Complaint: [redacted]
I am rejecting this response because:Most recent response from company :We have responded to requests from Mr and Mrs [redacted], but have not gotten any type of response. In That e-mail, we asked for an updated punch list but have not received it. Many of the things in the complaint, were things that were added in as extras.  For example, the trees being cut were done because the [redacted]' chainsaw was not working.    As for the hauling away of the chain link fence, Mr. [redacted] told our guys that were there he was going to take care of that because a family member wanted it.    We are more than willing to work with the [redacted]' to get the things taken care of we were contracted to do. We will schedule a time for these things to be taken care of. Prior response from company:  [redacted] <[redacted]>; They came back and busted out 5 post in the back and reset where we had gotten a bad batch of concrete. They said there were more and needed to go back with more concrete. The trees if you'll remember were not part of the job. When we were talking about the fence [redacted] had said his chainsaw was broke. I told yall; being neighborly that I would help him cut them down and he could get a chipper to put them in. The 12' gate at the front, he asked the carpenter that was building it to leave like that because he had a way he wanted to do it. The fence was set 2' from the corner post because the old fence was crooked, I brought him out before done and showed how it would look if we ran same line. Then moved fence back exactly where we talked about. The tin on the building I again was being neighborly because I told him before we did it that there was no way around a tree that was leaning on a Tin building to keep from falling on it. All of your complaints except for concrete I did not invoice for yet. If you would like a second invoice for additional work we would be more than happy to accommodate your needs. To say you paid us for something that was not done is absolutely incorrect. My price for fencing alone is 25 a foot. I gave you that fence at at orotund 19 a foot and did a lot of extra things because you needed it done. The concrete will be fixed asap. Anything else that was payed for will be also. The clean up of  old fence even stated by your husband to the guys when they were there was his deal. I don't know how many contractors you talked to before me; but I never invoiced any of that stuff or gave a price to do it. I also did not do the hardy on the building in the back or invoiced for it. You left that part out. Because it was not part of what I charged for. I would like a revised list of anything wrong with your privacy fence that you paid for and rushed us through. Because I will get any issues fixed that were paid for. Thanks,[redacted]Sent from my iPhoneOn Jul 7, 2015, at 9:47 AM, [redacted] <[redacted]> wrote:We were home off and on all last week.  No one showed up while we were home, and if anyone came by while we were gone, they didn't do any work because the job IS NOT finished.  Nothing else has been done since they were here on Sunday, June 28th for a couple of hours and concreted one or two poles.Take Care.  God Bless. [redacted] :)From: [redacted][email protected]: Re: fence jobDate: Tue, 7 Jul 2015 01:19:10 -0500To: [redacted]-Sorry for the delayed response.  We went out of town for [redacted] birthday and I didn't "work" while we celebrated her birthday and the holiday. [redacted] said the guys did come back during the week. He is working out of town this week, but will come by when he is back to take a look at it.  Hope y'all had a Happy 4th![redacted] Sent from my iPhoneOn Jul 2, 2015, at 9:49 AM, [redacted] <[redacted]> wrote:Got it.  Saw them.  They haven't been back.  A lot of the fence posts are not set in concrete and are starting to lean.Take Care.  God Bless. [redacted] :)Subject: Re: fence jobFrom: [redacted][email protected]: Mon, 29 Jun 2015 10:51:24 -0500CC: [redacted]To: [redacted]-The guys came there yesterday.  They left when it started to rain.  They are supposed to be back there to finish it up. Thanks-[redacted] Sent from my iPhoneOn Jun 24, 2015, at 8:38 AM, [redacted] <[redacted]> wrote:Hi!I am writing in regards to the fence job for [redacted] Hill, TX 78642.  You received your last payment on May 6th, and we haven't seen you since.  [redacted] and I are not happy about this.  The work we hired you to do needs to be completed this week.  We have looked into and are prepared to file a claim with the Revdex.com at 8:00am on Monday, June 29th if need be.  I would appreciate notification upon receipt of this email.  Thank you.Take Care.  God Bless  My current response to company:  The last time we saw your guys was the day after [redacted] received your wife's email.  It was probably the day after you received the initial claim from the Revdex.com.  The guys were there for maybe 2 hours and from the evidence reset maybe 3 posts.  By your own admission in the emails, you are well aware of major issues with the job, and yet you haven't made attempts to complete it.  