My motheris a senior ***. They conned her into a 10 year contract in 2014 at 73.45 per month for a water softner unit.
Now that she wants it removed, they are charging over 3600.00 to terminate the contract and refuse to remove the unit stating that 'its not their problem' meaning that its our problem to disconnect and remove it. They have no issue charging to install or to service it.

Desired Outcome

We want the co tract terminated at little to no cost and the unit properly removed at no cost to her. They conned her and now that she wants it gone. She cannot continue to afford the costs.

My mom was completely duped by a sales man going door to door selling water softeners. She wanted one and agreed to having it put in. The following week the same man came and told her he was coming to check up on the unit and that they forgot to install a piece. He had her sign another contract for it which she assumed was just for the water softener and this additional piece that they 'missed'. The pieces both had the same company name on it so it all made sense. We then noticed she was being charged by two companies on her bill but were told one company was bought out by the other so it was fine. Turned out the sales man ended up selling her without her knowledge a carbon filter that she was completely unaware off and the new contract was for a whole new machine. She is now selling her house and this is how this all came to fruition. The man who came to look at it confirmed it is two separate pieces and in order to get out of her contract they're making her pay $8,000. She's had the unit since 2015 and has been paying $100/month.

I can't believe someone would take advantage of anyone like that let alone an older lady and for the company to allow this to happen. This is absolutely ridiculous. He had her believe it was part of her original purchase all the while knowing he was making her sign a whole new contract. That is unjust and just not right.

I want the buy out cancelled as she was never aware of the second contact.

. We don't know how to get out of this contract, negotiate with them or get rid of their product in her home. This is an extremely urgent matter, as she is about to lose her home over these unjustified fees they are charging her.
I, ***, have Power of Attorney. I would like to actually speak to someone or personally visit with you, so you can peruse the paperwork; contracts, product information and service, bank statements which show continued automatic withdrawls on products that have well been paid for, because it is all too confusing for me. Your immediate attention to this matter would be greatly appreciated; URGENT.

This company has overcharged my Mother for products that she did not need and have never been serviced. The contract is for 10 years and she has already paid $28,000 thus far (after 5 years). It is a number of products (furnace, a/c, water filtration, water softener, etc.). She was duped by them from a door-to-door salesman and within less than 24 hours, they were in her home installing all these unnecessary products, designed for a home twice the size she lives in. She has more than paid for these products, over the last 5 years and now they want the exact same amount to cancel the contract. Could you imagine paying $56,000 for these items? Her house is only worth approx. $200,000, that a quarter of the price of her investment. This is totally unacceptable and we need to put a stop to this right away before she loses her house because she can't afford these payments any longer. Note: This purchase was made by both my Mom & Dad, but Dad has since had to be moved to a nursing home, so she is alone with all these payments.

....the door to door salesman introduced themselves on behalf of *** and also said they were sent from the government of Ontario, they said it was mandatory for me to change my furnace and said it was illegal to have an old outdated furnace, they said I could get charged for having an old furnace. they mentioned that the government would give me incentives for having it changed. They were very convincing. Every year they are increasing my payments, I have yet to receive an updated bill I do not know the total balance , every time I try to call they give me some *** excuses saying they will have it emailed but I have still not received nothing. *** . I will be taking legal action against them.

. Door to door salesman. Friendly. What he said was not what it was. Said I would not notice a change in my bill. The new units would save me money. Goverment incentive to upgrade.
The unit has been leeking. Its to do with the cycle drainage.
Made calls for maintenance. Never came or cancelled.
Looked into buying out which I made clear to door to door gentlemen. Had to pay 100 dollars to get info on how much I owed. Its not a ti date buy out. Its for the entire term. However I stated. Repeadily to the salesman I wanted no contract. Unbelievable that I still owed that much after all the time had past.
Tried to get *** to seperate the bill from them. They wouldnt or couldnt. Yet could not help me.
The amount the consumer is paying for these units in unreal. I cant believe it.

I was approached by door to door salesman from *** for the sale of a water softener which I did not believe I was required for my home. The salesman tactics were very convincing in that he offered government incentives for the rental of the water softener. These incentives were suppose to out weigh the costs of the rental but no such incentives ever appeared on the bill from simply comfort. I was given ten days to cancel any contract with them but I was unable to get into contact with the company for those ten days and was simply denied once I those ten days were up. There was no follow-up call to the installation of the product, the product was not installed properly and caused a major leak which damaged equipment in my home, I was never compensated for that loss even though I was asked to provide photos and billing for the damage and was never contacted after that. The bills from simply comfort clearly show that I am paying for two water softening systems where the monthly fees are increasing every year. It has been 4 years now of trying and failing to come into contact with the company to rectify these issues with no success. I was able however to contact them in regards to a buy out and was informed that over $10 000 in fees were still owing for a buy out even after four years. I was tricked into keeping a contract I did not want from the minute the products were installed and was not given the opportunity to cancel within the first ten days as advertised in the contract.

