I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. The resolution that was given to me was to refinance my loan with another company and they would work with me on the amount that the other company will approve me for. I researched other companies and their interest rate was extremely high and would not put me in a better financial situation. Yes, he did discuss what phone conversations he had however the full terms of the loan were not discussed until I called to make my second payment with Jason. He did offer to waive one payment but stated that I still make the payment and apply it to the principle. I was not satisfied with the way I was talked to. He does have phone conversations however prior to getting the loan the terms were NOT disclosed. Yes, I did sign the paperwork and should not have trusted the employee that what I was requesting was in fact what I signed. I requested that they work with me in regards to the payment since I am unemployed so it is affordable to pay down the interest. The current payment is my entire unemployment.
His statement about my complaint being erroneous is not entirely correct. I am very displeased with the response and that the best resolution to my request was to take my business to a competitor. How is it legal for them to say my complaint is erroneous when they don't have the recording of what took place in the office when the paper work was signed. When I called about the loan I was told I could pay off the loan in 18 months. However, it was not fully explained to me until I called and made my second payment with Jason and he explained it very well. Had he been the person I talked to at the beginning I would have never taken out the loan.

Regards,

I've taken out a loan four or five times from Southwest. It's clear that they are there to help-- loan officers are friendly and willing to work with you. They are not there to repo your car. Everything is above board and not shady and weird like one other place I tried (won't mention the name, but I will never go back there). And, the rates are really good (for a title loan place anyway). Would definitely recommend.

Attached is our response to the complaint.  Though we were able to successfully assist this party, he was never a Southwest customer and therefore are requesting that the complaint be removed.  We have also requested from the party that we withdraw this complaint to which he verbally...

committed to doing so.Please contact me directly should you need any further assistance with this matter.Best Regards,Fernando R.Director of Legal AffairsSouthwest Finance, LLC dba Southwest Title LoansDear Sir or Madam,Thank you for your recent communication regarding the above referenced complaint.  Southwest Title Loans greatly values our customers and therefore we take all complaints very seriously.  We also recognize the immeasurable value of the Revdex.com as a fair and trustworthy liaison for these types of matters and thank you for serving in the best interest of both parties. We contacted the party concerning his complaint to advise that Southwest at no time owned or serviced his loan with [redacted] Financial.  However, we understood that he was facing a very difficult circumstance in trying to have a lien removed from a company that is no longer in business and offered to assist his efforts as best we could.  We are pleased to announce that we were able to locate an authorized representative who was able to remove the lien from the title.  We have notified the party of our success in assisting him and asked that he withdraw his complaint entirely due to him having never been a Southwest Title Loans customer to which he agreed. We again thank you for your correspondence and hope you also find this resolution satisfactory.  Please do not hesitate to contact me should you have any questions or require additional information.Sincerely,Fernando R[redacted]Director of Legal AffairsSouthwest Title Loans

Dear Sir or Madam,

Thank you for your recent communication regarding the above referenced Complaint.  Southwest Title Loans greatly values our customers and therefore take all complaints very seriously.  We also recognize the immeasurable value of the Revdex.com as a fair and trustworthy liaison for these types of matters and thank you for serving in the best interest of both parties.

We would like to request that this Complaint be dismissed due to lack of merit in both the content of the claims listed in the Complaint as well as the resolution expressed in the Desired Settlement

Complaint Claims
Several details listed by the Customer in the Complaint were erroneous and non-factual, including the claims that the Customer was unaware of the loan terms and interest rate.  We spoke with the customer regarding these claims to advise that we have numerous recordings and signed documents showing that the terms and interest rate were clearly communicated to her at multiple points before and after Loan Origination.  Customer acknowledged and accepted that she has no documentation or evidence to substantiate her claims and that all existing evidence contradicts her claims.  Customer further stated that she consulted with an attorney who also stated there was insufficient evidence to file a claim and suggested that she seek resolution through the Revdex.com.

Desired Settlement
Despite the Customer’s acknowledgement that her Claims did not match actual events, Southwest recognizes that the customer is in a difficult circumstance and offered financial assistance to the Customer.  We regret to inform you that the Customer has rejected this offer and remained firm on seeking her originally stated Desired Settlement despite there being no wrongdoing on behalf of Southwest.  We had given the customer an additional 24 hours to petition a more reasonable way for us to assist her in her hardship.  The customer has yet to respond which unfortunately hinders our ability to respond to the Complaint within the allotted timeframe with a satisfactory resolution.

We again thank you for your correspondence and hope you agree that the Complaint be dismissed due to lack of merit in both content and desired resolution.  Please do not hesitate to contact me should you have any questions or require additional information.

Sincerely,

Director of Legal Affairs

Review: Southwest Title Loan made a payment arrangement with us. When we couldn't fulfill the arrangement we contacted them and kept in contact regularly making a payment when we could and again keeping them posted. On Thursday 8/6/15 I advised [redacted] at SW title that the Police Department (my husbands work) union benevolent fund is paying off the balance of the title loan. The check was cut that day. [redacted] advised that was perfect. I asked if everything would be ok with my vehicle through the weekend in the event they don't get the check until Monday and [redacted] advised "yes". My vehicle was reposed on Sunday 8/9 with no notice. I talked to Summer Monday morning as they were closed Sunday. Summer advised they get the check in full for payment arrangements to pay off and my vehicle and I'll have to come up with $400+ more to get it out. She was of no help whatsoever and said I broke a payment arrangement when in fact I stayed in constant contact with [redacted] so he was aware of our situation. As soon as they knew a check went out for the total of the arrangement to get my title back, they sent it out to recovery to get repo'd. They took my car and the city of mesa's money and won't help us at all even after they told me on the phone that my car was safe until monday 8/10. Desired Settlement: Either pay the city of mesa back and keep my vehicle (It is NOT right to take their money and my vehicle) or return my vehicle to me with no additional fees and process the payoff check from the city of mesa, as you received the monies we agreed upon.