To address the issues in the response; [redacted] spoke with one of your crew about the completion of the gate in regards to using wheels and suspension wires to keep the gate from sagging.[redacted] never said "please leave the gate in a manner that we will need to pull stakes and unscrew 2 separate boards any time we wish to use the gate".  He did decline the offer of concreted aluminum poles and wires to help with the suspension, and he did specifically request the hardware catches and such be installed on said gate; the tin building that had its corner caved in was never included in any of the initial bids since we were told that the company would be able avoid damaging it.  After the building was damaged, it was explained that unfortunately, there hadn't been a way to avoid it, even though everything that could be thought of had been tried.  We were told not to worry, because the company would "go grab a couple of sheets of tin and fix that up in no time" "no problem".  Now to the meat of the issues.  The original bid was for a wooden fence to replace the old chain link fence.  While [redacted] and his wife came over and discussed everything in the original bid, we walked the entire property and discussed several different options ranging from only a couple of sides of the fence being replaced to a little extra for a wood chipper to chip all the trees that would need to be removed from the fence line.  Repeatedly it was stipulated that the existing fence line HAD TO BE CLEARED! There was a lengthy discussion between [redacted] and [redacted] about the legalities of clearing the tree line on the other side of the fence, and how far it had to be done in order to get the fence completed.  [redacted] was told by [redacted] that [redacted] would clear "as far back as you want, but I don't want you to get into trouble with your neighbors".  [redacted] and [redacted] finally settled on 2 feet behind the current fence line, so that [redacted] could maintain the outside of the fence as necessary. This was and has always been one of the major stipulations with this job. The treeline was to be cleared. As I have stated, there was discussion of cutting up the wood and even renting a chipper to dispose of it and have a stockpile of mulch for the yard.  This was declined as [redacted] had a chainsaw (that was temporarily broken) and was willing to handle the disposal of the wood once it was cleared.  The old fence was to be removed completely and [redacted] would see to its disposal, as we have family that was interested in it.  [redacted] even offered to help in the removal of some of the metal posts, as he found several crew members just breaking them off at ground level. [redacted] gave the instruction to leave the wood inside the fence to be gathered and handled at our convenience.  [redacted] and his crew were neighborly enough to cut some of the trees into sections for easier moving.  Some of the trees are still on the outside of the fence line where [redacted] is having to walk the length of the property and uncleared fence line to section it up and dispose of it.  [redacted] mentioned to [redacted] early in the job that he had found an old wire fence on the outside of our fence line and warned him to be careful of that as he didn't know how interwoven it was with the trees that were needing to be cut out.  [redacted] also warned [redacted] to be aware of some poison ivy he had encountered along the outside of the fence. [redacted] assured him that he was aware of both circumstances as he had already found the wire fence and was dealing with it, and that although he was not allergic to the vines, someone on his crew was very allergic and was taking a lot of precaution.  As the new fence was slowly replace the old behind the shop, [redacted]'s crew began to set the wooden posts before constructing the picket panels.  As this was noticed, I went to check on the fence one afternoon, and discovered the new fence was being built well inside the old fence.  I immediately told [redacted] so that he could verify with [redacted] what was going on.  [redacted] mentioned that he knew we were getting in a hurry to have the fence completed, as we had already gotten complaints from the neighbors about our dogs running loose, and it would be faster to run the new fence inside the old to avoid having to cut through the trees.  That is when [redacted] mentioned that it looked like the old fence line had zigzagged a little to avoid some of the older trees.  [redacted] stated that he didn't want us to be dissatisfied with a crooked fence, so they decided to set the new one inside the old.  [redacted] said he understood, and appreciated the concern, but was clear that he didn't want to give up any property that he didn't have to. [redacted] asked [redacted] to follow the original fence line and to move the wooden posts back to that point.  [redacted] assured him it would be done.  