I am being asked to pay back an amount that I do not owe.
I'm writing this email to inquire about filing a complaint against Simply Comfort. I went to their office that was located in 2225 Sheppard Avenue E on the end of July 2018 and talked to a *** lady named ***. I spoke to her and told her that I no longer need the service they provided. I rented out air conditioning unit prior to this day and specified that I no longer require this rental equipment and asked for it to be removed. Since that day the air conditioning has not been removed after I made the necessary arrangements to cancel the rental. After I reported, I've still been charged by *** for almost a year after and am still continuously being charged. I reported to Simply Comfort and they never took any action, I talked to *** and reported the same matter and they said they would take care of it. After my complaint to *** (since Simply Comfort is working as a third party), and they said they'd open up a new file regarding this matter in order to get the air conditioning removed and the reference number is XXXXXXXX. So far, on February 1st I called *** and talked to the supervisor named ***, and she was connected to Simply Comfort. I spoke to her and she said she would make a note, and still I haven't gotten any correspondence on this issue. I have notified *** that I will not be paying the additional charges from the rental because I feel that it is not my wrongdoing, but I will continue to pay for my regular services. I'm now reporting to you on the best way to go forward with this case since I feel that I've done all I could do.

I want the amount that it is being asked for me to pay to be removed because it is not my responsibility as explained above I took the necessary actions to rid myself of the air conditioning and went in person and made many calls to do so.

I had took over the contract from previous owner when I bought my house. At the year of 2013 if I buy out I only paid $6000 for both equipment, every year company kept increase 3.5% on my monthly. I did ask to buy out equipment, after 5 years I still had to paid $4800 to buy out my equipment ***.***. ***. They told me they will me email my receipt but almost a month I had not received my receipt and discharge letter from company. I did contact few time but still had resolve my problem. Company already took the money from my credit card.

Desired Outcome

I would like company provide receipt, discharge letter and manufacturing warranty information for both of my equipment. Also an adjustment compensated for increased over past 5 years.

Beware of the cancellation fees for protection services. Company charges $99 plus taxes fees for cancellation of protection plan which is similar to insurance coverage.

Back on June 19 2016 a door-door saleman called *** who knock at the front door selling a contract for a soft water filter unit that would clean up the water in the house. He show me that the water needed to be cleaned up. I agreed with his assessment. The equipment was installed that day. ***

I did manage to get the payments reduced from $60.00 to $39.99 plus HST with a 10 Price Freeze. I also had stated that I was fully covered for any service requirements with priority service 7 days per week and 24 hours a day.

Since that time, the contract has been transferred to several different companies under the same type of name. From *** to *** to a sister company Simply Comfort Inc. Simply Comfort told me back in February 2018 that the contract was switched again to ***. Only all the withdrawals from my bank account still say Simply Comfort as the payee. Each year the price has gone up. $1.81 starting Feb 1/18 and now on Feb 1/19 another $1.83. The locked in contract was for on $45.20 which included the HST. They have no right to increase my payment each year as I have continued to make all the payments. I do not have a new contract which stated that there would be any increase so what they are doing is WRONG. I need this fixed ***.

I have send emails out which have never been answered by anyone, Plus my phones call never get answered and I get a message to try again and they are very busy or the call gets dropped.

I am hoping someone can help.

On December 14, 2016 Simply Comfort, now known as Simply Smart Home, installed a high efficiency furnace in our house when we were without heat. The installer asked my wife to sign a contract (10-year term) to lease the furnace but insisted that we could buy the equipment at any time. He even suggested that we would get a 15 percent discount off the price of the furnace. We didn't have $4,600 available at that time and agreed to pay $79 approx plus taxes per month to lease the furnace.
Again, the installer said we could buy the equipment at any time.
Now we are selling our house. We have paid more than $2,000 over two years which I believed was reducing the cost of the equipment.
When I contacted the billing department of Simply Smart Home they said I had to pay the full 120 payments due for the furnace.
At this time there's 96 payments remaining totalling approximately $9,000.
That's double the cost of the $4602 price of the furnace.
We thought that paying after two years would reduce the amount owed.
We wish to negotiate a fair price for the equipment. $9,000 after paying $2,000 is not a fair price.
Simply Smart Home refuses to budge saying we signed the contract and had a chance to cancel it if we weren't satisfied.
We didn't know we'd be selling our home and didn't think we'd have to pay an inflated 10-year price if we were offering to settle the contract after two years.

Desired Outcome

We are seeking a negotiated settlement that reflects payment for the cost of the equipment, i.e. a two-year-old high efficiency furnace with 24 monthly payments against the principal taken into consideration.

