S&A Homes went beyond our procedure to accommodate requests after these dates. For the grading repairs, S&A Homes corrected and completed re-grading, through a major re-grade and a second toure-grade of the rear yard. This new grading adhered to all warranty standards and was accepted at the time. For the hardwood repairs, all identified boards have been replaced and completed, with the last replacements coming in April of 2014. For general surface damage, the acceptable industry standard is to replace individual boards. The floor was completed and accepted at this time as well. Now being years from Settlement, and years from the expiration of the warranty period, S&A believes that all outstanding items were previously addressed, inspected by S&A Homes staff, and accepted by Mr***. S&A Homes considers both of the items noted below as closed items

in response to the complaints1) This has been explained multiple times, wet weather delayed everyone in the Spring. I dont understand why this continues to be brought up- even if there was an escrow- it would have been released when the landscaping was complete and it would be released by an independent reviewer not by the customer. This is a moot point given it is October.Outstanding warranty items- certain items need to be ordered and or scheduled for subcontractors to complete. We were at the customers house on Friday September 29th so we couldnt start scheduling subs until October Once the subs have the materials and are available the repairs will be complete. As to the driveway, it has been explained to the customer on multiple occasions and in the numerous responses that the driveway topcoat is complete and we will not be repaving the driveway

For your reference, details of the offer I reviewed appear below.The Landscaping contract I received with the purchase of my home from S&A included a statement in regard to the grading around the house Specifically, the grading was required to direct water away from, rather toward the foundation of my home Subsequently, S&A built a new home next door to us At that time, S&A created a grading issue in the the slope from the neighbors house to ours directs water toward our foundation We asked for this to be fixed as water pooled excessive on that side of the house Without every informing us or speaking with us, workers were sent to the house and installed a single drain toward the rear of the home This drain was placed such that 2/of side of our house continues to have no drainage nor solution for excess water that flows from the neighbors house toward our house If it was indeed an excess of water due to an unusual event, S&A is solely responsible for creating a grade toward our foundation that increased water flow to our house and its foundation We asked for S&A to repair this on more than one occasion without any response We have had this independently assessed by a landscape expert who indicated that there needs to be at least two more drains holes placed in between the homes and that the land needs to be regraded to direct water away form the housean issue that S&A again created when they built the neighbors house The cost to complete this work from the independent contractor is about $ We have asked, and ask again, for S&A to pay for this work and to cover the expenses of our flood for which increased risk was created by S&A, admitted to when they partially (but incompletely) repaired the problem, and subsequently ignored our please to correct the issue, followed by the flooding event

We met with the customer. We are going to raise the drain and add topsoil to the areas discussed with the customer. Due to the amount of rain this spring, all of our landscaping contractors are behind in their schedules and we will be starting the work when they are available

The management of warranty claims is exclusive to twice a year to manage the process. With hundreds of homeowners, the process would be difficult at best to manage if there were not set review periods

