I'm very upset right now. The end of November 2019, I applied online for a personal loan of $500 via www.skytrailcash.com. Since that time, the company has drafted 2 payments from my bank account ($167.24 on 12/13/19 and $155.10 on 12/27/19). I'm now scheduled for another EFT payment of $155.10 on this coming Friday, 1/10/2020. That's 3 payments already and it hasn't been 2 months since I received the loan disbursement. According to the website, only $11.80 has been applied to the balance, leaving $488.20 as the balance and $624.17 as a total balance that includes $135.97 interest/fees. I've already paid $322.34 and after 1/10/2020, the amount I will have paid will increase to $477.44.

First of all, they are deducting from my bank account EVERY pay period. I'm a single parent. I cant afford to make a payment EVERY pay period. Secondly, they are applying only a minimum amount of my payments to the balance. Last of all, this interest is unlawful and I will be contacting someone for legal assistance if this is not resolved. This is predatory lending at its finest and I didn't realize they would be pulling and applying my payments like that.

The customer received a Welcome Call from our Customer Service department on November26, 2019. At that time, the loan and repayment schedule were thoroughly explained to her.Although the loan and repayment schedule were thoroughly explained and in light of her currentfinancial hardship, the Company will reach out to the customer with an offer to resolve their loan.The customer can call the Company at *** if there are further questions or concerns.

I borrowed a total of 1200 from sky trail cash. I've paid back 1022. I called and asked how much to pay off and they want another 980. That's 800 worth of interest in 2 months!!! I've called and tryed to work out an agreement and they refuse to cooperate with me at all.

This is the worst loan I have ever applied for.They are terrible business.

As of today I owed $610.84. I made an additional payment of $400. With a remaining balance of $210.84. I was hoping that by making the additional payment that I would knock off a good chunck of total interest. Which based on the phone call I had is not the case. So my next payment is $158.63. And because of "daily interest" my $210.84 wont be paid off until APRIL OF 2020. That makes no sense whatsoever.

Due to the customer making the additional payment on November 20, 2019, the principaland interest breakdown on the payment schedule would not be accurate. For example, the paymentthat would have processed on November 29, 2019 would have still processed for $158.63, but theinterest and principal amounts would have been allocated differently. Unfortunately, due to systemrestrictions, we are unable to determine the exact amounts of his principal and interest reductions onthat payment.Although not required to do so, as a courtesy, the Company will reach out to the customer with an offerto resolve their loan.

I have a loan with Sky Trail Cash in the amount of 896.54 and the interest rate is 597.36% which means I will pay back $3,416.40. WOW!!!!!!!!!!!!!! I just noticed on the website it states the following:

So, being that I live in CA why was I allowed to take out this loan. I had NO IDEA...….and they do not follow our laws but we have to follow the high interest rate of the Indian Tribe?? WOW!!! And the threats and all the horrible treatment that I read from other borrowers by these people is so sad. They should be ashamed of themselves. I WISH I NEVER TOOK OUT A LOAN FROM THIS PLACE.

I lost my job and was unable to pay my $1,200 loan with Skytrail Cash. It's been about a year and I honestly forgot I even had the loan. My brother received a threatening call today "I have the message" of a person "***" saying they represent Skytrail Cash. The messages addresses my brother & me and says I have committed fraud and I'll be taken to court if I don't call back! They also say they've attempted to serve me and also will go / call my work "which is illegal". The whole phone call is trying to scare me or my brother which is unacceptable! My brother was truly scared for me and thought I was in trouble!

I called the number back and the name of the company was different. Then once I talked to another agent who represented my account they said they are *** again. I told him the situation and he said he'll call the
'lawyers"... He also said he would contact "***" from Skytrail who they represent. He got back on the phone and said I owed $2,800... I said no that's incorrect and it changed to $1,300 if they don't take me to court. I said I would pay Skytrail back and never had a problem with that but could only start on the 1st of November "two weeks away". He said he would give me 24 hours to get money together or I would be going to court then jail. I said it was impossible but in a couple weeks I could and he said that's not good enough and good luck! He hung up...

I called Skytrail Cash and spoke to a Manager in collections ... She confirmed this company does represent them but can't comment on their practices and was rude. I said the company you work with is threatening me and I'm trying to setup a payment but they won't let me. I told her I felt rattled and was hoping they could help... She said call the company back and she couldn't help me! I asked for her name and she stated she gave it to me already. I asked for it again and again and she refused and ended the call!

