Complaint: [redacted] I am rejecting this response because:Most recent response from company :We have responded to requests from Mr and Mrs ***, but have not gotten any type of responseIn That e-mail, we asked for an updated punch list but have not received itMany of the things in the complaint, were things that were added in as extras For example, the trees being cut were done because the ***' chainsaw was not working As for the hauling away of the chain link fence, Mr [redacted] told our guys that were there he was going to take care of that because a family member wanted it We are more than willing to work with the ***' to get the things taken care of we were contracted to doWe will schedule a time for these things to be taken care ofPrior response from company: [redacted] < [redacted] >; They came back and busted out post in the back and reset where we had gotten a bad batch of concreteThey said there were more and needed to go back with more concreteThe trees if you'll remember were not part of the jobWhen we were talking about the fence [redacted] had said his chainsaw was brokeI told yall; being neighborly that I would help him cut them down and he could get a chipper to put them inThe 12' gate at the front, he asked the carpenter that was building it to leave like that because he had a way he wanted to do itThe fence was set 2' from the corner post because the old fence was crooked, I brought him out before done and showed how it would look if we ran same lineThen moved fence back exactly where we talked aboutThe tin on the building I again was being neighborly because I told him before we did it that there was no way around a tree that was leaning on a Tin building to keep from falling on itAll of your complaints except for concrete I did not invoice for yetIf you would like a second invoice for additional work we would be more than happy to accommodate your needsTo say you paid us for something that was not done is absolutely incorrectMy price for fencing alone is a footI gave you that fence at at orotund a foot and did a lot of extra things because you needed it doneThe concrete will be fixed asapAnything else that was payed for will be alsoThe clean up of old fence even stated by your husband to the guys when they were there was his dealI don't know how many contractors you talked to before me; but I never invoiced any of that stuff or gave a price to do itI also did not do the hardy on the building in the back or invoiced for itYou left that part outBecause it was not part of what I charged forI would like a revised list of anything wrong with your privacy fence that you paid for and rushed us throughBecause I will get any issues fixed that were paid for. Thanks, [redacted] Sent from my iPhoneOn Jul 7, 2015, at 9:AM, [redacted] < [redacted] > wrote:We were home off and on all last week No one showed up while we were home, and if anyone came by while we were gone, they didn't do any work because the job IS NOT finished Nothing else has been done since they were here on Sunday, June 28th for a couple of hours and concreted one or two poles.Take Care God Bless [redacted] :)From: ***[email protected]: Re: fence jobDate: Tue, Jul 01:19:-0500To: [redacted] -Sorry for the delayed response We went out of town for [redacted] birthday and I didn't "work" while we celebrated her birthday and the holiday [redacted] said the guys did come back during the weekHe is working out of town this week, but will come by when he is back to take a look at it Hope y'all had a Happy 4th! There was a lengthy discussion between [redacted] and [redacted] about the legalities of clearing the tree line on the other side of the fence, and how far it had to be done in order to get the fence completed [redacted] was told by [redacted] that [redacted] would clear "as far back as you want, but I don't want you to get into trouble with your neighbors" [redacted] and [redacted] finally settled on feet behind the current fence line, so that [redacted] could maintain the outside of the fence as necessaryThis was and has always been one of the major stipulations with this jobThe treeline was to be clearedAs I have stated, there was discussion of cutting up the wood and even renting a chipper to dispose of it and have a stockpile of mulch for the yard This was declined as [redacted] had a chainsaw (that was temporarily broken) and was willing to handle the disposal of the wood once it was cleared The old fence was to be removed completely and [redacted] would see to its disposal, as we have family that was interested in it [redacted] even offered to help in the removal of some of the metal posts, as he found several crew members just breaking them off at ground level [redacted] gave the instruction to leave the wood inside the fence to be gathered and handled at our convenience [redacted] and his crew were neighborly enough to cut some of the trees into sections for easier moving Some of the trees are still on the outside of the fence line where [redacted] is having to walk the length of the property and uncleared fence line to section it up and dispose of it [redacted] mentioned to [redacted] early in the job that he had found an old wire fence on the outside of our fence line and warned him to be careful of that as he didn't know how interwoven it was with the trees that were needing to be cut out [redacted] also warned [redacted] to be aware of some poison ivy he had encountered along the outside of