I am sorry, who is Chris D***? We have spoke to so many people at S&A I can't keep track and find it hard to believe in response to some as they have never been into our home That is one of the main reasons along with us asking since our walk through to have things being fixed and it taking so long on S&A's part We have talked to a large number of other people and the all concur that their items have not be fixed in a timely manner How is this fair to home owner? My husband is traveling I am unsure of who he spoke to at ***, but I would suggest that S&A figure it out because that is what we hired them to do Regardless the are responsible and we have email after email prior to our one year of the floor needing fixed, so regardless if S&A no longer worked with ***, that has nothing to do with us Our floor is horrible, we did not buy a used home, we bought brand new I would be happy with being reimbursed the additional monies that WE spent on the UPGRADES and having my husband fix or we pay to have someone fix I would think that is fair There are multiple areas coming up on our first floor Truly sad when you walk and can feel that it is not even bonded As well, the upstairs hallway pushes down (sinks) when you walk on it If you ask Rory, I assure you he will say they did everything they could and we know they did, HOWEVER it is to be brand new and you can fill your skin pinch when walking over that area, which is not up to par with being brand new I will talk to my husband in regards to the engineer checking on the floor How would he determine this? What type of test are performed? I would be perfectly happy with being reimbursed our extra expenses on the upgrades of this and having my husband fix this You have to realize the ridiculous amount of times S&A Homes has been into our home, it's exhausting to say the least, Rory is a very nice guy, however at this point, I'd prefer that we handle it. You can not rip up the flooring and just tend to those areas Per *** *** and the flooring manufacture (***) that we have spoke to numerous times, it ALL would need ripped out if there are more than one or two areas I am aware our front door is fiberglass We have had water issues since construction which I had sent pcitures and emails on numerous occassions dating back to even before moving in They even had to rip out our hardwood floor that was ruined, AND being ruined again I will take the manufacturers word for it in that the door application that was used on our home is not recommended on porches that do not have a roof covering it I am sure it is a cost thing as it is cheaper and S&A seems to cut corners wherever needed to make more profitwe have learned this through building and the aftermath The manufacturer ALSO stated that the door was installed improperly which is why we still have water coming into our home Please just be practical What homeowner wants the builder coming in a dozen times to "fix/review" the front door when you still have yet to correct it All S&A has done was caulked and painted it Again this is has been an issue since before we moved in and our door was rotting before our one year Who buys a brand new home and their door is rotting The manufacturer has been extremely professional and is taking care of our door issue BUT our hardwood is warped around the door, AGAIN My husband had talked to someone at Atrium, they were actually suppose to come back up and have not We had talked to a dealer that sales this windowthey said the installation was probably done wrongjudging by our front door being installed improperly I would say the chances of that are probably correct We do know our Project Manager was rarely here due to health issues (so he told us) I was here daily and no one from S&A was We understand typically the sub contractors are usually the ones with the lowest bid and are rushing through to do things Clearly by the number of issues we have had and no PMthis is our story 6& We had asked Rich about the tile since prior to living here This is faulty / shoddy workmanship that has never been corrected We have tile in our basement that was to be used in fixing this Again, you can't just take out a few tiles, the WHOLE floor is not level and you can see this when looking at it AGAIN not BRAND NEW "Homeowners maintenance" would not even apply to this Again, this whole process has been exhausting but I will not give up We are business owners ourselves and would never treat a customer this way We have three homes going up in our development of close friends and more to come of people we know We even have friends in other areas that ask us how everything went that are building We would like to say that S&A did finally do "something" in making this right I would be happy with being reimbursed the extra that we spent in flooring upgrades (that ALL need ripped out) and either we hire someone or my husband replaces to our satisfaction S&A has tried to come in numerous times to fix things and we either have more issues or the same This needs handled yesterday. Although S&A Homes did make contact with us, the home buyers, none of the issues mentioned in the compliant have been resolved to date. The exterior painting is not complete, the grading of our lawn (to include additional fill) is not complete, the landscaping is not complete, and the issues with our driveway have not been corrected. All of this exterior work was to be completed no later than June 30, per the attached agreement (signed by all parties when we went into contract with S&A Homes in 2016). Our desired outcome is for S&A Homes to finish the job in its entirety. In addition, because S&A has not completed any of the above mentioned work by the agreed date of June 30, 2017, we are requesting the money held in escrow for the exterior work to be returned to us since S&A Homes is in violation of the agreement. The response provided by S&A Homes in an attempt to resolve this compliant should be considered nonresponsive as they failed to finish the job nor was there any mention or actions taken to return the money in escrow due to the violation of the agreement. It should also be noted that at no time last week did S&A Homes provide us with an estimated completion date for all the above outstanding work.

Pictures attached were taken on September 13, 2016! This problem was part of the Home Inspection Also viewed wires layin on grass Wires were coming from inside of home (pictures attached) Who would close on a home where these problems exist and at last visit to home and the original Punch List that was months old were not completed! Also at the last meeting pointed out to Chris that maybe the delays were caused because every time I did a walk through their were more problems like the bulging walls in the Breakfast Room that I observed that day and pointed out to him that the Punch List had still not been completed What Mr*** needs to explain to the Revdex.com is why he promised on August 30th to have this problem resolved in weeks As of September 13th neither me nor my real estate agent have heard from him If S&A homes were working on Closing on this home the repairs to stonework would be completed Although there are more than this problem with stone workWill be sending pictures of stone work to lawyer Their lawyer sent me "Seletive" pictures of stone work Will be sending pictures to refute his claims that work was done properly as confirmed by masonary expert and by the fact that the stone work is already cracking (see pictures) Tired of the run around and S&A and MrShoonmaker not keeping his word or promises, Will be calling troubleshooter reporter *** *** from *** to review the facts of the horrible workmanship, and S&A homes continuing to blame me for the delay when they have not kept there word about completing work listed on Building Inspection Report nor the original month old punch list.Regards,

[All of our issues haven't been resolved but I am pleased to report that S&A Homes did resolve many of the issues on August 31st. I am hopeful the remaining issues will be resolved within the next two weeks however, a message sent on September 2nd notifying S&A Homes that a hole has formed and needs filled in due to dirt settling in an area that was excavated on August 31st hasn't even been responded to at this time. Even now that they have a new contractor in place the response to issues doesn't initially seem much better or faster.]

For your reference, details of the offer I reviewed appear below.We did not agree to the waiting for the exterior work (driveway repairs and topcoat and repair of roof ridge vent) or the interior work (replacement of insulation removed due to flooding) to be completed at our month home inspection. These items were to be completed days after closing on the home which was April 27, 2017. In addition, the month home inspection was actually to be held at the month point, but S&A did not make themselves or their contractors available to support that agreed to (via contract) date. All of the "punch list" items were to be completed days after closing and the month inspection items were to be completed at the month timeline; not months. We do agree with S&A bringing the contractors to the home for the date of the inspection to ensure all items on our warranty work order are completed that day rather than scheduling them, but the "punch list" items need to be completed immediately. There is absolutely no excuse for the lack of care or customer service provided by S&A Homes.
