I am rejecting this response because: Sacramento Landscaping still owes me the remaining amount of my deposit backThey never performed any of the work that was in the contract There is nothing in their contract that says the deposit is non-refundable I have sent a copy of the contract to the Revdex.com for their review The contract does not say that there is a fee for scheduling Our project was never scheduled The contract does not say anything about charges for text messages or phone calls or estimates No work was performed that would justify any charges Sacramento Landscaping is keeping some of my deposit, even though they never performed any contracted work for me

This letter is in response to the complaint for the ID number listed above.I performed a free estimate for the customer and met with them on two separate occasionsPut together a contract for the project and emailed it to the customerCustomer mailed us a signed copy of the contract with $
deposit.We did not charge for the two meetings and contract.Once we receive the signed contract our company put into motion scheduling and putting together a materials list.We also corresponded with the customer on multiple occasions through text and multiple occasions by phone.We spent more time than the $that we received for the deposit on the project.We refunded the customer $by mailOur company kept $for the work started on the project after receiving the initial contract and deposit.We feel that we were more than fair to the customer by refunding $140.We were on schedule or close to on schedule to do the project even with my injury that ended up only being a scare and nothing that would hinder us from performing the workEven with all the rain we received in December and January we were close to the initial start date to be able to start and complete project.Thank you,*** ***Sacramento landscapingMarch 2,

Dear Revdex.com,My original reply answers all the questions to the owners original letter and the second letter.He is mistaken that we had not done any scheduling of the projectHow would he know that? If I had not done any scheduling at all and only responded to his text and phone calls then why was I contacting him to let him know that we had an approximate scheduling dateAs you may know we had extraordinary amounts of rain this year and we could not pour concrete during the rain.Yes I hurt my footI did not know the extent of the injuryAs a good contractor I let the customer know that there may be the possibility that I could not do the projectI had a doctors appointment, they sent me to get an x-ray, and there was no internal damageI was able to perform workThis took approximately three days of one week and went into the doctor Monday of the following weekIt was less than one week before I had final notice and it was before our approximate starting date for installationThe owner saying that I did not respond to him was because he thought I was going to respond the same dayThere was a misunderstandingThere was no way I could see a doctor, get a x-ray, have an x-ray technician look at the x-ray, get the information back to my doctor, and then set up an appointment with me within a few daysIf you are able to do that please let me know who your doctor isSo why would I tell my customer that I would get back to him the same day or even within one or two days?Again I never said that I could not do the project but I let the owner know that there was a possibility that I may not be able to do it.Again I was more than reasonable to give any refund at all for all the time that was put into the projectNot counting the estimate or the visits to their homeYes that was freeAll contractors that I know would not give any refund at allWhen I talk to the original person from the Revdex.com he said I was more than fair giving any refund at allHe mentioned that most contractors would not give any refund back at all.Thank you for resolving this issue.*** ***

They never performed any of the work that was in the contract.  There is nothing in their contract that says the deposit is non-refundable.  I have sent a copy of the contract to the Revdex.com for their review.  The contract does not say that there is a fee for scheduling.  Our project was never scheduled.  The contract does not say anything about charges for text messages or phone calls or estimates.  No work was performed that would justify any charges.  Sacramento Landscaping is keeping some of my deposit, even though they never performed any contracted work for me.

I am rejecting this response because:Consumers should be warned about businesses that try to charge them for un-disclosed things.  Sacramento Landscaping is trying to charge me for things that were never discussed orally or put in writing in their contract.  Nothing in their contract says I would be charged for phone calls, text messages or scheduling.  In fact, our project was never actually scheduled.  [redacted] kept delaying getting back to me regarding his injury.  Also, it took over a month and 3 separate requests from the Revdex.com for Sacramento Landscaping to even respond to Revdex.com.  Nothing in the contract says the deposit is non-refundable.  Nothing in the contract states that there would be any charges prior to the actual work beginning.  Nothing in the contract states there would be charges for phone calls, text messages or scheduling.  I would like the business to refund the remaining amount of my deposit, so we can all move on. Thanks,[redacted]