Simply comfort convinced me to sign up for a water softener and didn't tell me it's for 120 months and that I have to replace the filters every year for $100 a year. I want to cancel and they told me I have to buy it out for $7,000.

Re: A consumer complaint to Simply Comfort door to door sale
I was the owner of the property: *** Crescent, Brantford, ON, ***
On April 2017, a door-to-door sales representative from Simply Comfort talked to us and moved our water heater rental agreement from *** to Simply Comfort and installed us a new water heater and a new HVAC. We were only provided a copy of the water heater rental agreement (dated April 18, 2017), without a HVAC agreement, and we were told this month to month rental contract was for 48 months only. The company sale people never told us anything about the Notice of Security Interest will be registered on the title, which will have impact on the sale of the property, and we were not informed the possible buyout cost, nor we were informed the rental term was as long as 10 years.
We had the property on sale which scheduled to close on July 31st, 2018. Before the closing, on July 26th, the buyer's lawyer informed the buyer that the search of title revealed a Notice of Security Interest of the HVAC in favour of *** registered as BCXXXXXX, May 17, 2017. The lien is for $12,609. The contract was for 10 years to 2026. This buyout price is sky-high compared to a market price of a brand-new installed HVAC around $3000. The buyer was not willing to sign a 10 years expensive assumption agreement with Simply Comfort and requested us to buyout the HVAC; especially, after searching online knowing this company had been complained by lot of customers. To complete the deal, we as sellers had to buyout a HVAC in an unreasonable price.
However, when I called to Simply Comfort (waited over 60 minutes in order to talk to someone while the automated system kept stating I am first in line) asked for a copy of the contract, I was told the contract has been transferred to a company we have never heard of (***. ***). The people on the phone in Simply Comfort clearly told me *** is the same company of Simply comfort. I then called *** but there is no real person answering the phone (X (XXX) XXX-XXXX), the voice mail only asks you to write an email to ***@***.com. The website indicates the turn around time is 2-3 days. I emailed them three times for a copy of the contract for the HVAC and the buyout statement on July 27 and July 30, 2018, no response was received.
To complete the deal, my lawyer's office attempted to contact *** to get a payout statement, who registered the interest. *** advised that the account was assigned to ***, and *** advised that this account has been transferred to ***. (It seems that our contract was sold by Simply Comfort to other companies without our notice). Finally, a shocking buyout statement was received on July 30 from ***, the notice bonded the water heater and HVAC together, the lien was original for $12,609, but yet their payout is increase to over $17K ($17529.96). To have the sale closed, we had no choice and we finally paid $9,775.31 to Paid *** to buy out the HVAC.
Still, we were not able to get *** to discharge the Notice of Security Interest after the payout of the HVAC System. The buyer had to sign a further assumption agreement with *** and they had to pay the postponement fee required by ***. This deal became a nightmare for both buyers and sellers because of that. I emailed Simply Comfort on August 3rd for a copy of the contract and fa complaint to Simply comfort, no response was received.

Desired Outcome

My concerns for dishonest practices in Simply Comfort: (Address: *** Ave E *** North York, ON ***) 1. Did not disclose to the customers about a lien will be registered against your home, which will have impact on the refinancing or resale. People trying to sell their homes can find themselves in a bind and the final sale price may be less than what they expected. That's because this company put a lien on the house and the seller is left to settle up. 2. Did not inform the consumers who signed HVAC rental contracts will pay far more than their system is worth as a 10 years rental is required 3. Did not inform the customers that the buyout price will be triple higher than the cost of a new HVAC installed by a local contractor. 4. Did not provide copy of the contract to the customers. 5. Did not inform the customers that the rental contract will be sold to other financial companies with increased price each time. 6. Emailed for a copy of contract on August 3 2018, never receive any responses. We hope to get the refund as the difference of the AC we paid ($10748) with a fair market price of a brand new AC ($3000).

(The consumer indicated he/she DID NOT accept the response from the business.)The response just tried to push the balls between two names under the same umbrella.When I called simply comfort, the customer service clearly told me they are the same company, *** is like their financial department, the answer machine said "this conversation was recorded for training purpose", I believe if the conversation was indeed recorded it can be found within the company if they wanted to.Simply comfort sold the contract and let *** collect the money. No matter they put it as one or two companies, ***.I am complaining the salesperson of the simply comfort here, the way simply comfort sold the contract and hided the content, not yet complaining how *** collected the money. It is not right to throw the ball to the one who collect money on behalf of a sale with ***.

