I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Response to business response1. Poor workmanshipYes per our agreement they would not charge me for engraving on replacement units. As per our agreement the were to pay for the damaged units from their poor workmanship this has not happened. They have damaged thousands of units. In which I have had to pay to re process these units which has cost me tens of thousands of dollars. There claim to have a very low error rate is not true it is my opinion that their error rate is very high. They always claimed that it was due to my anodizing. When it is very clear that there is no problems with my anodizing due to the fact that I have had thousands engraved by professional engravers with absolutely no issues with the anodizing. Also I have used several different engravers and have brought units that Scorpion Ridge engraved on to them (without disclosing who did the poor engraving). These different engravers have given me the same answers each time. They do not know how to use their equipment properly as far as speed settings and power settings to do quality work. They are using the incorrect setting to speed up the process and not caring about quality.  Or they have equipment that has not been properly maintained or serviced! These professional engravers have also engraved on units that Scorpion Ridge had claimed that the anodizing was the issue with absolutely no issues and perfect engraving!Furthermore Scorpion Ridge has NO Knowledge of the anodizing process or any knowledge of how anodizing works! With that being said they are not qualified to blame it on the anodizing! It is simply a Lie to save them the cost of replacing Damaged units. In the agreement mentioned in their response they state that once these units have left their place of business (home) to ensure it was their errors. This is just so they could get paid as fast as possible and had nothing to do with not being able to tell if the errors were theirs.  We also had a verbal agreement that I would need an area to inspect these units at their place of business that was well lit as to be able to inspect hundreds of units  thoroughly. This was never met!! Instead I was forced to try to inspect my products engraving quality on the floor of their front room with the foul smell of Pet Urine and Feces. with very poor lighting. I would do my inspections in my shop where it is very well lit and plenty of room to inspect hundreds of units at a time. They stated they could not be assured the errors were theirs. Please note the other company's DO NOT use the same Font, Size of text and they also use different artwork!! Therefore there would be no problem proving the errors were Scorpion Ridge's Errors! Also please see attached photos of units! There is ABSOLUTELY no way The Quality workmanship of my other engravers could be mistaken for the Sub Parr poor workmanship of Scorpion Ridge! Attachment Example-1 Scorpion Ridge on left Professional engraver on Right!Attachment Example-2 Professional engraver Showing a different design on bottom and a Logo that they have never done in that size. Attachment Example-3 Professional engraver Different design! As you can CLEARLY see the quality if the engraving by my professional engraver is far and beyond the quality and workmanship of Scorpion Ridge!Attachment poor-1 this image shows that they have no Clue what precision is. Which the advertise precision engraving. Centering the text has nothing to do with anodizing!Attachment poor-2 Mistakes made by Scorpion Ridge paid for by me. Attachment poor-3 The one on the right is the Approved logo. the other 2 are incorrect. How is this the anodizing?I have THOUSANDS of these units damaged by Scorpion Ridge!!  2. [redacted] was notified by me when he was at my shop on 6/12/15 that I would be sending this invoice. I had the damaged units marked and out for him to view their errors! As far as their statement that the business relationship was terminated by them is FALSE! Please see attached email from me dated 6/21/15 Giving them the opportunity to bring their engraving standards up to par or I would be forced to no longer use them. They chose not to!Attachment Scorpion Email3. They still have DISPLAY units in their office (home) Of military units that they have never been  returned or can produce a paid invoice for these units. Furthermore these units are of Highly Trademarked Logo's that I have the Trademark Licensing for and they do not!  They also have MANY more of these test units!They still continue to have my product in their advertising ie;  Website and Social Media! most of which are highly Trademarked Logo's That I hold the proper licensing for and they do not! These entities have been notified as to their illegal advertising and their legal departments will be handling that!  If I may add we can find NO records of a Scorpion Ridge Custom Laser Engraving registered with the [redacted] or records of [redacted] or [redacted] being listed as a Statutory Agent, Manager or Member of any Corporation or LLC listed with the state of Arizona! My company works very closely with ALL branches of the [redacted] and many other Government agencies along with a Very long list of charities Nation Wide!My reasoning for this claim is to 1. Get my invoice paid and be done with this Amateur Company and hopefully save another Business the very long list if problems that I have had with using this company.It is in my opinion that this company has been very dishonest with me and will lie to save themselves a Nickle!I am only trying to produce the Best product possible for my customers!Thank you.[redacted]Owner[redacted]###-###-####[redacted]

We have been doing business with Scorpion Ridge for about 3 years and have not had one bad experience. They are always accommodating and customer services is great. They have our business and I would recommend them.

September 22, 2015Re: Complaint ID# [redacted]Thank you for your time and help with this complaint. Again, our wish is to resolve this situation and maintain our excellent rating with your company. We believe we have responded to all the legitimate settlement requests made by this customer.Pay unpaid invoice There are no legitimate outstanding invoices to be paid. He is asking us to pay him for alleged damages, on units that he;-Personally inspected at our place of business, on a desk that will hold 200 units at a time, in front of a large window, under a bright light.  With his signature, he approved the quality of engraving, and payment of these units.  He then took the units and left our business with them.-He took the units to his home based business, had them there for four days, inspected them again, made adjustments to invoices citing alleged damage reducing our invoices total balance due by $40.20, thereby violating our business agreement.-He then paid the balance due, less the $40.20 on June 22, 2015.-After we terminated our business agreement with him, then he sent us the invoice demanding payment for additional alleged damages, and threatening legal action if we did not pay.Return his product We returned his original display units (the five that we displayed in our office with his business cards as free advertising for him) in 2013. We also returned the four test units, that we received in aprx May of 2015. We emailed you the proof of delivery (which required his signature) from [redacted].Remove my product from the're advertisingWe have removed this customers logo and company name from all our advertising, and all references to his company in our product description, we will no longer engrave his logo on the bottom of the remaining stock we have to sell. There is no connection between his business and ours, on our website or in any of our advertising. Future customers will have no reason to connect our business's as other manufactures sell the same product he does.We still have units to sell, (units we accepted in lieu of payment when he could not pay the balance due on his account). We have a right to recoup the monies he owed us by selling the units he gave us, in lieu of payment, for that very purpose. Pictures of units we have engraved (without his logo and/or company name) are needed to sell them.On 6/22/2015 when my husband delivered the last order to this customer at his home based business, he also intended to let him know we could no longer do business with him. This last year,this customer has been increasingly difficult to work with and unprofessional in speech and manner. Our goal was to politely terminate the business relationship, and wish him good luck. After about 10 minutes it was very apparent that a professional discourse was not possible, so my husband left.Please note that my husband left with a check for payment for the units that this customer is seeking additional compensation for. (less the $40.20)After that “conversation” and the receipt of his letter, we thought the best avenue was to email him, and agree with him that our businesses were no longer a good fit, and wish him good luck in the future. Not to pursue the balance due on his account, because it would mean additional communication.Please note;At any time during the four years we did business with this customer, if he was dis-satisfied with our workmanship, all he had to do was stop bringing his business to us.We have engraved thousands of other anodized items for other customers with no problems or complaints.We have never advertised or listed our company as a corporation.The only military trademarked items we have engraved for resale were his orders. We do not offer trademarked items for sale on our website nor in our shopping cart.Thank you for your time and attention, we look forward to hearing back from you soon. We hope you also see we have done everything possible to resolve this dispute. Including not requesting the $40.20 balance due on his account.