The next afternoon, the pickets for that section had been assembled rather quickly and when I looked,  the posts had not been moved at all, and the picket assembly had been nothing more than an attempt to hide the fact that the fence had not been moved at all. When [redacted] brought this to [redacted]'s attention, the corner post for the fence was moved out to take the place of the existing metal corner post, but nothing else was done to recover the property that was now outside the fence line.  [redacted] was very neighborly in that he was willing to work til all hours to keep the job going.  It was mentioned to him several times that it was late (11pm) and if he wanted to he could always come back in the morning.  [redacted] and I repeatedly stressed to [redacted] and his wife, that we understood that there were other responsibilities than just this project, and we didn't want his family or personal health to fail because of the strain of this job.  We tried to be understanding anytime there was a delay in the completion.  When [redacted] and his wife began asking for the final payment and admitted there were still things to be completed, he stated that it was just minor things that could be fixed in a day or so.  [redacted] discussed this with [redacted] and expressed his concern that we would  no longer be a priority once the last payment was given, but [redacted] assured us that it was normal and that he had to pay the guys for the work already completed. The yard was left a disaster with our own trash cans full of debris and garbage standing and laying throughout the yard. Tools were left out for days in the weather before they finally were removed. There was even a section of fence that still wasn't completed.  [redacted] took it upon himself to set one of the gate latches in place because a week after it was installed, it was still being held closed by large rocks and debris.  It was stated in the response that [redacted] only charged 19 dollars a foot, but after figuring what was paid, and dividing it by the measured 494 feet of fence line, it sure adds up to 25 per foot.  [redacted]'s neighborly actions did include sectioning some of the trees, and he even offered to set some barbed wire along the top of the back fence, as he had it left from another job, and knew that we had already had property stolen from our yard. There is no barbed wire on our fence, but it was a kind offer.  I would very much prefer to have the tree stumps removed from under the current fence, which are causing some of the pickets to stand 6 inches above the ones next to them.  I would prefer to have the new fence in the same location as the old one. I would prefer to have all the gates with working hardware.  I would prefer to have the pickets not popping loose because the screws were set too deeply.  I would prefer to have the job completed, clean and the shed fixed.

We have been looking at the schedule the last few weeks to tie up loose ends for 2015.   We had an emergency with our pregnancy that threw the last several months off. We will contact the homeowner with a scheduled time.

On or about Oct 25, 2014, I contracted The[redacted] Repair Men (1.888.287.8009) to come and repair a [redacted] Oven/Range door. The[redacted] Repair Men sub-contracted the work to[redacted] Services (901.281.8341). This sub-contractor is part of [redacted] Repair (The Company does not exist). On 2 Sep 2014, the repairman came out repair the oven. Instead of repairing the oven the hinge points were damaged. Furthermore, my wife was told to purchase the hardware to repair the damage. She did purchase the hardware only to find out that that the repair men would not return her calls. I contacted The[redacted] Repair Men on 28 Nov 14 and spoke with [redacted]. He informed me that [redacted] and [redacted] were the technicians that trouble shot the oven issue.Account_Number: 104241Desired SettlementRefund of $90.00

Company will not issue promised refund for amount they acknowledged they over charged our credit card. They are no longer returning our calls. We called The Service Repair Men company, a booking company for appliance repair, on Presidents Day 2015. We were told we had to pay them a $55 booking fee to hold our appointment scheduled for later that day. We were told that the $55 booking fee would go towards our repair bill.Smith Services called an hour before our appointment window to say they weren't coming as their parts department closed early. The tech said he had no idea why they would have made our appointment for that time. They had to come the next day. Very inconvenient as we both work full time. The next day a service tech came. We specifically said we needed a quote. We agreed to start the repair. The tech attempted to replace a part for our washer lid. The repair was unsuccessful. We called to have an error with our washer lid repaired as the lid locking mechanism was causing a light to flash when it was running. However there was nothing functionally wrong with the washer itself and it could finish a full cycle if we unplugged it and re-plugged it in. It was not making any abnormal sounds. We