Been going through these guys for 3+ years for various loans on my cars.

Review: I took out a loan almost 4 months ago with Southwest Title loans and understood this to be a normal loan with interest that was paid every month like other loans. I had no idea what an interest only payment was nor was it explained by the person they sent to have me sign the documents and sure was not explained when I first spoke with a representative. I have already paid approximately $1000.00 in only 3 months on this so called loan and not one penny has gone to the principal. I have contacted them through emails and phone calls and I finally was put through to someone higher up and this person did not do one thing to help me out, but he did explain in length there terms. They just suckered me in with a loan that was suppose to be 8% and telling me it's easy, you can pay it off however you need to without ever explaining in detail that I would be paying over $324.00 a month in an interest only payment and nothing would go towards the principal. I'm a single mom with two kids at home and a grandbaby with a heart condition that may require surgery in the next couple months. I would never have agreed to these terms if they were explained the way they were After I signed the paperwork. I don't know how this company has a great rating as this is worse than any payday loan that I have ever used.Desired Settlement: I am asking that I be allowed to pay a lump some payment of the original loan amount which was 4250.00 with no additional interest and that my title is signed back over to me asap as I will now have to sell the truck to cover the loan from my family to take care of this disaster. I want them to explain to their customers better and although others may not have contacted you I have just recently been made aware of this from other customers. This is no better than extortion in my opinion.

Review: Date of my loan was 5/7/14 for $1,927.40 of with the total amount financed being $1,676.00, the amount of the check to me. As of 2/4/15 I have paid $2,071.50 in INTEREST and $107.28 (I've been told)being accredited towards the principal amount of $1,567.07 which NEVER changes? This is a neutron loan where interest accrues daily and nothing gets applied to the principal unless pay above and beyond the monthly accrued interest at $7.83 per day.($7.83 x 30 days) OR, I pay a lump sum of $1,567.07 which is the principal amount.

This is ludicrous! This was a hardship loan and now its a misery loan. What can be done?Desired Settlement: Apply the $2,071.50 that I have already paid to date to the Total Payments listed on the loan as: $1,927.40

Review: I had a title loan with them. The loan was paid off in cash by another title loan company. There refused to release the lien on the title to the new company in a timely manner. They told me that the title had been released but in fact it was not. They stated that their policy is to place a 7 day hold on the release of the title to protect their interest. The loan was paid off in cash so there was no risk to Southwest Title. When I spoke to them on the phone they gave me conflicting information about the status of the lien release. They were rude to me on the phone and refused to give me the phone to the district manager so that I could speak to them about the policy. there policy caused me hardship and risked me being evicted from my home because the title was not released. The new loan company would like release the funds of the new loan to me because the title was not released therefore I could not pay my rent.Desired Settlement: I would like them to examine there current policies regarding lien release when a customer has paid off a loan personal or through another financial institution and change it.

Review: I called southwest title loans in December 2014 and spoke to [redacted]. At that time I explained to him I was looking for a title loan and that I wanted to have it amortized to be paid off in 18 months. He said he could do that and offered me a rate of 6 percent. He said he would let th employee know at the office on hunt highway so everything would be ready for me. I arrived at the office and told the girl that [redacted] said I could have 6 percent interest and the loan would be amortized for 18 months. She said ok. I called the next month to make my payment and at that time the employee told me that I had a thirty day loan that starts over every thirty days. So my payment is just interest. I was furious. I told the guy what I was told that I requested a 6 percent interest rate and to have loan amortized to be paid off in 18 months. He said he didn't know what to tell me. A couple of months later I lost my job and was waiting to receive my unemployment. I called to let them know and the girl was really rude.mshe said I could send her the paperwork to show I was approved for unemployment but if I was two days late they could repossess my car while I am pumping gas or at my home. I explained to her that my cars value has gone down a

A lot and I just need a little extra time to pay my loan. She said well you could just do a voluntary repossession. I explained to her that I need my car to attend job interviews. She said well whatever if we want we can repossess your car if you are one day late. When I finally got the money to pay my payment. I talked to [redacted] and she was super nice and explained to me that she would have her supervisor review the call that it was rude of the employee to say that to me. I never heard back from the company. So 8 months into the loan I have paid 1600 in interest. My car is work ablurn2000. I was not properly disclosed the terms of the loan and did not receive the product I initially requested. I feel that this is in violation of a federal regulation for a financial company. When I have brought this to their attention I was told the employee I dealt with had been let go because she didn't properly disclose to a lot of employees.Desired Settlement: I would like the amount I have paid be applied,to the principle of the loan and my payment to be adjusted. I feel that is the least they can do for how I was treated and not properly disclosed the terms of the loan