The only thing I want to do is setup a way to pay this back but both companies have refused... They only want to seem to scare me and lie about the amount I owe. I feel like I should possibly contact the authorities and or lawyer. You can't threaten people or their family and Skytrail Cash is employing a company that does so!

I applied for this loan almost 1 year ago in the amount of $500. I was having hard times and was not able to complete my payments. I had every intention of paying what I owe once I get on my feet and am able to. As of right now I am pregnant and not working and receiving calls from a collection agency on behalf of Skytrail Cash threatening to sue me garnish my wages or do whatever they need to in order to get their money back. The problem also that I'm having with this is that their saying I owe $996 and that's not what I borrowed, their also trying to say I gave them a fake bank account number which is in correct because I received the funds to my *** account in which they verified before approving the loan. Not sure what steps to take , but once I'm able to ho back to work I have every intention of fixing this problem. In the meantime I'm pregnant and stressing about being sued and can't do anything right now.

I received a loan for $500. So far, I have made 8 payments of $155 and the cinnamon wants an additional 5 payments of $155. The original loan has already been paid as you can see from these figures.

The problem is that I only owe them 300 dollars and now they are saying t bgg at I owe then 526 dollars which is more than what I borrowed. So I canceled the loan and now they are bugging me for more money. All I owe them is 130 dollars which is what I am going to pay.

Please take a look at this loan. I have found out that the highest percentage of loan can be taken out is 8% if the loan is below $1,000 and I'm being charged thousands of dollars for a $550 loan. I do not want to get out of paying the long because I know I owe the $550 but I want to be sure that this is fair practice. Please contact me at your earliest convenience. Thank you

Specifically, you assert that the finance charges exceed 8%.However, after researching its files regarding your account records, Company records reflectthat all terms, including the repayment schedule and finance charges were properly disclosed to youpursuant to Tribal and applicable federal law. Company records further reflect that you applied for a$500.00 loan with the Company on November 26th, 2018. You electronically signed the loan agreementand the Company accepted the customer’s application and originated the loan to your bank account inthe amount of $500.00. Good Afternoon, When I applied for the loan, I clearly specified on Holidays, I get paid after them as I know that's how its been. I contacted Kim H via Chat for SkyTrail Cash trying to ask how to proceed in Christmas fell on our company's payroll processing dates - note I was not asking to move the date - but being that I read that if I have a Holiday I get paid after the fact. She told me I can't move any payments and I told her that I read about the Holiday Question and that I know that I get paid afterwards. I only contacted via chat, because it is Wednesday 26 1:33PM (EST) and I dont see the payroll processed yet. I need someone with a managerial position to clarify this to me. How am I responsible for payroll when the Christmas Holidays 12-24 and 12-25 our offices where closed and payroll was not done??

