Mr Adam R was contracted by the sellers of the home I purchased 5/3/2018 to install a sand mound septic system as part of my home purchase agreement. He displayed a generally dishonest & disagreeable attitude during the entire process which I could overlook had he not completely destroyed 75% of my land in the process of installing the new septic system, which he received a sum of $24,000 to complete. I started with a field of rich dark soil and beautiful grass and was left with a yard full of palm to melon sized rock, rusty re-bar metal, nails, broken pottery, old sports balls, long wires, rusty metal brackets, and terrible clay dirt that nothing but a few weeds with grow in. When questioned about the quality of the fill dirt last year, Adam's response was that he got the dirt from a trailer repair business in York Pa. and that he wasn't required to used screened topsoil, just clean fill. The fill he used is no-where close to being clean. I was assured that he would return this spring and level out and re-seed any low lying areas. When contacted in March to do so, Mr. Ross sent his employees over who said they were instructed to "just dump the dirt in a pile". Which is what he did. The ground I was left with is a liability to me as it's a hazard to my friends and family who wish to walk and play in the yard. My Fiance and I have made several attempts to speak with Adam and try and work something out and he is ignoring our calls.

Ross Excavating & Septic Response • May 17, 2019

Dear Revdex.com.

Attached to this memo which represents our side to the dispute/complaint made by the known person mentioned above, I have also attached your "standard business questionnaire" per your request. We have read the complaint that was filed against our business and we would like to share "our" side to the story. We have been in business for what will be 20 years, this August. I have never in my 20 years of business had anyone file a complaint with myself/my business.

Our statement: We were contracted to install a new sand mound septic system by the ORIGINAL owner of the home before *** purchased the home. She asked to move into the home early knowing that work was being done. While we were there working, she AND her boyfriend were there watching over us most days. It is absolutely impossible to install any type of septic system without disturbing soil, grass, yard etc. Nonetheless, while doing so, we were constantly being harassed and yelled at for this of which we stated numerous times we would fix everything and it's part of the job. Once we finished the septic installation, we backfilled with dirt AND topsoil, seeded and layed straw down for new grass growth. Once we complete the job as a whole, an SEO (Sewer Enforcement Officer) comes out and inspects our work and signs off on the job work permit as "complete". An SEO came out, inspected, passed the job, and it was deemed as "complete". The homeowner's boyfriend (not the homeowner) called us on NUMEROUS occasions thereafter, often late in the evening hours, screaming and yelling to fix the settling of the dirt, the grass isn't growing, there was too much mud etc...we went out on several occasions to fix this for them with new top soil, new grass seed which happens to be top of the line grass seed and comes from a seed distributer not a local chain store. We also went out to replace their plastic PVC septic cap/line FREE OF CHARGE because they haphazardly mowed over it and then proceeded to call us later in the evening upset, angry and complaining about it. We fixed it with no charge as good customer service even though we aren't responsible for what people mow over. We have had entirely a ridiculous amount of rain since early Spring 2018. We do not control the rain and Mother Nature and what rain can do to people's yards. We tried telling them this many times. Because of the amount of rain, settling did occur at this job because of it being new ground, new topsoil etc. They demanded we come out and fix it on several occasions. We did and it still did not suffice for them. Recently they called us and said they wanted a new load of top soil delivered....did we have to "give" them topsoil...NO..but we did. We then asked where do you want it? They said by their septic system. We delivered it and sat it where we were told. That still was not good enough. Our topsoil is from our own stockpile. We have never found any type of sports balls, metal casings, debris, etc. If this were the case, I'm sure by now someone else would have pointed this out to us!

The issue we have with them is, when her boyfriend who doesn't own the home calls us later at night or late evening, he is belligerent, yelling, harassing, and threatening us. Enough is enough. We stopped taking the calls. We have NEVER been disrespectful to them and feel we have remained as courteous and as pleasant as we can be. We have decided not to reply to the phone messages anymore as they have become belligerent and a form of harassment! Let me state that we DO NOT have any form of contract with ***, the current homeowner, because the job was not done for her! The job was completed for the previous homeowner in order for the house to be sold to ***. This job was also inspected and passed by a SEO and was signed off as complete!

We have always stood by our work and have always provided top quality customer service. Our job was completed above AND beyond for the septic system installation at the home that *** now owns.

Thank you for your time in this matter and considering "our side" to this event.

Adam R.,

Owner
