your order on October 18, 2103.

The terms of the offer that you

agreed to at the time of your order clearly state that you were to have a one

week trial period starting from the date of your order processing in which you

could cancel your account to avoid further charges.  They also indicate that “you must take

affirmative action to avoid further charges or you will be charged in the

amount of $94.31 ten days from the date of your order processing for the

product.” 

These terms were presented to you in multiple places on our website when you

ordered our product. Additionally, you were sent an order confirmation email

after your order was completed that provided a full written version of the

terms you agreed to.

When you ordered the product you also checked a box indicating that you had

read and agreed to the terms of the offer. When a customer checks that box we

must assume that they have actually done what they are stating they did. If

there was any confusion with the terms you could have called our customer

service team and they would have been happy to assist you.

Since you did not cancel during your trial period, you were charged $94.31 on October

30, 2013. A month later there still had not been a cancelation request and

you were shipped another package on November 29, 2013 at the cost of $105.22

($94.31 for the product and $10.91 for the shipping).

To date we have never heard from you to cancel your account or to

request a refund. On December 9, 2013 we received notification from your credit

card company that you filed a dispute against our charges in the form of a

chargeback. This prevents us from issuing any refunds as it would result in

multiple refunds on a single transaction.

I ordered a trial of your product online. Or at least I thought I had placed an order. I got a confirmation email that was full of instructions and it also talked about being billed monthly for the full product at a price of around 94.31. It also came with instructions on how to return the product. The online offer did not detail any of this information. I immediately called to cancel after reading all the information in the confirmation email. The CSR assured me that my order was cancelled and that when I received my sample order just follow the instructions on how to return it. It's December 11th 2015, I placed the order on November 15th 2015, and I have yet to see anything that looks like an order. I awoke this morning to your company trying to deduct 94.31 from my bank account at 2:12 a m. I immediately called to dispute this only to be told that although my order was cancelled an order was sent out. A recording came on before I even spoke with the CSR to tell me that my order was cancelled but if I still needed to speak with someone press zero and that's what I did. The CSR told me that she would give me the tracking number and to follow up with my local post office. I declined. That's why my address was given so that the product could be delivered to my home. Which it was not! I didn't get my sample I didn't get anything! Your company took the money I paid for the sample and didn't give me the sample. Please refrain from trying to pull money from my bank account.
If you are going to have offers online you should fully disclose every detail. People want to know what they are getting up front not after the fact!

This company are scamming people with their advert. DO NOT BUY THE TRIAL PACK IT IS A SCAM THEY WILL WITHDRAW MONTHLY AMOUNTS FROM YOUR BANK ACCOUNT.

Something must be done about this company it is fraudulent and not right that they keep getting away with it.

The first time we heard from you regarding the cancelation of your account was on May 2, 2016 when you canceled your account with a representative. Your account was immediately canceled and you have not received any shipments or charges since then.   The representative reminded you of the terms of the offer that were agreed to at the time of your order and offered a 60% refund on your charge in lieu of returning the product for a full refund.  You accepted that offer and a refund of $56.59 was issued on May 2, 2016.   Thank you,    Evan C[redacted] Spark Whitening

They state that I had to check a 'confirm' box to accept the terms, but if you go through the customer experience, the information stating you have to pay for the full program flashes quickly, and in my case, auto-checked and went to completion.  Their email states my package did not ship until the next day.  I called immediately to cancel, and they told me the package had already shipped.  Based on the business' response, it had not shipped, and they could have canceled my order and refrained from sending it to me.
Additionally, since engaging with this fraudulent company, I have been bombarded with spam calls and emails.  It is clear they sold my information.  Lastly, the fact that they create fake pages under the guise of health, using company logos such as CNN to validate their fake articles, is immoral marketing.  No one should engage with this company, who has several different company names listed to the same address.

At that time we issued you a returned merchandise authorization number to return your shipment to avoid any further charges for the product. We never received your product back so you were charged $94.31 for the product. Since the time your account was canceled, you have contacted your credit card company and initiated a chargeback for the remainder.  Because of the chargeback, we cannot issue you a credit at this time because you would then end up getting a credit twice for those purchases. Your account was immediately canceled and you have not received any shipments or charges since then. At that time we issued you a returned merchandise authorization number to return your May shipment for a refund of the full product price. Your initial shipment and charge of $94.31 was not refundable as we did not hear from anyone to cancel within the trial period.Your return was received within the return deadline date and a refund of $94.31 was already issued back to you on June 9, 2015. That is the full product price of the May shipment minus $10.91 for shipping costs, which per the terms that you agreed to is not refundable.  As stated in our purchase terms you may only return the most recent shipment for a refund. So, in summary, we have issued you a refund for $94.31 but your account is not eligible for any further refunds. The following return instructions were sent to you outlining the steps required to receive your refund. I apologize but your account is not eligible for any refund as we were not contacted within the trial period to cancel. After receiving the response from Spark Whitening, which had incorrect  information, I contacted them both by phone and email to correct the information.  I am still awaiting a reply.  That is why I did not accept or reject the response they sent to the Revdex.com. 
Spark claims that they can not credit my account because I have already been credited through my VISA dispute.  This is not the case, as I stated in my original complaint.  The VISA credit had been reversed on Dec. 31, 2015.  It was after that when I filed my complaint with Revdex.com.  So Spark  Whitening is not correct in the assumption that I have already been made whole on this issue.  
There did not appear any way through the Revdex.com message to indicate this which is why I did not respond immediately.

At the time you canceled your account, we issued you a return merchandise authorization number (both through a live customer service representative and through a follow up email) so you could return your shipment to avoid any further charges.