On 30 Aug 2018, I was issued a loan from Ningodwaaswi, LLC d/b/a Sky Trail Cash for $700. To date, I have paid $356.32. Ningodwaaswi, LLC d/b/a Sky Trail Cash expects an additional six payments of $178.16. If I make the eight payments, I will pay $1425.28 for a $700 loan. Per South Carolina law (where I reside), payday loan lenders can only charge up to $15 per $100. On a $700 loan, the fees collected should be $105. If I pay a total of $1425.08, I will repay the $700 PLUS $725.28 in interest. I will pay MORE in interest than the loan. I will pay $620.28 more than allowed by South Carolina law. Ningodwaaswi, LLC d/b/a Sky Trail Cash is a predatory payday loan lender hiding behind Tribal laws. Payments are due on paydays. The interest being charged according to documents is 584.90%!!!!! 584.90%!!!!! This coupled with the payments due on paydays classifies Ningodwaaswi, LLC d/b/a Sky Trail Cash as a PREDATORY payday loan lender. Ningodwaaswi, LLC d/b/a Sky Trail Cash preys on individuals in dire financial situations and profits astronomically and excessively on those situations. It is DISGUSTING and CRIMINAL. I will repay the $700 loan. To date, my balance due on that is $343.68. I will pay that $343.68 plus the $105 in allowed fees for a total of $448.68. I will NOT, however, pay $178.16 per payday. I will settle this matter with the payment schedule outlined below: 19 Oct: $50 2 Nov: $50 16 Nov: $50 30 Nov: $50 14 Dec: $50 28 Dec: $50 11 Jan: $50 25 Jan: $50 8 Feb: $48.68 All payments as outlined above will be made by check mailed to Ningodwaaswi, LLC d/b/a Sky Trail Cash. “Companies” like Ningodwaaswi, LLC d/b/a Sky Trail Cash which prey on individuals under hardship conditions must be stopped or, at the very least, strictly regulated. This inquiry related to a loan from Ningodwaaswi LLC dba Sky Trail Cash (the “Company”), which is owned by the Lac du Flambeau Band of Lake Superior Chippewa Indians (“Tribe”). The Company takes these types of inquiries very seriously and would like to provide you with the below information. However, nothing in this communication should be construed as a waiver of the Tribe’s or the Company’s sovereign immunity, all of which are expressly preserved.The Company is a wholly-owned and operated subsidiary of LDF Holdings, LLC (“LDF Holdings”). LDF Holdings is a wholly-owned and operated subsidiary of the L.D.F. Business Development Corporation, which is a wholly-owned and operated economic arm and instrumentality of the Tribe. The Tribe is a federally recognized Indian tribe, organized under a Constitution pursuant to the Indian Reorganization Act of 1934, 48 Stat. 984, 25 U.S.C. §§ 476, et seq., as amended, and is identified on the United States Department of Interior’s list of federally acknowledged Indian Tribes. 83 FR 34863-01 (July 23, 2018). The Company is an arm of the Tribe. As an arm of the Tribe, the Company possesses all of the privileges and immunities of the Tribe. The Tribe and the Company are entitled to tribal sovereign immunity and they are not subject to state law. Wells Fargo Bank, N.A. v. Lake of the Torches Econ. Dev. Corp., 677 F. Supp. 2d 1056, 1061 (W.D. Wis. 2010) (holding that entities acting as arms of a tribe are entitled to tribal sovereign immunity).The complaint took issue with the cost of the loan. The Company issues loans in accordance with the Tribe’s Tribal Consumer Financial Services Regulatory Code and it is licensed under Tribal law. The customer’s loan agreement provided that it would be governed by the laws of the Tribe, without regard to the laws of any state. The interest and fees applicable to the loan were permitted by Tribal law. They were accurately and clearly reflected in the loan agreement that the customer signed before receiving the loan. Due to its immunity, the Company is not subject to South Carolina law.The customer asked to reach a settlement with the Company. Following its receipt of the complaint, the Company reached out to the customer. The parties then agreed on a payment plan. The Company confirmed the payment plan in an e-mail to the customer on October 9 and she responded, stating “thank you.” Thus, the Company believes this complaint has been resolved.

After being told that my payments could only be made via an offshore processor, I got sketched out and did some research which brought to light a slew of illegal activities and schemes that this operation is engaged in including usuary, money laundering, and rent-a-tribe.
First, the maximum allowable interest rate for any loan in California is 15%. Skytrailcash charges 559% AKA extreme "usuary".
Second, they only process phone payments through offshore processors. They straight up told me that I had to call my bank to allow for my payments to be processed in the UK. This can only mean that they are trying to avoid having domestic records of their payments . I asked myself why would a company with "sovereign immunity" care if they had domestic records-unless they didnt really have immunity ?
Apparently skytrailcash cash and several other "tribal lenders" try to affiliate themselves with the Lac du Flambeau native american tribe without actually being a part of them. In a very recent California Supreme Court case,
People v. Miami Nation Enterprises, the whole "rent a tribe" scam was addressed wherein companys such as skytrailcash were simply operating "under the arms" of native American tribes without actually being a part of them. Skytrailcash has to be aware of this ruling and are either trying not to have any domestic records kept or cannot get a domestic payment processer to work with them.
They know and, more importantly, I now know that what they are doing is in fact illegal and my next step would be to open a case with the FTC if they dont comply

The business has yet to refund the excess money they charged me for their illegal loan. I have paid an excess of $224 to them which I am owed. The statement they provided me yet again tries to validate and protect themselves and their activities by hiding behind the sovereign immunity they claim to have. Ironically , the case they cite within their statement, wells Fargo v lake of the torches, was actually appealed and the ruling overturned the very next year. This fact only helps to prove that they are operating with full knowledge their "sovereign immunity" is not legitimate . While the tribe they affiliate themselves with does hold this status, their distant relationship to it does not grant them the same protections.(https://www.publicjustice.net/tribal-immunity-may-no-longer-get-jail-free-card-payday-lenders/) what they are doing is illegal. The customer also complained that the Company used a third-party processor for debit cardtransactions, which processes approvals from ***. As stated in the subject loanagreement, the Company offered several repayment options to the customer. On August 14, 2018, thecustomer asked to make a loan payment using a debit card. The Company advised that its third-party debitcard processor was based in London, United Kingdom, and the customer would need to inform his bank.The customer agreed and his debit card payment was processed per his request.
