Silver Cloud Financial, Inc. ("SCF") is in receipt of your communication dated February 18, 2016 in reference to [redacted] complainant identified above. After reviewing [redacted] notes on [redacted] account and [redacted] complaint itself, [redacted] following determination was made.

[redacted] applied for an $800 loan with SCF, which was funded on December 15, 2015. [redacted] terms of [redacted] loan, [redacted] payment schedule, finance charges and [redacted] annual APR were disclosed to [redacted] in [redacted] loan contract, and [redacted] contract was signed and [redacted] terms agreed to before SCF issued [redacted] funds. All SCF loans follow a standard 20-payment schedule. However [redacted] did not have to follow [redacted] 20-payment schedule; all SCF customers may pay additional principal or pay their loan off in full at any time without penalty. Therefore, SCF disagrees with [redacted]'s complaint.

However, SCF is committed to excellent customer service and has marked [redacted] account paid in full and will not collect any further payment on this account. No additional monies are due.

SCF is pleased to be able to assist [redacted] consumer in this manner, although it is under no legal obligation to do so. SCF is located on sovereign land of [redacted] Habematolel Pomo [redacted], which is a federally recognized Indian tribe. It is licensed by [redacted] Habematolel Pomo [redacted] to make small loans. [redacted] SCF loan agreement and website contain all disclosures required by Habematolel Pomo [redacted] and federal law and make it clear that all transactions are governed by [redacted] tribal law of [redacted] Habematolel Pomo [redacted].

I accept them closing account however I still believe I was sent things to sign but they didn't have all [redacted] totals and time it take to complete loan. And if what they do is legal I hope these laws are change soon cause it [redacted] people who need who are hurt and can lose a lot

SCF is sorry to learn that [redacted] is experiencing financial hardship. SCF has acted in accordance with the Loan Agreement and therefore will not issue a refund. However, because SCF is committed to excellent customer service, it has decided to waive the remaining balance. Nothing further is due and owing. SCF considers the account closed.

Thank you so much for your quick response to this matter.  I am writing to inform you that this matter has been resolved as of this date and I feel that I will have no other problems with this company.
 
I took the position of contacting them and  sending them a letter while getting my bank involved with the suspicion of fraud being my major complaint.  Satisfactory results were delivered at this time.  If for any reason I should have problems with this company again, I will not hesitate to contact you and resume my complaint process.

[redacted] information was submitted to SCF by application on October 12, 2017. During the application process it was identified that this information was submitted fraudulently and the application was withdrawn. No loan has been made in [redacted] name or using her information, and her information has been added to our do-not-contact list as well as flagged so no loans can be made using it in the future.
 
While SCF cannot prevent fraudulent applications or identity theft, it has implemented and follows these procedures to minimize the impact to the consumer.   SCF is pleased to be able to assist the consumer in this manner. SCF is located on sovereign land of the [redacted], which is a federally recognized Indian tribe. It is licensed by the [redacted] to make small loans. Silver Cloud Financial, Inc. ("SCF") is in receipt of [redacted] rejection of our proposed settlement and disagrees with her assessment. SCF emailed her notice of its intent to waive the finance fee on the remainder of the loan on June 13, [redacted]. The email was sent to [email protected], and a copy of the email is attached for reference. If this is not the correct email address for her, we ask that [redacted] provide another one. Or, she may call the compliance department directly to discuss the settlement offer at 866-**6-9685.
 
We hope that she will be happy to see that SCF's calculation of her remaining balance is over $100 less than what she reported in her latest response. Although we continue to disagree with [redacted] claim, we are happy to be able to assist her in this manner. Again, we encourage her to contact customer service at 855-254-54** to arrange a payment plan for the remaining balance at her earliest convenience in order to resolve this matter.

SCF's loan application and approval process occurs online. [redacted] submitted her application electronically on May 9, [redacted]. As part of the application process, consumers are directed to a webpage where they may electronically sign their loan agreement. Our records indicate that the loan agreement associated with [redacted] application was signed electronically on May 9, [redacted]. Her loan was funded on May 13, [redacted]. While it is possible that [redacted] mistakenly signed her loan agreement when she applied for a loan, she has not made any attempt to return any of the loan proceeds.  However, because SCF is committed to excellent customer service, it is willing to waive the interest on the loan and allow [redacted] to repay the principal balance. SCF encourages her to contact SCF at 855-209-8392 to set up payment arrangements.

The terms of the loan, the payment schedule, finance charges and the annual APR were disclosed to [redacted] in her loan contract, and she signed the contract and agreed to the terms of the loan before SCF issued the funds. Further, all SCF agents are required to inform customers that their loans are structured on a 20-payment schedule, and that they may pay additional principal or pay their loan off in full at any time without penalty.
 
SCF is sorry to hear that [redacted] is not satisfied with the customer service provided to her. SCF is committed to excellent customer service and therefore agrees to waive the finance fees for the remainder of the loan. SCF's complaint resolution department has contacted [redacted] via e-mail and informed her of its resolution and encouraged her to contact customer service at 855-254-5430 to arrange a payment plan for the remaining balance.
