Again, I will no accept any response until all work is completed and a face-to-face consultation has been completed.

A refund for the over payment is in process and will be mailed out next week. As for the chimney cap, the warranty does not require it to be replaced. However, I have instructed our warranty department to replace the cover as a customer service.Regards, [redacted]

When I spoke with MK Roofing I was told that they only deal with roofs and not the transition to faux stone.  I was told that they could "look and see if there was anything they could do."  MK Roofing not being able to work with the rock transition would not solve my problem.  That part of the conversation must not have been documented.

The warranty, provided by Structure Home Warranty states on page 3, Section 4, subsection 3, item b, states: "You agree that only those repairs necessary to make the house habitable or mitigate further damage shall be performed."  The roof/faux stone junction, as well as the whole wall, was not built correctly.  These repairs are being made to prevent more water from destroying sheetrock and entering into the house which will cause a great deal of damage.  With the outside wall not being built correctly the first time, there was hardly any barrier to prevent more water from coming into the house.  When water can freely flow down the faux stone and onto sheetrock, damage is going to occur and has occurred.  When there was no flashing in-between the faux stone and the roof, damage is going to occur.  When the proper water barriers (in this case were not up to code) are not on an outside wall, damage is going to occur.  Water will find a way through the rock and into house.  There was no waterproofing spray to seal the stone and mortar to help keep water out.  Water is very a destructive force.  These repairs are being made to mitigate further damage.  There are no other solutions that would mitigate damage except rebuilding the wall.

Again--------This is the opinion of the homeowner. We were not on site to check out the issue.

I understand that there has been a death in the Sandlin family and I certainly send my...

thoughts and prayers. However, they have not been responsive in the past and I want to keep this dispute open until all the home issues are completely resolved. Over the weekend there was a leak in my roof which caused damage to my laundry room ceiling and walls. All of this needs to be fixed.

This is only the homeowner's opinion. Since we were not on site when the stone was taken down we have no idea what could have been the cause for any water encroachment. These repairs were unauthorized by Sandlin Homes. Tearing down an entire wall of stone to repair one piece of flashing is ridicules and unwarranted.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my dispute. We did not simply change our mind. We backed out of our contract due to the work ethic or lack of from your contractors. There were numerous e mails sent to [redacted] as well as [redacted]. [redacted] always responded, [redacted] did every now and then. Unfortunately we endured months of one problem after another. Things that were red lined were still done wrong and had to be re done. Each time we came to see the home we were purchasing we found another problem that we would find half fast fixxed the next time. Yes we did terminate our contract and rightfully so. I can't justify spending that kind of money on poor workmanship. Sandlin was able to sell the home plus keep our deposit . I can't see how selling the home and keeping our 6,000 is causing Sandlin to loose money. This is a case of doing the right thing as a company. We wrote emails asking for a portion of our money back and all we got was a email from [redacted] telling us the money would not be refunded and good luck on our new home search. Not ONE person including Mr. [redacted] NEVER called to try to make this right or resolve any issues. No body seems to be concerned with everything we had to endure as a family building a home that was supposed to be our dream home and all it was was disappointment after disappointment. No body ever took any kind of accountability for their mistakes. Unfortunately the more people I talk to the more I am finding out that we aren't the only ones that have had bad experiences with Sandlin Homes. I'm just glad we walked away when we did. As a business owner myself I would never treat a client this way. I would get to the bottom of the problem and do whatever I could to fix it. Sandlin did none of these things but had no problem keeping every dime we gave them. The response from Mr.[redacted] was actually insulting to me.

Complaint: [redacted]
I am rejecting this response because: I purchased a new home; a damaged chimney cap was installed and, while functional, was still damaged.  A new one should be installed and I reject the idea that hammering out the dent is acceptable and within the parameters of the warranty. i have not received any communication in regards to the fence despite several efforts to get a straight answer from Sandlin Homes.

Please enter your reason(s) for rejecting the business response below. That is not true at all!! There was no conflict with my schedule, Sandlin promised me that the list would be completed on 7/14-15/2016 I took vacation days and they no showed and would not answer my text or phone calls. Now they want me to schedule all of the venders to complete all of work that they failed to complete. I have written proof that we agreed on those dates and unanswered text when they didn't show up! Nobody at Sandlin takes ownership they have always blamed somebody else I.E. Venders and co-workers. They need to set up all of their venders to complete the work. I have let them know that I will take two more vacation days on 8/4-5/2016 so they can setup their venders on those two days to complete the list that will be over 2 MONTHS OLD and have failed to hear back from them! It is past time for somebody over there to take ownership and make things happen and hold people accountable.

Yes,Sandlin Homes "addresses" issues. They just do not have a qualified representative follow up and ensure the issue has been RESOLVED completely and professionally. They give no time line for when the "addressed" issues will be completed to the customer's satisfaction and continually send out sub-contractors without contacting me or my wife letting us know workers will be arriving at the house.Poor, Poor, Poor customer service.

I have looked back at this 2014 issue and I asked the roofing company to check their records. Their reply was:

Per our contract we will retain all earnest monies. The section is 2, C-1 that states buyer has to cancel within 30 days of execution or the contract is hard and the builder moves forward with construction based on a lenders qualification letter. The buyer has sent me an email stating that they...

understand they will not be receiving any deposits back.
Thanks,

I have discussed all reported issues and was informed all were corrected in accordance of the warranty provided to the customer. The charge for the fence is being reviewed and if determined an overpayment was incurred a refund will be issued to both buyers. I would assume this refund will be sent...

this week. [redacted]Sandlin Homes

The roofing company has been notified and once we are certain the leak has been taken care of, we will take care of the interior residuals.