were quoted $199. We had a budget of $250. The tech suggested if we wanted to save money to google how to repair it ourselves. The work the tech did was not successful. In fact, when he started the machine after his attempted repair the washer made an awful squealing noise to which the tech seemed shocked, unaware and rushed to unplug it. We told the tech to remove the part he put in and take it back as now the washer is too expensive for us to repair. We also stated that the washer did not make that noise prior to his attempted repair and that we were dissatisfied. After removing the part for our originally quoted $199 job, we were presented a bill for $109 for labor and $55 booking fee. We said we already paid their booking agency and we were told it would be deducted not added to our final bill. Tech said we'd have to take it up with his managers and gave us their number. Signed the receipt with a note saying amount being disputed as the manager already left for the day. We got in contact with [redacted] who agreed we shoukd be refunded the $55 and to allow 10-14 days. That was on Feb 18th. As of March 9th no refund. We called [redacted] back at about 8:30am who took down our info and said she'd call back that morning. We never received a return call despite our numerous call backs without answer. We called the booking agency to complain and they called the tech who said we were dealt with that morning to which we told the booking agency no one ever called back to resolve. Booking agency gave us tech's number to call as he assured them it would be taken care of that afternoon. The number we were provided for the tech ended up being the generic office number that rings and rings with no answer. It has been 3-business since our last call to them and almost a month since our service. No call backs and no refund despite their agreement to refund the duplicate charge of $55.We feel at this point we are being scammed for a service call for a simple lid locking mechanism that is appatently one we could do ourselves with the internet, per tech's earlier comment to damage that rendered our washer inoperable. They also seem unaware of what their booking agency tells incoming customers or use it as a reason to double dip. Desired SettlementOriginally agreed with Smith Services for a refund of $55. However at this point due to the delay, lack of call backs and their tech causing considerable more damage than what we called them out for, we would like a refund in full, in the amount of $109. The damage that resulted from the failed repair attempt caused us to have to purchase a new washer. Despite the tech running a full diagnostic and only finding that the lid locking mechanism needing replacement. Then resulting in a bad mother board. Also dissatisfied that we had to pay $55 in advance for an appointment time they did not honor.

The business card indicates that this is a 24/7 service but I cannot get them to return calls even during the stated business hours. This business says on its business card that it is a 24/7 company, but the recorded message that I keep getting states that normal business hours are between 8:00 and 5:00 Monday though Friday. My dryer has stopped working. When I first called this service they came right out even though it was on a week end, but when the same problem came back a couple of weeks later, I had to wait from Wednesday to Friday to get someone to come out. I was told I needed a new motor for my dryer and I paid for it up front. It was supposed to be installed on Monday. I was called at about 3:00 on Monday and told that it was too late in the day to deliver the motor. My husband and I both had appointments for Tuesday, so the delivery was scheduled for today (Wednesday) between 8:00 and 10:00. Because we are running out of clothes, I tried to call back Monday, again during regular business hours, to say I would cancel my Tuesday appointment in order to be home. I left a message but never got a call back. I called several times on Tuesday, several hours apart, and left messages again, but never received a return call. At five minutes to 10:00 I tried to call again and still got a recorded message.Desired SettlementAt a minimum, a customer's messages should be acknowledged by a return phone call within a reasonable time. It is also dishonest to put the 24/7 claim on the business card, even if it is only claiming that one can "call" 24/7. An answering machine with a message does not fulfill that expectation.Business Response On behalf of Smith Service, I would like to apologize to Mrs. [redacted] for her unpleasant experience with our company. I would also like to take this time to inform Mrs. [redacted] as well as new customers that Smith Service has made tremendous changes to our staff, our company's procedures, as well as adding a few new protocols to insure customer satisfaction. Unfortunately, our updated business status came as a result of an unsatisfied customer but in the future Smith Service guarantees to provide excellent customer service in a timely manner.