A sales person came to our door around 2-3 years ago from this place pitching an air conditioner to us , we needed one so that was obviously appealing to us , however we did not know the contract we signed was for 10 years or we would have never EVER signed for this , they are saying we now owe them almost $11,000 to buy this out ,*** , please help us

On May 5 2017, a sales representative, *** representative number XXXX from Simply Comfort came to my home to sell me an Air Purifier, which on my *** bill is defined as Ornamental Lighting (?), Order number XXXXXX, account number XX XX XX XXXXX X. I was assured that this would clean my air, keep my house dust-free and help my family with allergies. I have not recognized any change to the air quality in my home and would like to have a maintenance technician come to my home and remove the Air Purifier because I do not feel that it is necessary. I have made several calls to Simply Comfort starting in August 2017 to which I was told I should wait a few more months to see any true change. I called again in December 2017 and they told me that they could do nothing, that I was stuck with the air purifier for 10 years at a cost of $62.38 (incl tax) per month on my *** bill. I consider it to be unlawful for me to have signed a contract with no escape clause. I have paid my monthly dues diligently and as outlined in the signed contract I have in my possession I have the right to demand agreed upon services as is listed in #6 of the contract. I have made several requests to have this machine removed but Simply Comfort has provided no response.
Besides the air purifier, I have 2 other products by Simply Comfort that I have asked repeatedly between May 5 2017 and June 12, 2018 to have a technician come to my home and provide an annual maintenance check of my air conditioner and furnace. I have spoken to several customer service agents and managers but have had no appointment kept and not further results from Simply Comfort.
In closing, I would like to stress that I would like to have the air purifier removed from my home and the charges stopped to my *** bill. I would like Simply Comfort to provide the service promised on my air conditioner and furnace by providing their annual maintenance, as a protection to my warranty.

I would like to have Simply Comfort remove the air purifier from my home and stop charging me a monthly fee. I would like Simply Comfort to provide the guaranteed annual maintenance on my air conditioner and furnace.

(The consumer indicated he/she DID NOT accept the response from the business.)I did receive a response from the Customer Relations Manager with Simply Comfort who reassured me that she understood the issue and transferred my call to a Customer Service Representative to make an appointment for me with a technician. The Customer Service Representative who gave me only a first name of *** was very *** and did not respect the fact that I am francophone and made no effort to be patient with my language barrier while speaking in my second language. I asked not to deal with him any further. He did not give me an appointment but made me very nervous and told me that in order for me to have the air purifier removed from my furnace I would have to pay for the whole mechanism completely which I am not in a position to do. I am waiting for a call from Simply Comfort to provide a date and time for a technician to come to my home and provide 2 services. I want the technician to remove the air purifier. I also want him or her to provide the maintenance of my air conditioner. I have been trying to arrange these services for months, I want Simply Comfort to provide some compensation (on my monthly bill) for my air conditioning and furnace and I want confirmation from Simply Comfort that I will no longer be charged for the air purifier that they are to remove.

. I wanted someone to repair my existing A/C and the person who came to my house told me I needed to replace my 11 year old A/C with a new one from Simply Comfort. I was offered a contract with payments of $89.99 plus tax for 120 months or ten years that included no additional payments for parts and maintenance while I was making the payments. I was insured my monthly payments would not increase because I would be paying over $12,000 after I made all 120 monthly payments for an A/C worth $4,500 if I chose to pay for it in full at the time of installation. Recently, Simply Comply decided to outsource its billing without the knowledge of its customers to an affiliate company called Crown Crest Capital (CCC) and CCC instantly decided to increase my monthly rate by 3.99% according to the fine print on my contract. Also, if I want to 'buy out' my contract to 'own' the A/C sooner, I would have to pay $10,600 and that includes a $500 administration fee. I was also told I could not give back my A/C even if I do not want it anymore because they said I had agreed to a 'lease to own' contract.

Took over a 'rent to own' for 10 long years, when I purchased my house - WAY overpriced - over $10,000 for just the furnace - ridiculous!! Monthly price has now gone up for a unit put in over 2 years ago??? Unacceptable. Tried to get explanation over several emails - no response. Now trying to pay it out to get rid of this company and surprise, no response.

Avoid this company at ALL costs!!! Total ripoff.

We have made multiple attempts to contact the company regarding charges being taken from our account. We have called and waited on hold for over 4 hours, we have sent multiple emails, a letter and have received no response. We have monthly charges coming out of our account and can not verify what they are for or for how long they will be withdrawn for. My mother passed away two months ago and I have been unable to figure out what this company is charging us for. Due to the customer service we have received, we would rather just have the equipment removed so we can go with a more reputable company or I would like to change the payments to another account as the current account will be closed at the end of this month. I look forward to an expedited resolution

Communication from the company and clarification of the charges. If no resolution is achieved then I would like the equipment removed immediately.

This busness will not take any responsabality for their product or theire credit departement,trying to pay off my furnace off witch was way way over paid to begin with and they don't answer their calls or return them and now I have a leene on my house and can't renew my mortgage because of that,what a joke and what a bad service from both party.
