Service provider severely damaged a my residence while attempting to provide a service.
Friday, June 30, 2017 - *** (Sandy Acres Company) had his crew begin the removal of old shingles to replace the roof at ***. His crew directed the shingle delivery personnel to deliver/stack the shingles all on one location of the roof. This collapsed the roof and destroyed one trust and one cross member. While ***'s crew, and at times *** himself, were on the roof the continually removed big sets of shingles into the landscaping on two sides of the residence. They destroyed four Crepe Myrtles, and five large Tomato plants. This was photographed numerous times and even videoed. While they continued to remove the shingles, they damaged the seamless guttering on the South facing side of the building. At this point, we had already talked to Mr. and he insisted that everything will be fine when he was done.

Saturday, July 01, 2017 - We were able to get in the attic and access the damage and decided that we were no longer to let Mr. or his crew destroy our house any longer. The problem was that the roof was now exposed to the elements since the shingles had been removed somewhat. We found a great roofer who was willing to come out and help us out of our predicament on Sunday morning. I left a message for *** about his workmanship and what had transpired. He showed up shortly thereafter and was told he or his crew was not going to do the work.

Sandy Acres Company Response

This is a letter I emailed Jason on friday 7/21/17

Let me see if I understand this. The total was $5,000 and your responsibility was $2,500 per the contract you signed (see attachment). Out of the total I was to supply the felt (which about 40% was done the same day as the tear off), nails, button cap nails for the felt, dumpster, permit and the ridge caps which I left there (6 bundles). On Friday you called in the early evening and I came over to address your concerns. Not to long after I showed up your mother n law came out and as she was walking over to your house she made the comment that she was going to make sure that I did not get paid. That is when I came over to your house and asked what was going on. When I asked her to identify who was doing something wrong she got all confused and could not identify anyone specifically. You and I talked and you stated to me not to worry all you where concerned about was getting the roof on and it not leaking. A short time later your mother in law came back out and asked about the satellite dish. I explained to her that I had advised you to call Dish and set up an appointment in case we could not realign the dish. I spent about 30-40 minutes with her trying to get the signal back but could only get local channels. She said “that’s okay we’ll call dish”. Per the contract you signed it explains that about the dish. The guys worked till almost 10pm that night.

Saturday morning a 7:37am you called and left a message regarding the roof rafter. Your tone was very normal and you stated we needed to fix it. I showed up about 8:30am and took responsibility for it and stated I would fix it and needed inside to see the extent of the damage. That is when you went off the handle and told me that I was not to step another fking foot on your house. When you left I clean out the gutters, fixed the 2 small dents from the ladder on the gutter (which is not even on your section of the property because the ladder was set over the neighbors garage not yours) and washed them out, trimmed all the bushes and cleaned out the planters. I sent a couple messages stating I needed to get up on the roof and finish felting to keep any water out. You refused it and stated again that I was not to go on the roof.

On sunday there where 3 guys on the roof for no more than four hours. You claim the bill was $1,700. Lets break it down. They needed about 3 rolls of felt @ $55 to finish felting the roof in and to fix the roof the total material would be less than $75 and about 2 hrs for 2 guys. While these guys are on the roof with their ladder leaned up against the gutter like we had I observed one of the workers brushing the roof material off in to the gutters (see video). Than on the estimate you want me to pay for contractor to clean the gutters and than replace them from another contractor. I also observed them cleaning stuff out of the bushes which are the same bushes you claim are destroyed.

You claim my guy yelled at the roofing delivery guy about where to put the shingles and that he signed some waiver. I’ve asked several times to see it but you cant produce it and than tell me to get it myself. I asked them for a copy of it and they don’t have one on file. My guy and the delivery guy both claim that your statement is false. I don’t hold roof depot responsible regardless. Remember I took responsibility from the start to fix it but that did not happen.

You claim we destroyed your yard with ruts. I observed your new roofers on 7/17/17 and 7/18/17 using your yard as a parking lot.

And you want me to pay you $7,001.00 and claim the neighbor wants $2,500 for a total of $9,501.00? Not to mention to get it to the condition that it was in before you threw me off the job was almost $2,500. So we add those and get $12,001.00 that comes from me and you don’t even chip in your $2,500? I’m either really bad in math, don’t charge enough for my services or you think I’m completely insane. I think we call it even and go our separate ways.

I talk to the new Roofer and they stated that they advised Jason Mickey that the gutters are fine, the drip edge does not need replaced and they also agree that since he made the decision to do the work for $1,700 that I should not be responsible for his decisions.