the fence [redacted] assured him that he was aware of both circumstances as he had already found the wire fence and was dealing with it, and that although he was not allergic to the vines, someone on his crew was very allergic and was taking a lot of precaution As the new fence was slowly replace the old behind the shop, ***'s crew began to set the wooden posts before constructing the picket panels As this was noticed, I went to check on the fence one afternoon, and discovered the new fence was being built well inside the old fence I immediately told [redacted] so that he could verify with [redacted] what was going on [redacted] mentioned that he knew we were getting in a hurry to have the fence completed, as we had already gotten complaints from the neighbors about our dogs running loose, and it would be faster to run the new fence inside the old to avoid having to cut through the trees That is when [redacted] mentioned that it looked like the old fence line had zigzagged a little to avoid some of the older trees [redacted] stated that he didn't want us to be dissatisfied with a crooked fence, so they decided to set the new one inside the old [redacted] said he understood, and appreciated the concern, but was clear that he didn't want to give up any property that he didn't have to [redacted] asked [redacted] to follow the original fence line and to move the wooden posts back to that point [redacted] assured him it would be done The next afternoon, the pickets for that section had been assembled rather quickly and when I looked, the posts had not been moved at all, and the picket assembly had been nothing more than an attempt to hide the fact that the fence had not been moved at allWhen [redacted] brought this to ***'s attention, the corner post for the fence was moved out to take the place of the existing metal corner post, but nothing else was done to recover the property that was now outside the fence line [redacted] was very neighborly in that he was willing to work til all hours to keep the job going It was mentioned to him several times that it was late (11pm) and if he wanted to he could always come back in the morning [redacted] and I repeatedly stressed to [redacted] and his wife, that we understood that there were other responsibilities than just this project, and we didn't want his family or personal health to fail because of the strain of this job We tried to be understanding anytime there was a delay in the completion When [redacted] and his wife began asking for the final payment and admitted there were still things to be completed, he stated that it was just minor things that could be fixed in a day or so [redacted] discussed this with [redacted] and expressed his concern that we would no longer be a priority once the last payment was given, but [redacted] assured us that it was and that he had to pay the guys for the work already completedThe yard was left a disaster with our own trash cans full of debris and garbage standing and laying throughout the yardTools were left out for days in the weather before they finally were removedThere was even a section of fence that still wasn't completed [redacted] took it upon himself to set one of the gate latches in place because a week after it was installed, it was still being held closed by large rocks and debris It was stated in the response that [redacted] only charged dollars a foot, but after figuring what was paid, and dividing it by the measured feet of fence line, it sure adds up to per foot ***'s neighborly actions did include sectioning some of the trees, and he even offered to set some barbed wire along the top of the back fence, as he had it left from another job, and knew that we had already had property stolen from our yardThere is no barbed wire on our fence, but it was a kind offer I would very much prefer to have the tree stumps removed from under the current fence, which are causing some of the pickets to stand inches above the ones next to them I would prefer to have the new fence in the same location as the old oneI would prefer to have all the gates with working hardware I would prefer to have the pickets not popping loose because the screws were set too deeply I would prefer to have the job completed, clean and the shed fixed Regards, [redacted] ***

Hi Mrs***,
I wanted to check on our complaint. We responded to the business' response on Monday, December 28th about getting the job finished. In our response, we stated that we would allow the business two weeks to schedule a time to finish the work or they would refund us our final $4,payment. This Monday, January 11th will be two weeks. We still have not heard from Smith Services. When I looked at the Revdex.com site about our complaint, it shows that it is considered resolved and closed. We are going on almost months since we first filed our claim. At this point, since the business refuses to contact us or finish the job, we would like Smith Services to refund our money. Please let me know what steps we need to take next. Thank youTake CareGod Bless.*** * *** *-)

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me
We will be glad to finally have the job completed. Which still includes removing the old fence, completing new fence and hardware, and repairing the fence that is currently not installed correctly ( i.eposts that are leaning and missing concrete, gaps in the picket line, and setting fence so that it is not resting on tree stumps)
